The OSCE Project Co-ordinator in Ukraine and the International Renaissance Foundation supported a training session for eight board members of the Association of Legal Clinics in Ukraine on strategic planning, which was held in Bucha, Ukraine, on 30-31 May 2016.

The participants conducted brainstorming sessions on formulating the mission statement, main areas of practice, institutional development of the organization as well as an strengths, weaknesses, opportunities and threats (SWOT) analysis of organizational capacity, and prepared a strategic plan for 2016-2018. They also learned about the best practices of organizational and institutional development from national and international experts.

Katarzyna Furman, board member of the European Network for Clinical Legal Education, and Filip Czernicki, board member of the Polish Legal Clinics Foundation, shared their experience of management standards and methods of improving efficiency.

The event was organized as part of the OSCE project aimed at supporting reform and development of legal education in Ukraine. The Project Co-ordinator also developed the first manual clinical legal education in Ukraine, which was an important component of quality and practice-oriented legal education.

The OSCE Project Co-ordinator on 15 July 2016 launched the first distance course in Ukraine on the application of the case-law of the European Court of Human Rights (ECtHR).

Developed, designed and produced by the OSCE Project Co-ordinator, the course was finalized after it was successfully piloted on the online platform of the National School of Judges of Ukraine (NSJU).

From now the NSJU will have this sustainable tool at its disposal for systematically training judges on applying the case-law of the ECtHR without having to involve extra human or financial resources. Thirty judges from all over Ukraine have already been trained distantly and received their certificates of accomplishment.

The content was developed in co-operation with experts on the European Convention on Human Rights and the case-law of the ECtHR, and Ukrainian judges.

The course was developed as part of the “Safeguarding Human Rights through Courts” project, which is being implemented by the OSCE Project Co-ordinator in Ukraine with the financial support of the Government of Canada.

Thirty experts were trained to deliver specialized training courses for judges on how to review corruption–related disputes and prevent corruption in the judiciary during a two-day session, organized by the OSCE Project Co-ordinator in Ukraine and the National School of Judges on 5-6 July 2016 outside Kyiv.

The trainees, judges-lecturers of five regional branches of the School, enhanced their knowledge of anti-corruption legislation, including national regulations and relevant international conventions, major aspects of judges’ ethics, including the identification and prevention of real and potential conflicts of interest, and judicial review of corruption-related disputes. The purpose of the session was to create a pool of experts able to deliver training courses for their peers at the National School of Judges on a regular basis.

According to the Judicial Education Concept adopted by the School, the training methodology was based on interactive techniques and included discussions, case studies, mini-lectures, various exercises and role plays, and screenings of short simulation videos on the topic.

To ensure the sustainability of OSCE efforts, the training course on anti-corruption will be submitted for institutionalization at the National School of Judges by the end of the year. This course will form part of the School’s mandatory curriculum for every judge appointed to the post.

The training session was part of a project by the OSCE Project Co-ordinator in Ukraine to enhance the quality of judicial education and training.

Some 18 officers of the Moldovan armed forces, as well as representatives of the Interior and Justice Ministries successfully completed a training course on the safe handling of ammunition stockpiles held at the Military Academy in Chisinau from 23 February to 11 March 2016.

The participants were familiarized with different types of ammunition, including small arms and light weapons and conventional ammunition, and were instructed on how to handle, pack and store ammunition.

“Knowing how to handle ammunition in a manner that does not pose a risk to yourself and to those around you is an essential skill for any member of the armed forces, regardless of their rank,” said Per Normark, Programme Manager of the Conflict Prevent and Resolution programme at the OSCE Mission to Moldova. “This training course has equipped participants with practical knowledge on how to handle a range of types of ammunition, thereby building the capacity of the Moldovan armed forces to ensure a secure and safe environment.”

The course, which was supported by the OSCE Mission to Moldova, was conducted by specialized trainers in the National Army with the guidance of a group of experts from Austria and Sweden.

The training course is part of a multi-year project to train Moldovan ammunition specialists. The aim of the project is to provide the specialists with the necessary skills for the safe and secure storage of small arms and light weapons in accordance with OSCE and international best practices.

SLOVIANSK, Ukraine, 7 April 2016 – The OSCE Project Co-ordinator in Ukraine, at a ceremony in Sloviansk, Donetsk region today, presented representatives of the Infrastructure Ministry’s State Special Transport Service with 15 sets of protective equipment, including vests and helmets, which are to be delivered to local deminers working along transport routes in the east of the country.

The State Special Transport Service is responsible for ensuring the safety of the transport network and for restoring railways and bridges destroyed by hostilities. This often involves clearing mines and unexploded ordnance that threaten civilian transportation routes. 

“Safety of communications is extremely important in the context of sustainable post-conflict recovery, future peace and security in the region,” said Vaidotas Verba, the OSCE Project Co-ordinator in Ukraine. “I hope that with our help the Service will be in better position to swiftly and efficiently ensure safer conditions for the movement of people and goods in the conflict-affected areas.”

Since July 2014 the Service has cleared over 300 kilometres of railways in government-controlled areas of Donbas and disposed of more than 4,500 unexploded ordnance, mines and booby traps. This is among the more than 100,000 such dangerous items discovered and destroyed by all organizations working in the region, which are involved in dealing with these remnants of conflict.

To help Ukraine address this new challenge, the OSCE Project Co-ordinator is also training the country's humanitarian deminers on international mine action standards, helping to introduce a modern information management system to improve operations and the inter-agency co-ordination of efforts, and assisting in developing relevant legislation and standards.

More than 40 specialists from Afghanistan, Armenia, Kazakhstan, Kyrgyzstan and Tajikistan completed a training seminar on advanced explosive ordnance disposal on April 20, 2016 in Dushanbe, organized by the OSCE Office in Tajikistan as a part of a multi-year project.

The course, which covered levels one and two of the explosive ordnance disposal curriculum outlined in International Mine Action Standards, was held at the Lyaur Field Training Centre of Tajikistan’s Ministry of Defence. The participants came from national armed forces, national mine action co-ordination authorities and civilian agencies which are directly engaged in addressing explosive hazards threats.

“The second explosive ordnance disposal training cycle is particularly significant as it introduces the mentorship approach to training whereby junior instructors – graduates of the first training cycle implemented in years 2014 and 2015 - are providing training shoulder-to-shoulder with their United States Army Central colleagues to the students from Central Asian and Afghanistan,” said Scott Kearin, Acting Head of the OSCE Office in Tajikistan.

U.S. Ambassador to Tajikistan Elisabeth Millard highlighted the leadership that the Ministry of Defense of Tajikistan has shown in hosting this series of training events. She said: “The need for competent explosive ordnance disposal specialists and trainers is critical for removing landmines and explosive remnants of war that threaten safety and stability in Tajikistan and surrounding countries.” She praised the Tajik Ministry of Defence for hosting a train-the-trainer program that allows them to lead humanitarian mine action programmes in the wider region.

Muhabbat Ibrohimzoda, Director of the Tajikistan National Mine Action Centre, said: “Tajikistan recognizes the present-day threats of explosive hazards and the need to address these challenges throughout the region and on a global level.”

Two separate courses – for Russian speaking and Tajik-Dari speaking groups of students - were facilitated by the OSCE Office in partnership with the United States Army Central and supported by the U.S. Embassy’s Office for Military Co-operation in Dushanbe. They were financed by the U.S. State Department’s Office of Weapons Removal and Abatement.

Since 2009, the OSCE has been supporting the development of co-operative mechanisms on a technical level among states in Central Asia and Afghanistan to address concerns and challenges stemming from explosive hazards.

TASHKENT, 12 July 2016 – A three-day seminar for journalists to improve their skills in reporting on human trafficking, organized by the OSCE Project Co-ordinator in Uzbekistan and the Office of the Prosecutor General, began yesterday.

The seminar brings together 26 journalists from all the regions of Uzbekistan to discuss the challenges of reporting on human trafficking and effective ways to overcome them by drawing on international and national good practices. “For better coverage of human trafficking, it is important to both see it as a global phenomenon and understand its specifics in your own country,” said Anatoly Verbin, an international media expert, addressing the media specialists.  

Ambassador John MacGregor, the Project Co-ordinator in Uzbekistan, said that OSCE anti-trafficking commitments include the cultivation of partnership with journalists to enhance their knowledge and understanding of the complexity of the phenomenon, which is a composite of many serious crimes as well as denials of rights. “Prevention of human trafficking cannot be effective if the media do not join us in raising awareness of this crime. The trafficked persons need understanding and assistance in restoring their rights, not moral accusations, judgment or pity,’’ he noted.

Gyulnoza Rakhimova, the head of the press service of the Office of the Prosecutor General, stressed that the training will cover current legislative and law enforcement practices, how to make the information more interesting for readers and not to violate the rights of victims of trafficking.”

The training is part of the OSCE Project Co-ordinator’s project to assist Uzbekistan in combating trafficking in human beings and to develop a comprehensive victim-support system through expert advice and information.

Ways to increase the sustainability of social businesses by using social media marketing tools were discussed at a training session organized in Kyiv on 26 July 2016 by the OSCE Project Co-ordinator in Ukraine.

The event gathered representatives of three social businesses that were established with the support of the OSCE Project Co-ordinator in Ukraine so that they can provide job skills for people vulnerable to human trafficking. The social businesses also simultaneously serve as revenue sources for local NGOs working on anti-trafficking.

The training course focused on widespread social networks and ways of using them for increasing social enterprises’ profit, including the best use of social media to attract customers and gain their positive feedback. The participants had a chance to practice their digital skills and communication abilities during the hands-on exercises aimed at producing high-quality content for social networks.

Natalia Myakushko, Head of the Rukomysli Social Enterprise in Lviv, thanked the OSCE Project Co-ordinator for its continuous support. “The innovative idea of social business requires innovative tools for its development and this training helps us to use modern communication channels in an efficient way for the benefit of people vulnerable to human trafficking,” she said.

This is the first of three training sessions which will help social entrepreneurs develop a strategy for interacting with new media.

The training sessions are part of a project on preventing human trafficking in Ukraine through the economic empowerment of vulnerable persons, which is being implemented by the OSCE Project Co-ordinator in co-operation with the Ukrainian Ministry of Social Policy, and with the support from the Canadian Government and Norwegian Ministry of Foreign Affairs.

The project aims at the establishment of and support to social businesses that work to prevent human trafficking by providing beneficiaries with sufficient and sustainable income at home, giving them genuine and viable livelihood options, and therefore decreasing the likelihood of persons taking up deceptive job offers where they may be exploited.  

So far, 52 people at risk of human trafficking, including 14 internally displaced people, two victims of domestic violence and one ex-combatant, as well as six people who were formerly subjected to human trafficking have already benefited from the job skills’ courses within these social businesses.

KYIV, 5 AUGUST 2016 –OSCE Special Representative and Co-ordinator for Combating Trafficking in Human Beings, Madina Jarbussynova, on Friday concluded an official visit to Ukraine aimed at raising awareness of human trafficking and the risks encountered by the most vulnerable groups as a consequence of the current crisis.

During her five-day visit, she met with representatives of the Donetsk Oblast state administration and female Internally Displaced People (IDPs) in Kramatorsk. Ambassador Jarbussynova also travelled to Kharkiv to talk to relevant civil society representatives about the situation on the ground, how to prevent the expansion of the conflict-driven human trafficking phenomenon, and to evaluate existing mechanisms of identifying, referring and assisting victims of trafficking in human beings.

“More than one-and-a-half million citizens have been displaced – a vast number that demands a comprehensive response,” Jarbussynova said. “This vulnerable group can easily find itself in situations where human trafficking may occur.”

In Kyiv, the OSCE Special Representative met with Ukrainian authorities to discuss progress in anti-trafficking measures and review future plans.

“The Government of Ukraine has recently demonstrated a high level of commitment to addressing human trafficking, particularly in enhancing its victim identification efforts and in filing cases to relevant courts”, said Jarbussynova.

At the same time, she noted that there are still considerable gaps in the National Referral Mechanism for victims, and that long-term, sustainable measures should be sought.

The Special Representative travels regularly to Ukraine, engaging with high-level authorities and holding training sessions together with the Special Monitoring Mission and the OSCE Project Co-ordinator to strengthen the capacity of the Ukrainian institutions and OSCE monitors to spot human trafficking trends and to report on alleged cases.

The OSCE Programme Office in Astana will support a training seminar on preventing money laundering and combating the financing of terrorism (AML/CFT) for some 40 designated non-financial business and professions, namely notaries and advocates. The expert from the Russian Federation will present their country’s best practices on the efficient implementation of the AML/CFT national legislation and familiarize the audience with the AML/CFT international legal standards and requirements. The event also aims to enhance the co-operation between the non-financial sector actors and the AML/CFT national authorities.

The event is part of the Office’s long-standing efforts to promote good governance and AML/CFT framework in the host country.

The OSCE Center in Bishkek and the Training Centre for Prosecutors under the General Prosecutor’s Office will conduct a training course for twenty-four public prosecution officers from all provinces of Kyrgyzstan on effective investigation of cases of torture.

The training aims at enhancing theoretical and empirical knowledge of prosecution officers about the specifics of efficient investigation of torture allegations.

The participants will discuss the key challenges arising during investigation of torture allegations and exchange best practices applied within their respective duty stations to address these challenges.

The OSCE Mission to Skopje in close cooperation with the French Embassy is organizing on-site training courses on face recognition for border police officers countrywide. These half-day trainings, to be conducted by a French trainer, will help the border police officers detect impostors and prevent illegal use of documents in order to detect returning freedom-fighters and tackle the phenomenon of cross-border criminality more effectively, especially trans-national organized crime activity, human trafficking and human smuggling.
The first training will be conducted at Deve Bair crossing point, and will also take place at Kjafasan, St. Naum, Medzhitlija, Bogorodica, Dojran, Delchevo and other border crossing points.

Improving the situation of Roma in Ukraine by enhancing co-operation between Roma civil society organizations and national and regional authorities was the focus of a roundtable meeting organized by the OSCE Office for Democratic Institutions and Human Rights (ODIHR) and the Ministry of Culture of Ukraine in Kyiv on 24 November 2015.

Some 40 participants from Ukrainian national and regional authorities, Roma civil society and the international community, discussed the challenges faced by Roma in the areas of education, employment, housing and policing.

“Further efforts are needed to implement a strong anti-discrimination approach in all policies targeting the integration and protection of Roma and, in particular, of Roma women,” said Mirjam Karoly, ODIHR Senior Adviser on Roma and Sinti Issues. “Measurable progress at the local level can only be achieved if policies are needs-based and have concrete objectives that are matched with measurable indicators and realistic budgets.”

Andriy Vitrenko, Deputy Minister of Culture of Ukraine for European Integration, stated that the Ministry was tasked in 2013to facilitate the implementation of the Strategy on the Protection and Integration of the Roma National Minority into Ukrainian Society up to 2020. “In order to achieve the goals set out in the Strategy, close collaboration among a number of ministries at the national level and good co-ordination with regional and local level authorities are needed.”

During the meeting, the participants emphasized that many Roma lack personal documents, hindering them from exercising their fundamental, social and political rights.

Volodomyr Kondur, Chairperson of the Roma Coalition, said: “We welcome the adoption of national and regional policy documents addressing the problems Roma face, but we want to see effective and sustainable results and ask for ensuring involvement of the Roma civil society in all stages of policy implementation and evaluation.”

The roundtable meeting was organized as a follow-up to ODIHR’s Situation Assessment Report on Roma in Ukraine and the Impact of the Current Crises and in line with the 2003 OSCE Action Plan on Roma and Sinti.

Some 70 representatives of akimats (municipalities) in villages of Kazakhstan’s Tselinograd District’s met on 27 May 2016 in Akmol, Akmola region, to discuss the ongoing local self-governance reform and brainstormed on how to further develop the legal and institutional framework.

The event participants reviewed economic and financial aspects of local self-governance, administrative offences proceedings, public procurement, state property management as well as community involvement in the decision-making process at the local level.

The training seminar was supported by the OSCE Programme Office in Astana in co-operation with the National Economy Ministry. The event is part of the Programme Office’s long-standing efforts to promote good governance and democratization in Kazakhstan.

A record number of 1,150 local inspectors in Serbia have successfully completed a three-month OSCE-supported online course on implementing the new Law on Inspection Surveillance. Of this number, 280 inspectors from the capital and its municipalities were publically recognized on 7 July 2016 at the premises of the Assembly of the City of Belgrade.

Local-level inspectors work in the areas of construction, environment, traffic, communal issues.  This course, supported by the OSCE Mission to Serbia, was developed at the request of the Standing Conference of Towns and Municipalities (SCTM) and the Ministry of Public Administration and Local Self-Government.  

“The capacity building of staff working in local self-governments is particularly important as they are the closest to the citizens.” said Acting Head of the Democratization Department at the OSCE Mission, Olivera Zurovac-Kuzman. “The strong interest in the training course speaks about the relevance of the inspectorate and their roles in local communities. Proper surveillance is key in responding to the need for better governance at all levels of government,” she added.

The online course on the Law on Inspection Surveillance was developed after the successful implementation of online training courses for local self-government employees and councillors in 2014 and 2015, which proved to be an effective new approach for the professional development of local self-governments.

The OSCE Mission to Serbia will remain committed to supporting local self-governments across Serbia in the process of public administration reform.

The OSCE Mission to Moldova held the final in a series of three training sessions for 12 psychologists and professionals working with domestic violence victims. The session took place on 27 June 2016 in Rybnitsa, a town on the left bank of the Dniester/Nistru River.

The event aimed to equip participants with essential skills in family counselling and post-traumatic stress rehabilitation. Participants studied means to identify family violence, various coaching techniques to use when working with families, as well as methods for handling trauma and post-traumatic stress among domestic violence victims.

In the past week, similar training events have been held in Chisinau and Tiraspol with the total participation of 50 professionals from Bender, Causeni, Chisinau, Comrat, Drochia, Rybnitsa and Tiraspol.

Participants in the training sessions included psychologists, teachers, medical professionals, lawyers and social workers, all of whom encounter cases of domestic violence in their work through Moldova’s referral system.

The training events were held as part of the Mission’s project to strengthen the capacity of those who provide crisis services to women and families on both banks of the Dniester/Nistru River. The project was developed following a country-wide assessment conducted in 2014 and 2015. The assessment identified a number of challenges in this field in Moldova, most notably the difficulties in accessing domestic violence services – including shelters and crisis centres – for those living in rural areas, and a lack of state resources.

The OSCE Mission to Moldova organized a summer school on 15-17 July 2016 for 25 lawyers from both banks of the Dniester/Nistru River aimed at enhancing their ability to represent individuals who have been subject to discrimination. The summer school was held at Vadul-lui-Vodă, a town by the river.

Participants in the summer school studied various types and instances of discrimination, as well as the existing legal criteria for combating discriminatory actions and practices. In particular, the discussions focused on stereotypes and prejudices that can lead to the unequal treatment of people and looked at the latest trends in international case law addressing discrimination. Participants also had the opportunity to test their understanding of discrimination by taking part in mock scenarios involving gender, linguistic and ethnic bias and hate speech. 

“The problem of discrimination is very relevant in our current environment,” said Nicolae Radita of the Roma National Centre. “The summer school training has provided me with the tools to prevent and combat discrimination more effectively in my day-to-day work.”

Yan Feldman, Chairperson of Moldova’s Equality Council also participated in the summer school and updated participants on recent issues arising out of the Council’s work.

This event is part of a year-long OSCE project that aims to facilitate the exchange of experiences among lawyers from both banks of the Dniester/Nistru River.

A one-week advanced training course, organised by the OSCE Mission to Skopje in co-operation with the German Federal Police and the Police Training Centre in Idrizovo, has started today for ten Border police officers on how to detect forged travel documents and certificates.

The training course aims to increase the participants’ operational awareness on security features of regional passports and Schengen visas as well as to enhance their skills regarding the use of modern forensic equipment.

Upon completion of this training course, participants will be ready to deliver the training modules to their colleagues working in the field of documents security.

The training course is part of the Mission’s support to national institutions in the fight against trans-national threats and organized crime with a special focus on irregular migration and human trafficking.

ASTANA, 22 July 2016 – An OSCE-supported two-day training seminar for some 30 defence lawyers from the northern part of Kazakhstan began today in Astana, with the aim of enhancing their understanding, common interpretation and implementation of the new criminal procedure legislation.

The event is organized by the OSCE Programme Office in Astana in co-operation with the National Bar Association and the Almaty Bar Association for lawyers from the Akmola region, Pavlodar, Kostanay, Karaganda and Petropavlovsk.

Presentations will focus on new approaches and methods of legal protection, the legal institute of investigative judges in criminal proceedings, international guarantees for lawyers’ legal security, collection of evidence, and the questioning of witnesses. The interaction of lawyers with citizens, officials conducting criminal proceedings, the media and social networks will also be discussed.

“It is of utmost importance to ensure adequate conditions for the training of judges, prosecutors and lawyers as the equal actors of the lawsuit,” said Ambassador György Szabó, Head of the OSCE Programme Office in Astana. “The Bar, as an independent institution, is responsible for ensuring the professional development of defence lawyers. As demonstrated by the current training, the OSCE stands ready to support efforts in this direction”

Kadirzhan Baimukhanova, Deputy Head of the Republican Bar Association, said: "In the current conditions of rapidly developing legislation, such training seminars on the legislative novelties are crucial in ensuring the high professionalism of defence lawyers."

Other topics covered by the training course are new information technologies, e-government, relevant ethical and professional requirements as well as national and international standards and best practices.

The seminar is the first in a series of four planned for this autumn. Future events will take place in Almaty, Aktobe and Ust-Kamenogorsk. The series is part of the Programme Office’s long-standing efforts to strengthen the rule of law and support judicial reform in the host country.

The OSCE Programme Office in Astana concluded a series of two-day training seminars for some 100 members of the National Preventive Mechanism (NPM) against Torture on 2 August 2016 in Aktobe, Western Kazakhstan.

From May to August 2016, participants were trained in Pavlodar, Almaty, Astana and Aktobe on practical aspects of the NPM’s implementation.

The training seminars aimed at increasing the transparency and effectiveness of the Mechanism in monitoring, reporting and conducting preventive visits at detention facilities. National experts discussed with the NPM members the working procedures and methodology, challenges in fulfilling human rights obligations and ethical aspects in line with national and international anti-torture standards. Special emphasis was placed on the necessary co-operation between NPM and the law-enforcement sector.

The set of seminars was organized in partnership with the Ombudsman’s Office of Kazakhstan and the Regional Office of the UN High Commissioner for Human Rights and is part of the Office’s long-standing commitment to reinforce the NPM and promote the Optional Protocol to the UN Convention against Torture.

ASTANA, 20 June 2016 – An OSCE-supported training seminar for some 30 prosecutors and defence lawyers from different regions of Kazakhstan on plea bargaining and the role of procedural prosecutors in criminal procedure began today in Astana.

During the three-day seminar the participants will learn about issues related to the interpretation and application of the Criminal Procedure Code’s relevant provisions by legal professionals. International experts from the United States and Ukraine will familiarize participants with best practices in using plea bargaining in criminal proceedings and the role of prosecutors in preliminary investigation. Intensive discussions and mock exercises are planned to enhance comprehension and practical skills.

The recent introduction of the concepts of plea bargaining and procedural prosecutors into the new Code aims to simplify criminal procedure and contribute to the development of a more effective and cost-efficient criminal justice system in Kazakhstan.  These concepts have been in place since the Code entered into force in January 2015.

“It is important to ensure sufficient balance between simplified criminal procedure, cost-efficiency and the procedural rights of participants,” said Colin McCullough, Political Officer at the OSCE Programme Office in Astana. “This is predicated upon a high level of professionalism of the investigative bodies, adequate legal literacy of the general population and the absence of corruption.”

Nail Akhmetzakirov, the Vice-Rector of the Law Enforcement Academy under the Prosecutor General’s Office, said: “The purpose of a plea agreement is the simplification of criminal proceedings, with omitting a number of investigative actions and the entire trial process. This requires a high professional level of the defender and the prosecutor.”

The event was jointly organized by the OSCE Programme Office in Astana and the Law Enforcement Academy, as part of the Programme Office’s long-term activities to support criminal justice sector reform in Kazakhstan.

ASTANA, 4 July 2016 – A two-day OSCE-supported training seminar on the practical aspects of implementing the National Preventive Mechanism (NPM) for preventing torture began today in Astana, Kazakhstan.

Some 20 NPM members participated in the third in a series of four events aimed at building the capacities of the NPM in the context of monitoring, reporting and preventive visits to places of detention.

“You represent a reliable ‘pulse’ of the interaction between citizens and law-enforcement authorities and your reaching out to various places of detention provides us with some ‘measurement’ in that sense,” said Ambassador Gyorgy Szabo, Head of the Programme Office in Astana. “Such training events are productive for developing a common methodology and approach and for increasing the potential to prevent abuses of power and cruel and degrading treatment.”

The training addressed working procedures and methodology, key challenges in fulfilling human rights monitoring obligations at detention facilities and ethical matters. Both national and international anti-torture standards were taken into consideration.

Particular attention was paid to the co-operation between NPM and law-enforcement departments, prosecutors, prison administrations, healthcare institutions and media representatives.

The seminar was organized by the OSCE Programme Office in Astana in partnership with the Commissioner for Human Rights (Ombudsman) of Kazakhstan and the Regional Office of the UN High Commissioner for Human Rights.

The series of training events is part of the Office’s long-term assistance to the NPM and work in promoting the Optional Protocol to the UN Convention against Torture in the host country.

BISHKEK, 28 July 2016 – A two-day training conducted by the OSCE Centre in Bishkek for 14 defence lawyers and 12 officers from the Prosecutor’s office on the right to liberty and freedom from arbitrary arrest or detention, ended today in the Kyrgyz capital.

The workshop focused on the international framework for measures of restraint, as well as the internationally recognized constitutional right to institute proceedings in cases of violations.

The detention of minors, persons with disabilities, women with children, or defendants in need of continued medical treatment and hospitalization were among the topics discussed, and participants learned more about their specific concerns to ensure that the restraint measures taken comply with human rights standards.

“The right to liberty is a basic fundamental right, protected by international human rights law and enshrined in the Kyrgyz Constitution,” said Anete Erdmane, acting Senior Human Dimension Officer at the OSCE Centre. “To ensure that restrictions on liberty are applied in compliance with the law and that other human rights are not violated as a result of the deprivation of liberty, it is important that prosecutors and lawyers are aware of the relevant standards and obligations. In line with its mandate, the OSCE Centre works to improve the administration of justice and strengthen the rule of law in Kyrgyzstan.”

The course was delivered by Ulugbek Azimov, a well-known national expert in the field, while  Sergey Poduzov, an international human rights law expert from Russia, also led a training session.

The training course is part of the OSCE Centre’s project on promoting a comprehensive approach to the rule of law, administration of justice, prevention of torture, and capacity building.

Some 20 newly-recruited personnel of the Atlantis rehabilitation centre took part in a two-week capacity building training course, conducted in the premises of the penal colony in the village of Novopokrovka, which concluded on 10 June. The event was organized by the Kyrgyz State Service for Execution of Punishment (SSEP) and the OSCE Centre in Bishkek.

OSCE-supported international trainers and specialists on therapeutic work with drug- and alcohol-addicted prisoners presented the Minnesotan treatment model, which is recognized as a global best practice among psychotherapeutic programmes for treatment of people with such problems, and organized practical sessions on the development of therapeutic skills.

“Specific professional training is critical to enable the staff of the penitentiary service to carry out their work in full safety,” said Daniele Rumolo, Senior Human Dimension Officer at the OSCE Centre in Bishkek. “Providing them with the necessary skills to effectively deal with specific categories of prisoners is also crucial to prevent criminal activities inside the prisons and enhance the respect of the rule of law.”

The course is part of an OSCE project on supporting the implementation of the National Strategy on the Development of Penitentiary System “Umut-2”. The project addresses the human rights situation and safety in penitentiary establishments through capacity building activities for prison staff.

National Points of Contact from 16 OSCE participating States on implementing UN Security Council Resolution 1540 (2004) on the non-proliferation of weapons of mass destruction and their components were familiarized with countries’ commitments stemming from this Resolution, at a training session co-organized by the OSCE from 28 June to 1 July 2016 in Kaliningrad, in the Russian Federation. A National Point of Contact from Chile – an observer State – also took part.

The session was hosted by the Government of the Russian Federation, and conducted in partnership with the UN Regional Centre for Peace and Disarmament in Asia and the Pacific (UNRCPD) and the UN Office for Disarmament Affairs (UNODA).

Welcoming the participants on behalf of Russia’s Foreign Minister Sergey Lavrov, an official of the Russian Ministry of Foreign Affairs stressed that “the efficiency of the UN Security Council Resolution 1540 can be guaranteed only through its full implementation by all countries”, and by encouraging close and constructive co-operation between all parties.

Robin Mossinkoff, the Head of the Forum for Security Cooperation Support Unit, said: “The OSCE has been supporting the network of OSCE National Points of Contact on implementing Resolution 1540 with annual meetings since 2014, and appreciates the Russian Federation’s initiative to hold this year’s annual meeting in format of a training session.”

Participants were provided with an overview of the international non-proliferation regimes and instruments. They discussed the national legislative and regulatory framework, enforcement of legislation with regard to export and border controls, transshipment, illicit trafficking and brokering control as well as the role of the Points of Contact in supporting the development and implementation of these measures.

Anton Martyniuk, the UNRCPD Coordinator of the project, noted that establishing Points of Contact and fostering their operation is a solid contribution to implementing Resolution 1540 at the national, regional and international levels.

Participants also visited a border crossing point to learn more about the work of a commodity identification centre.

The training course was organized as part of the joint UNODA-OSCE project on facilitating the regional implementation of UN Security Council Resolution 1540. UNRCPD and the OSCE organized the course in co-operation with the 1540 Committee and its Group of Experts.

KYIV, 15 July 2016 – The OSCE Project Co-ordinator in Ukraine today opened a new sphere of project assistance to Ukraine – improving democratic control of defence and security sectors – with a presentation of international experience and best practices at a conference in Kyiv.

The event, co-organized with the Parliament and the Ministry of Defence, brought together more than 120 parliamentarians, military and civilian representatives of various ministries, experts, and civil society activists to learn about the basic principles in this area, as well as practical examples from other countries.

During the conference, the OSCE Code of Conduct on Politico-Military Aspects of Security and the OSCE Security Sector Governance and Reform Guidelines were presented. Ukrainian translations of these documents can be found at www.osce.org/fsc/41355  and www.osce.org/uk/secretariat/253156, respectively.

The participants discussed in detail the national models of parliamentary and civic control over the defence sectors of Austria, Bulgaria, Denmark, Germany, and Norway.

“The ability of Parliament, and of society at large, to exercise control over its security services is a true litmus test for democracy and rule of law,” said Jeffrey Erlich, Senior Project Officer at the OSCE Project Co-ordinator’s Office. “Such oversight contributes to a much more effective security sector by rooting out corruption, and by strengthening the bond between society and the armed forces.”

Igor Dolgov, Deputy Minister of Defence, said: “For me there is no question of whether it is possible to simultaneously deal with current crisis and implement reforms in defense sectors, including strengthening mechanisms of democratic control over armed forces. It is needed and it is already happening.”

Until the end of the year, the OSCE Project Co-ordinator will provide expertise in developing a concept paper and implementation plan for democratic oversight; assist in promoting dialogue between the military, parliamentarians, experts and civic activists; and contribute to raising awareness among the public by publishing relevant online resources.  Further assistance efforts will continue after 2016.

In partnering with the Geneva Centre for the Democratic Control of the Armed Forces (DCAF), the project will also draw on their expertise.

Two two-day training courses on combating domestic violence through strengthening the co-operation and capacities of different state and non-state players were organized jointly by the OSCE Office in Yerevan, the Armenian Police and the Social Justice non-governmental organization on 17-18 May and 19-20 May 2016 in Tsakhkadzor, Armenia.

The participants consisted of 80 representatives from the Yerevan and Gegharkunik province police juvenile and community services, social services, municipal child protection units, guardianship and trusteeship councils and non-governmental organizations. They were divided into two groups and trained separately.

“Combating domestic violence has always been high on the OSCE agenda, as it is primarily a violation of a human right and often a precursor of more serious crimes. The police and local governments both play key roles in combating domestic violence, however, only through a concerted multi-agency approach can it be done most effectively,” said Bernhard Frankl, Politico-Military Programme Officer at the OSCE Office in Yerevan.

Participants were introduced to definitions of domestic violence, its characteristics and types, the prevailing myths, phases and cycles. Active debates and group exercises were held to discuss potential victims along with the psychological and behavioral aspects and techniques of interviewing victims. The effects of domestic violence on different aspects of society, multi-sectoral responses and legal regulations were also highlighted.

The training course is part of an ongoing project by the OSCE Office to strengthen police capacities in preventing domestic violence.

From 16 to 20 May 2016 in Budva, Montenegro, the OSCE Mission organized a training course for 45 legal professionals from northern Kosovo on international human rights standards during trial proceedings.

Participants, who are candidates to join the reintegrated justice system in northern Kosovo, were briefed and engaged in in-depth discussions on the human rights requirements, international standards and best practices in ensuring a fair trial.

The training consisted of presentations and lectures on international human rights standards, search tools for the European Court of Human Rights database, rights of access to justice and equality in the administration of justice, right to a public hearing, right to be presumed innocent and privilege against self-incrimination, protection of victims and witnesses, the equality of arms principle and the right to a hearing before a competent, independent and impartial tribunal established by law.

“The justice system in the northern Kosovo has been dysfunctional for years now. Such a situation negatively impacted both the rule of law, proper delivery of justice and the observance of fundamental human rights, including the right of access to justice and the right to trial within a reasonable time,” said Jean-Claude Schlumberger, Head of the OSCE Mission in Kosovo. “The aim of this training was two-fold: enhance participants’ awareness of the importance of promoting and protecting human rights and fundamental freedoms in the courtroom but also encourage them to use pertinent international mechanisms in their daily work.”

Nikola Kabašić, a leading representative of the judicial community in northern Kosovo, said: “Continuous and systematic education of professionals whose main responsibility is to promote, implement and protect human rights is an obligation of all local and international institutions and organizations. That is why this training is important because the level of democracy of one society is measured by the extent of respect of human rights and fundamental freedoms.”

Kosovo Deputy Minister of Justice, Nusret Hoxha, who was a guest at the training course noted the Ministry’s support as well as the need for local judges and prosecutors to be given additional opportunities to become familiar with best international practices in the justice sector.  

The course was held following a needs assessment conducted by the OSCE Mission, which highlighted the need to engage in educational programs as a priority in building the capacities of judicial professionals in the north.

The OSCE Mission in Kosovo is mandated with human rights and communities rights protection and promotion, democratization and public safety sector development. The Mission supports the justice system in Kosovo and runs programmatic activities aiming to improve its performance in line with human rights and fair trial standards.

VIENNA, 20 July 2016 – OSCE media freedom representative Dunja Mijatović today condemned the murder of journalist Pavel Sheremet in Kyiv, Ukraine.

This morning, Sheremet, a journalist with Radio Vesti and the Ukrainskaya Pravda online media outlet, was killed in a car explosion.

“This killing and its circumstances must be swiftly and thoroughly investigated, and the perpetrators brought to justice,” Mijatović said, noting President Petro Poroshenko’s strong condemnation of the act and immediate action to investigate. “We have lost a prominent and dedicated journalist and my sincere condolences go out to Sheremet’s family, friends and colleagues.”

Sheremet, originally of Belarus and recipient of the 2002 OSCE Parliamentary Assembly’s Prize for Journalism and Democracy (www.osce.org/pa/54293), worked as a journalist in Ukraine, Belarus and Russia during his career.

“This morning’s gruesome incident reminds us all that the safety situation for journalists in Ukraine must be addressed effectively and timely,” Mijatović said.  

The Representative recalled the murder of the prominent Ukrainian journalist Georgyi Gongadze in 2001, the founder of Ukrainskaya Pravda, and reiterated her call on the authorities to fully investigate that crime.

DUSHANBE, 26 July 2016 – The Parents Against Terrorism training series, organized by the OSCE Office in Tajikistan, started yesterday in Kulyab in the country’s Khatlon region with the aim of enhancing the knowledge and understanding of the local population about Violent Extremism and Radicalization that lead to Terrorism (VERLT) in order to build the community’s resilience to this phenomenon.

The trainees came from different layers of society, representing local government bodies, law enforcement agencies, educational institutions, as well as the local population. The course was led by local trainers from civil society, the Ministry of Labour, Migration, and Employment, and the Committee on Religious Affairs.

“The government of Tajikistan is seriously concerned about the growing threat of global terrorism and violent extremism,” said Khurshed Kenjaev, a representative of the Security Council under the President, in his opening remarks. “It is taking solid preventative measures to tackle this phenomenon, since it cannot be the sole responsibility of law enforcement agencies to deal with the threat.” 

Ivan Ene, OSCE Field Officer in Kurgan Tyube, said: “Countering violent extremism and radicalization that may lead to terrorism requires a holistic approach. The intervention of law enforcement agencies to dissolute the problem of violent extremism and terrorism is effective to only a certain extent, therefore, if we want to apply more effective measures to fight this phenomenon, we need to engage and use the capacity of local communities and parents.”

The course focuses on the role of mothers as “positive agents of change” within Tajik culture. They are informed about the early signs of violent extremism and radicalization that may lead to terrorism. The training participants were also briefed on the violent extremist groups that are believed to be active in Tajikistan.

In the coming days, similar training sessions will be held in Kurgan-Tyube and Shaartuz. A similar activity was organized across Tajikistan in 2015 and recently held in Sughd region.
