Some employers and industries were able to pivot and weather the devastating effects of COVID-19. Others scaled back operations or closed permanently due to changes in demand, supply chain issues, or hiring shortfalls.  As businesses start to reopen, employers are facing new challenges.

The Butch Lewis Emergency Pension Plan Relief Act of 2021 Becomes Law

On March 11, 2021, President Biden signed into law the $1.9 trillion American Rescue Plan Act of 2021, which includes the Butch Lewis Emergency Pension Plan Relief Act of 2021.  This law is designed to forestall the insolvency of approximately 100 multiemployer pension plans that were expected to run out of money necessary to pay vested benefits over the next 20 years.  Included among these funds is a particularly large fund that – absent congressional intervention – would have gone insolvent by 2025, leaving millions of retirees without their expected monthly pension.

The Littler Annual Employer Survey 2021

Employers transitioning to a post-pandemic workplace face a host of novel challenges.

High on that list is navigating hybrid work models and what a return to physical workplaces looks like – especially when, as our survey reveals, the percentage of employees who prefer remote or hybrid work is higher than the percentage of employers who plan to offer it. The survey also finds employers taking a cautious approach to asking about employees’ COVID-19 vaccination status and making a range of changes to their physical workplaces.

False Claims Act Retaliation in 2021

A corporate whistleblower can create more financial, organizational, and reputational damage to an employer by using the federal False Claims Act (FCA), 31 U.S.C. § 3729-33, than by using any other “whistleblower” law. While the FCA contains no requirement that the whistleblower be an employee to create the damage, most FCA whistleblowers are employees, and almost all of them bring the problem to their management or human resources department before they suffer an adverse employment action. Management often does not hear the whistle blowing when the damage is still avoidable.

The Littler 2021 European Employer Survey Report

Despite all that remains uncertain for European employers – involving the trajectory of the COVID-19 pandemic, new working models or any number of other emergent workforce issues – one area has come into greater focus: Most companies are planning a return to the office in some form.

The ETSI NFV&MEC API Plugtests™ 2021 event, which ran remotely during the whole month of February, allowed participants to self-evaluate the conformance of their API server implementations with network function virtualization and multi-access edge computing API specifications. The event allowed also to validate and gather feedback on ETSI NFV and MEC API and Conformance Testing Specifications, and associated Robot test suites. The Report of this multi-vendor interoperability (IOP) event, held remotely, is now publicly available for download. NFV and MEC overall interoperability reached a 95% to 100% success rate.
