A federal jury in Miami today convicted two physicians and two medical assistants in connection with a $5.3 million Medicare fraud scheme. After a two-week trial in federal court in Miami, a jury found David Rothman, M.D., 66; Keith Russell, M.D., 65; Eda Marietta Milanes, 43; and Jorge Luis Pacheco, 50; guilty on all charged counts, including conspiracy to commit health care fraud and multiple counts of health care fraud for submitting claims to Medicare for unnecessary medications.

Four Miami-area residents pleaded guilty today in connection with a $10 million Medicare fraud scheme involving HIV infusion clinics. Today Assistant Attorney General Lanny A. Breuer of the Criminal Division announced the formation of the Human Rights and Special Prosecutions Section (HRSP), the first new section to be formed in the Criminal Division since 2008.

Miriam Freytes, 49, pleaded guilty today to one count of conspiracy to commit health care fraud before U.S. District Court Judge Denise Page Hood of the Eastern District of Michigan.

Attorney General Eric Holder today welcomed the confirmation of Christopher H. Schroeder as the new Assistant Attorney General for the Justice Department’s Office of Legal Policy (OLP). Schroeder was confirmed today by the U.S. Senate.

As part of the Department of Justice’s ongoing initiative to confront intellectual property (IP) crimes, Acting Deputy Attorney General Gary G. Grindler announced today the appointment of 15 new Assistant U.S. Attorney (AUSA) positions and 20 FBI Special Agents to be dedicated to combating domestic and international IP crimes.

Last night, federal agents arrested Lee Bentley Farkas, the former chairman of Taylor, Bean & Whitaker Mortgage Corporation. He has been charged in a 16-count indictment in the Eastern District of Virginia.

"The pharmaceutical manufacturer Allergan has agreed to plead guilty and pay $600 million to resolve serious criminal and civil fraud allegations," announced Assistant Attorney General West.

"The Department of Justice is busy investigating and prosecuting financial fraud in all its forms, including investment fraud schemes, mortgage-related fraud, securities fraud, insider trading, money laundering, and other crimes," said Assistant Attorney General Breuer

"Mr. Keeney’s dedication to the Department and to his colleagues is – quite simply – unparalleled," said Attorney General Holder.

"This morning, federal agents began arresting 11 individuals on charges that they conspired over an approximately 19-month period to corrupt the legislative process in Alabama," said Assistant Attorney General Breuer.

"This morning, we filed a civil antitrust lawsuit in U.S. District Court in Michigan against Blue Cross Blue Shield of Michigan alleging that provisions in their agreements with hospitals stifle competition, resulting in higher health insurance prices for consumers in Michigan," said Assistant Attorney General Varney.

"Over the last quarter century, asset forfeiture and money laundering prosecutions have become integral to our country’s law enforcement strategy," said Assistant Attorney General Breuer.

"Today’s charges mark the first time that HEAT’s Medicare Fraud Strike Force has indicted a corporate entity for Medicare fraud," said Assistant Attorney General Breuer.

"In addition to the arrests and criminal charges that Assistant Attorney General Breuer announced, we are also announcing that we have obtained a Temporary Restraining Order freezing the assets of four corporate entities," said Assistant Attorney General West.

"Every year, health care fraud costs American taxpayers billions of dollars and undermines the integrity of the health care programs on which so many of us depend," said Assistant Attorney General West.

Leading up to next week’s election, the Department has devoted significant time and resources in recent months to enforce the Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) and the Military and Overseas Voter Empowerment (MOVE) Act of 2009, in order to ensure that all military and overseas voters can access their right to vote and have their votes counted in the upcoming election.
