U.S. Customs and Border Protection Officer Paulo Morales, 47, was arrested today after having been indicted yesterday by a federal grand jury in the Southern District of Florida on charges of deprivation of civil rights and abusive sexual contact.

The Justice Department announced today the filing of a complaint in U.S. District Court for the Middle District of North Carolina against Forsyth County, N.C., and the county sheriff, William T. The Justice Department announced today that it has reached a settlement with United Airlines Inc., resolving Ten Eyck LaTourrette’s allegation that the airline violated the Uniformed Services Employment and Reemployment Rights Act (USERRA) by under compensating his retirement plan during his military service. LaTourrette is currently a major serving in the Colorado Air National Guard and a first officer for United Airlines.

The Justice Department announced that it has reached an agreement with Grayson County, Va., that will allow for the county and its four political subdivisions, the Grayson County School District and the towns of Independence, Fries and Troutdale, Va., to bail out from their status as “covered jurisdictions” under the special provisions of the Voting Rights Act, and thereby exempt these jurisdictions from the preclearance requirements of Section 5 of the Voting Rights Act. The Justice Department announced today that it has filed a lawsuit against the state of Georgia and its chief election official seeking relief to help ensure that military service members, their family members and U.S. citizens living overseas have the opportunity to participate fully in Georgia’s Aug. 21, 2012, federal primary runoff election and all future federal runoff elections.

A federal grand jury in Albuquerque has issued a seven-count indictment charging three corrections officers at the Bernalillo County Metropolitan Detention Center (MDC) with various crimes related to the assault of an inmate housed at MDC on Dec. 21, 2011, and subsequent attempts to cover up and impede the investigation of the assault.

The Justice Department announced today that it has reached a settlement in its lawsuit against the Pennsylvania Department of Corrections (PDOC).

Sylvester Bruce, 44, a former corrections officer with Navajo Nation’s Shiprock Detention Center (SDC) in Shiprock, N.M., pleaded guilty today in federal court on charges related to the sexual abuse of an inmate during the summer and fall of 2010. Specifically, Bruce pleaded guilty to one count of violating the civil rights of the victim when he touched her breasts against her will. Bruce also pleaded guilty to making material false statements to the FBI when he denied taking pictures of inmates inside the cells of the SDC.

The settlement in this case represents the largest recovery the Civil Rights Division has obtained on behalf of a returning service member since 2004, when it assumed jurisdiction for the enforcement of the Uniformed Services Employment and Reemployment Rights Act.

Former Milwaukee Police Officer Ladmarald Cates was sentenced today by U.S. District Judge J.P. Stadtmueller to 24 years in prison.

The Justice Department announced today that it has filed a lawsuit against the state of Michigan and its chief elections officials to help ensure that military service members, their family members and U.S. citizens living overseas have the opportunity to participate fully in Michigan’s Aug. 7, 2012, federal primary election and Sept. 5, 2012, federal special primary election.

A federal jury in Valdosta, Ga., convicted defendant Walter Young, 54, the former chief of the Omega Police Department in Omega, Ga., for physically abusing a man in his custody, the Justice Department announced.

The Justice Department released a letter of findings today determining that the Lauderdale County Youth Court, the Meridian Police Department (MPD), and the Mississippi Division of Youth Services (DYS) are violating the constitutional rights of juveniles in Meridian, Miss. The department’s investigation found reasonable cause to believe that these agencies have violated the constitutional due process rights of children in the city of Meridian and the county of Lauderdale under the Fourth, Fifth, and Fourteenth Amendments of the U.S. Constitution.

The U.S. District Court for the Eastern District of Virginia has approved a comprehensive settlement agreement between the United States and the Commonwealth of Virginia, resolving the department’s findings that Virginia’s system for serving people with intellectual and developmental disabilities violated the Americans with Disabilities Act (ADA). The department had found that Virginia was violating the ADA requirement, as interpreted by the Supreme Court’s decision in Olmstead v. L.C., to provide people with intellectual and developmental disabilities the opportunity to live and receive services in the community.

The Justice Department announced that it has reached an agreement with U.S. Virgin Islands officials to help ensure that military service members, their family members and U.S. citizens living overseas have the opportunity to participate fully in the territory’s Sept. 8, 2012 primary election and the Nov. 6, 2012, general election.

The Justice Department announced today that it seeks to intervene in a class action lawsuit against the Law School Admission Council (LSAC) in federal court in San Francisco to remedy violations of the Americans with Disabilities Act (ADA). The lawsuit, The Department of Fair Employment and Housing v. LSAC, Inc., et al., charges LSAC with widespread and systemic deficiencies in the way it processes requests by people with disabilities for testing accommodations for the Law School Admission Test (LSAT). As a result, the lawsuit alleges, LSAC fails to provide accommodations where needed to best ensure that those test takers can demonstrate their aptitude and achievement level rather than their disability.

Following a comprehensive investigation, the Justice Department today released its letter of findings determining that the Topeka Correctional Facility (TCF), an all-female facility in Topeka, Kan., under the jurisdiction of the Kansas Department of Corrections (KDOC), fails to protect women prisoners from harm due to sexual abuse and misconduct from correctional staff and other prisoners in violation of their constitutional rights. The Justice Department delivered a letter detailing the findings to Governor Samuel D. Brownback and Secretary of the KDOC Ray Roberts.

Police of Puerto Rico Lieutenant Erick Rivera Nazario and Officer Jimmy Rodriguez Vega were indicted on civil rights charges alleging that they used excessive force on two men, the Justice Department announced today. Nazario and Vega allegedly violated the constitutional rights of Jose Irizarry Perez and his father Jose Irizarry Muniz while the two were celebrating the local election results at the Las Colinas housing development in Yauco, Puerto Rico, on Nov. 5, 2008. Rivera was also indicted for making false declarations before the federal grand jury during its investigation into the civil rights violations.

The Justice Department and U.S. Attorney Thomas G. Walker announced today the filing of a complaint in U.S. District Court for the Eastern District of North Carolina against the Warren County, N.C., Board of Education for violating the employment rights of Army Reserve Sergeant Dwayne Coffer under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

The Justice Department has filed a lawsuit against the city of San Jacinto, Calif., alleging violations of the Fair Housing Act and the Americans with Disabilities Act based on its treatment of group homes for persons with disabilities. This lawsuit is part of the Justice Department’s continuing effort to enforce civil rights laws that require states and municipalities to end discrimination against, and unnecessary segregation of, persons with disabilities.

A federal judge sentenced Spokane, Wash., Police Officer Karl F. Thompson Jr. to 51 months in prison followed by three years supervised release for civil rights and obstruction violations stemming from his March 18, 2006, beating of an unarmed citizen and an extensive cover-up that followed, the Justice Department announced today. Following a Taser deployment and a rapid series of baton blows to the head, neck and body, the victim, the late Otto Zehm, 36, was hogtied, stopped breathing and was transported to the hospital, where he died two days later. The defendant claimed the beating was justified because he felt threatened by a plastic bottle of soda Zehm was holding.

Bryan Benson, a former Anderson, Calif., police officer, was arrested today on charges of deprivation of civil rights for sexually assaulting a woman while transporting her to jail and of trying to conceal his criminal conduct, announced the Justice Department.

The Justice Department today filed a civil rights lawsuit against Terry S. Johnson, in his official capacity as head of the Alamance County Sheriff’s Office (ACSO) in North Carolina.

The Justice Department announced today that it has reached an agreement with the State of New Hampshire that will allow for all 10 of the towns in that state that are covered jurisdictions under the special provisions of the Voting Rights Act to bail out from coverage by these provisions.

The Justice Department announced that it has reached an agreement with the Browns Valley Irrigation District, a special district in California, that, if approved by the court, will allow for the district to bail out from its status as a “covered jurisdiction” under the special provisions of the Voting Rights Act, and thereby exempt the district from the preclearance requirements of Section 5 of the Voting Rights Act. The district covers part of Yuba County, which is a jurisdiction subject to Section 5. The agreement is in the form of a consent decree filed today in the U.S. District Court for the District of Columbia.

The Justice Department announced today that Lindrith Tsoodle, 57, a former officer with the Three Affiliated Tribes Police Department, was apprehended and arrested on the Rocky Boy Reservation in Montana yesterday in relation to his indictment on civil rights and obstruction violations.

The United States Justice Department and U.S. Attorney Wendy J. Olson announced today the filing of a complaint alleging that the Jerome County Sheriff’s Office willfully violated the Uniformed Services Employment and Reemployment Rights Act of 1994 by failing to reemploy and terminating Idaho Army National Guard Member Mervin Jones while he was recuperating from a knee injury that he sustained while performing military service.

Craig Billings, 39, a former deputy sheriff with the Murray County Sheriff’s Office in Sulphur, Okla., pleaded guilty today in federal court to a one-count information charging him with Deprivation of Rights for using unreasonable force and violating the civil rights of an individual who was being booked into the Murray County Jail.

"Our Declaration of Independence declared in 1776 that “all men are created equal,” but it took 100 years and a civil war that took hundreds of thousands of lives to end slavery; another hundred years to create legal equality for African Americans; and we struggle to this day to make equality a reality. I see this every day in my work as the chief civil rights law enforcement official for the United States," said Assistant Attorney General Perez.

Today, Matthew E. Davidson, a former corrections officer of the Alabama Department of Corrections, pleaded guilty in U.S. District Court in Montgomery, Ala., to two counts of violating the civil rights of a former inmate at Ventress Correctional Facility in Clayton, Ala., and to one count of conspiring with other corrections officers to obstruct justice by covering up the incident.
