(Court of Appeals of New York) - In this case, petitioner, a not-for-profit theater corporation, filed applications for real property tax exemptions with respondent assessor and was denied. Petitioner then commenced this RPTL article 7 proceeding for review of its tax assessments. Order of the Appellate Division granting the petition is affirmed, where: 1) the statute does not elevate one exempt purpose over another, and under the circumstances, the use of property to provide staff housing is reasonable incidental to petitioner's primary purpose of encouraging appreciation of the arts through theater; and 2) petitioner has demonstrated that it is entitled to an RPTL 420-a tax exemption.

(United States Supreme Court) - In a case alleging racial gerrymandering, held that the Virginia House of Delegates lacked standing to appeal the invalidation of Virginia's 2010 redistricting plan. As a single chamber of a bicameral legislature, the House had no standing to appeal a three-judge federal district court's redistricting ruling separately from the State of which it is a part. Justice Ginsburg delivered the opinion of the 5-4 Court, joined by Justices Thomas, Sotomayor, Kagan and Gorsuch.

(California Court of Appeal) - Affirmed. Plaintiff was cited for wage and hour violations. Plaintiff contended that it could require its employees to work “on-duty” meal periods less than 30 minutes. The appeals court found that an employer must provide meal periods of at least 30 minutes regardless of whether they are on-duty or off-duty.

(United States Second Circuit) - Affirming the district court's grant of summary judgment that although Apple and a group of major publishers committed an unlawful antitrust conspiracy there was no antitrust injury that resulted.

(United States Seventh Circuit) - Held that the district court should have abstained from exercising jurisdiction over a lawsuit contending that the First Amendment required the Clerk of the Circuit Court of Cook County, Illinois, to release newly filed complaints to the press at the moment of receipt by her office -- not after processing. Ordered the case dismissed without prejudice.

(United States Fifth Circuit) - In a trademark infringement case, summary judgment was granted to defendant as no reasonable jury could conclude that defendant misappropriated plaintiff's mark in any way, and the district court did not abuse its discretion in denying defendant's request for attorneys' fees.

(United States Eleventh Circuit) - Judgment against plaintiffs on their claims of trade dress infringement, trade dress dilution, and unjust enrichment, and judgment for one counter-claimant that a settlement agreement barred plaintiffs from bringing the present suit, are affirmed, as plaintiffs' claims fail as a matter of law. Where plaintiffs failed to file a postverdict motion regarding the settlement, they cannot raise it on appeal.

(United States Tenth Circuit) - In an action claiming trademark infringement, unfair competition, and cybersquatting, summary judgment for defendant is affirmed where: 1) trademark infringement and unfair competition claims failed as plaintiff did not show that "Utah Lighthouse" was protectable, that defendant's use was in connection with any goods or services, and that defendant was likely to cause confusion among consumers as to the source of goods sold on its online bookstore; 2) defendant lacked a bad faith intent to profit from the use of plaintiff's trademark in several domain names under the Anti-Cybersquatting Protection Act (ACPA); and 3) defendant's website met safe harbor conditions of the ACPA since it was a parody.
