Hospital ICUs Are Adapting To COVID-19 At 'Light Speed'

Intensive care teams inside hospitals are rapidly altering the way they care for patients with COVID-19.

The changes range from new protective gear to new treatment protocols aimed at preventing deadly blood clots.

"Things are moving so fast within this pandemic, it's hard to keep up" says Dr. Angela Hewlett, an infectious diseases physician at University of Nebraska Medical Center in Omaha and medical director of the Nebraska Biocontainment Unit. To stay current, she says, ICUs are updating their practices "on an hourly basis."

"We are learning at light speed about the disease," says Dr. Craig Coopersmith , interim director of the critical care center at Emory University. "Things that previously might have taken us years to learn, we're learning in a week or two. Things that might have taken us a month to learn beforehand, we're learning in a day or two."

The most obvious changes involve measures to protect ICU doctors, nurses and staff from the virus.

"There is a true and real probability of infection," says Dr. Tiffany Osborn a critical care specialist at Washington University School of Medicine and Barnes-Jewish Hospital in St. Louis. "You have to think about everything you touch as if it burned."

So ICUs are adapting measures used at special biocontainment units like the one at the University of Nebraska. These units were designed to care for patients affected by bioterrorism or infected with particularly hazardous communicable diseases like SARS and Ebola.

The Nebraska biocontainment unit "received several patients early on in the pandemic who were medically evacuated from the Diamond Princess cruise ship," Hewlett says. But it didn't have enough beds for the large numbers of local patients who began arriving at the University of Nebraska Medical Center.

So the nurses, respiratory therapists and physicians from the biocontainment team have "fanned out and are now working within those COVID units to make sure that all of our principles and protocols are followed there as well," Hewlett says.

Those protocols involve measures like monitoring ICU staff when they remove their protective gear to make sure the virus isn't transmitted, and placing infected patients in negative pressure rooms, which draw air inward, when possible to prevent the virus from escaping.

One of the riskiest ICU procedures is inserting a breathing tube in a COVID-19 patient's airway, which creates a direct path for virus to escape from a patient's lungs. "If you're intubating a patient, that's a much higher risk than, say, going in and doing routine patient care," Hewlett says.

So ICU teams are being advised to add several layers of protection beyond a surgical mask.

Extra personal protective equipment may include an N95 respirator, goggles, a full face shield, a head hood, an impermeable isolation gown and double gloves.

In many ICUs, teams are also placing a clear plastic box or sheet over the patient's head and upper body before inserting the tube. And as a final safety measure, the doctor may guide the tube using a video camera rather than looking directly down a patient's airway.

"It usually takes 30 minutes or so in order to get all of that equipment together, to get all of the right people there," says Dr. Kira Newman, a senior resident physician at UW Medical Center in Seattle. "and that would be a particularly fast intubation."

But most changes in the ICU are in response to an ongoing flood of new information about how COVID-19 affects the body.

There's a growing understanding, for example, that the infection can cause dangerous blood clots to form in many severely ill patients. These clots can kill if they block arteries supplying the lungs or brain. But they also can prevent blood from reaching the kidneys or even a patient's arms and legs.

Clots are a known risk for all ICU patients, Cooperman says, but the frequency and severity appears much greater with COVID-19. "So we're starting them on a higher level of medicine to prevent blood clots and if somebody actually develops blood clots, we have a plan B and a plan C and a plan D," he says.

ICU teams are also recalibrating their approach to ensuring that patients are getting enough oxygen. Early in the pandemic, the idea was to put patients on mechanical ventilator quickly to make sure their oxygen levels didn't fall too far.

But with experience, doctors have found that mechanical ventilators don't seem to work as well for COVID patients as they do for patients with other lung problems. They've also learned that that many COVID-19 patients remain lucid and relatively comfortable even when the oxygen levels in their blood are extremely low.

So many specialists are now recommending alternatives to mechanical ventilation, even for some of the sickest patients. "We're really trying now to not intubate," Osborn says.

Instead, ICU teams are relying on devices that deliver oxygen through the nasal passages, or through a mask that fits tightly over the face. And there's renewed interest in an old technique to help patients breathe. It's called proning.

"Instead of them being on their back, we're turning them on their front," Osborn says. The reason, she says is to open up a part of the lung that is collapsed when a patient is on their back.

U.K. Surpasses Italy In Recorded Coronavirus Deaths, Now Leads Europe In Fatalities

Over 32,000 people have died from the new coronavirus in the United Kingdom, according to the Office for National Statistics, marking the first time in the pandemic that it has led Europe in the number of deaths.

The country has surpassed Italy in COVID-19 deaths. The U.S. still leads the world in the highest number of coronavirus deaths; over 70,270 had died from the disease as of Tuesday.

The number of total deaths recorded in the U.K. is "higher than we would wish, I think is all I can say," Angela McLean, chief scientific adviser of Ministry of Defence said during the country's press briefing Tuesday.

McLean also emphasized that deaths in U.K. care homes have been steadily rising and said the trend was something the country "need[s] to get to grips with."

"I don't think we'll get a real verdict on how well countries have done until the pandemic is over," British Foreign Secretary Dominic Raab said Tuesday. "And particularly until we have comprehensive international data on all causes of mortality."

Since different countries collect and report coronavirus data using different methods, the comparisons between regions are not perfect. As more time passes and more tests are conducted and more data comes in, coronavirus death rates will become more precise.

The peak in deaths comes as other European countries, including Italy and Spain, are easing shelter-in-place restrictions, while U.K. Prime Minister Boris Johnson is expected to modify Britain's orders in the next week.

Nursing Home Association Asks For $10 Billion In Federal Coronavirus Relief Funds

With more than 11,000 resident deaths, nursing homes have become the epicenter of the COVID-19 crisis. Now, they're asking the federal government for help — $10 billion worth of help.

The American Health Care Association, the trade organization for most nursing homes, called the impact on long-term care facilities "devastating." In a letter sent this week to the Federal Emergency Management Agency and Health and Human Services Secretary Alex Azar, they ask for the federal government to designate relief funding from the CARES Act for nursing homes the way it has for hospitals.

The money would be used for personal protective equipment, salaries for expanded staff, and hazard pay. In addition, some of the funds would make up lost revenue for nursing homes that have been unable to admit new residents because of the outbreak.

The AHCA also wants nursing homes to have more access to testing and some members of Congress want that too. This week, 87 members of the House of Representatives sent their own letter to Azar, as well as to Seema Verma, the administrator of the Centers for Medicare and Medicaid Services, which regulates nursing homes. The letter asks those agencies to direct states — which have received billions of dollars for increased testing — to give priority to long-term care facilities.

The letter also notes that nursing homes are now required to report their numbers of COVID-19 infections and deaths to the Centers for Disease Control and Prevention, but that they can't meaningfully do this unless they can test everyone in the facility.

Democrats in both the House and the Senate have also introduced legislation intended to make things safer for both nursing home staff and residents. The bill would require nursing homes to take a range of actions, from providing better infection prevention, to supplying sufficient protective gear, to protecting a resident's right to return to the nursing home after they've been treated for COVID-19 at a hospital.

U.S. Coronavirus Testing Still Falls Short. How's Your State Doing?

To safely phase out social distancing measures, the U.S. needs more diagnostic testing for the coronavirus, experts say. But how much more?

The Trump administration said on April 27 the U.S. will soon have enough capacity to conduct double the current amount of testing for active infections. The country has done nearly 248,000 tests daily on average in the last seven days, according to the nonprofit Covid Tracking Project. Doubling that would mean doing around 496,000 a day.

Will that be enough? What benchmark should states try to hit?

One prominent research group, Harvard's Global Health Institute, proposes that the U.S. should be doing more than 900,000 tests per day as a country. This projection, released Thursday, is a big jump from its earlier projection of testing need, which was between 500,000 and 600,000 daily.

Harvard's testing estimate increased, says Ashish Jha, director of the Global Health Institute, because the latest modeling shows that the outbreak in the U.S. is worse than projected earlier.

"Just in the last few weeks, all of the models have converged on many more people getting infected and many more people [dying]," he says.

But each state's specific need for testing varies depending on the size of its outbreak, explains Jha. The bigger the outbreak, the more testing is needed.

Thursday Jha's group at Harvard published a simulation that estimates the amount of testing needed in each state by May 15. In the graphic below, we compare these estimates with the average numbers of daily tests states are currently doing. (Jump to graphic)

Two ways to assess whether testing is adequate

To make their state-by-state estimates, the Harvard Global Health Institute group started from a model of future case counts. They calculated how much testing would be needed for a state to test all infected people and any close contacts they may have exposed the virus. (The simulation estimates testing 10 contacts on average.)

"Testing is outbreak control 101, because what testing lets you do is figure out who's infected and who's not," Jha says. "And that lets you separate out the infected people from the non infected people and bring the disease under control."

This approach is how communities can prevent outbreaks from flaring up. First, test all symptomatic people, then reach out to their close contacts and test them, and finally ask those who are infected or exposed to isolate themselves.

Our chart also shows another testing benchmark for each state: the ratio of tests conducted that come back positive. Communities that see around 10% or fewer positives among their test results are probably testing enough, the World Health Organization advises. If the rate is higher, they're likely missing a lot of active infections.

What is apparent from the data we present below is that many states are far from both the Harvard estimates and the 10% positive benchmark.

Just nine states are near or have exceeded the testing minimums estimated by Harvard; they are mostly larger, less populous states: Alaska, Hawaii, Montana, North Dakota, Oregon, Tennessee, Utah, West Virginia and Wyoming.

Several states with large outbreaks — New York, Massachusetts and Connecticut among others — are very far from the minimum testing target. Some states that are already relaxing their social-distancing restrictions, such as Georgia, Texas and Colorado, are far from the target too.

Jha offers several caveats about his group's estimates.

Estimates are directional not literal

Researchers at the Global Health Initiative at Harvard considered three different models of the U.S. coronavirus outbreak as a starting point for their testing estimates. They found that while there was significant variation in the projections of outbreak sizes, all the models tend to point in the same direction, i.e. if one model showed that a state needed significantly more testing, the others generally did too.

The model they used to create these estimates is the Youyang Gu COVID-19 Forecasts, which they say has tracked closely with what's actually happened on the ground. Still the researchers caution, these numbers are not meant to be taken literally but as a guide.

If social distancing is relaxed, testing needs may grow

The Harvard testing estimates are built on a model that assumes that states continue social distancing through May 15. And about half of states have already started lifting some of those.

Jha says, that without the right measures in place to contain spread, easing up could quickly lead to new cases.

"The moment you relax, the number of cases will start climbing. And therefore, the number of tests you need to keep your society, your state from having large outbreaks will also start climbing," warns Jha.

Testing alone is not enough

A community can't base the decision that it's safe to open up on testing data alone. States should also see a consistent decline in the number of cases, of two weeks at least, according to White House guidance. If their cases are instead increasing, they should assume the number of tests they need will increase too.

And Jha warns, testing is step one, but it won't contain an outbreak by itself. It needs to be part of "a much broader set of strategies and plans the states need to have in place" when they begin to reopen.

In fact, his group's model is built on the assumption that states are doing contact tracing and have plans to support isolation for infected or exposed people.

"I don't want anybody to just look at the number and say, we meet it and we're good to go," he says. "What this really is, is testing capacity in the context of having a really effective workforce of contact tracers."

The targets are floors not goals

States that have reached the estimated target should think of that as a starting point.

"We've always built these as the floor, the bare minimum," Jha says. More testing would be even better, allowing states to more rapidly tamp down case surges.

In fact, other experts have proposed the U.S. do even more testing. Paul Romer, a professor of economics at New York University proposed in a recent white paper that if the U.S. tested every resident, every two weeks, isolating those who test positive, it could stop the pandemic in its tracks.

Jha warns that without sufficient testing, and the infrastructure in place to trace and isolate contacts, there's a real risk that states — even those with few cases now — will see new large outbreaks. "I think what people have to remember is that the virus isn't gone. The disease isn't gone. And it's going to be with us for a while," he says.

Mystery Inflammatory Syndrome In Kids And Teens Likely Linked To COVID-19

Sixty-four children and teens in New York State are suspected of having a mysterious inflammatory syndrome that is believed to be linked to COVID-19, the New York Department of Health said in an alert issued Wednesday. A growing number of similar cases — including at least one death — have been reported in other parts of the U.S. and Europe, though the phenomenon is still not well-understood.

Pediatricians say parents should not panic; the condition remains extremely rare. But researchers also are taking a close look at this emerging syndrome, and say parents should be on the lookout for symptoms in their kids that might warrant a quick call to the doctor — a persistent high fever over several days and significant abdominal pains with repeated vomiting, after which the child does not feel better.

"If [the child is] looking particularly ill, you should definitely call the doctor," says Dr. Sean O'Leary, a pediatric infectious disease specialist at Children's Hospital Colorado Anschutz Medical Campus and member of the infectious disease committee for the American Academy of Pediatrics.

The new condition associated with COVID-19 is called Pediatric Multi-System Inflammatory Syndrome. Symptoms include persistent fever, extreme inflammation, and evidence of one or more organs that are not functioning properly, says cardiologist Jane Newburger, a professor of pediatrics at Harvard Medical School and director of the Kawasaki Program at Boston Children's Hospital.

"It's still very rare, but there's been a wave of cases. Physicians and scientists are working hard to understanding the mechanisms at play, and why only some children are so severely affected," Newburger says.

Some symptoms can resemble features of Kawasaki Disease Shock Syndrome. Kawasaki Disease is an acute illness in children involving fever, together with symptoms of rash, conjunctivitis, redness in the lips, tongue and mucous membranes of the mouth and throat, swollen hands and/or feet, and sometimes a large group of lymph nodes on one side of the neck, says Newburger. Some children with the condition develop enlargement of the coronary arteries and aneurysms in those blood vessels.

A small percentage of Kawasaki cases go on to develop symptoms of shock – which can include a steep drop in systolic blood pressure and difficulty with sufficient blood supply to the body's organs. Kawasaki disease and KDSS more often affect young children, although they can sometimes affect teens, Newburger says.

Some cases of the new inflammatory syndrome have features that overlap with KD or with KDSS — including rash, conjunctivitis, and swollen hands or feet. The new inflammatory syndrome can affect not only young children but also older children and teens.

But patients with the new syndrome have lab results that look very different, in particular, "cardiac inflammation to a greater degree than we typically see in Kawasaki shock syndrome," which is usually very rare, O'Leary says. In New York City and London, which have seen large numbers of cases of COVID-19 cases, "those types of patients are being seen with greater frequency."

Some patients "come in very, very sick," with low blood pressure and high fever, O'Leary says. Some children have had coronary artery aneurysms, though most have not, he adds.

Other patients exhibit symptoms more similar to toxic shock syndrome, with abdominal pain, vomiting and diarrhea and high levels of inflammation in the body, as well as the heart, O'Leary says. Most cases are treated in the intensive care unit, he says. Treatment includes intravenous immunoglobulin, which can "calm the immune system," says Newburger, as well as steroids and cytokine blockers.

The evidence so far from Europe, where reports of the syndrome first emerged, suggests most children will recover with proper supportive care, says O'Leary, though one adolescent, a 14-year-old boy in London, has died, according to a report published Wednesday in The Lancet.

Most children with the syndrome, O'Leary and Newburger note, have either tested positive for a current infection with the coronavirus, or for antibodies to the virus, which would suggest they were infected earlier and recovered from it.

And, according to case reports, some of the kids with the inflammatory syndrome who tested negative on coronavirus tests had been exposed at some point to someone known to have COVID-19. The inflammatory syndrome can appear days to weeks after COVID-19 illness, doctors say, suggesting the syndrome arises out of the immune system's response to the virus.

"One theory is that as one begins to make antibodies to SARS-COV-2, the antibody itself may be provoking an immune response," says Newburger. "This is only happening in susceptible individuals whose immune systems are built in a particular way. It doesn't happen in everybody. It's still a really uncommon event in children."

In late April, the U.K.'s National Health Service issued an alert to pediatricians about the syndrome. Reports have also surfaced in France, Spain and Italy, and probably number in the dozens globally, Newburger and O'Leary say, though doctors still don't have hard numbers. Newburger says there needs to be a registry where doctors can report cases "so we can begin to generate some statistics."

"Doctors across countries are talking to each other, but we need for there to be some structure and some science so that everybody can interpret," she says.

Earlier this week, the New York City Health Department issued an alert saying 15 children ranging in age from 2 to 15 had been hospitalized with the syndrome. Newburger says that she's been contacted about cases in New Jersey and Philadelphia, as well.

While the syndrome's precise connection to the coronavirus isn't yet clear, O'Leary says the fact that the children in most of these cases are testing positive for exposure to the virus, one way or another, provides one point of evidence. The sheer number of cases — small in absolute terms, but still "much higher than we would expect normally for things like severe Kawasaki or toxic shock syndrome" — provides another, he says.

And then there's the fact that most reports of the syndrome have come out of the U.K. and New York City, places that have been hit with large numbers of COVID-19 cases.

"It's pure speculation at this point," he says, "but the U.K. cluster kind of went up about a month after their COVID-19 infections went up, which would suggest that it is some kind of an immune phenomenon."

White House Rejected 'Overly Prescriptive' CDC Guidance For Reopening Communities

The White House coronavirus task force rejected detailed guidance drafted by the Centers for Disease Control and Prevention on how workplaces ranging from schools to bars to churches should resume operations to prevent the spread of the virus because it was viewed as "overly prescriptive."

President Trump has said he wants to see the country begin to reopen. The pandemic crashed the economy by keeping people at home, leading to millions of job losses. The White House task force issued guidelines on how to gradually and safely reopen but left decisions up to governors based on conditions in their states.

Experts have warned that a rush to reopen could have disastrous implications for containing COVID-19. Many businesses have said they want more details about how to do things safely.

The draft detailed guidance was provided to the task force in late April, a couple of weeks after it released its April 16 guidance to states for reopening.

The task force sought "certain revisions" to the CDC's detailed guidance, two administration officials told NPR. But revised recommendations were never returned to the task force.

The Associated Press first reported on the task force decision to shelve the detailed guidance. Copies obtained and published by the AP, The New York Times and The Washington Post revealed detailed, staged directions for child care centers, schools, camps, restaurants and bars, churches and mass transit providers about how to safely resume operations.

"I think many people would argue that it is not the role of the federal government to tell specific entities — whether they be schools or churches or businesses — how they should go about doing things because the nation is so diverse," one of the administration officials said.

The task force said that some of the points may be helpful, but they needed to "zoom out a little bit and not be so prescriptive," according to the official. The task force said they would welcome a new set of recommendations, but that never happened, the official said.

"Issuing overly specific instructions — that CDC leadership never cleared — for how various types of businesses open up would be overly prescriptive and broad for the various circumstances states are experiencing throughout the country," the second administration official said. "Guidance in rural Tennessee shouldn't be the same guidance for urban New York City."

The United States last month reached 1 million known coronavirus cases, representing one-third of all coronavirus cases worldwide. Nearly 74,000 Americans have been felled by the disease as of Thursday, according to data compiled by the Johns Hopkins Coronavirus Resource Center.

How What You Flush Is Helping Track Coronavirus

With coronavirus testing still lagging behind targets, many health officials are searching for other ways to assess the spread of the outbreak. One possibility? Looking at what we flush.

SARS-Cov-2 is often spread through sneezes and coughs, but it also leaves the human body through our waste. Scientists around the world are now testing sewage for the virus, using it as a collective sample to measure infection levels among thousands of people.

While the field of "wastewater epidemiology" existed before the coronavirus pandemic began, it's now rapidly expanding in the hope that it can become a front-line public health tool.

"Normally when I tell people I work with poo, they're not super interested," Stephanie Loeb, a post-doctoral researcher at Stanford University, told NPR in an interview over Skype. But, she says: "There's really a lot of information in our waste."

In the basement of a university building, Loeb pulls samples from freezers filled with vials of raw sewage, collected regularly from 25 wastewater treatment plants around California. Each is a snapshot of that community's health.

"It's this perfect mix, you know," says Krista Wigginton, a professor of environmental engineering at the University of Michigan, also working on the Stanford project. "The entire community is putting samples in at the same time."

She says by the time the virus reaches wastewater treatment plants, it's still possible to read its RNA.

"These are virus particles that are mostly intact, but that are no longer infective," Wigginton says. "That's what it looks like at this point."

The idea is that measuring overall virus levels in sewage over time could indicate whether an outbreak is growing or shrinking, potentially showing that trend earlier than patient testing would.

"That's a real-time measurement of what's happening in the community," says Wigginton. "Whereas some other tools we have, like the number of confirmed cases in clinics, sometimes those are delayed by quite a bit of time because people don't go get checked until maybe their illness has progressed by quite a bit."

The approach is already used for other diseases, such as polio. Health officials are working to eradicate polio around the globe and in Israel, an outbreak was spotted early through the wastewater system.

Stanford University isn't the only group working on coronavirus detection in sewage.

"We have a lot of nicknames," says Newsha Ghaeli, co-founder of the start-up Biobot. "I think some of our customers joke around that we're the 'sewer girls.'"

Biobot is currently testing sewage from about 150 communities across the U.S. Originally, the company was using sewage to monitor the opioid crisis, but quickly started offering coronavirus testing.

"It really caught fire," says Ghaeli. "Within ten days, we hit internal capacity."

Ghaeli says in some cities, they've been able to detect coronavirus in sewage the same week the first cases appeared. Other projects in France and the Netherlands have produced similar results.

In a more challenging scientific feat, the team is also working to estimate the number of individuals who have coronavirus in a community, based on the levels found in sewage.

Calculating that depends on knowing how much virus individuals shed, and some people seem to shed for a longer time than others, complicating the math. Other things could also affect the virus levels, such as how long it takes for the wastewater to reach the treatment plant and rainy weather, which causes runoff to flow in the sewage system in some communities, diluting the samples.

"There's a lot of research that needs to be done before we can say this number in wastewater means this many cases in the community," says Wigginton.

The advantage of testing sewage is that it may capture individuals who are less likely to go to a doctor's offices.

"Every person that is using the toilet has a voice," says Mariana Matus, Biobot's other cofounder. "And they can be taken into account for public health resources and prioritization of resources."

While it's still early in the technology's development, some see it being helpful in detecting new waves of the outbreak.

"I think it is potentially a new role that utilities can play," says Doug Yoder, deputy director of the Miami-Dade Water and Sewer Department in Florida, which serves 2.3 million people. "There has been, at the community level, not a whole lot of data about conditions community-wide."

Miami-Dade County has been sending sewage samples to Biobot for six weeks now, which have shown their virus levels going up and down a bit.

"We've seen in a couple instances the virus counts increase by a factor of six," he says. "And then the week following, it went back down. This data may not yet be ready for primetime in terms of community decision-making, but it has potential and promise for being able to see trends."

Health officials are eager for the information, he says, as one more way to gauge what's really happening with their local outbreak.

Will Antibodies After COVID-19 Illness Prevent Reinfection?

Most people infected with the novel coronavirus develop antibodies in response.

But scientists don't know whether people who have been exposed to the coronavirus will be immune for life, as is usually the case for the measles, or if the disease will return again and again, like the common cold.

"This to me is one of the big unanswered questions that we have," says Jeffrey Shaman, a professor of environmental health sciences at Columbia University, "because it really says, 'What is the full exit strategy to this and how long are we going to be contending with it?' "

He's one of many scientists on a quest for answers. And the pieces are starting to fall into place.

Antibodies, which are proteins found in the blood as part of the body's immune response to infection, are a sign that people could be developing immunity. But they are by no means a guarantee they will be protected for life – or even for a year.

Shaman has been studying four other coronaviruses that cause the common cold. "They're very common and so people seem to get them quite often," Shaman says. Ninety percent of people develop antibodies to those viruses, at least in passing, but "our evidence is those antibodies are not conferring protection."

That may simply because colds are relatively mild, so the immune system doesn't mount a full-blown response, suggests Dr. Stanley Perlman, a pediatrician who studies immunology and microbiology at the University of Iowa. "That's why people get colds over and over again," he says. "It doesn't really tickle the immune response that much."

He's studied one of the most severe coronaviruses, the one that causes SARS, and he's found that the degree of immunity depended on the severity of the disease. Sicker people remained immune for much longer, in some cases many years.

For most people exposed to the novel coronavirus, "I think in the short term you're going to get some protection," Perlman says. "It's really the time of the protection that matters."

Perlman notes that for some people the symptoms of COVID-19 are no worse than a cold, while for others they are severe. "That's why it's tricky," he says, to predict the breadth of an immune response.

And it's risky to assume that experiences with other coronaviruses are directly applicable to the new one.

"Unforutunately, we cannot really generalize what kind of immunity is needed to get protection against a virus unless we really learn more about the virus," says Akiko Iwasaki, a Howard Hughes Medical Institute investigator at the Yale University School of Medicine.

An immunobiologist, she is part of a rapidly expanding effort to figure this out. She and her colleagues are already studying the immune response in more than 100 patients in the medical school hospital. She's encouraged that most people who recover from the coronavirus have developed antibodies that neutralize the coronavirus in a petri dish.

"Whether that's happening inside the body we don't really know," she cautions.

Research like hers will answer that question, eventually.

But not all antibodies are protective. Iwasaki says some can actually contribute to the disease process and make the illness worse. These antibodies can contribute to inflammation and lead the body to overreact. That overreaction can even be deadly.

"Which types of antibodies protect the host versus those that enhance the disease? We really need to figure that out," she says.

The studies at Yale will follow patients for at least a year, to find out how slowly or quickly immunity might fade. "I wish there was a shortcut," Iwasaki says, "but we may not need to wait a year to understand what type of antibodies are protective."

That's because she and other immunologists are looking for patterns in the immune response that will identify people who have long-term immunity.

Researchers long ago figured out what biological features in the blood (called biomarkers) correlate with immunity to other diseases, says Dr. Kari Nadeau, a pediatrician and immunologist at the Stanford University School of Medicine. She expects researchers will be able to do the same for the new coronavirus.

Nadeau is working on several studies, including one that seeks to recruit 1,000 people who were previously exposed to the coronavirus. One goal is to identify people who produce especially strong, protective antibody responses. She says the antibody-producing cells from those people can potentially be turned into vaccines.

Another critical question she's zeroing in on is whether people who become immune are still capable of spreading the virus.

"Because you might be immune, you might have protected yourself against the virus," she says, "but it still might be in your body and you're giving it to others."

That would have huge public health implications if it turns out people can still spread the disease after they've recovered. Studies from China and South Korea seemed to suggest this was possible, though further studies have cast doubt on that as a significant feature of the disease.

Nadeau is also trying to figure out what can be said about the antibody blood-tests that are now starting to flood the market. There are two issues with these tests. First, a positive test may be a false-positive result, so it may be necessary to run a confirmatory test to get a credible answer. Second, it's not clear that a true positive test result really indicates a person is immune, and if so for how long.

Companies would like to be able to use these tests to identify people who can return to work without fear of spreading the coronavirus.

"I see a lot of business people wanting to do the best for their employees, and for good reason," Nadeau says. "And we can never say you're fully protected until we get enough [information]. But right now we're working hard to get the numbers we need to be able to see what constitutes protection and what does not."

It could be a matter of life or death to get this right. Answers to these questions are likely to come with the accumulation of information from many different labs. Fortunately, scientists around the world are working simultaneously to find answers.

Putting A Price On COVID-19 Treatment Remdesivir

Now that the Food and Drug Administration has authorized remdesivir for emergency use in seriously ill COVID-19 patients, the experimental drug is another step closer to full approval. That's when most drugs get price tags.

Gilead Sciences, which makes remdesivir, is donating its initial supply of 1.5 million doses, but the company has signaled it will need to start charging for the drug to make production sustainable. It's unclear when that decision might be made.

"Going forward, we will develop an approach that is guided by the principles of affordability and access," Gilead CEO Daniel O'Day told shareholders during the company's annual meeting Wednesday.

In a quarterly financial filing made the same day, Gilead said its investment in remdesivir this year "could be up to $1 billion or more," much of it for scaling up manufacturing capacity.

The company also acknowledged that it's in the spotlight. "[G]iven that COVID-19 has been designated as a pandemic and represents an urgent public health crisis, we are likely to face significant public attention and scrutiny about any future business models and pricing decisions with respect to remdesivir," Gilead said in the quarterly filing.

How will the company balance its business calculations with the drug's potential value to society?

"Gilead has not yet set a price for remdesivir," company spokeswoman Sonia Choi wrote in an email to NPR. "At this time, we are focused on ensuring access to remdesivir through our donation. Post-donation, we are committed to making remdesivir both accessible and affordable to governments and patients around the world."

Among potential treatments for COVID-19, remdesivir, an intravenous drug that was once studied for Ebola, is one of the furthest along.

"It's hard to imagine a situation in which there will be more public scrutiny," said Michael Carrier, a professor at Rutgers School of Law who specializes in antitrust and pharmaceuticals. "On the one hand, Gilead will try to recover its R&D in an atmosphere in which it is able to potentially make a lot of money. On the other hand, the pressure will be intense not to charge what's viewed as too high a price."

Breaking with its usual practices, the Institute for Clinical and Economic Review, or ICER, an influential nonprofit that analyzes drug pricing, issued an expedited report on remdesivir.

"Under normal circumstances, we would be unlikely to do a report when the evidence is this raw and immature," ICER President Steven Pearson said in an interview with NPR. "But it was quite clear that the world is moving at a much quicker pace."

If the price is based just on the cost of making the drug, then a 10-day course of remdesivir should cost about $10, according to the ICER report. (Gilead said results of a recently completed study suggest a five-day course of treatment may be just as effective.)

But if the drug is priced based on the drug's effectiveness, ICER estimates it should cost around $4,500 — assuming the drug is proven to have some benefit on mortality. If it doesn't and the drug only shortens hospital stays, that value-based price goes down to $390.

Results from a federally funded study described by Anthony Fauci, director of the National Institute for Allergy and Infectious Diseases, suggested that remdesvir could reduce recovery time by a median of four days — 11 days to recovery for patients treated with remdesivir compared with 15 days for those who got a placebo. A potential survival benefit is less clear.

Rutgers's Carrier said he expects Gilead to set the remdesivir price somewhere between the $10 and $4,500 that ICER estimated. The company has already shown that it can respond to public pressure when it asked the FDA to rescind the orphan drug status it won for remdesivir, he pointed out.

"When you see that $10 figure, that sets a benchmark for a figure that is eminently affordable," Carrier said. Ultimately, he said a price more than $1,000 per treatment course would be unpopular.

Gilead "will be watched very carefully," he said, because of its prior history of pricing. He referred to two other Gilead drugs that drew scrutiny over high price tags. The company charged $1,000 per pill for Sovaldi, a cure for hepatitis C. And its HIV drug Truvada can cost $22,000 per year.

But there is such a thing as pricing remdesivir too low, said Craig Garthwaite, who directs the health care program at Northwestern University's Kellogg School of Management.

"We don't think this is the only drug we need," he said, adding that remdesivir doesn't appear to be a "home run" against the coronavirus, based on existing data. "The thing that would worry me the most is that we're somehow telling people that if you take the risky bet to try, and you'll go after a coronavirus cure and you do it, you're not going to get paid."

Instead, he said he would like to see acceptance of a generous price for remdesivir to send the message to drug companies that the best thing they can do is "dedicate every waking moment to trying to develop that cure, and that if they do that, we will pay them the value they create," he said.

During a Gilead earnings call on April 30, analysts asked executives whether they could expect similar financial returns on remdesivir as they've seen with Gilead's other drugs.

"There is no rulebook out there, other than that we need to be very thoughtful about how we can make sure we provide access of our medicines to patients around the globe," Gilead CEO O'Day said. "And do that in a sustainable way for the company, for ... shareholders, and we acknowledge that."

On May 1, the FDA authorized remdesivir for emergency use, meaning it will be easier to administer to hospitalized patients with severe disease during the pandemic, but the drug is not yet officially approved. The federal government is coordinating distribution of the treatment.

Day acknowledged on the recent earnings call that the company "could" charge for remdesivir under an emergency use authorization, but he stressed that Gilead is donating its current supply, which should last through "early summer."

To date, the National Institutes of Health said it has obligated $23 million toward its COVID-19 remdesivir trial. And the U.S. Army Medical Research Institute of Infectious Diseases did some of the early in vitro and animal studies with the medicine prior to the pandemic.

"Taxpayers are often the angel investors in pharmaceutical research and development, yet this is not reflected in the prices they pay," Reps. Lloyd Doggett, D-Texas, and Rosa DeLauro, D-Conn., wrote in a April 30 letter to Health and Human Services Secretary Alex Azar.

Concerned about remdesivir's price, they asked for a full breakdown of taxpayer funds that have gone toward the development of the medicine. "An unaffordable drug is completely ineffective," they wrote in the letter. "The substantial taxpayer investments in COVID-19 pharmaceutical research must be recognized."

Reopening After COVID: The 3 Phases Recommended By The White House

President Trump wants states to begin relaxing stay-at-home orders and reopen businesses after the spread of the coronavirus pummeled the global economy and killed millions of jobs.

The White House coronavirus task force released guidelines on April 16 to encourage state governors to adopt a phased approach to lifting restrictions across the country. Some states have moved ahead without meeting the criteria.

The task force rejected a set of additional detailed draft recommendations for schools, restaurants, churches and mass transit systems from the Centers for Disease Control and Prevention that it considered "overly prescriptive."

A number of states have already begun to lift restrictions, allowing for businesses including hair salons, diners and tattoo parlors to once again begin accepting customers. Health experts have warned that reopening too quickly could result in a potential rebound in cases.

States are supposed to wait to begin lifting any restrictions until they have a 14-day "downward trajectory" of influenza-like illnesses and confirmed virus cases, as well as sufficient hospital capacity and testing for health care workers.

School Counselors Have A Message For Kids: 'It's OK To Not Be OK'

The high school senior sitting across from Franciene Sabens was in tears over the abrupt amputation of her social life and turmoil at home. Because of the coronavirus, there will be no prom, no traditional send-off or ceremony for the graduates of Carbondale Community High School in Carbondale, Ill. And Sabens, one of the school's counselors, could not give the girl the one thing Sabens' gut told her the teen needed most.

"I want to hug them all, but I really wanted to hug that one," Sabens remembers.

Instead of a desk between counselor and student, there were miles of Internet cable and a computer screen. No hug. No private office. This is Sabens' new normal.

"Zoom is just not gonna ever bridge that gap," she says. "That one was pretty rough."

The job of the school counselor has evolved over the years, from academic guide to something deeper: the adult in a school tasked with fostering students' social and emotional growth, a mental health first responder and a confidant for kids, especially teens, who often need a closed door and a sympathetic ear. But the closure of nearly all U.S. schools has forced counselors like Sabens to reimagine how they can do their jobs. And the stakes have never been higher.

Why students need counselors now more than ever

Between closed schools, social isolation, food scarcity and parental unemployment, the coronavirus pandemic has so destabilized kids' support systems that the result, counselors say, is genuinely traumatic.

Sarah Kirk, an elementary school counselor in Tulsa, Okla., is especially worried about her students who were already at-risk, whose families "really struggle day to day in their homes with how they're going to pay the next bill and how they're going to get food on the table. Being home for this extended period of time is definitely a trauma for them."

For so many children, Kirk says, "school is their safe place. They look forward to coming. They don't want to leave when the day is over. And to take that away from them, I do worry about the traumatic experience that will cause for many of our students."

Counselors say part of the trauma comes from students being isolated from each other.

"In a middle school, that social piece is so important," says Laura Ross, a middle school counselor in Lawrenceville, Ga. Yes, they do a lot of connecting via social media, and that's still happening, "but that face-to-face and being with their friends... they're missing that."

Students are also experiencing a kind of grief "over what they've lost," Sabens says, especially seniors. "Losing out on the end of their senior years — something that they've dreamed about their whole life... has really been overwhelming for them. So there have been a lot of tears. There have been a lot of questions... 'What did we ever do to deserve this?'"

Unfortunately, there are no easy answers. Instead, Sabens says, she tries to let students know "that it's OK to not be OK. I mean, most of the world is not OK right now... It's OK to grieve about what you're losing because it is tragic."

Brian Coleman, a high school counselor in Chicago, says trauma is nothing new to many of his students, but he hopes awareness of the potentially traumatic effects of school closures means "trauma-informed care is going to really, really explode in ideally healthy, meaningful ways."

That means school leaders should right now be planning for the future, asking how they can best support students when they come back to school, Ross says, "making sure that we're prepared to deal with some of those feelings that are going to increase — of anxiousness, of grief, of that disconnect that they had for so long."

Broken connections

Not only are many students grieving and struggling with new trauma, it's also harder now for school counselors to help them. That's because counselors have lost one of the most powerful tools they had before schools closed: access. Before, counselors could speak to entire classrooms about bullying and how to manage their feelings, plus they enjoyed office space where students could drop in for a quick visit or schedule a tough conversation.

"I think about my eighth graders," says Laura Ross in Lawrenceville. "My office is in their hallway. I mean, they just stop by to say hello. They stop by when they're upset, just to come in and talk and, you know, figure out their feelings."

But all of that has changed. Today, a face-to-face video meeting is the closest a counselor can get to the old ideal. Before that can happen, though, Sabens says she has to find her students.

"Email, email, email, email — lots of emails," she says, calling it her "primary mode of communication with the students."

Connecting is even more complicated for elementary school counselors whose students generally don't have cell phones or email addresses. In Tulsa, Sarah Kirk says this inability to speak directly with children is "exactly what keeps me up at night."

So far, Kirk has mostly been in contact with parents and caregivers. "That's whose [phone] number I have... But it's really up to the parent if they want to hand the phone over [to the student]." She worries that, if a child is not OK at home and needs help, she won't know.

Kirk's focus on these calls has also shifted away from academics toward "the basic needs of our kids... making sure they have enough food. We're making sure they're safe."

Evelyn Ramirez, a first-year middle school counselor in rural Redwood Valley, Calif., agrees: "Our main priority right now is just to check the welfare of each student."

Ramirez, a first-generation Mexican-American, says online learning can put additional strain on immigrant and low-income families. "I feel for the students whose parents don't know English or don't really know how to help their students."

"It's no longer private"

NPR spoke with counselors across the country, from California to Georgia, Oklahoma to Ohio, and nearly all said they worry about even the best-case scenario — when they're able to connect with a student face-to-face using video chat technology. Their fear: privacy.

At school, "we have some sort of office space... where students can feel like they're having a private conversation with counselors," says Coleman in Chicago. "Now we're asking them to be vulnerable in some capacity at home. And for so many students, home is a space where they're triggered or they don't feel comfortable sharing ... because it's no longer private."

Yes, the student's bedroom door may be closed, says Ramirez in Redwood Valley, but "at any given point, someone can walk in or, you know, mom's down in the living room. She can probably hear [our] conversation." And that might keep students from really opening up about things like basic stress or even abuse.

The same holds true for many elementary school counselors.

"We do small group counseling for kids [who] are adjusting to a variety of changes, and there's an element of confidentiality that's built into that group," says Marie Weller, an elementary school counselor in Delaware, Ohio. "So I can't do a group online. I can't use Canvas or Zoom or Google Hangouts for a group because I can't get the confidentiality. So [I'm] trying to figure out, how can I check in?"

Getting creative

In Lawrenceville, Laura Ross admits: These have been trying times. But there's also a surprising upside, she says. The distance from students has forced her to get creative about how she uses technology to build a bridge back to them.

Before the outbreak, Ross helped create an after-school club for students who identify as LGBTQ+. When school closed, Ross set up a Google Classroom and asked if the club's members wanted to continue to meet virtually. "They definitely did. And the reactions were just a relief that they were still going to have the support of that club... the place that they could truly be themselves."

Ross says they even meet at the same time each week, just on Zoom.

On her last day in the office, before Ohio closed its schools, Marie Weller remembers starting to leave — then hesitating beside the childlike puppets she sometimes uses in her classroom counseling presentations. "Huh," she thought. "Maybe I'll be able to use these."

Weller and her fellow elementary school counselors say one important part of their job is making sure all students have the social-emotional skills and coping strategies they'll need to navigate a complex world. How can they do that now, from home?

Weller improvised.

She set up a smartphone camera in her house, surrounded by those puppets — a kind of surrogate classroom audience — and set about recording mini counseling lessons from her kitchen. Instead of the chime she normally uses to begin a lesson, she rings a mixing bowl with a red spatula. To teach kids about how and why they should filter what they say, leaving hurtful thoughts unspoken, she opens the coffee maker to show them how a real, paper filter works.

Weller does her own editing and even got permission from folk music favorites The Irish Rovers to use their song "What's Cooking In The Kitchen" as her opening theme. The resulting videos are brief, rich and charming, with lines like, "Your brain's amygdala acts like a guard dog."

And in Tulsa, Sarah Kirk is doing something similar, posting videos where she's sitting on the floor of her house, surrounded by colorful pennants and stuffed animals. Her dog, Crew, a cuddly 80-pound sheepadoodle (nearly as big as Kirk), even makes a camera-blocking cameo.

In her first episode, Kirk read a story meant to reassure children she can no longer hug. It's about how we all have an invisible string that connects us, even when we're far apart.

Cal State Fullerton Announces Plans For A Virtual Fall. Will Other Colleges Follow?

On Monday, California State University, Fullerton announced it was planning to begin the fall 2020 semester online, making it one of the first colleges to disclose contingency plans for prolonged coronavirus disruptions.

"Our plan is to enter [the fall] virtually," said Pamella Oliver, the schools provost, at a virtual town hall. "Of course that could change depending on the situation, depending on what happens with COVID-19. But at this point that's what we're thinking."

The public institution in Southern California also said it hopes to resume in-person learning when it's safe to do so.

Oliver asked faculty to start planning for fall virtual classes now, citing the pain felt this spring when the university was forced to transition to online classes. "Having to jump quickly, without having in-depth plans," she said, "added to the difficulty."

Colleges and universities moved spring classes online, and many also closed campuses in response to the coronavirus pandemic. Schools are now grappling with how long the disruptions will last, and what the fall semester will look like, but many have been hesitant to announce their fall plans publicly.

College enrollment was already on a downward trend before the pandemic, making it a competitive field for college recruiters — every student they sign up counts. The big question is: Will students still enroll if college is all online? And will colleges that were already in dire financial straits survive the outbreak?

With Campuses Closed, Columbia And Pace Students Sue For Refunds

On Thursday, Columbia University and Pace University joined a growing number of colleges — including University of Miami, Drexel University and the University of Arizona — facing legal complaints aimed at their response to the coronavirus pandemic.

Thursday's suits were filed in federal court on behalf of Xaviera Marbury, a student at Pace, and an unnamed student at Columbia. Both complaints say students are owed reimbursement as well as damages for services that are no longer available now that campuses are closed. In both cases, those services include:

I. Face-to-face interaction with professors, mentors, and peers;
ii. Access to facilities such as computer labs, study rooms, laboratories, libraries, etc.;
iii. Student governance and student unions;
iv. Extra-curricular activities, groups, intramurals, etc.;
v. Student art, cultures, and other activities;
vi. Social development and independence;
vii. Hands-on learning and experimentation; and
viii. Networking and mentorship opportunities.

Marbury's complaint says her dorm rent costs $9,380 for the semester; she lost access to her dorm for approximately half the semester, the complaint says, but Pace is only offering to reimburse $2,000. Similarly, the Columbia complaint says that the student was refunded just 11% of their mandatory fees for the semester. The complaints also claim that though classes continue, their degree will eventually be worth less on the job market.

Marie Boster, a spokeswoman for Pace University, pointed out that the college is still offering services like tutoring and counseling along with classes remotely. "The faculty, staff and leaders of Pace continue to work tirelessly to support our students during this challenging time," she says. Columbia University had no comment on the suit.

The complaints, filed by a personal injury law firm in South Carolina, seek class action status on behalf of Columbia and Pace students. That same firm, Anastopoulo Law Firm, is also behind the suits against the University of Miami and Drexel.

"Universities are not delivering those services that students and their families have paid for," Anastopoulo attorney Roy T. Willey IV tells NPR. "It's not fair for the universities with multi-million dollar endowments to keep all of the money that students and their families have paid."

If the suits gain traction, the resulting damages would be a further blow to colleges already reeling from the financial impacts of the coronavirus. As NPR's Elissa Nadworny has reported, college endowments have taken a hit, some schools have begun to announce hiring freezes and others are looking at merging or closing their doors.

AP Exams Are Still On Amid Coronavirus, Raising Questions About Fairness

A lot is at stake for students taking Advanced Placement exams, even in normal times. If you score high enough, you can earn college credit. It's also a big factor in college applications. But for some students, the idea of studying right now feels impossible.

"I'm constantly thinking about making sure my family doesn't get sick and I don't get sick," says Elise, a high school junior outside Boston. (We're not using her full name because she's worried about hurting her college applications.)

Concerns about the coronavirus have put most standardized tests, such as the SAT and ACT, on hold this spring. But AP exams are going forward with a new online format — and that's raising questions about fairness.

Elise, 17, says she spent months preparing for what is typically a three-hour, multiple-choice and essay-based exam; she was blindsided when she learned it will now be an online, 45-minute, open-response test.

"I have no idea what I'm going to get when I open that test," she says.

Elise was hoping the College Board, which administers AP exams, would cancel this year's exams, as it did the spring SATs. But since the tests are being offered, she says she feels she has to take them. She worries it would look bad on her college applications if she opted out.

For other students, just the idea of taking the exam at home is causing anxiety. Kayleen Guzman, 17, from Boston says it's hard to find peace and quiet in her house right now.

"Currently, it's me, my mom, my dog, my sister and my stepdad," she explains. "Sometimes I feel like it's too much chaos."

But Guzman is glad she still has the opportunity to take the AP exams at all this year. She says she worked hard in her two AP classes and she wants the chance to earn college credit.

However, it's still unclear how much credit colleges will give students for this year's exams.

"None of us would say that we are confident that a 3 or 4 or 5 on the AP exam this year means the exact same thing as a 3, 4 and 5 on the exam last year," says Harvard University's Andrew Ho, who studies the reliability of educational tests.

Ho says that because of the new format, this year's AP exams won't be measuring the same thing as previous years' exams. For one, the new tests will cover less material. And changing where kids take it — from a proctored classroom to their laptops at home — is a big deal. But Ho adds, "Just because it's not completely comparable doesn't mean the College Board and colleges, through their own policies, couldn't adjust."

Some colleges are already adjusting. The University of California system has come out explicitly to say it won't change the way it credits AP scores. Other colleges that didn't want to go on the record say they are planning to change their policies, but the details weren't ready to share just yet.

In a statement, College Board spokesperson Jerome White said the organization decided to move forward with AP testing to give motivated students the opportunity to earn college credit. He added that the organization is making "a significant financial investment" to make the exams available online, from cheating prevention software to helping students who may not have an Internet connection or access to a computer.

Still, some educators worry that those efforts won't be enough.

"This situation has created a lot of distraction," says Savannah Lodge-Scharff, an AP Physics teacher for Boston Public Schools. She argues that without in-person classes, many students won't be able to engage with the material in the same way. On top of that, financial stress means many of her students are juggling additional responsibilities, like taking care of siblings.

"I have some of my students who are working 40, 50, 60 hours a week at the grocery store right now in the fear their parents are going to be laid off," she explains.

And then there's the question of geographic equity. This year's exams will be administered at the same time worldwide, meaning students in Hong Kong will be up at midnight to take it.

Court Rules Detroit Students Have Constitutional Right To An Education

In a landmark decision, a federal appeals court has ruled that children have a constitutional right to literacy, dealing a remarkable victory to students.

The ruling comes in response to a lawsuit brought by students of five Detroit schools, claiming that because of deteriorating buildings, teacher shortages and inadequate textbooks, the state of Michigan failed to provide them with the most fundamental of skills: the ability to read.

For decades, civil rights lawyers have tried to help students and families in underfunded schools by arguing that the U.S. Constitution guarantees children at least a basic education. Federal courts have consistently disagreed. Until now.

The ability to read and write is "essential" for a citizen to participate in American democracy, the 6th Circuit Court of Appeals ruled on Thursday. One cannot effectively vote, answer a jury summons, pay taxes or even read a road sign if illiterate, wrote Judge Eric Clay, and so where "a group of children is relegated to a school system that does not provide even a plausible chance to attain literacy, we hold that the Constitution provides them with a remedy."

"Like a daycare"

The 2016 complaint alleges that Michigan's then-Gov. Rick Snyder and the state's board of education denied Detroit students their fundamental right to literacy. It cites textbooks that were tattered, outdated and in such short supply that teachers could not send work home. The suit also describes school buildings that were in shocking disrepair: broken toilets and water fountains, leaking ceilings, shattered windows.

In warmer months, the complaint says, a lack of air-conditioning caused some students to faint; in winter, students regularly wore hats, coats and scarves to class. Students became accustomed to seeing cockroaches, mice or rats scurrying across the floor.

"You're sitting down in the classroom, and you see rodents in a corner. Or you can hear things crawling in the books," says Jamarria Hall, a plaintiff in the class-action suit, who graduated in 2017. "But the saddest thing of all was really the resources that they had, like, being in a class where there's 34 students, but there's only six textbooks."

Given these conditions, the five K-12 schools named in the complaint also struggled to retain teachers. Many classes were taught by paraprofessionals or inexperienced teachers placed through the Teach For America program. Often, Hall says, when teachers quit suddenly or didn't show up, students would simply be sent to the gym.

"For days on end — weeks on end — if the school didn't have a substitute or couldn't fill that gap, the gym was basically the go-to place. Or they would set students down in the classroom and really put on a movie, like Frozen... like a daycare," Hall remembers.

At one school, the complaint says, a math teacher quit soon after the school year began "due to frustration with large class sizes and lack of support. ... Eventually, the highest performing eighth grade student was asked to take over teaching both seventh and eighth grade math. This student taught both math classes for a month."

The complaint delivers a crushing assessment of these schools' failure to educate students: Proficiency rates "hover near zero in nearly all subject areas," it says.

"Illiteracy is the norm."

Previous legal efforts to argue that families in low-income, underfunded schools deserve better have run headlong into the U.S. Constitution, which makes no mention of the word "education," let alone a right to it.

One of the most famous cases, San Antonio Independent School District v. Rodriguez, made it all the way to the Supreme Court before the justices, in a 5-4 decision, ruled that families in poorer districts have no federal right to the same levels of funding as wealthier districts. They essentially said: The system isn't fair, but the U.S. government has no obligation to make it so.

In fact, the first judge to hear the current, Detroit case came to much the same conclusion.

U.S. District Judge Stephen Murphy dismissed the Michigan suit in 2018, writing that, yes, "literacy — and the opportunity to obtain it — is of incalculable importance," but not necessarily a fundamental right.

The students' lawyers disputed Murphy's reasoning and appealed his ruling, and, on Thursday, two of three judges took their side.

"We're not asking for a Cadillac"

In the past, many of the arguments used to pursue educational equity in the courts have been inherently comparative. Using the 14th Amendment's Equal Protection Clause, lawyers have focused on disparity — how one school or one district's resources compare to another's.

"This [case] is different," says Tacy Flint, a partner at Sidley Austin LLP and a lawyer for the plaintiffs. "It's not comparative. It's not a question of some people being treated worse than others. This fundamental right to a basic minimum education is a right that every child has."

Flint and her co-counsel focused more on a different pillar of the 14th Amendment, the Due Process Clause, saying the Constitution protects essential rights that "you can't imagine our constitutional democracy or our political life functioning without." And, Flint says, "access to literacy clearly fits that description."

Put simply: The plaintiffs' lawyers did not set out to level the playing field for all students. Instead, they attempted to use the appalling conditions of five Detroit schools to establish a floor.

"This case focuses squarely on literacy as the irreducible minimum," says Kristine Bowman, professor of law and education policy at Michigan State University.

And that minimum is pretty minimal.

"We're not asking for a Cadillac, or even a used, low-end Kia. We're asking for something more than the Flintstones' car," says co-counsel Evan Caminker, a former dean of the University of Michigan Law School.

In his dissent to Thursday's decision, Circuit Judge Eric Murphy argued that accepting literacy as a constitutional right would open a Pandora's box for states, and force federal courts to wrestle with questions beyond their purview: "May they compel states to raise their taxes to generate the needed [school] funds? Or order states to give parents vouchers so that they may choose different schools? How old may textbooks be before they become constitutionally outdated? What minimum amount of training must teachers receive? Which HVAC systems must public schools use?"

Murphy wrote that history, and legal precedent, are on his side: "The Supreme Court has refused to treat education as a fundamental right every time a party has asked it to do so."

After all, the judge reasoned, food, housing and medical care are also "critical for human flourishing and for the exercise of constitutional rights," but the Constitution "does not compel states to spend funds on these necessities of life." Why should education be any different?

A spokesperson for Michigan Gov. Gretchen Whitmer says her office is reviewing the court's decision before it decides what to do next. Whitmer's office also said in a statement that "the governor has a strong record on education and has always believed we have a responsibility to teach every child to read."

While the ruling is historic, it comes with several caveats. Basic literacy is a remarkably low standard to set for schools. As such, legal experts say, this ruling won't have an immediate impact on children in underfunded schools.

"We're not talking about the court having to recognize a broad-based, free-floating, generalized right to education," says Michelle Adams, a professor at Cardozo School of Law in New York City. This will not "open the floodgates of litigation. We're talking about a situation where students are being warehoused and required to be in school and yet they literally cannot read."

The case is also relatively young. The court's decision could be reviewed by the full 6th Circuit, appealed to the U.S. Supreme Court, or returned to play out in District Court. Whitmer's office has not yet indicated how the state will respond.

"The fight is not done yet," says Jamarria Hall, who is now living in Tallahassee, Fla., and taking classes at a community college. "We were fighting just to get into the ring. Now we're in the ring. Now the fight really starts."

DeVos To Use Coronavirus Relief Funds For Home Schooling 'Microgrants'

This week, U.S. Education Secretary Betsy DeVos announced that more than $300 million from the first coronavirus rescue package will go to two education grant competitions for K-12 and higher ed.

States will be able to apply for a piece of the $180 million allotted to the "Rethink K-12 Education Models Grant" and $127.5 million allotted to the "Reimagining Workforce Preparation Grant."

The money is 1% of the more than $30 billion set aside for education in the CARES Act. Those billions are intended to help states with the highest coronavirus burden.

States can access the money by creating proposals to fund virtual or work-based learning programs. The grant categories include two of DeVos' pre-existing pet policy ideas: "microgrants" that go directly to home-schooling families, and microcredentials that offer a shorter path to workforce preparation.

On the higher ed side, the secretary has long pushed for workforce-oriented education and shorter paths to a degree. She's been praised for this stance by online and for-profit colleges, while traditional institutions have been less sanguine.

Similarly, the secretary is a longtime advocate of alternatives to public schools, including home schooling. She has praised programs like Florida's Gardiner Scholarship, which provides up to $10,000 to the families of children with special needs to support home schooling. Last fall, DeVos proposed a $5 billion "Education Freedom Scholarship" program, which would have used federal tax credits to support, essentially, a voucher program that families could use both for private schools and home schooling.

While this week's announcement is significant for the policy directions it signals, it's a comparatively small amount of money. Education groups have asked the federal government for $200 billion (with a B) more in funds to maintain basic services.

6 Ways College Might Look Different In The Fall

What will happen on college campuses in the fall? It's a big question for families, students and the schools themselves.

A lot of what happens depends on factors outside the control of individual schools: Will there be more testing? Contact tracing? Enough physical space for distancing? Will the coronavirus have a second wave? Will any given state allow campuses to reopen?

For all of these questions, it's really too early to know the answers. But one thing is clear: Life, and learning for the nation's 20 million students in higher education, will be different.

"I don't think there's any scenario under which it's business as usual on American college campuses in the fall," says Nicholas Christakis, a sociologist and physician at Yale University.

So why are so many colleges announcing they will be back on campus in the fall?

In many cases, it's because they're still trying to woo students. A survey of college presidents found their most pressing concern right now is summer and fall enrollment. Even elite schools, typically more stable when it comes to enrollment, have reportedly been tapping their waitlists.

In the midst of all this uncertainty, it's worth looking at some of the ideas out there. With the help of Joshua Kim and Edward J. Maloney, professors and authors of the book Learning Innovation and the Future of Higher Education, here are some potential scenarios for reopening colleges and universities:

All virtual

Perhaps the most obvious option for the fall is to continue doing what they've been doing this spring. Colleges have signaled that they're planning for this option — even if it's a last resort. California State University, Fullerton, was one of the first to announce publicly it was planning for a fall semester online.

"Obviously we want to resume in-person teaching as soon as possible, but we also need to make sure that we're safe," says Ellen Treanor, who helps lead strategic communication at the school. Treanor says it made a lot of sense to assume the school would start online. "What would be the easier way to transition? It would be easier to transition beginning virtually and then transitioning in person," she said. "The faculty [needs] to be prepared."

With virtual classes, students can remain at home, although some colleges are exploring bringing them back to campus, where they could use the school's Wi-Fi to take online classes.

Delayed start

A delay in the semester would allow a school to wait it out until it was safer to reopen. One option is to push back a month or two, starting in October or November. Another idea is to push a normal start to January. In that case, the spring semester would become the fall semester, and potentially students could stay on campus through next summer to make up the spring semester. Boston University floated a version of this January start date when it announced a number of plans it was exploring.

One downside to a late start is what students will do in the meantime, especially those who don't have financial stability and rely on campus or the university to be a safe and stable home.

Some online, some face-to-face

This would be a hybrid model, with a combination of virtual and in-person classes. It may be a good choice for campuses that don't have enough classrooms to allow adjusting face-to-face teaching to the requirements of social distancing.

"You might have some of the larger classes being taught online simply because it's harder to imagine a 150- or 350-person classroom," says Maloney, who leads the Center for New Designs in Learning and Scholarship at Georgetown University. "So you might see that class split up into multiple sections." For large, entry-level classes, colleges may have a lecture component online and then meet in smaller groups in person.

"The hybrid model doesn't have to just be about modality," Maloney says. "It can be, but it could also be about fundamentally rethinking what the core structure has been for those large classes."

Of course, shifting larger classes online may not be enough, by itself, to alleviate the health concerns of having students on campus. Early research from Cornell University found that eliminating such classes didn't lessen student interactions with each other.

Shortened blocks

In block scheduling, students take just one course at a time for a shorter duration, typically three or four weeks. Colorado College, a liberal arts school south of Denver, has been using this model for 50 years. The college adopted this style of classes because "it allows [students] to take a deep dive and really focus in unique ways on the single subject," says Alan Townsend, the provost there. In a typical year, the school offers eight blocks.

In addition to its intensity, block scheduling is attractive right now because it allows flexibility. Colleges that use it have the opportunity to change the way classes look every three weeks — since there are multiple start and stop points. (With a semester, you have only a single start and then, often 16 weeks later, an end.)

"It's easier for us to now think creatively for next year," Townsend says. "Different students can make different choices. That's really hard to do with a semester-based system, but the blocks allow us to do that a little bit more flexibly."

The school is also entertaining the idea of sending faculty abroad to teach a block for international students who might not be able to enter the U.S, or adding summer blocks to give students even more opportunities to take classes.

Only some on campus

Some colleges have suggested bringing only freshmen back to campus and having upperclassmen either delay their start, or be online and remote.

The idea centers on research that shows just how important a student's first year of college is as a predictor of graduation. Adapting to campus can be a challenge, so this would allow first-year students to get comfortable and have extra support on campus.

Since upperclassmen are already familiar with how campus and classes work, the theory goes, they can more easily adapt to an online environment. Other versions of this approach would have students who have housing needs come back to campus first, and then, over time, phase in other groups of students.

All these options seek to keep the population density of the campus lower while still maintaining some face-to-face interactions.

On campus, with some changes

Social distancing, improved testing and contact tracing could help colleges reopen their campuses.

"Every school is trying to figure out a way to have students come back and do whatever we can while also protecting public health," says Learning Innovation co-author Joshua Kim, director of online programs and strategy at Dartmouth College.

"At the same time, we know that, however that works, things will be different. It's probably unlikely that we'll be able to cram students together in large, packed lecture halls or put doubles and triples in residence halls or have big events."

To follow social distancing, professors are measuring their classrooms, calculating how many students could fit in the space if they were 6 feet apart. Deans are planning out how students could enter and exit the classrooms safely.

But it's not just the classrooms that pose a challenge. For residential colleges, it's the dorms.

"Whether or not students are actually learning in the classroom, it's incredibly important for them to have an on-campus experience," Maloney says. So schools are thinking about how they can spread their students out, putting them in places where they normally wouldn't go.

Some ideas include housing students in offices that aren't being used, local hotel rooms or off-campus housing. Institutions are also reimagining campus events, like freshman orientation, since it's unlikely hundreds of students will be in a packed auditorium.

"Rethinking how we do everything we do at a university is part of the process," Maloney says.

Students Call College That Got Millions In Coronavirus Relief 'A Sham'

A for-profit college received millions of dollars from the federal government to help low-income students whose lives have been upended by the coronavirus outbreak, but that same school, Florida Career College (FCC), is also accused of defrauding students.

A federal class-action lawsuit filed on behalf of students in April calls FCC "a sham" and alleges that, long before the pandemic, the college was targeting economically vulnerable people of color. The plaintiffs say the vocational school enticed them with false promises of career training and job placement — but spent little on instruction while charging exorbitant prices and pushing students into loans they cannot repay.

The lawsuit comes as thousands of colleges across the country are receiving federal emergency relief in response to the coronavirus pandemic. Through the CARES Act, FCC has been allotted $17 million. The law requires that at least half of that money goes directly to students, but makes few stipulations for the rest of it.

Experts say the complaint against FCC raises serious concerns about the college's ability to safeguard taxpayer dollars, as well as its ability to serve its own students.

In a statement to NPR, Florida Career College General Counsel Aaron Mortensen says: "This lawsuit is baseless legally and factually. Though we cannot comment because the matter is in litigation, we will aggressively fight these false allegations."

Equipment was "at best limited, and at worse, nonexistent"

Plaintiff Kareem Britt was working as a cook when he noticed a Facebook ad for FCC.

"Are you tired of working minimum wage jobs? Eating ramen noodles?" the ad asked. "Are you ready to step up to steak? HVAC degrees make $16 to $23/hr."

An FCC representative told Britt that a degree could change his life and that the school would help him land a job. He qualified for a $6,000 federal Pell Grant and an FCC "scholarship loan" for $3,000. Britt decided to enroll in the HVAC training program.

After classes began, though, Britt says equipment necessary to learn the trade was in short supply. "Tools, machinery, and other learning devices were at best limited, and at worse, nonexistent," according to the complaint.

When it came time for the school to help Britt find a job, he says, FCC found him just two, two-week placements, and he failed to find HVAC work on his own. Making matters worse, once he'd finished school, Britt learned that he had also taken on federal loans worth $9,500, which he must now pay back as a hotel cook, the same kind of job he'd held before enrolling.

Reverse redlining

The complaint alleges that Florida Career College, along with its parent company, specifically targets economically vulnerable people of color.

"They are recruiting at majority Black high schools," says Toby Merrill, director of the Project on Predatory Student Lending at the Legal Services Center of Harvard Law School, one of the organizations representing the plaintiffs. "They are putting up billboards in towns where the population is mostly Black. And they're doing a lot of advertising on social media where you can choose to target your ad essentially by race."

Stephen Stewart is Jamaican and says he was drawn to an FCC ad on Instagram. He decided to visit campus, and says one word captures his experience: "pressure."

Like Britt, Stewart was considering FCC's HVAC program. After his tour, when a representative told him the program would cost more than $20,000, Stewart balked. He remembers the representative pushed, telling him: "'I know so many students that have went here... I'm talking about people with five, six kids in a worse situation than you're in.'" Stewart was 20 at the time and childless. "'You're telling me that they can go through this, make their payments and pay off their tuition, and you can't?'"

Stewart enrolled in FCC's HVAC program after being promised that, within a year, the school would find him a job in his field.

The complaint takes aim at these recruiting practices. It alleges that FCC is selling the promise of a career and financial success to cash-strapped communities of color where college feels out of reach, "discriminating against students on the basis of race by inducing them to purchase a worthless product by taking on debt they cannot repay."

According to Education Department data, 85% of FCC's students are people of color.

This practice of discriminating by targeting students of color has a name: Reverse redlining — a reference to the historical practice of excluding African-American families from home ownership and denying them access to services. Reverse redlining is illegal, and it's what sets this suit apart from previous legal battles over alleged predatory practices by for-profit colleges.

"In a weekly memo to my board last Friday, I said, 'So the new angle of attack against our sector is that we are predatory to minority communities,'" says Steve Gunderson, head of Career Education Colleges and Universities, an organization that serves as the national voice for career education schools like FCC.

"We have always celebrated the fact that approximately 45 to 50% of the students in our schools are African American and Hispanic," he says. "We're proud of that."

"Classes were a scam"

Long before the federal government granted FCC $17 million in pandemic relief, the school was already largely government-dependent. According to federal data, the lion's share of FCC's revenue — 86% — comes from federal financial aid funds, namely Pell Grants and student loans.

At the same time, federal data also suggest that the college fails to prepare many students for their chosen professions. Under an Obama-era rule known as "gainful employment," schools could lose access to federal aid if graduates don't earn enough income to repay their student debts. According to the complaint, 16 of the 17 FCC programs evaluated under the gainful employment rule failed that metric, meaning graduates weren't able to repay their loans. (The gainful employment rule was repealed in 2019.)

The median annual earnings of FCC graduates who ultimately found employment ranged from $8,983 to $32,871, according to the suit, which helps explain why, according to the most recent federal data, just 23% of FCC students have been able to pay down any of their loans' original balance within three years of leaving.

"Classes were a scam, a waste of time," says Stephen Stewart. The equipment was "limited" and "outdated," he says, and the instructor admitted to the class that he had little experience with HVAC. Stewart's worst day, though, came near the end of his nine-month program when he visited the career services department to ask when they'd help him find a job as they had promised.

Stewart says he was given a list of possible HVAC companies and told, "'You gotta get your job.'" So he did, with no help. But Stewart says it was clear that FCC hadn't given him the skills he needed to keep up in the job, let alone succeed, and he ultimately left. Today, Stewart is $15,000 in debt and says he feels "shattered" by the whole experience.

"The thing that upsets me the most about this is how much it preys upon people's hopes and dreams," says Ben Miller, who studies higher education accountability at the left-leaning Center for American Progress. "You know, you have a lot of folks who want to make a better life for themselves. They have maybe one shot at college, and you rip them off and basically ruin it."

But Gunderson takes a very different view, as head of the national association for postsecondary career colleges.

"[This lawsuit] is so frustrating, because this is nothing more than an organized national effort to destroy the reputation of the [career college] sector," he says.

Gunderson insists that career colleges, including FCC, have been held to unrealistic standards. He points to the gainful employment rule, which he says measured students' incomes relatively soon after graduation. "You've got to go into the five- or 10-year mark before most of these occupations have what you and I would call our respectable salaries."

But federal data also show that, even 10 years after enrolling in FCC, more than half of its students still didn't earn more than the typical high school graduate.

Gunderson says this lawsuit is just the latest salvo in a decade-long fight to discredit for-profit, career colleges — a fight he calls "monotonous and disappointing."

"Even if you're doing a terrible job"

The law requires that at least half of the $17 million FCC is receiving through the CARES Act must go directly to students, but makes few stipulations for the rest of those funds. In a letter, U.S. Education Secretary Betsy DeVos said institutions have "significant discretion" on how to award the assistance to students.

"We stand ready to deliver these funds," said Fardad Fateri, the head of FCC and its parent company, International Education Corporation, in a press release. "It is important we get these grants into the hands of our students right away, so they can better deal with this crisis."

FCC's $17 million is a small piece of the more than $14 billion lawmakers set aside in the CARES Act to help colleges and vulnerable students during the coronavirus pandemic. But Ben Miller says, in Congress' haste to help schools that serve low-income students, lawmakers are giving money to many schools with questionable records like FCC's.

"When there's no consideration of quality or outcomes, it's potentially a big award, even if you're doing a terrible job," Miller says.

Meanwhile DeVos has also championed separate policies that have made it easier for schools like FCC to continue to enroll students and receive federal student aid even as their graduates struggle. In 2019, DeVos repealed the Obama-era gainful employment rule that would have denied low-performing schools access to federal student aid.

Under the Trump administration, the Education Department has also changed the College Scorecard, a website meant to help prospective students compare colleges by price and performance. The department has removed easy access to schools' loan repayment rates. In 2018, it also removed another important metric: How the earnings of a school's graduates compared to the earnings of high school grads.

"Rather than highlighting institutions that show the best employment and loan repayment outcomes for students, this administration has made a concerted effort to hide this information from students with no explanation as to why," says Michael Itzkowitz, who was director of the College Scorecard during the Obama administration. "What's become more transparent is their willingness to prioritize certain institutions — namely for-profits — even if those aren't the best options for students choosing to pursue a postsecondary education."

The Education Department did not respond in time to requests for comment.

When students filed suit against the now-defunct for-profit Corinthian Colleges, claiming, like Britt and Stewart, that their schools had made promises about job placement and future earnings that they simply did not keep, DeVos revised another rule, known as "borrower defense," to make it more difficult for defrauded borrowers to get their money back. But the revision was so strict that 10 Senate Republicans joined with Democrats in March to rebuke the education secretary and reverse her decision.

Small, Private Colleges Get Boost From Coronavirus Relief Funds

When Congress allocated money for higher education in the coronavirus rescue package, it set aside nearly $350 million for colleges that had "significant unmet needs."

Most of that money has now been allotted by the U.S. Department of Education to small, private colleges that serve just a fraction of U.S. college students. Meanwhile, public colleges — which serve more than 70% of all college students — are facing a steep drop in state funding.

The 20 institutions that received the most amount of money from the unmet-need fund serve less than 3,000 students combined, and about half are religious schools — including Bible colleges and seminaries — several of which serve less than 100 students.

Lawmakers designed this unmet-need fund to give priority to any higher education institution that has received less than $500,000 through the CARES Act's other pots of funding. As a result, a school like Virginia Beach Theological Seminary, which serves 47 students, is eligible to receive $496,930 in federal aid.

"Imagine you had a special reserve fund to deal with a big crisis and you spent over 90% of that in one fell swoop on vacation tickets," or something that "wasn't as necessary in the moment," says Ben Miller, the vice president for postsecondary education at the left-leaning Center for American Progress. Miller argues larger public colleges, including community colleges that serve tens of thousands of students, should be getting more financial support. He calculates the department allocated more than $320 million of the $350 million on relief for small colleges, most of them private.

"As a result, they only have about 8% of the dollars they originally got here left to help any other college in the country that might be most affected," he says.

As with other CARES Act funding, in order to receive the money, an institution would still need to request it from the Department of Education.

Much of the CARES Act's more than $14 billion for higher education is being distributed according to the number of full-time low-income students a college serves, which is measured through federal Pell Grants.

The $350-million unmet-need fund followed a different formula. Miller says for this particular pot, schools that did not receive $500,000 or more from other available CARES Act funds were given the difference between what they did receive and $500,000 limit.

"So the result is that the smaller you are and the less money you've already gotten, the more you get from this program," Miller says.

But $350 million can only go so far. Education Secretary Betsy DeVos was given the discretion to choose which schools would benefit from the fund, and by how much.

Some schools were baffled when they learned they had been allotted hundreds of thousands of dollars in relief, and many weren't aware they were even eligible for the money. Brad Smith, the president of Bakke Graduate University in Dallas, which was allotted $497,338 in federal aid, says he didn't learn of his school's eligibility until he was contacted by NPR.

"I don't know anything about this," Smith says, noting that his school hadn't asked for additional federal help. "I'm taking responsibility to find out what it means."

An Education Department spokesperson tells NPR, "In order to receive this funding, an institution will need to request it. Any institution that does not need this money should simply decline to request it so schools will not be in the position of having to return unneeded funds."

The department says, once the requests are processed, any remaining funds will be redistributed through competitive grants.

Patt's Hats: Time for the rights of spring – color!

You don’t believe it looking out your windows in Southern California today, but spring it is. Perhaps I am forcing the spring by wearing bouquets on my stems – I think I can identify ranunculus, poppies, dianthus, and maybe roses?

I don’t know how authentically botanical fabric print designers think they ought to be, but I have an unshakable childhood recall of a bedroom in my great-grandmother’s house wallpapers in blue roses, and I was for years thereafter convinced that I could grow myself some blue roses.

And is there a happier color than this jacket’s coral/peach, or a springier fabric than the cotton-blend pique? It’s not as strenuous a shade as it would be in its brightness equivalent elsewhere on the color wheel, like electric blue or acid green. [And if it were, well, I’d wear it anyway!]

But the cloche hat – Daisy Buchanan, eat your platinum heart out. The ruched ombre silk ribbon on the crown and the minute bits of bent and curled ostrich feathers, like hatchlings on the hat! [I like saying that even more than I like writing it: "ruched ombre." It sounds like a fantastical concoction of molecular gastronomy: "the rambutan brûlée this evening is topped with ruched ombre."?     

Any bets on whether the May release of "The Great Gatsby" will revive 1920s chic? Who’s ready for dropped waistlines, lower heels and  long sautoir necklaces?

Confessions of a fair-weather Dodgers fan

There are 162 games in the regular season of a major league baseball team, and I have watched exactly … hm … none. Spring, summer, autumn, as the Dodgers died and rose from the dead, I wasn’t looking.

But now, like almost everyone else in L.A., I will be cheering them in the playoffs, cheering them to their first World Series game since Michael Dukakis ran for president.

I am that deplorable creature: The fair-weather fan.

I like sports just fine, but my sport is football.

They say baseball is a relaxing game. Boy, is it!  You can eat, doze, eat again, and it’s still the fourth inning. I’ve tried to love baseball, I really have. But the diamond can’t beat the gridiron when it comes to football’s built-in thrill advantage: At any possible second, the football can change hands, the defense becomes the offense … and score!

Just about the best time I ever had at Dodger Stadium was watching the pope round the bases in his Popemobile, when he visited L.A. That was the year before the Dodgers won the World Series for the last time. I hear baseball players are superstitious; maybe it’s time to invite the new pope for a return engagement.

Kitty Felde – now there’s a fan. She’s even written plays about baseball! But she’s way back in the nation’s capital, stuck with the Washington Nationals to root for.

A paradox

It’s a paradox, really. I’ve interviewed the former Dodgers owner, Peter O’Malley, who is a truly wonderful man. I’ve interviewed Carl Erskine, the Dodgers pitcher who goes back to the Brooklyn days, and a sweeter guy you could never meet. I know Roz Wyman, the First Fan, the city councilwoman who worked the magic to bring the Dodgers here from Brooklyn.  I interviewed the McCourts, back when they were still a plural. The L.A. Times once sent me to write about Fernando Valenzuela’s hometown in Mexico, back when El Zurdo started burning up the mound at Chavez Ravine. And I sat with that gift of a man, Vin Scully, at Dodger Stadium, as the team warmed up on the jewel-box beautiful field.

None of that made a true baseball believer of me. Instead, I pine like Juliet for a pro football team. O Dodgers, Dodgers, wherefore art thou the Dodgers, and not the Green Bay Packers?

But I would be thrilled if the Dodgers took the whole baseball enchilada – thrilled, because I am an Angeleno, and the Dodgers are that rare civic institution that ties us all together, even if you don’t know a base hit from base ten.

And that makes me as entitled as the next local to put on my Dodger Blue and holler my heart out, and cheer them all the way to the World Series.

2020 TCM Classic Film Festival Goes Virtual With Special Home Edition During COVID-19

Like all public events following the start of widespread stay-at-home orders from the state and federal government, the 2020 TCM Classic Film Festival was unfortunately cancelled this year due to health concerns posed by COVID-19. But festival faithful and classic film buffs won’t be left hanging this year.

Instead of a live, in person event, TCM decided to do a Special Home Edition of the annual festival that will air on the TCM Channel. The festival kicked off Thursday evening with a screening of the 1954 version of “A Star is Born” starring Judy Garland and James Mason and will include a number of films from past years’ festival lineups as well as ones that were slated for this year’s event. It ends late Sunday night (technically early Monday morning) with a screening of the 1982 film Victor/Victoria, for which Julie Andrews was slated to be in attendance at the 2020 festival before it was cancelled.

Today on FilmWeek, Turner Classic Movies hosts Ben Mankiewicz and Dave Karger join Larry Mantle to preview this year’s Special Home Edition of the TCM Classic Film Festival, talk about having to pivot due to the pandemic, and sharing some of their favorite films that are screening at this year’s event.

New Documentary Explores History, Legacy Of Iconic LGBTQ Bookstore ‘Circus Of Books’ Through The Owners’ Daughter’s Eyes

Rachel Mason had, to a certain extent, the normal upbringing you’d imagine a family of five with small business owner parents would have. But in her documentary, ‘Circus of Books’, she pulls the curtain on the double-life her parents led as modest business owners and pillars of the LGBTQ community.

Karen and Barry Mason established West Hollywood’s Circus of Books on Santa Monica Boulevard in the 1980s. What seemed like an unassuming bookstore was actually a gay porn shop that became an institution in the LGBTQ community during a time when homosexuality was still largely unaccepted. The store was far from being a “bookstore with a circus theme”. The Los Angeles-based shop was the central hub for gay pornography around the country, once one of the main distributors for adult films. 

While the store was becoming a home for gay culture and pride, the Masons largely kept their business a secret from colleagues, friends, family, even their own children. It’s a central conflict that Rachel Mason explores throughout the film as the daughter of two shop owners caught between the pressures of maintaining a traditional family image and making a living as gay pornography distributors.

Today on FilmWeek, we’re joined by ‘Circus of Books’ director Rachel Mason for a conversation on her documentary and the experience of creating a film with her parents and their secret as the subject.

With signing of insurance bill, Lyft, Uber ridesharing loophole comes to an end

Amid all the talk about cutting-edge technology, much of Uber and Lyft’s success actually owes to that fact the ride-sharing companies have been able to exploit a basic loophole: The companies foist the cost of insurance on their drivers, but the drivers' insurance companies don’t know they are underwriting cars for hire, and even if drivers wanted to be honest and get a policy that would cover ride-sharing, they couldn’t, because no such policy exists.

AB-2293, introduced by Assemblywoman Susan Bonilla (D-Concord) and signed into law Wednesday by Governor Jerry Brown, tries to close the loophole by paving the way for insurance companies to offer hybrid personal/commercial policies by next summer.

Uber once derided the bill as a backroom deal between insurance companies and trial lawyers.

"The bill does nothing to enhance safety, yet compromises the transportation choices and entrepreneurial opportunities Uber offers Californians," the company wrote in a June blog post that encouraged customers to contact their representatives opposing the bill.

However, the company backed down and supported the legislation when Bonilla insurance requirements were lowered.

AB 2293 also specifically bans drivers from using their personal policies and mandates drivers have to be covered from the moment they turn on their app and look for customers, which is a response to the tragic accident on New Year's Eve in San Francisco when an UberX driver hit and killed a six year old child.

Uber argued that because the driver was waiting for a fare he wasn't working for the company at the time, so he wasn't covered by the company's insurance.
