The Department has filed a complaint in U.S. District Court in Arkansas against the City of Marion alleging it subjected Stacy D. Allen, an African-American and a former City part-time patrol officer, to discrimination on the basis of his race when he was not selected for either of two full-time patrol officer positions in the Marion Police Department.

Tony West, Assistant Attorney General (AAG) for the Justice Department’s Civil Division, today announced four new members of the Division’s leadership team.

The Justice Department today filed a lawsuit in U.S. District Court in Norfolk, Va., on behalf of U.S. Coast Guard Reserve member Paul Sutton against the city of Chesapeake alleging violations of the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

A Massachusetts man has been charged in U.S. District Court in Boston with crimes related to the illegal importation and illegal trafficking of sperm whale teeth. On May 13, 2009, a federal grand jury sitting in Boston, returned an indictment that was unsealed today against David L. Place of Nantucket, Mass.

Giancarlo Pertile was sentenced to prison for tax evasion yesterday afternoon. U.S. District Judge A. Howard Matz sentenced Pertile, the former owner of Art Marble Design Inc., in Moorpark, Calif., to 60 months in federal prison and ordered Pertile to pay a fine of $75,000. In January 2009, Pertile was convicted by a Los Angeles federal jury of five counts of tax evasion for the years 1998 through 2002.

Frederick Allen and Kimberlee Allen, both of Harwich, Mass., were arraigned today before Magistrate Judge Marianne B. Bowler in Boston on charges of conspiracy to defraud the United States, tax evasion and failure to file tax returns. The indictment alleges that the Allens conspired to defraud the United States of assessing and collecting federal income taxes from 1998 through April 2009.

The Department of Justice today asked the U.S. Court of Appeals for the Ninth Circuit to remand the cases of former Alaska State Representatives Victor Kohring and Peter Kott, who were convicted on corruption charges in 2007, to the District Court.

A former employee at the U.S. Embassy in Haiti was sentenced today to 18 months in prison for stealing more than $800,000 from the U.S. Department of State.

Jefferson Calimlim Sr. and his wife, Elnora Calimlim, both medical doctors in Milwaukee, Wis., were each sentenced today to 72 months in prison for forcing a woman to work as their domestic servant and illegally harboring her for 19 years in their Brookfield, Wis., residence.

Lawrence Cohen, a resident of Las Vegas and a former employee of the now defunct Freedom Books, pleaded guilty today to a tax charge before U.S. District Judge Kent J. Dawson in Las Vegas. Cohen pleaded guilty to one count of aiding and assisting in the preparation of a false 2000 Form 1040 for a client of Freedom Books.

A two-count federal grand jury indictment returned against Karl F. Thompson Jr., a Spokane, Wash., police officer, was unsealed today.

A federal court has permanently enjoined Reinhold Sommerstedt, a Las Vegas-based promoter of a sham trust tax scam.

The Dallas Independent School District (DISD) has agreed to settle claims that the school district violated the False Claims Act in connection with the Federal Communications Commission’s E-Rate program. Under the terms of the settlement, the DISD will relinquish more than $150 million in requests for federal funds, and will pay a total of $750,000.

The Department announced a simultaneous lawsuit and settlement with the state of Texas concerning the care given to residents of the state’s 13 facilities for persons with developmental disabilities. Along with the settlement agreement, the Department will file a complaint initiating a lawsuit against the state in federal court. An independent monitor will be appointed to oversee the state’s compliance with the settlement agreement and the court will retain ultimate jurisdiction.

Andrew Warren, 41, has been charged in U.S. District Court for the District of Columbia with one count of sexual abuse in Algeria within the special maritime and territorial jurisdiction of the United States.

John D. Stacey, a resident of Phoenix, was convicted today of income tax evasion, corrupt interference with the due administration of the Internal Revenue Service (IRS) and multiple counts of fraudulent use of a social security number. A federal jury convicted Stacey of all counts of the indictment following a three week trial before Judge Neil V. Wake in Phoenix.

Additional charges and defendants have been added to a federal case arising from the abduction of a boy from his Las Vegas home in October 2008.

Roderick Prescott, a resident of Orem, Utah, and a former principal of National Trust Services (NTS) in San Jose, Calif., and later Selma, Ore., pleaded guilty today to tax evasion. Prescott admitted to evading at least $550,000 in personal income taxes for 1998 and 1999. Prescott was scheduled to begin trial on July 7, 2009, before Chief U.S. District Judge Ann Aiken in Eugene, Ore.

A federal jury in Los Angeles convicted a physician assistant late yesterday for his role in a $7.7 million Medicare fraud scheme.

A federal judge in Tampa, Fla., has permanently barred eight men – including five tax preparers and two Certified Public Accountants (CPA) – from promoting an alleged tax fraud scheme involving bogus income tax credits.

As part of a multi-site settlement, G-I Holdings Inc. has agreed to address asbestos contamination caused by its past operation of the largest chrysotile asbestos mine and mill in the country. The 1,673-acre abandoned mine site in Vermont, known as the Vermont Asbestos Group Mine Site (VAG Site) is the most significant of the contaminated sites covered by the settlement, which includes 12 other industrial sites across the country where G-I may have disposed of hazardous waste.

A Kansas woman pleaded guilty to making a false statement to the FBI during an investigation into allegations of fraud against the Federal Communications Commission’s (FCC) E-Rate program. According to the plea agreement, filed today in U.S. District Court in Kansas City, Kan., Mary Jo LaDuron, aka Mary Jo Gault, of Leavenworth, Kan., lied to FBI agents who were investigating allegations of fraud against the E-Rate program.

Paul Tillis, a former Florida Department of Corrections officer, was sentenced today in federal court in Jacksonville, Fla., on a federal civil rights charge related to assaulting an inmate.

A former State Department employee was sentenced today to one year of probation and ordered to pay a $5,000 fine for illegally accessing more than 50 confidential passport application files.

A fourth individual pleaded guilty today to illegally accessing numerous confidential passport application files.

Dustin I. Nix, 21, of Donaldson, Ark., pleaded guilty today in federal court in Hot Springs, Ark., to two federal civil rights charges for his role in a conspiracy to force a woman and her young children from their home in Donaldson because she associated with African Americans.

Everett Cooney waived indictment and pleaded guilty in court in Little Rock, Ark., to a federal charge of sex trafficking an underage female. Chief U.S. District Judge J. Leon Holmes accepted Cooney’s guilty plea.

Frederic A. Bourke Jr., 63, was found guilty today by a federal jury in Manhattan of conspiracy to violate the Foreign Corrupt Practices Act (FCPA) and the Travel Act, and making false statements to the FBI.

George Michael Lee, Duc Cong Nguyen, Hop Nguyen and Tien Duc Vu were sentenced today in San Diego for their roles in a scheme by the "Tran Organization" to cheat casinos across the United States and Canada.

Antonio McWherter, a police officer in the East St. Louis, Ill., Police Department, was charged today in a two-count federal indictment stemming from a January 2006 incident in which the officer allegedly punched a handcuffed arrestee in the mouth. The indictment charges McWherter with a felony civil rights violation and with making false statements to the FBI.

Colorado Interstate Gas Company (CIG), the operator of the Natural Buttes Compressor Station located on the Uintah and Ouray Indian Reservation near Vernal, Utah, has agreed to pay more than $1 million and install environmental controls at its facility as part of a consent decree that resolves violations of the Clean Air Act.

Michael Bullard and Richard Armstrong were convicted yesterday by a jury in Boise, Idaho, on federal hate crime and conspiracy charges in connection with the racially-motivated assault of an African American man outside of a Wal-Mart store in July 2008.

A federal grand jury in Casper, Wyo., Thursday returned an indictment charging Randy Lee (a/k/a Jimmy Lee) and Jay Lee (a/k/a John Marks, a/k/a Anthony Romero) of Cheyenne, Wyo., with odometer tampering, title fraud, securities fraud, mail fraud and conspiracy to commit these offenses. The indictment alleges that the defendants worked as used car dealers at Lee’s RV’s, Inc., a dealership in Cheyenne.

Consultores de Navegacion, a Spanish company that operates the M/T Nautilus, an ocean-going chemical tanker ship, was sentenced today by U.S. District Judge Douglas P. Woodlock to pay a fine of more than $2 million and serve three years of probation for criminal violations related to the overboard discharge of oil-contaminated bilge waste on the high seas.

The Department announced an agreement with Gregg County, Texas, to improve access for persons with disabilities to its programs, services, activities and facilities. The agreement was reached under the Department’s Project Civic Access initiative, which helps bring localities into full compliance with the Americans with Disabilities Act (ADA). This agreement is the 163rd entered into under Project Civic Access.

Mark Edwin Cairnes, 51, of Jonestown, Texas, has been charged with advertising, receiving and possessing child pornography. A grand jury in the Western District of Texas returned the indictment against Cairnes on July 21, 2009, which was unsealed today after his arrest yesterday in Jonestown.

A federal jury in Orlando, Fla, found Erin Sharma, a Bureau of Prisons corrections officer, guilty today on felony federal civil rights charges related to a fatal assault on an inmate in March 2005.
