(United States First Circuit) - Affirming a district court dismissal of claims by an attorney suspended from the practice of law for a year in a suit against a host of judicial officers and administrators who participated in his disciplinary proceedings seeking the reinstatement of his license and money damages on the basis of alleged First, Seventh, and Fourteenth Amendment violations, but the Rooker-Feldman doctrine applies where a state court loser files in federal court and bars such actions.

Defendant advanced the theory that its insurance policy did not cover injuries caused by drunk driving collisions, because they are not “accidents”. The trial court granted summary judgment to Defendant, insurance company, stating that the intentional decision to drive while intoxicated meant the collision was not an accident. The appeals court held that there was nothing in Texas law that would construe the term “accident” in the manner put forth by the Defendant.

The exception allows maritime liens to be asserted by subcontractors whose selection was controlled or directed by a vessel's owner/charterer. Vacated and remanded on this issue.

(United States Federal Circuit) - Vacating the Patent Trial and Appeal Board's dismissal of an interference claim for lack of standing and remanding for further proceedings because the description of a method for removing hair using nanoparticles to damage hair follicles was a sufficient written description under the Patent Act because although the description only gave optical density rather than particles per ml, this was enough of a disclosure to convey to those skilled in the art that the inventor had possession of the claimed subject matter.
