The Department of Justice announced today that it has reached a settlement with Penguin Group (USA) Inc.–one of the largest book publishers in the United States–and will continue to litigate against Apple Inc. and Holtzbrinck Publishers LLC, which does business as Macmillan, for conspiring to raise e-book prices to consumers.

"We cannot, and we will not, tolerate misconduct on Wall Street of the kind admitted to by UBS today, and by Barclays last June. We will continue to follow the facts and the law wherever they lead us in this matter, as we do in every case," said Assistant Attorney General Breuer.

"Today, the Justice Department is filing a criminal information charging UBS Securities Japan – a subsidiary of the multinational financial institution UBS AG – with felony wire fraud for engaging in a scheme to manipulate the London Interbank Offered Rate, or LIBOR – a key benchmark for financial products and transactions around the world," said Attorney General Holder.

U.S. District Court Judge William P. Johnson entered a consent decree of permanent injunction against Sunland Inc., a Portales, N.M.-based producer of peanut butter, and Jimmie D. Shearer, president and chief executive officer of Sunland, the Justice Department announced today.

Caddell Construction Company Inc., a major commercial and industrial federal government construction contractor based in Montgomery, Ala., has entered into an agreement with the Department of Justice to resolve criminal fraud violations arising from Caddell’s intentional overstating of developmental assistance provided to a disadvantaged small business as part of a Department of Defense (DoD) program.

Florida-based American Sleep Medicine LLC has agreed to pay $15,301,341 to resolve allegations that it billed Medicare, TRICARE – the health care program for Uniformed Service members, retirees and their families worldwide – and the Railroad Retirement Medicare Program for sleep diagnostic services that were not eligible for payment.

The Justice Department announced today that it will monitor the municipal special election on Jan. 8, 2013, in Branchville, S.C., to ensure compliance with the Voting Rights Act of 1965. The Voting Rights Act prohibits discrimination in the election process on the basis of race, color or membership in a minority language group.

Jack Ray Carr, of Baton Rouge, La., was sentenced today to 78 months in federal prison for one count of corruptly interfering with the due administration of the Internal Revenue laws, four counts of filing false income tax returns and one count of aiding and assisting in the preparation of a false income tax return.

Mary Estelle Curran of Palm Beach, Fla., pleaded guilty today in the U.S. District Court for the Southern District of Florida to filing false tax returns for tax years 2006 and 2007.

A federal inmate formerly held in Pennsylvania’s Allenwood Federal Correctional Complex pleaded guilty today in Harrisburg, Pa., before U.S. District Judge Yvette Kane, to first degree murder for stabbing and kicking a fellow inmate to death.

Today, the Justice Department announced that yesterday afternoon it filed in federal court a comprehensive agreement that will resolve long running litigation with the state of Tennessee originally concerning conditions of care at the former Arlington Developmental Center (ADC).

Three men, including two former officers with the Police of Puerto Rico, were convicted today by a federal jury in San Juan, Puerto Rico, for their roles in providing security for drug transactions.

The Department of Justice today settled a civil complaint against Richard A. Retta, of Rockville, Md, in the U.S. District Court for the District of Columbia, for violations of the Freedom of Access to Clinic Entrances (FACE) Act.

A federal court has permanently barred Pete Escalante Gutierrez and Jeanette Gutierrez from preparing federal tax returns for others.

A Pennsylvania man pleaded guilty today for coercing and enticing a minor and possessing child pornography.

A former special agent of the Department of Homeland Security’s Office of Inspector General (DHS-OIG) pleaded guilty today in a Southern District of Texas federal court to participating in a scheme to falsify records and to obstruct an internal field office inspection.

The Justice Department announced today that a federal court has permanently barred Cash Management Systems, a Virginia corporation, from promoting two tax schemes that allegedly involve disguising wages as tool-reimbursement or tool-rental payments.

A federal grand jury in Philadelphia unsealed an indictment yesterday charging Kyle Novitsky, 45, and Judith Aloe, 52, both of North Miami Beach, Fla., with making false odometer statements, securities fraud and conspiracy to commit these offenses.

Stephen Thomas of York, Penn., was sentenced today in U.S. District Court for the District of Columbia for tax evasion.

"Let’s work to prevent fraud, but let’s not erect new, unnecessary requirements that have a discriminatory impact. Let’s have a debate on the merits without trying to make it harder for our perceived opponents to vote," said Assistant Attorney General Perez.

Connie M. Knight, 46, previously of Belle Chasse, La., pleaded guilty in federal court in New Orleans today to three felony criminal charges and one misdemeanor criminal charge for creating false identification documents an impersonating a federal official.

"These realities indicate that stalking is a serious issue for every community across the United States that requires a multidisciplinary approach – Fortunately, many of the agencies that are needed to appropriately address and respond to the crime of stalking are represented on this panel today," said Acting Director Hanson.

"Today, more than ever, we must summon the courage to confront even the most intractable public safety challenges. And we must reject the notion that partisan gridlock and political convenience are acceptable reasons for inaction – particularly when lives are at stake, and the most vulnerable members of our society – our children – are depending on us," said Attorney General Holder.

The Justice Department filed suit today asking the U.S. District Court for the Middle District of Florida to permanently bar Torrey Burden from preparing federal tax returns for others. The civil injunction suit alleges that Burden prepares returns through A&L Financial Solutions in St. Petersburg, Fla.

U.S. District Judge David M. Lawson, of the Eastern District of Michigan, entered a consent decree of permanent injunction against Ann Arbor, Michigan-based Green Hope LLC, dba Rosewood Products, and its president, Phil G. Ye.

The Justice Department has reached an agreement with the city of Memphis, Tenn., under the Americans with Disabilities Act (ADA) to improve physical accessibility for people with disabilities at Liberty Bowl Memorial Stadium, home of the AutoZone Liberty Bowl, Memphis Tigers and Southern Heritage Classic football games.

U.S. District Court Judge Lesley Wells entered a consent decree of permanent injunction against Ben Venue Laboratories Inc., a Bedford, Ohio-based drug manufacturer.

A Kansas City, Kan., federal court permanently barred an Instant Tax Service franchisee, A&S Tax Services LLC, from further operating or preparing federal tax returns for others.

The company that operates Path, an online social networking application, agreed to pay an $800,000 penalty to settle charges that it violated the Federal Trade Commission (FTC) Act and the Children’s Online Privacy Protection Rule.

Our National Institute of Justice and Bureau of Justice Statistics have, for many years, made significant contributions to our base of knowledge," said Acting Assistant Attorney General Leary.

"Yesterday, the Justice Department filed a civil lawsuit against Standard &s Financial Services – as well as its parent company, McGraw-Hill – alleging that the credit rating agency S&P engaged in a scheme to defraud investors in financial products known as Residential Mortgage-Backed Securities, or RMBS, and Collateralized Debt Obligations, or CDOs," said Attorney General Holder.

"Even though the banks and other institutions hired S&P to rate these financial products, and even though S&P earned millions as a result of issuing those ratings, S&P promised that its ratings would be unaffected by their concerns about market share, revenue or profits," said Acting Associate Attorney General West.

"As a result of these provisions, FIRREA is a powerful weapon for combatting financial fraud, and it will continue to play a key role in the Department's efforts to hold accountable those who violated the law," said Principal Deputy Assistant Attorney General Delery.

"Now, we can all be proud of the track record that’s been established – and the results we’ve obtained – in recent years. But we must also recognize that government can’t do it all – and we’ll never be able make the progress we need, and that our citizens deserve, on our own. Sixteen people were sentenced to prison today for hate crimes arising out of a series of religiously-motivated assaults on practitioners of the Amish religion.

Today the United States filed a civil action against ATP Oil &s Bureau of Safety and Environmental Enforcement (BSEE) and the U.S. Environmental Protection Agency (EPA). The complaint addresses the defendants’ alleged unlawful discharges of oil and unpermitted chemical dispersants from the defendants’ floating oil and gas production platform, the ATP Innovator, into the Gulf of Mexico.

A federal grand jury in Muskogee, Okla., has indicted Raymond A. Barnes, 42, and Christopher A. Brown, 31, the former jail superintendent and assistant jail superintendent, respectively, of the Muskogee County Jail (MCJ) on multiple counts of civil rights offenses related to allegations of excessive force on inmates at MCJ on or between August 2009 and May 2011.

Transocean Deepwater Inc. pleaded guilty today to a violation of the Clean Water Act (CWA) for its illegal conduct leading to the 2010 Deepwater Horizon disaster, and was sentenced to pay $400 million in criminal fines and penalties.

A Gainesville, Fla., woman was sentenced today to serve one year and one day in prison for her role in the obstruction of a multinational investigation into the disappearance of her husband, then an employee in the U.S. Consulate in Curacao.
