A former residential sales manager and a former contractor at a Florida property management company pleaded guilty today to wire fraud in connection with housing repair contracts for the U.S. Department of Veterans Affairs.

Attila Nemeth, 26, a Hungarian citizen, was sentenced today by U.S. District Judge J. Frederick Motz to 30 months in prison for transmitting a malicious code to Marriott International Corporation computers and threatening to reveal confidential information obtained from the company’s computers if Marriott did not offer him a job.

Chikenna D. Jones, 36, pleaded guilty before U.S. District Judge James J. Brady of the Middle District of Louisiana to one count of conspiracy to commit health care fraud and one count of conspiracy to defraud the United States and to pay and receive health care kickbacks.

Smith & Nephew Inc. has entered into a deferred prosecution agreement with the Department of Justice to resolve improper payments by the company and certain affiliates in violation of the Foreign Corrupt Practices Act (FCPA).

"In many ways, there is no better proof that comprehensive immigration reform is long overdue than these state statutes. People are understandably frustrated with our broken immigration system, and some states have turned to “self-help” measures like enacting these local statutes," said Assistant Attorney General West.

A former owner of two Illinois-based technology companies was sentenced today to serve 30 months in prison for her participation in a conspiracy to defraud the federal E-Rate program.

The Justice Department, at the request of the Food and Drug Administration’s Office of Criminal Investigations (FDA-OCI), has charged Gary D. Osborn and his corporation, ApothéCure Inc., with two misdemeanor criminal violations of the Federal Food, Drug and Cosmetic Act (FDCA) in connection with their interstate shipment of two lots of misbranded colchicine injectable solution that led to the deaths of three people in the Pacific Northwest.

Massoud Habibion, 49, aka “Matt Habibion” and “Matt Habi,” a U.S. citizen and co-owner of a Costa Mesa, Calif., company, Online Micro LLC, pleaded guilty today in the District of Columbia to conspiracy to illegally export computers from the United States to Iran through the United Arab Emirates.

Jeng “Jay” Shih, 54, a U.S. citizen, was sentenced today in the District of Columbia to 18 months in prison, while his Queens, N.Y., company, Sunrise Technologies and Trading Corporation, was sentenced to 24 months corporate probation for conspiracy to illegally export U.S.-origin computers from the United States to Iran through the United Arab Emirates (UAE).

Italian-based shipping company Giuseppe Bottiglieri Shipping Company S.P.A., owner and operator of the Motor Vessel Bottiglieri Challenger, and Vito La Forgia, the vessel’s chief engineer, have been charged in a four-count indictment with the illegal dumping of waste oil and oil-contaminated waste water in violation of the Act to Prevent Pollution from Ships, conspiracy and two counts of obstruction of justice.

"Then – and now – he stands as a model of what it means to be a true advocate for, and defender of, justice," said Attorney General Holder.

Akinsunbo Akinbile, 44, of Richmond, Texas, was sentenced by U.S. District Judge Keith P. Ellison in Houston.

The United States has entered a consent decree against ATF Fitness Products Inc., Manufacturing ATF Dedicated Excellence Inc. (MADE), and the owner and president of both companies, James G. Vercellotti, the Justice Department announced today.

The former director of corporate maintenance and renovations at Medical Facilities of America Inc. pleaded guilty today to accepting kickbacks and evading taxes.

The Justice Department and Puerto Rico-based Indrescom Security Technology Inc. have agreed to settle allegations that the company discriminated against a work-authorized individual during the Employment Eligibility Verification Form I-9 process by requiring him to present a lawful permanent resident card, despite the fact that the employee had already produced documents establishing his identity and authority to work in the United States, and not allowing him to work when he did not produce the card.

"Over a decade ago, as a lawyer in the California Attorney General’s office, I worked on a variety of consumer protection issues, from identity theft to the victimization of elder consumers. And over the last three years, President Obama, Attorney General Eric Holder and I have made protecting consumers a centerpiece of the Justice Department’s overall anti-fraud efforts," said Acting Associate Attorney General West.

Biomet Inc. has entered into a deferred prosecution agreement with the Department of Justice to resolve improper payments by the company and its subsidiaries in violation of the Foreign Corrupt Practices Act.

Ilios Shipping Company S.A. was sentenced today in federal court in New Orleans for violating the Act to Prevent Pollution from Ships (APPS) and obstruction of justice.

Ariel Rodriguez, 41, Reynaldo Navarro, 37, and Ysel Salado, 26, each pleaded guilty today before U.S. District Judge Marcia G. Cooke to one count of conspiracy to commit health care fraud, and Melissa Rodriguez, 24, pleaded guilty on March 28, 2012, before Judge Cooke to the same charge.

The Department of Justice and the U.S. Environmental Protection Agency (EPA) today announced an innovative environmental agreement with Ohio-based Marathon Petroleum Company that already has significantly reduced air pollution from all six of the company’s petroleum refineries.

A former executive of a New York-based tax liens company who supervised the purchasing of municipal tax liens at auctions in New Jersey pleaded guilty today for his role in a conspiracy to rig bids for the sale of tax liens auctioned by municipalities throughout the state.

American pharmaceutical company Merck, Sharp & Dohme was sentenced by U.S. District Court Judge Patti B. Saris in Boston to pay a criminal fine in the amount of $321,636,000 in connection with its guilty plea related to its promotion and marketing of the painkiller Vioxx (rofecoxib), the Justice Department announced today.

A financial investor who purchased municipal tax liens at auctions in New Jersey, as well as a company in which he was a partner, pleaded guilty today for their roles in a conspiracy to rig bids for the sale of tax liens auctioned by municipalities throughout the state.

"When it comes to violence, the challenges our children face are clear. We know that over 60 percent -- regardless of race – are exposed to some form of violence, crime, or abuse. Whether it's at home, in school, on the streets, or online, our children are witnessing and experiencing intolerable levels of violence. U.S. District Judge Ursula Ungaro in Miami sentenced Roberto Gonzalez to 120 months in prison, Olga Gonzalez to 87 months in prison and Fabian Gonzalez to 87 months in prison.

Anthony L. Dinunzio, 53, of East Boston, Mass., the alleged leader of the New England organized crime family of La Cosa Nostra (NELCN), was arrested today on racketeering and extortion charges.

Integrated Production Services Inc. (IPS), a Houston-based natural gas and oil drilling contractor, was sentenced today in federal court in Muskogee, Okla., to pay a criminal fine of $140,000 for violations of the Clean Water Act at its hydraulic fracturing operation in Atoka County, Okla., the Justice Department announced.

It’s an invitation for us to stand together and confront the enormity of sexual violence; to re-dedicate ourselves to bringing justice to victims and their families; to break the silence and to redouble our efforts to hold perpetrators of sexual assault accountable," said Acting Associate Attorney General West.

The president of a Costa Rican company that sold reinsurance bonds to life settlement companies was found guilty by a federal jury in Richmond, Va., today for carrying out a half-billion-dollar fraud scheme that affected more than 2,000 victims throughout the United States and abroad.

The Justice Department announced that it had reached a settlement of alleged violations of the Servicemembers Civil Relief Act (SCRA) providing damages and credit repair to 26 servicemembers whose cars were towed and sold while they were on active duty without obtaining court orders as SCRA requires.

"From Los Angeles, to Chicago, to Miami, these defendants allegedly submitted over $450 million in fraudulent claims to the Medicare program. This represents the largest Medicare fraud takedown in Department history, as measured by the amount of alleged fraudulent billings," said Assistant Attorney General Breuer.

"Know this: times of difficulty, of novel questions and new tests, are the most exciting, and consequential, times to be a lawyer. Since our nation's earliest days, the service and contributions of attorneys - and, very often, of young attorneys - have kept the great and unique American experiment in motion," said Attorney General Holder.
