Per-Song or Per-Album? Record Labels Challenge Court’s Piracy Damages Ruling

Several major record labels are asking the Fifth Circuit Court of Appeals for a rehearing en banc in their piracy lawsuit against Grande Communications. They argue that the court erred in holding that piracy damages should be calculated per album, rather than per song. They argue that this decision, which will lower the $47 million damages award, doesn't reflect the way that music is commercialized today.

Analog Equivalent Rights (17/21): The Previous Inviolability of Diaries

Privacy: For our analog parents, a diary or a personal letter could rarely be touched by authorities, not even by law enforcement searching for evidence of a crime. Objects such as these had protection over and above the constitutional privacy safeguards. For our digital children, however, the equivalent diaries and letters aren’t even considered worthy of basic constitutional privacy.

In most jurisdictions, there is a constitutional right to privacy. Law enforcement in such countries can’t just walk in and read somebody’s mail, wiretap their phonecalls, or track their IP addresses. They need a prior court order to do so, which in turn is based on a concrete suspicion of a serious crime: the general case is that you have a right to privacy, and violations of this rule are the exception, not the norm.

However, there’s usually a layer of protection over and above this: even if and when law enforcement gets permission from a judge to violate somebody’s privacy in the form of a search warrant of their home, there are certain things that may not be touched unless specific and additional permissions are granted by the same type of judge. This class of items includes the most private of the personal: private letters, diaries, and so on.

Of course, this is only true in the analog world of our parents. Even though the letter of the law is the same, this protection doesn’t apply at all to the digital world of our children, to their diaries and letters.

Because the modern diary is kept on a computer. If not on a desktop computer, then certainly on a mobile handheld one — what we’d call a “phone” for historical reasons, but what’s really a handheld computer.

And a computer is a work tool in the analog world of our parents. There are loads of precedent cases that establish any form of electronic device as a work tool, dating back well into the analog world, and law enforcement is falling back on all of them with vigor, even now that our digital devices are holding our diaries, personal letters, and other items far more private than an analog diary was ever capable of.

That’s right: whereas your parents’ diaries were extremely protected under the law of the land, your children’s diaries — no less private to them, than those of your parents were to your parents — are as protected from search and seizure as an ordinary steel wrench in a random workshop.

So the question is how we got from point A to point B here? Why are the Police, who know that they can’t touch an analog diary during a house search, instantly grabbing mobile phones which serve the same purpose for our children?

“Because they can”, is the short answer. “Also because nobody put their foot down” for advanced points on the civics course. It’s because some people saw short term political points in being “tough on crime” and completely erasing hard-won rights in the process.

Encrypt everything.

EUBrazilOpenBio final newsletter is now available

The final EUBrazilOpenBio newsletter for November 2013 is now available. The  newsletter presents the final press release showcasing the main results of 2 year collaborative work, namely: the innovative, web-based working environment designed to serve biodiversity scenarios; the new version of the Catalogue of Life cross-mapping tool developed in the i4Life project; the provision of the Ecological Niche Modelling tool as a service through the openModeller extended web service, and its application in collaboration with BioVeL; the EUBrazilOpenBio Joint Action Plan.

This newsletter highlights:

  • EUBrazilOpenBio Joint Action Plan - drawing on policy strategies, analysing  current progress in contributing to international targets and defining actions for future collaborative research. It defines common actions with the aim of contributing to relevant Aichi Targets in the years ahead.
  • EGI federatec use case on ecology - Over the last two years, BioVeL and EUBrazilOpenBio have joined forces to make openModeller ready for cloud deployment. Work within the EGI Federated Cloud Task Force has led to considerable success in enabling the openModeller service on the EGI Federated Cloud.

8th GEO European Projects Workshop (GEPW-8): Presentations and photgraphs are now available

The  8th GEO European Projects Workshop (GEPW-8) took place in Athens, Greece, on 12 and 13 June, hosted by the Greek GEO Office - National Observatory of Athens and co-organized by the Mariolopoulos-Kanaginis Foundation for the Environmental Sciences.

The event was intended to bring all those interested in and actively contributing to the Global Earth Observations System of Systems (GEOSS) from all over Europe together, in order to present their work and discuss how Europe can contribute to this international effort, especially in the wake of the launch of the new EU Framework Programme for Research, Horizon 2020, and renewal of the mandate of GEO for another 10 years through the endorsement of the 2014 Geneva Declaration.

Oral presentations, a book of abstracts and the photos from the event are now uploaded and available for download on the events website.

The GEO BON bi-annual progress report is now available

The new GEO BON bi-annual report is now published. It provides an overview of the activities developed by our network over the last two years. It starts with a brief presentation of the GEO BON mission and structure.

It also presents the two core activities of GEO BON: the development of the Essential Biodiversity Variables framework and of the Bon-in-a-Box toolkit. The different national, regional and thematic biodiversity observation networks associated with GEO BON are presented. The report highlights the most important activities from each of the nine working groups of GEO BON, where experts around the world work around specific biodiversity monitoring topics.

Workshop "iMarine data platform for collaborations"

A key goal of the iMarine initiative is to support stakeholders in a sustainable use of the marine ecosystem. 

On 7th March 2014, iMarine is organizing an interactive workshop "iMarine data platform for collaborations" to showcase how its powerful data infrastructure is capable of addressing the challenges of the Ecosystem Approach. 

The workshop also offers important opportunities to work together on developing plans related to iMarine sustainability, such as the public partnership model concept, as well as engage new potential users and partners for the future. 

The workshop is co-located with the Fishery Dependent Information conference and will take place at Food and Agriculture Organisation of the United Nations (FAO) headquarters, Viale delle Terme di Caracalla, 00153 Rome, Italy. 

Participation is free of charge but subject to registration.

4th EU BON Roundtable: Pathways to sustainability for EU BONs network of collaborators and technical infrastructure

The 4th EU BON roundtable will take place on Thursday, 17 November 2016 at the premises of the Museum fuer Naturkunde in Berlin with the motto "Pathways to sustainability for EU BONs network of collaborators and technical infrastructure".  

One of the key questions will be how to achieve sustainability for the many different products of EU BON, such as tools, software, models and infrastructure after the project ends. It should be discussed how a European Biodiversity Observation Network and its essential components could be sustained after the project will end in May 2017, by which institutions or networks and how the products can be used in the best way for European policy and research needs.
