An anonymous reader quotes a report from The Register: Royal assent was granted to two right to repair bills last week that amend Canada's Copyright Act to allow the circumvention of technological protection measures (TPMs) if this is done for the purposes of "maintaining or repairing a product, including any related diagnosing," and "to make the program or a device in which it is embedded interoperable with any other computer program, device or component." The pair of bills allow device owners to not only repair their own stuff regardless of how a program is written to prevent such non-OEM measures, but said owners can also make their devices work with third-party components without needing to go through the manufacturer to do so. Bills C-244 (repairability) and C-294 (interoperability) go a long way toward advancing the right to repair in Canada and, as iFixit pointed out, are the first federal laws anywhere that address how TPMs restrict the right to repair -- but they're hardly final. TPMs can take a number of forms, from simple administrative passwords to encryption, registration keys, or even the need for a physical object like a USB dongle to unlock access to copyrighted components of a device's software. Most commercially manufactured devices with proprietary embedded software include some form of TPM, and neither C-244 nor C-294 place any restrictions on the use of such measures by manufacturers. As iFixit points out, neither Copyright Act amendments do anything to expand access to the tools needed to circumvent TPMs. That puts Canadians in a similar position to US repair advocates, who in 2021 saw the US Copyright Office loosen DMCA restrictions to allow limited repairs of some devices despite TPMs, but without allowing access to the tools needed to do so. [...] Canadian Repair Coalition co-founder Anthony Rosborough said last week that the new repairability and interoperability rules represent considerable progress, but like similar changes in the US, don't actually amount to much without the right to distribute tools. "New regulations are needed that require manufacturers and vendors to ensure that products and devices are designed with accessibility of repairs in mind," Rosborough wrote in an op-ed last week. "Businesses need to be able to carry out their work without the fear of infringing various intellectual property rights."

Immigrant rights lawyers are preparing to fight back against Donald Trump’s plans to carry out the largest mass deportation in U.S. history once he takes office again in January. The president-elect has already named some leading anti-immigration figures for his incoming administration who will lead the plan, including former ICE head Tom Homan and his longtime aide Stephen Miller. Trump’s picks were central in family separations, the Muslim ban, attacks on Deferred Action for Childhood Arrivals, or DACA, and other anti-immigrant policies during the first Trump administration. Trump is also reportedly planning to greatly expand immigrant detention in private for-profit prisons, and during the campaign he spoke of invoking the Alien Enemies Act of 1798 to speed up deportations. “We have been preparing nearly a year for this,” says attorney Lee Gelernt, deputy director of the ACLU Immigrants’ Rights Project, who argued some of the most high-profile immigration cases during the first Trump administration. He stresses that while groups like the ACLU will challenge the Trump administration in the courts, “it needs to be a national effort” to prevent abuses. “We are not opposed to basic immigration reform, but this cannot be a situation where we’re just going after immigrants left and right.”

More often than not in traditional management consulting engagements involving operations, there is usually room for setting up or revising goals, metrics & reporting, and service level agreements. Depending on the phase of development of a company (often couched as Stage 0 [Ad-Hoc], Stage 1 [Functional], Stage 2 [Intrabusiness Cross-Functional], etc. maturity levels by a consulting firm), the next higher-level of metrics and reporting may apply and be a goal for the client organization to strive for.

Where management has to be somewhat careful about applying metrics, however, is how people and company culture play a role in getting everything to work together right.

To put a finer point on things, one can put in place a perfectly appropriate set of metrics and reporting systems for a company yet miss the boat completely on a management-level as to how the results should be applied because of the culture.

As an example in sales operations, I have frequently seen a competitive environment laid out. People's individual performance levels are exposed, and poor performing people are weeded out. This environment can work out in some cases. On the other hand, in a collaborative engineering or product development environment, cooperation may be encouraged.

On a related topic, a friend of my wife and I, Dr. Uri Gneezy at the University of Chicago, has some great research on the relationship between competition and gender. From the research summary:

Gneezy suggests that CEOs creating incentives in their firms should be aware that making the internal environment more competitive might create a bias that helps men, while putting women at a relative disadvantage.

My take on applying this type of research would be to recognize and raise one's sense of awareness to the environment one is implementing metrics in. Although metrics may be encouraged to be tracked to an individual-level doesn't automatically equate to that the environment has to be a competitive one. Choosing a collaborative versus dictatorial management style that is compatible with the desired company culture is a separate choice from metric implementation.

Known as Erasmus of Rotterdam, was a Dutch Renaissance humanist, Catholic priest, social critic, teacher, early proponent of religious toleration, and theologian. Erasmus was a classical scholar who wrote in a pure Latin style and enjoyed the sobriquet "Prince of the Humanists." He has been called "the crowning glory of the Christian humanists." Using humanist techniques for working on texts, he prepared important new Latin and Greek editions of the New Testament. These raised questions that would be influential in the Protestant Reformation and Catholic Counter-Reformation. He also wrote The Praise of Folly, Handbook of a Christian Knight, On Civility in Children, Copia: Foundations of the Abundant Style, Julius Exclusus, and many other works. Erasmus lived through the Reformation period, but while he was critical of the Church, he could not bring himself to join the cause of the Reformers. In relation to clerical abuses in the Church, Erasmus remained committed to reforming the Church from within. He also held to Catholic doctrines such as that of free will, which some Reformers rejected in favor of the doctrine of predestination. His middle road approach disappointed and even angered scholars in both camps. He died in Basel in 1536 and was buried in the formerly Catholic cathedral there, which had been converted to a Reformed church in 1529. Erasmus was his baptismal name, given after St. Erasmus of Formiae. Desiderius was a self-adopted additional name, which he used from 1496. The Roterodamus in his scholarly name is the Latinized adjectival form for the city of Rotterdam. -- Biography: Desiderius Erasmus was born in Holland on October 28th. The exact year of his birth is debated but some evidence confirming 1466 can be found in Erasmus's own words. Of twenty-three statements Erasmus made about his age, all but one of the first fifteen indicate 1466. He was christened "Erasmus" after the saint of that name. Although associated closely with Rotterdam, he lived there for only four years, never to return. Information on his family and early life comes mainly from vague references in his writings. His parents almost certainly were not legally married. His father, named Roger Gerard, later became a priest and afterwards curate in Gouda. Little is known of his mother other than that her name was Margaret and she was the daughter of a physician. Although he was born out of wedlock, Erasmus was cared for by his parents until their early deaths from the plague in 1483.
