2. We heard the parties and perused the record. During the year under consideration, the assessee sold a residential house property for a sum of Rs.12.75 crores on 06-11-2015. She purchased another residential house property on 17-02-2016 for Rs.11.02 crores. The new house property was purchased in the joint name of the assessee and her son Shri Kurada Sagar Chakravarthy. The assessee claimed deduction of Rs.8.47 crores u/s 54 of the Act towards the cost of new residential house property against the long term capital gain arising on sale of original house property. Since the new residential house property has been purchased in the name of assessee and her son, the AO restricted the deduction u/s 54 of the Act to 50%, i.e., he allowed deduction to the extent of Rs.4.23 crores only. The Ld CIT(A) also confirmed the same and hence the assessee has filed this appeal.

The singular contention urged by the learned counsel for the petitioner is that the first respondent had committed a fundamental error in adopting the revised assessed tax of the year 2007-08 as the basis for revising the assessment and refixing the compounded tax liability for the years 2008-09, 2009-10 and 2010-11. In support of this contention, attention is drawn to Section 7(b) of the KGST Act and reliance is placed on the decisions in Sicilia Hotel Pvt. Ltd (Supra), and Kalyan Tourist Home v. State of Kerala (2017 (2) KLT 761).

Opposing the contentions, the learned Government Pleader would submit that, the power for revising the assessment after payment of compounded tax under Section 7(b) cannot be limited to be based only on the tax payable as conceded in the return or accounts or the turnover tax paid for any of the previous consecutive three years. It is contended that there is no inhibition in Section 7 that revision of assessment cannot be on the basis of assessed tax. It is submitted that this position has been succinctly laid down by the Division Bench in Kalika Hotel and Bar, Amballur(M/s) v. State of Kerala (2012 (3) KHC 85) and The Commercial Tax Officer v. M/s Hotel Breezeland Ltd. (2019 (2) KLT 432).

On 28-02-2019, Sri. K.P. Mathaikunju and 3 others filed a contempt of court case before this court against the respondents herein, alleging that the respondents have committed civil contempt by publishing a face book post in a face book page to which the respondents are the admins and also published a similar news in the website www.ovsonline.in on 27-02-2019, to the effect that the cases, O.P (C) No.65/2019 & Tr.P (C) No.76/2019, which pertains to the dispute regarding the 'Vadavukod Church' were dismissed by the High Court on 27-02- 2019, which in fact were only reserved for judgment on that day. It is alleged that the act of the respondents in this regard would amount to interference with the administration of justice and therefore they have committed contempt of court punishable under provisions of Contempt of Courts Act, 1971. The Registry of this court expressed doubt with respect to maintainability of CON.Case (Crl. ) No.1/2019 (Suo motu) -4- the above said contempt of court petition. Therefore the case was posted before the learned Single Judge who as dealing with OP (C) No.65/2019 and Tr.P (C) No.76/2019, as unnumbered contempt petition. Initially, the learned Judge appointed an 'amicus curiae' in the matter, through order dated 01-03-2019. But subsequently, on 31-05-2019, the Single Judge directed the Registry of this court to place the petition before Hon'ble Chief justice for appropriate further action on the administrative side, in the light of the decision of the Full Bench in Rehim P. V. M.V. Jayarajan and others (2010 (4) KLT 286). When the matter was placed for consideration before the Hon'ble Chief Justice on 25-06-2019, it was ordered to place the matter as a suo motu criminal contempt case, for preliminary hearing, before the appropriate Bench. When the matter came on the judicial side, this court ordered notice to the respondents. Personal appearance of the respondents were dispensed with for the time being. The respondents appeared and each of them had filed separate affidavits. Now the case is coming up for consideration as to whether there exists prima facie contempt and to decide whether further proceedings need to be pursued in the case by framing charge against the respondents. Income Tax Appeal Nos. 135/2019 & 146/2019 are filed challenging a common order passed by the Income Tax Appellate Tribunal, Cochin Bench in ITA Nos.536/Coch/2018 and 537/Coch/2018, dated 12-03-2019. Income Tax Appeal No.313/2019 is filed against the revised order passed by the same Tribunal ITA No.537/Coch/2018, dated 11-10-2019. The assessee was the appellant before the Tribunal, who is the appellant herein. The revenue is the respondent.

Appellant is a company registered under the Companies Act, engaged in wholesale and retail trade of beaverages within the State of Kerala, and is a 'State Government Undertaking' falling within the 'Explanation' provided under Section 40 (a) (iib) of the Income Tax Act, 1961 (hereinafter referred to as 'the Act' for short). With respect to I.T. Appeal Nos. 135, 146 & 313/2019 -5- the assessment year 2014-2015, the Deputy Commissioner of Income Tax, Circle-2 (1), Thiruvananthapuram finalized the assessment of income tax against the appellant, under Section 143 (3) of the Act, through the order of assessment dated 14- 12-2016. But, the Principal Commissioner of Income Tax, Thiruvananthapuram initiated proceedings under Section 263 of the Act and set aside the order of assessment, on holding that the same is erroneous and is prejudicial to the interest of the revenue, to the extent it failed to disallow the debits made in the Profit and Loss Account of the assessee with respect to the amount of surcharge on sales tax and turn over tax paid to the State Government, which ought to have been disallowed under Section 40 (a) (iib) of the Act. Against order of the Principal Commissioner of Income Tax, issued under Section 263 of the Act, dated 25-09-2018, the appellant approached the Tribunal in ITA No.536/Coch/2018.

1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with crime No.189/2020 registered at Police Station City Kotwali, Distt. Raigarh Chhattisgarh for the offence punishable under Section 34(2) & 59(A) of the Chhattisgarh Excise Act.

2. Case of the prosecution, in brief, is that 10 bulk liters of illicit liquor was seized by the police from the present applicant.

3. Learned counsel for the applicant submits that the applicant is in detention since 17.4.2020 He further submits that applicant has no criminal background and has been falsely implicated in the case, and therefore, the applicant may be released on bail. 2

The appeal is directed against judgment dated 06.4.2010 passed by Sessions Judge Raipur in Session Trial No.161/2008 wherein the said Court convicted appellant for commission of offence under Section 304 Part-II of the Indian Penal Code, 1860 and sentenced him to undergo rigorous imprisonment for 05 years and to pay fine of Rs.1000/- with default stipulation.

2. In the present case, name of the deceased is Kalu @ Tarun Bagh. As per the version of the prosecution, on 11.6.2008 at 2 noon, the appellant and the deceased were drinking liquor in the house of the appellant. During the course of drinking, a dispute arose regarding daughter of the appellant namely Suman. On this dispute, the appellant and other persons assaulted the deceased and the appellant sat on the chest of the deceased and pressed his neck due to which the deceased become unconscious. He was taken to hospital but succumbed to the injuries. The matter was reported, investigated and the appellant was charge sheeted and convicted as mentioned above.

The Appellant vide her RTI application sought information regarding the copy of the documents of the Department of Personnel and Training (DoP&T) associated with the files related to the appointment of various Attorney Generals of India since 01.01.2010.

Dissatisfied due to non-receipt of any response from the CPIO, the Appellant approached the FAA. The FAA, vide its order dated 09.10.2018 stated that the Appeal had been examined and it was found that the CPIO on 11.09.2018 had sought certain clarifications from the Appellant. Hence, the Appellant was advised to clarify the same to the CPIO to enable him to provide the available information.

The case of the prosecution is that while the first informant/Police Officer attached to the respondent-police station along with other officials were on patrolling duty near a ware house situated close to Pratibha School at about 3.00 a.m., on 13.03.2020, they found these petitioners along with four others preparing to commit decoity. The petitioners were apprehended and a case was registered in Crime No.18/2020 of Roza police station for the offence punishable under Sections 399 and 402 of IPC.

The learned counsel for the petitioners submits that a false case has been foisted against the petitioners and 3 they are not involved in any such offence much less the one now alleged against them. He submits that the petitioners are eking out their livelihood by driving the auto and also by doing coolie work. He submits that the petitioners are arrested on 13.03.2020 and since then they are in judicial custody and by imposing any conditions, they may be enlarged on bail.

2. Learned advocate Mr. Karia for the applicant submits that the applicant is arrested on the basis of statement of co-accused. Learned Advocate further submits that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions.

3. Learned Additional Public Prosecutor appearing on behalf of the respondent-State has opposed grant of regular bail looking to the nature and gravity of the offence. He further submits that the applicant has two past criminal antecedents.

In view of the submission made, let the instant defect be ignored. Learned counsel for the petitioner, in present circumstances, undertakes to remove the remaining defect no. 9(ii) and (iii) regarding filing of certain pages within a week. Defect no. 9(v) is ignored as according to the learned counsel for the petitioner, last page of the restoration application is not of much relevance. Defect no. 9 (iv) is also ignored.

Special Representative for Afghanistan Reconciliation Zalmay Khalilzad has sought Pakistan's support for reducing violence in Afghanistan and accelerate the intra-Afghan dialogue, the US Embassy here said on Saturday. Khalilzad discussed the Afghanistan peace process with Pakistan Chief of Army Staff (COAS) General Qamar Javed Bajwa on Friday. During the discussion, he also asked for help to secure the release of American navy veteran-turned contractor Mark Frerichs, who went missing in Afghanistan.
