A former official of the U.S. Tax Court was sentenced today in connection with a bribery conspiracy involving contracts at the U.S. Tax Court in the District of Columbia. Fred Fernando Timbol Jr., 43, of Mount Airy, Md., was sentenced by Judge Ricardo M. Urbina of the U.S. District Court for the District of Columbia to 18 months in prison and three years of supervised release.

A former congressional staffer pleaded guilty today to conspiring with others to commit honest services fraud. Ann Copland, 52, pleaded guilty before U.S. District Judge Richard W. Roberts in the District of Columbia.

A securities attorney pleaded guilty today to defrauding investors in stock manipulation schemes involving 19 different publicly traded companies. David B. Stocker, 49, of Phoenix pleaded guilty in U.S. District Court in Alexandria, Va., for his participation in a stock manipulation conspiracy known as a “pump-and-dump” scheme.

The Department is making grant funding available for public education programs concerning immigration-related employment discrimination. The Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC), a section of the Department’s Civil Rights Division, announced the availability of funds for public education programs regarding employees’ rights and employers’ obligations under the anti-discrimination provision of the Immigration and Nationality Act (INA).

Lazare Kabaya Kobagaya, 82, of Topeka, Kan., was arrested today on charges of naturalization fraud and misuse of an alien registration card. According to the indictment, Kobagaya allegedly participated in genocidal activities during the 1994 Rwandan conflict including mobilizing attackers to commit arson and murder. Kobagaya is alleged to have failed to disclose his alleged participation in these activities during his immigration and naturalization processes.

The former head securities trader for Lancer Group hedge funds pleaded guilty on April 28, 2009, to one count of conspiracy to commit mail, wire and securities fraud. Eric Hauser, 65, pleaded guilty before U.S. District Court Judge Adalberto Jordan in Miami. Hauser admitted to participating in a scheme to manipulate trading of stocks owned by the Lancer Group hedge funds.

Todd Gongwer of Dublin, Ohio; Lance Parker of Dublin, Ohio; and Joel Lee, of Galena, Ohio, pleaded guilty today to conspiracy to commit bank fraud. Gongwer, a licensed real estate agent, also pleaded guilty to tax evasion in the hearing before Judge Michael H. Watson in Columbus, Ohio. Parker also pleaded guilty to illegally structuring cash transactions.

"If our partnership with state, local and tribal law enforcement is to endure, federal financial support cannot be a one time occurrence. This country is facing prolonged problems that require steadfast commitment and long-term cooperation."

Twelve defendants, including eight Uzbekistan nationals, have been charged in a 45-count indictment returned by a federal grand jury in Kansas City, Mo., on May 6, 2009, on RICO (Racketeer Influenced and Corrupt Organizations Act) charges related to labor racketeering, forced labor trafficking and immigration and other violations in 14 states.

Melissa Thomas, 34, pleaded guilty today to one count of forgery in connection with a scheme to embezzle more than $17,000 from a political action committee (PAC), which was a client of her employer.

Attorney General Eric Holder announced the appointment of Brian M. O’Leary as the Executive Office for Immigration Review’s (EOIR) Chief Immigration Judge. Prior to his appointment, Judge O’Leary served as an immigration judge from May 2007 to June 2009 at the Arlington, Va., Immigration Court. He served as a temporary board member on the Board of Immigration Appeals from May 2006 to May 2007 and as a deputy chief immigration judge in the Office of the Chief Immigration Judge from March 2003 to May 2006.

Attorney General Eric H. Holder, Jr., announced today the appointment John H. Guendelsberger as a new member of the Board of Immigration Appeals (BIA). The BIA is part of the Justice Department’s Executive Office for Immigration Review located in Falls Church, Va., and is responsible for hearing appeals of decisions rendered by immigration judges or certain Department of Homeland Security officers.

After conducting a careful investigation of the proposed transaction between Oracle and Sun, the Department’s Antitrust Division concluded that the merger is unlikely to be anticompetitive.
