Twelve individuals, including three medical doctors, a doctor of osteopathy and a chiropractor, were charged today in the Eastern District of New York for their roles in separate health care fraud schemes that resulted in the submission of more than $95 million in false claims to the Medicare program.

"OJP’s mission is to increase public safety and improve the fair administration of justice across America through innovative leadership and programs," said Assistant Attorney General Robinson.

Zafar Mehmood, 45, allegedly masterminded a $30 million scheme involving the submission of fraudulent claims submitted to Medicare for services that were medically unnecessary and/or never provided through at least four home health agencies.

Justin A. Dedemko, 28, of Brooklyn, N.Y., pleaded guilty today before U.S. District Judge Anthony J. Trenga in the Alexandria Division of the Eastern District of Virginia.

Former Lincoln County, Mo., Sheriff’s Office Detective Scott Edwards, 49, of Troy, Mo. was indicted on civil rights charges for violating the constitutional rights of five women through acts of aggravated sexual abuse and sexual contact.

Two individuals – a loan officer and a title agent – have been sentenced by U.S. District Court Judge William P. Dimitrouleas in Ft. Lauderdale, Fla., for their participation in a nationwide $2.5 million reverse mortgage fraud scheme.

The Justice Department announced today that the Civil Rights Division will monitor elections on Nov. 8, 2011, in Alameda County, Calif.; Springfield, Mass.; Humphreys, Leflore, Panola and Wilkinson Counties, Miss.; Lorain County, Ohio; and Jasper, Texas.

The United States alleged that the Pompano Beach, Fla.,and Jacksboro, Tenn., companies manufactured and sold Zylon bulletproof vests despite possessing information showing that the Zylon materials degraded quickly over time and were not suitable for ballistic use.

Beatriz Torres-Cruz, 50, pleaded guilty before U.S. District Judge Joan A. Lenard in Miami to one count of conspiracy to commit health care fraud and one count of solicitation of health care kickbacks.

Michael Eisenberg, a resident of Long Island, N.Y., was sentenced Monday in connection with a series of fraudulent business opportunity ventures.

Carlos Mario Jimenez-Naranjo, aka “Macaco,” a paramilitary leader and one of Colombia’s most notorious drug traffickers, has been sentenced to 33 years in prison.

Daniel Solomon, 39, pleaded guilty before U.S. District Judge Lloyd D. George in the District of Nevada to one count of conspiracy to commit mail and wire fraud.

Denise Keser, 44, pleaded guilty before U.S. District Judge Gloria M. Navarro in the District of Nevada to one count of conspiracy to commit mail and wire fraud. Keser is the tenth person to plead guilty in connection with the scheme to defraud HOAs in the Las Vegas area.

Federal officials announced a civil settlement with the state of California Department of Transportation (Caltrans) resolving claims brought by the Presidio Trust and the U.S. Army resulting from Caltrans’ construction and operation of Highway 1 (also known as Park Presidio Boulevard) through the Presidio of San Francisco.

The Justice Department announced today that District Court Judge David C. Godbey has granted the request of the department and Dallas County to end court supervision of a lawsuit concerning conditions at the Dallas County Jail.

"We believe that enacting the SAVE Act will strengthen tribal jurisdiction over crimes of domestic violence, tribal protection orders, and Federal assault prosecutions," said Associate Attorney General Perrelli.

The agreement represents approximately 20 percent of the estimated $37.5 million in forfeited assets located in the Dominican Republic that stem from a conspiracy led by brothers Carlos, Luis and Jose Benitez, who allegedly defrauded the U.S. Medicare program of approximately $80 million.

Isabel Roque, 55, pleaded guilty before U.S. Magistrate Judge Edwin G. Torres in Miami to one count of conspiracy to commit health care fraud. Roque was the president of Isa & Yami Inc., which purported to provide patient transportation services in Miami.

The Justice Department announced today that it has opened a civil investigation into allegations of excessive use of deadly force by members of the city of Miami Police Department (MPD), in accordance with the pattern or practice provision of the Violent Crime Control and Law Enforcement Act of 1994.

David Lewalski, 48, was sentenced by U.S. District Judge James D. Whittemore. The court also ordered Lewalski to forfeit $29.8 million and numerous computers and computer equipment that are traceable to proceeds of the offense.

The Justice Department today filed a lawsuit against the owners and managers of 23 rental homes in Magee, Miss., for violating the Fair Housing Act by discriminating against families with children.

Mine S. Pase, 62, of Pago Pago, American Samoa, pleaded guilty to a one-count criminal information in U.S. District Court for the District of Columbia before U.S. District Judge Reggie B. Walton.

The 15-count third superseding indictment returned by the federal grand jury on Nov. 16, 2011, and unsealed today in Hammond includes 15 new defendants who are charged with conspiracy to engage in racketeering activity from August 1989 until the date of the third superseding indictment.

Jorge Luis Castillo, 56, a resident of New Jersey, pleaded guilty before U.S. District Judge John A. Gibney in the Eastern District of Virginia to conspiring to commit mail and wire fraud, which carries a maximum penalty of 20 years in prison.

The Justice Department today announced that Roger Harris, Hediger Enterprises Inc., Carroll Management Group, Forum Manor Associates L.P. and Forum Manor LLC have agreed to pay $295,000 in monetary damages and civil penalties to resolve a Fair Housing Act lawsuit alleging sexual harassment, race and sex discrimination, retaliation and intimidation at Forum Manor Apartments, a federally-subsidized apartment complex in Rolla, Missouri.

New Jersey-based dietary supplement companies Quality Formulation Laboratories Inc. and American Sports Nutrition Inc., as well as their owner and managers, were sentenced today for multiple counts of criminal contempt of court for violating a consent decree entered by the U.S. District Court for the District of New Jersey on March 16, 2010.

The owner and the former vice president for corporate strategy of Viable Communications Inc. were each sentenced yesterday to 108 months and 55 months in prison, respectively, for their roles in a scheme that defrauded the Federal Communications Commission (FCC) of at least $20 million.

Joaquin Tasis was sentenced today to 78 months in prison for his role in a $9.1 million Detroit-area Medicare fraud scheme, announced the Department of Justice, the FBI and the Department of Health and Human Services (HHS).

“The tragedy at Upper Big Branch will never be forgotten, and the families affected by it will never be made completely whole again. Today’s agreement represents the largest-ever resolution in a criminal investigation of a mine disaster and will ensure appropriate steps are taken to improve mine safety now and will fund research to enhance mine safety in the future,” said Attorney General Holder.

The Department of Justice today filed a lawsuit against the University of California, San Diego Medical Center, alleging that the medical center discriminated in the employment eligibility verification process against people who are authorized to work in the United States.

KV Pharmaceutical Company, which was the St. Louis-based parent company of now-defunct Ethex Corporation, will pay $17 million to resolve False Claims Act allegations that Ethex failed to advise the Centers for Medicare and Medicaid Services (CMS) that two unapproved products did not qualify for coverage under federal health care programs, the Justice Department announced today.

Jose Nunez, 63, Luisa Morciego, 40, and Eneida Fry, 46, were sentenced yesterday in Miami federal court for their participation in a $25 million home health Medicare fraud scheme, announced the Department of Justice, the FBI and the Department of Health and Human Services (HHS).

Penny Jones, a resident of Rigby, Idaho; Christopher Marrero of Davie, Fla.; Michael D. Beiter, Jr., formerly a resident of Coral Springs, Fla.; David Clum Jr. of Whites Creek, Tenn.; Dale Peters, a resident of San Mateo, Calif., Laura Barel, a resident of Lauderhill, Fla.; and John Michael Smith, Jr. of Hidden Hills, Calif., have been charged with participating in the scheme to file false tax returns.

The Justice Department today announced a settlement of its lawsuit against the owners, developers, architect and civil engineers of Park Place Apartments, a 276-unit complex in Louisville, Ky., resolving allegations that those involved in the design and construction of the complex discriminated against people with disabilities.

"The pillars of the division’s work are civil merger and non-merger enforcement, criminal enforcement, competition advocacy, and international activities and we have been active in all those areas," said Acting Assistant Attorney General Pozen.

Wachovia Bank N.A., which is now known as Wells Fargo Bank N.A., has entered into an agreement with the Department of Justice to resolve the company’s role in anticompetitive activity in the municipal bond investments market and has agreed to pay a total of $148 million in restitution, penalties and disgorgement to federal and state agencies.

Adrian-Tiberiu Oprea, 27, of Constanta, Romania; Iulian Dolan, 27, of Craiova, Romania; Cezar Iulian Butu, 26, of Ploiesti, Romania; and Florin Radu, 23, of Rimnicu Vilcea, Romania, were charged in a four-count indictment filed in the District of New Hampshire with conspiracy to commit computer fraud, wire fraud and access device fraud.
