1. Heard Ms. Haripriya Patel, the Applicant appearing in person (in Virtual Mode).

2. The present case has been taken up in pursuance of an article published in the New Indian Express dated 19.08.2024 "Three jumbos die in Odisha in 24 hours, electrocution cases rise". The article also mentions that: -

a) one elephant calf dies after being hit by a goods train on the Rourkela-Bimlagarh line near Roxy of Barsuan range under the Bonai Forest Division (BFD) in District: Sundargarh in the early hours on Sunday dated 18.08.2024;

b) a female elephant aged about 7 years died in Tamra Forest in Gurundia Block on the night of August 15 due to diseases; and

HON'BLE MR. JUSTICE MADAN GOPAL VYAS Order 07/11/2024 This application arises from a jail appeal.

2. This application seeking suspension of sentence has been filed on behalf of Dilip @ Vinod who has been convicted and sentenced to various periods of imprisonment for committing the offences under sections 302, 458, 120-B, 460, 449, 328, 395, 396, 324 and 323 of the Indian Penal Code and under sections 3/25 & 7/25 of the Arms Act.

3. Mr. Moti Singh, the learned counsel for the applicant refers to the order passed by co-ordinate Bench of this Court in 3 rd Suspension of Sentence Application (Appeal) No.1291/2022 by which Vijay Kumar @ Khushi son of Darpi @ Khushi has been enlarged on bail by suspending the sentence awarded to him in Sessions Case No. 109/2012.

This petition, under Section 482 of CrPC, has been filed for quashing the FIR on the ground of compromise in connection with Crime No.416/2011 registered at Police Station- Bahodapur, District Gwalior for the offences punishable under Sections 420, 467, 468, 471 of IPC, and all consequential proceedings arising out of it.

2 . Allegation against the petitioner is that he along-with other co- accused on the basis of forged power of attorney sold the plot to the complainant.

3. I.A.No.21627/2024 and I.A. No.21628/2024, applications for compromise have been filed by the petitioners as well as respondent No.2 duly supported by their affidavits.

It appears that a Sole Arbitrator had been appointed in terms of the arbitration clause contained in the agreement dated December 5, 2018.

An application under section 17 of the Arbitration and Conciliation Act, 1996 (for short "the Act") had been preferred before the learned Arbitrator. Two Officers were appointed as Receivers in respect of the subject asset. The Receivers were directed to take physical possession of the said asset being an equipment being XR 220D, bearing engine no.22293605 along with its accessories, as mentioned in the agreement.

Pleadings disclose that the Receivers were not able to take physical possession of the asset in question as they were resisted by the respondents and the local police authorities also did not cooperate.

The Court:- This appeal by the revenue filed under Section 260A of the Income Tax Act, 1961 (the Act) is directed against the order dated November 08, 2023 passed by the Income Tax Appellate Tribunal 'A' Bench, Kolkata (the Tribunal) in ITA No.666/Kol/2023 for the assessment year 2012-13.

The revenue has raised the following substantial questions of law for consideration:-

(a) Whether on the facts and circumstances of the case and in law, the Learned Income Tax Appellate Tribunal has committed substantial error by not considering the addition made by the Assessing Officer on account of share capital / share premium of Rs.3,00,00,000/- made u/s 68 of the IT Act, 1961, without considering the fact that there is accommodation entry in the instant case?

The Court : This is an appeal filed by the revenue under Section 260A of the Income Tax Act, 1961 (the Act) challenging an order dated January 11, 2024 passed by the Income Tax Appellate Tribunal, "B" Bench, Kolkata (Tribunal) in I.T.A No.763/Kol/2022, for the assessment order 2013-14.

We have heard Mr. Aryak Dutt, learned standing counsel appearing for the appellant and Mr. Soumitra Chowdhury, learned counsel for the respondent/assessee.

The appeal was filed beyond time and an application for condonation of delay was filed which was heard and the delay was condoned. Learned counsel appearing for the assessee would submit that the assessee has been advised to avail the provisions of the direct tax Vivad Se Viswas Scheme (VSVS) dated 15 th October, 2023. However, one issue may crop up if the assessee files an application under VSVS by citing that the duty fixed for eligible cases as has been mentioned in paragraph 3(Sl.1)(ii). Identical issue arose for consideration before this Court in the case of Principal Commissioner of Income Tax-1, Kolkata vs. Asish Kumar Ghosh, WPA 18282 of 2021 and by judgment dated 1st April, 2022 this Court had considered the very same issue and found that the assessee would be eligible to file a declaration under the provisions of the VSVS and a direction was also issued to process such application. The judgment rendered in Asish Kumar Ghosh will fully support the case of the assessee and therefore the assessee is entitled to file an application under the VSVS. Accordingly, the assessee is directed to file an application and the department shall process the application in accordance with law.

The Court:- This appeal by the assessee filed under Section 260A of the Income Tax Act, 1961 (the Act) is directed against the order dated January 16, 2024 passed by the Income Tax Appellate Tribunal 'C' Bench, Kolkata (the Tribunal) in ITA No.1964/Kol/2019 and C.O. No.39/Kol/2019 for the assessment year 2015-16. This appeal is admitted on the following substantial questions of law:-

(i) Whether the Tribunal was justified in law in upholding the invocation of sub-section (2) of section 14A of the Income Tax Act, 1961 and rule 8D(2)(iii) of the Income Tax Rules, 1962, in the absence of any satisfaction recorded by the Assessing Officer that having regard to the accounts of appellant, the appellant's claim that expenditure of Rs.9,77,888/ was incurred in relation to the exempt income was not correct?

The Court :- We have heard the learned Advocates for the parties. The revenue has filed this appeal under Section 260A of the Income Tax Act, 1961 (the Act) is directed against the order dated 9th May, 2023 passed by the Income Tax Appellate Tribunal "B" Bench, Kolkata (the Tribunal) in ITA/491/Kol/2021 for the assessment year 2011-12. The revenue has raised the following substantial questions of law for consideration:-

a. Whether the learned Tribunal has committed substantial error in law in granting relief to the assessee without considering the fact that neither the assessee nor the amalgamating company informed the AO about the scheme of amalgamation approved by the Hon'ble High Court and therefore defect in not issuing notice in the name of amalgamated company remained a curable defect under section 292B of the Income Tax Act, 1961 ?

The Court : This appeal filed by the revenue under Section 260A of the Income Tax Act, 1961 (the Act) is directed against an order dated October 26, 2023, passed by the Income Tax Appellate Tribunal, "C" Bench, Kolkata (Tribunal) in I.T.A No.1842/Kol/2017, for the assessment order 2009-10.

The revenue has raised the following substantial questions of law for consideration:-

i) Whether on the facts and in law, the Hon'ble ITAT is justified in setting aside the order of the Ld. CIT(A) and deleting the additional made by the A.O. towards unexplained share capital and share premium of Rs.15,51,00,000/- u/s. 68 of the Act by holding that the assessee had discharged its onus to prove the identity and creditworthiness of the share subscribing companies and the genuineness of the transactions overlooking the fact that not even a single Director of the share subscribing companies appeared before the Assessing Officer nor provided a valid reason for their non-appearance?

Accused Nos1, 2, 12 and 15 are before this Court in these three petitions under Section 438 of Cr.P.C., with a prayer to grant anticipatory bail in Crime No.98/2024 registered by Seshadripuram Police Station, Bengaluru City for the offences punishable Sections 120B, 409, 420, 465, 467, 468 & 471 of IPC R/w 149 of IPC.

2. Heard the learned counsel for the parties.

3. FIR in Crime No.98/2024 was registered by Seshadripuram Police Station, Bengaluru City against Smt Puttamma and others, on the basis of first information dated 04.10.2024 received from Sri Mallesh M, DYSP, attached to BDA, Bengaluru. Apprehending arrest in the said case, the petitioners had filed Crl.Misc.No.9338/2024, Crl.Misc.9367/2024 and Crl.Misc.No.9337/2024 before the jurisdictional Sessions Court, which was rejected on 21.10.2024. Therefore, they are before this Court.

The judgment and order dated 18.12.2017 passed by the Court of Sessions Judge, Special Court at Yadagiri in NC: 2024:KHC-K:8145 Special Case No.45/2015 is assailed in this appeal by the accused.

2. Heard the learned counsel for appellant, learned High Court Government Pleader for respondent/State and perused the evidence and material on record.

3. Charges were framed against the accused/ appellant for offences punishable under Sections 323, 354(A)(1), 504 of IPC and Section 3(1) (xi) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

4. The case of the prosecution is that on 09.06.2015 at about 11.00 a.m., when the complainant/PW-1 was proceeding towards the canal in Nagaral village to wash the clothes, the accused held her hands, abused her as 'le holeya sule' and called her to sleep with him and when she resisted, he dragged her by holding her tuft, assaulted on her back with his hands and thereby committed the charged offences.

Heard the learned Senior counsel for the appellant and learned counsel for the caveator-respondent Nos.1 to 9.

2. This miscellaneous first appeal is filed praying this Court to set aside the order of status-quo granted by the Trial Court dated 05.10.2024 in O.S.No.7166/2024 passed on I.A.No.2 filed by respondent Nos.1 to 9 and grant such other relief as deems fit in the circumstances of the case.

The respondents/plaintiffs before the Trial Court also sought for the relief of temporary injunction restraining the defendant Nos.1, 2 and 3 from enforcing or acting upon the invocation notice dated 28.09.2024 and from taking any further action regarding transfer or encumbrance of the pledged shares of Mantri Infrastructure Pvt. Ltd. (100%), Mantri Developers Pvt. Ltd. (51%) or Agara Techzone Pvt. Ltd. (12%) or from enforcing any security under the Bond Trust Deed and Pledge Agreements, until final adjudication of the rights of the parties by the Trial Court and inter alia sought for the relief on I.A.No.2 to restrain the defendant Nos.1 to 3 from enforcing or acting upon invocation notice dated 28.09.2024. The respondents also filed applications and order is passed only on I.A.Nos.2 to 4. It is also borne out from the records that caveat was also filed and learned counsel for both the parties were heard and suit was filed before the Vacation Court and I.A.No.1 was filed under Section 11(3) of Bengaluru City Civil Court Act to take up the matter before the Vacation Court and the same was allowed.

JUSTICE J.M.KHAZI) Petitioner who is complainant before the trial court has filed this petition under Section 482 of Cr.P.C. challenging the order dated 13.12.2017 passed by the trial court dismissing the complainant as against accused Nos.8 to 11, by which the trial court has ordered for issuance of process against accused Nos.1 to 7, but refused to proceed against accused Nos.8 to 11 who are revenue officials.

3. In support of the petition, complainant has contended that the refusal by the trial court to take cognizance against the accused Nos.8 to 11 is opposed to law, facts and probabilities of the case. The trial court has failed to appreciate that accused Nos.8 to 11 have failed to act in accordance with law. They have altered the boundaries of the property of the complainant in a manner advantageous to accused Nos.1 to 7, without issuing notice to the complainant. There are specific allegations in para 8 of the complaint regarding illegal acts of accused Nos.8 to 11 which is sufficient to take cognizance against them. Not only accused Nos.8 to 11 guilty of not providing opportunity to the complainant by issuing notice, but also in altering boundaries of the property of the complainant contrary to the documents. Complainant is required to be provided with an opportunity to establish the allegations made against accused Nos.8 to 11 and hence, the petition.
