The present petition is directed against order of detention dated 28.1.2020 passed by the respondent - detaining authority in exercise of powers conferred under section 3(2) of the Gujarat Prevention of Anti Social Activities Act, 1985 (for short "the Act") by detaining the petitioner - detenue as defined under section 2(c) of the Act.

Further, learned advocate for the detenue submits that illegal activity likely to be carried out or alleged to have been carried out, as alleged, cannot have any nexus or bearing with the maintenance of public order and at the most, it can be said to be breach of law and order. Further, except statement of witnesses, registration of above FIR/s and Panchnama drawn in pursuance of the investigation, no other relevant and cogent material is on record connecting alleged anti-social activity of the detenue with breach of public order. Learned advocate for the petitioner further submits that it is not possible to hold on the basis of the facts of the present case that activity of the detenue with respect to the criminal cases had affected even tempo of the society causing threat to the very existence of normal and routine life of people at large or that on the basis of criminal cases, the detenue had put the entire social apparatus in disorder, making it difficult for whole system to exist as a system governed by rule of law by disturbing public order.

In addition to this, two more repatriation flights -- one each from Singapore and Manila ( Philippines) -- are expected to arrive in Mumbai on Sunday, it said. CCP(S) No. 402/2019 regarding correct allotment of the GP Fund Computer Code numbers is pending before the respondents and has not been concluded, therefore, the respondents could not have proceeded to withhold the salary of the petitioners since the month of December, 2017, that too, without issuing any formal order to the petitioners. It is contended that the petitioners are continuing to discharge their duties uninterruptedly at their respective places of posting, however, their salary is not being released without there being any rhyme or reason. The petitioners claim that despite they having approached the respondents repeatedly, their salary was not released constraining them to approach this Court through the medium of writ petition bearing SWP No.2648/2018, wherein they prayed for the grant of following relief(s) in their favour:

2. Relevant facts are that plaintiff has filed suit for recovery against the defendant no.1 and 2. The case of the plaintiff, as set out in the plaint, is that plaintiff is a company registered under the Companies Act 1956 and is engaged in the manufacturing of coating powder and trading of decorative and industrial paints and thinner since 1994. The defendant is a limited company and registered under the Companies Act, 1956 and involved in the manufacturing of electrical panels. The defendant through its directors/ officials approached the plaintiff for purchase of the coating powder and industrial paints and thinner and at the time of commencement of the business, the terms of business, as specifically printed on or contained in the plaintiff's invoices were agreed by the defendant and thereafter business dealings and transactions started between the parites hereto in 2004 and since 15.04.2004 they have been maintaining a running account.

1.2 Notice to the respondent was dispensed with, as the respondent had not yet been summoned by the Trial Court.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. Therefore, noticing that several opportunities have already been afforded to the complainant, the complaint was dismissed. 3 Sh.Anish Bhola, counsel for the petitioner has assailed the CR No.-87/2020 Page No.-1 of 3 impugned Order on the ground that the Ld. MM committed a grave error in observing that the ECS mandate was not on record. It is pointed out that the petitioner/ complainant along with the complaint had placed on record a ' Debit Authorization Form issued by the customer" i.e. the respondent to the petitioner bank. It is argued that the Debit Authorization Form is akin to ECS mandate. The petitioner/complainant had also placed on record along with the complaint a memorandum issued by the bank, noticing return of the mandate on account of insufficiency of funds. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.

The case of the plaintiff as disclosed from the plaint is that the plaintiff is engaged in the business of providing internet services under licence from Department of Telecommunications, Ministry of Communications & Information Technology. The defendants approached the plaintiff for taking internet services and after negotiations the plaintiff agreed to provide services to a defendant and thereafter the plaintiff and the defendant signed customer application form (CAF) on 04.04.2015. The plaintiff provided the internet services to a defendant No. 1 company on monthly basis and after providing the services, the plaintiff raised bill of Rs.27,54193/­ and out of the said amount the defendants paid a sum of Rs. 22,08,000/­ and the balance sum of Rs. 5,46,193/­ is outstanding and due against the defendants which defendants failed to pay despite demands from the plaintiff.

An Air India flight with 163 Indians landed at the Hyderabad international airport from Kuwait on Saturday night as part of the government's Vande Bharat Mission to bring home Indian nationals stranded abroad, airport sources said. The AI flight 988 landed at the airport shortly after 10 pm, the sources said. To facilitate the arriving passengers and aircraft crew, the Hyderabad International Airport has kept the international arrivals and the stretch right from the aerobridge to the arrivals ramp fully sanitized and fumigated, the sources said. It will be ensured that passengers follow social distancing norms, they said. The passengers would be screened by thermal cameras prior to immigration formalities, they said. Fourteen people were rescued after the wall of a house collapsed in suburban Kandivali on Sunday morning, an official said. Two of those rescued received minor injuries and were admitted to a hospital, he said. The wall of the ground-plus-two-floor structure, known as Dipjyoti chawl, located in Lalji Pada area collapsed early morning, an official at the disaster control room said. Some locals said the incident took place when residents were asleep and they were unable to come out. A special train carrying 1,140 migrant workers stranded here in the lockdown has left Mangaluru railway station for Jharkhand. Dakshina Kannada MP Nalin Kumar Kateel and Vedavyas Kamath, MLA, were present at the railway station on Saturday night when the train left. A massive dust storm barrelled through the national capital and neighbouring areas on Sunday, a day after the mercury touched the 40.9 degrees Celsius mark in the city -- the season's highest so far. Light rains were also reported from isolated places in Delhi-NCR, weather experts said. Gusty winds and rains led to a significant drop in the mercury. The maximum temperature is expected to settle around 35 degrees Celsius. Delhi residents on social media shared videos of gusty winds with plumes of dust engulfing the streets. Kuldeep Srivastava, the head of the regional forecasting centre of the IMD, said it was a result of a fresh western disturbance. Winds gusting up to 70 kilometers per hour swept across the national capital accompanied by light rains, he said.

An Air India flight landed here from London at 1.30 am on Sunday carrying 239 Indians from the UK who were stranded there due to suspension of commercial passenger air services and the subsequent lockdown, an official statement said. In addition to this, two more repatriation flights -- one each from Singapore and Manila ( Philippines) -- are expected to arrive in Mumbai on Sunday, it said. While the flight from Singapore (AI 343) will be carrying 243 passengers, the Manila-Mumbai flight (AI 387) would bring back 241 Indian nationals from the South East Asian country, as per the statement.
