Iran hanged a 26-year-old man for a second time Wednesday months after a previous execution was halted half a minute in, an NGO said. Ahmad Alizadeh was arrested in October 2018 on a murder charge, which he denied, and was sentenced to death, Norway-based Iran Human Rights (IHR), which tracks executions in Iran, said in a statement. His death sentence was carried out on April 27 in Ghezel Hesar prison in Karaj outside Tehran. But just 28 seconds into the hanging he was brought down from the gallows when the victim's family suddenly shouted "forgiveness." His "lifeless" body was successfully resuscitated and the execution was halted, IHR said. Under Iran's sharia law, a victim's family can ask for blood money to spare the life of the perpetrator or also decide to forgive. However, in many cases the family of the condemned person cannot afford the sum set and the execution goes ahead, according to activists. Alizadeh remained under the threat of the death penalty in the absence of any deal with the victim's family for blood money. He was executed again in the Ghezel Hesar prison on Wednesday morning, IHR said. "Ahmad Alizadeh, a talented student, was hanged for the second time on charges of murder, which he denied and claimed he confessed to under torture," said IHR director Mahmood Amiry-Moghaddam, denouncing the "execution machine of the Iranian regime." Activists accuse Iran of using the death penalty to instill fear throughout society, particularly in the wake of 2022-2023 nationwide protests which shook the Islamic authorities. According to IHR, 2024 is seeing a new surge in executions, with at least 166 executions recorded in October alone, the highest number recorded in a single month since the group began documenting executions in 2007. Activists including Amnesty International say Iran carries out more annual executions than any country other than China, for which no reliable figures are available.

Attorney General Merrick Garland has imposed a moratorium on scheduling federal executions, the Department of Justice announced on Thursday. The department will review its policies and procedures on capital punishment, following a wave of federal executions carried out under the Trump administration.

In a memo to the Justice Department, Garland justified his decision to halt the deeply controversial practice, citing factors including its capricious application and outsized impact on people of color.

"The Department of Justice must ensure that everyone in the federal criminal justice system is not only afforded the rights guaranteed by the Constitution and laws of the United States, but is also treated fairly and humanely. That obligation has special force in capital cases," Garland said in the memo.

"Serious concerns have been raised about the continued use of the death penalty across the country, including arbitrariness in its application, disparate impact on people of color, and the troubling number of exonerations in capital and other serious cases," he added. "Those weighty concerns deserve careful study and evaluation by lawmakers."

Under former President Donald Trump, the federal government carried out its first executions in a generation last year, with 13 inmates put to death in Trump's final year in office. That included an unprecedented number of federal killings carried out in the last days of his single-term presidency, bucking a nearly century-and-a-half practice of pausing capital punishments during the presidential exchange of power.

Then-Attorney General William Barr said the executions were being carried out in cases of "staggeringly brutal murders." Civil rights activists had rallied to spare the lives of those on death row. Concerns of how humanely the sentences could be carried out, as well as the recent exonerations of a number of death row inmates, were major factors in the demonstrations to cease state-sanctioned killings.

"The Department must take care to scrupulously maintain our commitment to fairness and humane treatment in the administration of existing federal laws governing capital sentences," Garland said in his memo on Thursday.

President Biden, who nominated Garland to the top law enforcement post, opposes capital punishment. During his campaign, Biden pledged to pass legislation to end the federal death penalty.

Some congressional Democrats have been working on such legislation, but no action has been taken. Some progressives and activists opposed to capital punishment had been expressing frustration that they have not seen more movement on the issue from Biden.

"A moratorium on federal executions is one step in the right direction, but it is not enough," said Ruth Friedman, director of the Federal Capital Habeas Project. "We know the federal death penalty system is marred by racial bias, arbitrariness, over-reaching, and grievous mistakes by defense lawyers and prosecutors that make it broken beyond repair."

Friedman said Biden should commute all federal death sentences, warning that a pause alone "will just leave these intractable issues unremedied and pave the way for another unconscionable bloodbath like we saw last year."

Federal Appeals Court Panel Clears Path To Executions, Throwing Out Lower Court Order

Two judges appointed by President Trump to the District of Columbia Circuit Court of Appeals prevailed Tuesday in a ruling that clears the way for the executions of four inmates.

The only dissenter in the 3-2 ruling was Judge David Tatel, an appointee of former President Bill Clinton. The judges were reviewing a lower court's injunction that had blocked the scheduled executions.

The decision was seen as a win for Trump's Justice Department, which issued new guidelines last July that would have allowed the federal government to carry out its first executions in 16 years.

The fates of the four men remain unresolved because their death sentences were sent back to the lower court for further proceedings.

In December, the U.S. Supreme Court declined the Justice Department's request to vacate the lower court's injunction that scuttled the planned executions.

At issue is the question of whether the condemned men should be put to death by the injection of only one barbiturate — pentobarbital — as called for in the Justice Department's July 2019 memo.

Many of the 28 states where the death penalty is still legal require a lethal injection cocktail containing not one but three barbiturates. Those states include Indiana, where the scheduled executions were to take place.

Pharmaceutical companies have stopped producing at least one of the three drugs used in that lethal mixture, and several botched executions have resulted from some states using untested formulas.

The 1994 Federal Death Penalty Act calls for executions to be carried out "in the manner prescribed by the law of the State in which the sentence is imposed."

Judge Gregory Katsas argues in his majority opinion that the "manner prescribed" simply refers to the method of execution rather than the protocols each state follows in carrying out each kind of execution.

"The government says that 'manner' here means 'method'," Katsas writes, "such that the FDPA regulates only the top-line choice among execution methods such as hanging, electrocution, or lethal injection. In my view, the government is correct."

Judge Neomi Rao, in a concurring opinion, argues that while the word "manner" refers not only to the method of execution, it cannot be interpreted in isolation. "It is a broad, flexible term," she says, "whose specificity depends on context."

In his dissent, Tatel says the best understanding of the 1994 statute is that it "requires federal executions to be carried out using the same procedures that states use to execute their own prisoners.

"Had Congress intended to authorize the Attorney General to adopt a uniform execution protocol," Tatel argues, "it knew exactly how to do so."

Event-related desynchronization and synchronization (ERD/S) and movement-related cortical potential (MRCP) play an important role in brain-computer interfaces (BCI) for lower limb rehabilitation, particularly in standing and sitting. However, little is known about the differences in the cortical activation between standing and sitting, especially how the brain's intention modulates the pre-movement sensorimotor rhythm as they do for switching movements. In this study, we aim to investigate the decoding of continuous EEG rhythms during action observation (AO), motor imagery (MI), and motor execution (ME) for standing and sitting. We developed a behavioral task in which participants were instructed to perform both AO and MI/ME in regard to the actions of sit-to-stand and stand-to-sit. Our results demonstrated that the ERD was prominent during AO, whereas ERS was typical during MI at the alpha band across the sensorimotor area. A combination of the filter bank common spatial pattern (FBCSP) and support vector machine (SVM) for classification was used for both offline and pseudo-online analyses. The offline analysis indicated the classification of AO and MI providing the highest mean accuracy at 82.73$pm$2.38\% in stand-to-sit transition. By applying the pseudo-online analysis, we demonstrated the higher performance of decoding neural intentions from the MI paradigm in comparison to the ME paradigm. These observations led us to the promising aspect of using our developed tasks based on the integration of both AO and MI to build future exoskeleton-based rehabilitation systems.
