1. The present Appeal No. 340 of 2016 has been preferred by M/s. 3. The brief facts of the prosecution case are as under;

The first informant, Sri. K.Y. Raghavendra Rao is a resident of Vinoba Nagar in Davanagere. He has a daughter and a son. His daughter is a minor. When she 3 was studying in I PUC, accused No.1 used to follow her and tease her. He used to roam in front of her house. She had informed the matter to her parents. In spite of advising the accused, he did not stop following her. The matter was brought to the notice of one Leela Kumaraswamy, working in an NGO. However, accused No.1 did not cooperate when she had called him over phone to enquire about the matter. The accused was threatening the victim girl to listen to his words or to face dire consequences.

2. It is stated that the petitioner had filed a petition under Section 437 of Cr.P.C seeking enlargement of bail before the Court of Senior Civil Judge and JMFC, Nelamangala. It is further submitted that necessary report was made to the Principal District and Sessions Court, Bengaluru Rural District, Bengaluru on 07.04.2020 as well as on 13.04.2020 to ensure that the petition be taken up on priority in light of urgency explained and also as it involved liberty of the petitioner and as he had made out a case for being enlarged on bail in the petition filed under Section 437 of Cr.P.C.

3. It is further submitted that on both occasions, i.e. 07.04.2020 and 13.04.2020, learned District Judge has refused to order that the bail petition be taken up for 3 consideration stating that it is not a case of extreme urgency.

Learned counsel for the petitioner submits that despite the fact that the petitioner approached initially the Chief Judicial Magistrate, Srinagar, for registration of case against the respondent No. 6, by filing application/complaint under Section 156(3) Cr. In the wake of the gas leak at a factory in Visakhapatnam, the National Disaster Management Authority (NDMA) has issued detailed guidelines for restarting industries after the lockdown and the precautions to be taken for the safety of the plants as well as the workers. In a communication to all states and union territories, the NDMA said due to several weeks of lockdown and the closure of industrial units, it is possible that some of the operators might not have followed the established standard operating procedures. As a result, some of the manufacturing facilities, pipelines, valves may have residual chemicals, which may pose risk. The same is true for the storage facilities with hazardous chemicals and flammable materials, it said. The NDMA guidelines said while restarting a unit, the first week should be considered as the trial or test run period after ensuring all safety protocols. Mizoram has registered a 10 per cent drop in Infant Mortality Rate (IMR) in 2019-20 fiscal, making it to the second spot in the country after Nagaland. State health minister R Lalthangliana said the IMR has dropped from 15 per cent to 5 per cent (per 1000 live births), citing the latest Sample Registration System (SRS) bulletin. With 10-point drop in IMR in 2019-20, Mizoram is the best-performing state in the country, he said. Over the past three years, the state has achieved 27- point drop in IMR. The minister attributed the achievement to efforts of healthcare workers and support of people. Union Health Minister Harsh Vardhan had on Saturday congratulated Mizoram and Lalthangliana on the achievement. The state had recorded 21 per cent IMR in 2016-2017, with 405 infants dying before attaining the age of one. During 2017-18, it fell to 20 per cent, and the following year to 15 per cent.
