BISHKEK, 28 July 2016 – A two-day training conducted by the OSCE Centre in Bishkek for 14 defence lawyers and 12 officers from the Prosecutor’s office on the right to liberty and freedom from arbitrary arrest or detention, ended today in the Kyrgyz capital.

The workshop focused on the international framework for measures of restraint, as well as the internationally recognized constitutional right to institute proceedings in cases of violations.

The detention of minors, persons with disabilities, women with children, or defendants in need of continued medical treatment and hospitalization were among the topics discussed, and participants learned more about their specific concerns to ensure that the restraint measures taken comply with human rights standards.

“The right to liberty is a basic fundamental right, protected by international human rights law and enshrined in the Kyrgyz Constitution,” said Anete Erdmane, acting Senior Human Dimension Officer at the OSCE Centre. “To ensure that restrictions on liberty are applied in compliance with the law and that other human rights are not violated as a result of the deprivation of liberty, it is important that prosecutors and lawyers are aware of the relevant standards and obligations. In line with its mandate, the OSCE Centre works to improve the administration of justice and strengthen the rule of law in Kyrgyzstan.”

The course was delivered by Ulugbek Azimov, a well-known national expert in the field, while  Sergey Poduzov, an international human rights law expert from Russia, also led a training session.

The training course is part of the OSCE Centre’s project on promoting a comprehensive approach to the rule of law, administration of justice, prevention of torture, and capacity building. 

The company’s 83-year-old chairman, John Malone, will be the interim CEO.

From the USCCB – June 4, 2018 – Today, the U.S. Supreme Court decided the case of Masterpiece Cakeshop v. Colorado Civil Rights Commission. The case involves a Christian baker named Jack Phillips who declined in 2012 to create a custom wedding cake for a same-sex ceremony. State officials sought to compel Phillips to create such cakes under Colorado’s public accommodations law. The Supreme Court ruled 7-2 in favor of Phillips under the Free Exercise Clause of the First Amendment to the U.S. Constitution. Archbishop Joseph E. Kurtz of Louisville, Chairman of the Committee for Religious Liberty, Archbishop Charles J. Chaput, O.F.M. Cap., of Philadelphia, Chairman of the Committee on Laity, Marriage, Family Life and Youth, and Bishop James D. Conley of Lincoln, Chairman of the Subcommittee for the Promotion and Defense of Marriage of the U.S. Conference of Catholic Bishops (USCCB), issued the following joint statement: “Today’s decision confirms that people of faith should not suffer discrimination on account of their deeply held religious beliefs, but instead should be respected by government officials. This extends to creative professionals, such as Jack Phillips, who seek to serve the Lord in every aspect of their daily lives. (United States Third Circuit) - Affirming the dismissal of an in rem suit filed against a ship for cargo damage sustained in transit because liability for the damage was covered by the carrier's bill of lading, which included a forum selection clause requiring suit be brought in South Korea because although South Korean courts would not allow an in rem suit, the plaintiff could have brought an in personam suit and chose not to do so for strategic reasons and the foreign forum selection clause did not violate the Carriage of Goods by Sea Act.

(California Court of Appeal) - Affirmed an order voiding a default judgment on procedural grounds. Held that the complaint did not provide adequate notice to sustain a default because it failed to specify the amount of damages that the plaintiff was seeking, and instead merely prayed for "damages according to proof," in this lawsuit related to the construction of a hotel.
