Police of Puerto Rico Lieutenant Erick Rivera Nazario and Officer Jimmy Rodriguez Vega were indicted on civil rights charges alleging that they used excessive force on two men, the Justice Department announced today. Nazario and Vega allegedly violated the constitutional rights of Jose Irizarry Perez and his father Jose Irizarry Muniz while the two were celebrating the local election results at the Las Colinas housing development in Yauco, Puerto Rico, on Nov. 5, 2008. Rivera was also indicted for making false declarations before the federal grand jury during its investigation into the civil rights violations.

The indictment charges former FBI special agent Robert G. Lustyik Jr., 50, of Sleepy Hollow, N.Y.; Michael L. Taylor, 51, of Harvard, Mass., the principal of Boston-based American International Security Corporation (AISC); and Johannes W. Thaler, 49, of New Fairfield, Conn., each with one count of conspiracy, eight counts of honest services wire fraud, one count of obstructing justice and one count of obstructing an agency proceeding.

A federal jury late last night convicted two Harlan County, Ky., men on federal kidnapping charges and conspiracy charges, exposing them to a maximum of life imprisonment. The jury also acquitted the men of violating the sexual orientation provision of the Matthew Shepard James Byrd, Jr. Hate Crimes Prevention Act. David Jason Jenkins, 37, and Anthony Ray Jenkins, 20, were convicted on the kidnapping and conspiracy charges for their roles in kidnapping and assaulting 28-year-old Kevin Pennington, a gay man.

The Justice Department announced that it has reached agreements with Carroll County and Craig County, Va., that will allow the counties and their political subdivisions to bail out from their status as “covered jurisdictions” under the special provisions of the Voting Rights Act, and thereby exempt these jurisdictions from the preclearance requirements of Section 5 of the Voting Rights Act.

The United States has filed a complaint against a Virginia-based contractor alleging that the company submitted false claims for unqualified security guards under a contract to provide security in Iraq, the Justice Department announced today. The company, Triple Canopy Inc. is headquartered in Reston, Va.

A federal court has permanently barred Cynthia Carter, a Columbus, Miss., tax return preparer, from preparing federal tax returns for others, the Justice Department announced today. The civil injunction order, to which Carter consented without admitting the allegations against her, was signed by Judge Sharion Aycock of the U.S. District Court for the Northern District of Mississippi.

A federal court has preliminarily enjoined ITS Financial LLC, the parent company that owns the Instant Tax Service tax-preparation franchise operation, the Justice Department announced today. Dayton, Ohio-based ITS claims to be the fourth-largest tax-preparation firm in the nation, according to the government complaint in the civil lawsuit. Judge Timothy Black of the U.S. District Court for the Southern District of Ohio signed the order, which also applies to the company’s CEO, Fesum Ogbazion. The defendants consented to the preliminary injunction.

John Hall, 27, an inmate at the Federal Correctional Institution in Seagoville, Texas, pleaded guilty today in federal court to violating the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act stemming from his assault of a fellow inmate, who he believed to be gay, the Department of Justice announced. Hall assaulted his fellow inmate with a dangerous weapon, causing bodily injury to the victim on Dec. 20, 2011.

MoneyGram International Inc. – a global money services business headquartered in Dallas – has agreed to forfeit $100 million and enter into a deferred prosecution agreement (DPA) with the Justice Department in which it admits to criminally aiding and abetting wire fraud and failing to maintain an effective anti-money laundering program, as charged in an information filed today in the Middle District of Pennsylvania.

Thirty-four alleged members of the Aryan Brotherhood of Texas gang (ABT), including four of its most senior leaders, have been indicted by a federal grand jury in Houston for allegedly conspiring to participate in a racketeering enterprise.

"The Criminal Division is determined, with its federal, state and local law enforcement partners, to continue disrupting and dismantling ABT and other violent criminal enterprises," said Assistant Attorney General Breuer.

Chase McClary, 24, of Johnsonville, S.C., was sentenced today in federal court to four years in prison followed by three years supervised release for his racially-motivated attack of an African-American teenager.

Anthony L. Dinunzio, the acting leader of the New England La Cosa Nostra (NELCN) crime family, was sentenced today to serve 78 months in federal prison for his role in a racketeering conspiracy to extort protection payments from adult entertainment businesses in Rhode Island.

"Today, in U.S. District Court here in the Eastern District of Louisiana, the Department filed a 14-count information charging BP with 11 counts of felony manslaughter, one count of felony obstruction of Congress, and violations of the Clean Water and Migratory Bird Treaty Acts in connection with the Deepwater Horizon oil spill that began in April 2010," said Attorney General Holder.

A federal court in Ft. Lauderdale, Fla., has permanently barred a Broward County man from preparing federal tax returns for others, the Justice Department announced today. Jayvon Copeland, who last month pleaded guilty in a criminal case to conspiracy to defraud the United States, consented to the injunction order without admitting the allegations in the civil complaint filed against him last April.

A federal court has permanently barred a Michigan lawyer, Tammy Daniels of Farmington Hills, from promoting an alleged tax fraud scheme, the Justice Department announced today. The civil injunction order, to which Daniels consented without admitting the allegations against her, was signed by Judge Paul D. Borman of the U.S. District Court for the Eastern District of Michigan. In August the court enjoined Daniels’s co-defendants, Damian and Holly Jackson, from preparing federal tax returns for others and promoting the scheme.

The Department of Justice and the Federal Trade Commission (FTC) announced today that they will hold a joint public workshop on Dec. 10, 2012, to explore the impact of patent assertion entity (PAE) activities on innovation and competition and the implications for antitrust enforcement and policy.

A former executive of Lender Processing Services Inc. (LPS) – a publicly traded company based in Jacksonville, Fla. – pleaded guilty today, admitting her participation in a six-year scheme to prepare and file more than 1 million fraudulently signed and notarized mortgage-related documents with property recorders’ offices throughout the United States.

A federal jury sitting in Santa Ana, Calif., on Wednesday, Nov. 21, 2012, convicted Safieh Fard of one count of conspiracy to defraud the Internal Revenue Service (IRS) and one count of conspiracy to launder the proceeds of bank fraud obtained after submitting fraudulent mortgage applications, the Justice Department and IRS Criminal Investigation announced. Fard’s co-conspirators, her sister Sedigheh Bahramian, and two of her sons, Mohsen Kikalaye and Ahmad Kikalaye, pleaded guilty to related counts of bank fraud in 2010.

The Justice Department announced today that it reached an agreement with ComForcare In-Home Care & Senior Services, a home care provider for sick and elderly patients in Tigard, Ore. The agreement resolved claims that the provider violated the anti-discrimination provision of the Immigration and Nationality Act (INA), when it demanded unnecessary documentation from a newly naturalized citizen in response to an initial mismatch in E-Verify and then refused to hire her when she did not produce it.

Attorney General Eric Holder and European Union (EU) Commissioner for Home Affairs Cecilia Malmström will launch the Global Alliance Against Child Sexual Abuse Online at a ministerial conference tomorrow, Dec. 5, 2012, in Brussels.

The founder and president of the National Association of Special Police and Security Officers (NASPSO) – which represents private security guards assigned to protect federal buildings in the metropolitan Washington area – was convicted yesterday in Washington federal court, following a jury trial, of 18 counts related to his theft of union treasury and pension funds.

A federal court has permanently barred Larry Carnell Dixon Sr., a Louisiana tax return preparer, and his business, Dixon’s Tax Service, LLC from preparing federal tax returns for others, the Justice Department announced today. The civil injunction order, to which Dixon and Dixon’s Tax Service LLC, consented without admitting the allegations against them, was signed by Judge James Brady of the U.S. District Court for the Middle District of Louisiana.

The Department of Justice today announced the opening of their comprehensive grant solicitation period for funding to support public safety, victim services and crime prevention improvements for American Indian and Alaska Native tribal governments.

"This “new patriotism” should not countenance through procedural abuses – which are sadly found in our history, but nowhere in our founding documents – mechanisms that frustrate the desire of our fellow citizens to exercise their most fundamental, and uniquely American, rights," said Attorney General Holder.

But, as this report clearly illustrates, we cannot yet be satisfied - and this is no time to become complacent," said Attorney General Holder.

A New Jersey man was arrested today for crimes related to the illegal importation and illegal trafficking of narwhal tusks (whale tusk) and associated money laundering crimes.

The U.S. District Court for the District of Columbia issued a consent order of forfeiture today ordering the civil forfeiture of $6,976,924 traced to international money laundering of the proceeds from an offshore Internet gambling operation that illegally targeted U.S. residents.

U.S. District Judge Janet Bond Arterton today sentenced Azibo Aquart to death for murdering three Bridgeport, Conn., residents on Aug. 24, 2005.

The owner of a string of community mental health centers pleaded guilty today in connection with a health care fraud and money laundering scheme involving defunct health care provider Health Care Solutions Network Inc. (HCSN).

Earlier today, at the federal courthouse in Brooklyn, New York, U.S. District Judge Sterling Johnson, Jr. accepted a guilty plea by American biotechnology giant Amgen Inc. (Amgen) for illegally introducing a misbranded drug into interstate commerce. The plea is part of a global settlement with the United States in which Amgen agreed to pay $762 million to resolve criminal and civil liability arising from its sale and promotion of certain drugs. The settlement represents the single largest criminal and civil False Claims Act settlement involving a biotechnology company in U.S. history.

"Today, the Justice Department is filing a criminal information charging UBS Securities Japan – a subsidiary of the multinational financial institution UBS AG – with felony wire fraud for engaging in a scheme to manipulate the London Interbank Offered Rate, or LIBOR – a key benchmark for financial products and transactions around the world," said Attorney General Holder.

The Justice Department announced today that it has reached an agreement with the State of New Hampshire that will allow for all 10 of the towns in that state that are covered jurisdictions under the special provisions of the Voting Rights Act to bail out from coverage by these provisions.

The Department of Justice and the U.S. Bureau of Land Management announced today – Dec. 28, 2012 – a settlement of the United States’ federal court lawsuit against Custer County and the State of Idaho concerning county action on roads and trails on federal land in Custer County.

A Nevada federal court has permanently barred Benyam Tewolde from preparing tax returns for others, the Justice Department announced today. Tewolde and his wife, Yordanos Kidanits, are the alleged co-owners of an Instant Tax Service franchise that operates at multiple locations in the Las Vegas area. Instant Tax Service is a nationally franchised tax preparation company based in Dayton, Ohio.

Attorney General Eric Holder today welcomed the confirmation of Bill Baer as the Department of Justice’s Assistant Attorney General for the Antitrust Division.

The Justice Department announced that it has reached an agreement with the Browns Valley Irrigation District, a special district in California, that, if approved by the court, will allow for the district to bail out from its status as a “covered jurisdiction” under the special provisions of the Voting Rights Act, and thereby exempt the district from the preclearance requirements of Section 5 of the Voting Rights Act. The district covers part of Yuba County, which is a jurisdiction subject to Section 5. The agreement is in the form of a consent decree filed today in the U.S. District Court for the District of Columbia.
