1) The appellant/State has challenged judgment dated 07.01.2012 passed by the learned 2nd Additional Sessions Judge, Jammu (hereinafter referred to as the "trial Court") whereby, in a case arising out of FIR No. 116/2000 for offences under Sections 307/324/326/336/337 RPC registered with Police Station, Bagh-e- Bahu, Jammu, the respondents/accused have been acquitted of the charges.

2) The facts, leading to filing of this appeal, are that on 05.04.2000, PW Mohd Ashraf while undergoing treatment in Government Medical College Hospital, Jammu for the injury received by him, made a statement before the police that on the aforesaid date at about 10.30 am when he reached his in-laws‟ house at Raika, he saw a number of people having gathered over there. He further stated that his father-in-law Siraj Din and respondent No.1/accused were having a long standing land dispute going on between them. On account of this, the respondents/accused along with 8/10 more persons had come on spot. It was further stated that the respondent No.1/accused Showkat Ali with an intention to commit murder of PW Mohd Ashraf launched a murderous attack on him with a Pathi on left side of his head which resulted in grievous injury to him. It was also alleged that the other respondents/accused were carrying clubs and axes in their hands, but they did not launch any attack upon him. When some people came on spot, the respondents/accused fled away from the spot and PW Mohd Ashraf fell down unconscious.

PER SIDDHARTHA NAUTIYAL - JUDICIAL MEMBER:

These four appeals are filed by the assessee against the order passed by the Ld. Commissioner of Income Tax (Appeals), (in short "Ld. CIT(A)"), National Faceless Appeal Centre (in short "NFAC"), for the Assessment Years ITA Nos. 521 to 524 /Ahd/2023 Inox India Limited Asst.Years 2000-01 & 2002-03 to 2004-05)

- 2- 2000-2001, 2002-2003, 2003-2004 & 2004-2005. Since common issues are involved in all the year under consideration of appeals before us, the same are being disposed of by way of this common order.

SANJEEV NARULA, J.:

1. Mr. Khalid Jahangir Qazi, a national of United States of America holding the status of an Overseas Citizen of India,1 has invoked the jurisdiction of this Court under Article 226 of the Constitution of India, 1950, seeking entry to India. He challenges the legality of two restrictive measures imposed upon him - order dated 12th May, 2023 issued by the Consulate General of India, New York,2 cancelling his OCI card under the Citizenship Act, 1955,3 and the Citizenship Rules, 2009; and a subsequent blacklisting order issued by the Ministry of Home Affairs, under the Foreigners Act, 1946,4 restraining his entry into India. The underlying basis of these actions, as asserted by the Respondents, is the Petitioner's alleged involvement in activities deemed to be prejudicial to the interests of India.

1. Vide order dated 29.08.2024 Prakash Grih Nirman Sehkari Samiti Maryadit was directed to file the reply. Learned counsel representing respondent/ Prakash Grih Nirman Sehkari Samiti Maryadit has submitted that due to technical reasons reply has not been uploaded. The same may be filed within two weeks with copy to the opposite parties.

2. In the meantime, learned counsels for the State and BMC are directed to trace the map, revenue record with regard to allotment/allocation of green belt in the Map as approved.

3. Applicant present in person has submitted that the present matter relates only to the cutting of trees. MPPCB has issued notice to the Prakash Grih OA No. 139/2023(CZ) Krishnarani Agrawal vs. State of Madhya Pradesh & Ors. Nirman Sehkari Samiti Maryadit with assessment of environmental compensation but the same has not been replied till date. State PCB is directed to finalise the matter and report within two weeks.

The Court: We have heard learned counsel for the parties. On 25th April, 2023, the appeal was admitted and all further proceedings in the suit including the hearing of the application under Sections 5 and 8 of the Arbitration and Conciliation Act pending before the learned Trial Court was initially stayed for eight weeks and thereafter the said interim order was extended from time to time.

We feel that the appeal is required to be heard and we do not find any reason to vacate the interim order at this stage.

The interim order passed on 25th April, 2023 is confirmed. The applications stand disposed of.

2. The facts in brief in this writ petition are that the petitioners originally joined their service at the Bank of Madura at various positions on different dates. The Bank of Madura was amalgamated with ICICI Bank Limited, the 2nd respondent herein by the Scheme of amalgamation with effect from 10.03.2001. As per the said scheme, all the employees of Bank of Madura stood transferred to the service of ICICI Bank Limited however, all the service conditions of the employees of Bank of Madura are protected.

This writ petition is filed seeking mandamus to direct the respondents to extend the petitioners an opportunity to exercise option notionally with effect from 1.8.2003 or any subsequent dates based on the date of cession of service, in any event as per the 9th bipartite settlement.

2. The facts in brief in this writ petition are that the petitioners were originally joined their service at the Bank of Madura at various positions on different dates. The Bank of Madura was amalgamated with the 1st respondent Bank under the Scheme of amalgamation sanctioned by the Reserve Bank of India with effect from 10.03.2001. 1. The petitioner being a consolidated worker engaged by the Municipal Committee, Handwara came to be terminated/disengaged from service with immediate effect in terms of impugned order No. MC/Hand/Estt/2022-23/32-36 dated 06.04.2023 by the Executive Officer, Municipal Committee, Handwara. This order is under challenge in the present writ petition by the petitioner.

2. In terms of an order dated 12.04.2023, this Court came to keep on hold the operation of the impugned order dated 06.04.2023, with a further interim direction unto the respondents to allow the petitioner to continue as a consolidated worker in terms of his original engagement order dated 30.12.2006.

JUSTICE J.M.KHAZI) Petitioner who is complainant before the trial court has filed this petition under Section 482 of Cr.P.C. challenging the order dated 13.12.2017 passed by the trial court dismissing the complainant as against accused Nos.8 to 11, by which the trial court has ordered for issuance of process against accused Nos.1 to 7, but refused to proceed against accused Nos.8 to 11 who are revenue officials.

2. For the sake of convenience, the parties are referred to by their ranks before the trial court.

3. In support of the petition, complainant has contended that the refusal by the trial court to take cognizance against the accused Nos.8 to 11 is opposed to law, facts and probabilities of the case. The trial court has failed to appreciate that accused Nos.8 to 11 have failed to act in accordance with law. They have altered the boundaries of the property of the complainant in a manner advantageous to accused Nos.1 to 7, without issuing notice to the complainant. There are specific allegations in para 8 of the complaint regarding illegal acts of accused Nos.8 to 11 which is sufficient to take cognizance against them. Not only accused Nos.8 to 11 guilty of not providing opportunity to the complainant by issuing notice, but also in altering boundaries of the property of the complainant contrary to the documents. Complainant is required to be provided with an opportunity to establish the allegations made against accused Nos.8 to 11 and hence, the petition.

Petitioner is in custody for 11 months. He submits there was a romantic relationship between the parties. Victim has already been examined. Accordingly, he prays for bail.

2. Learned Advocate for the State opposes the bail prayer.

3. Inspite of notice nobody appears for the victim.

4. We have considered the deposition of the victim. Though she is a minor, she admitted there was friendly relationship between the parties. Her deposition is complete. There is little possibility of trial concluding in the near future.

Heard learned lawyers for both parties.

2. Petitioner submits there was a romantic relationship between two young persons. He is in custody for about more than four and half months. He prays for bail.

3. Learned counsel appearing for the State opposes the bail prayer.

4. Inspite of notice, nobody appears for the victim.

5. We have considered the materials on record. Statement of victim supports the version of the petitioner that there was a romantic relationship between two young persons. Petitioner is in custody for a considerable period of time. There is no chance of trial concluding in the near future, we are inclined to grant bail to the petitioner.
