BISHKEK, 28 July 2016 – A two-day training conducted by the OSCE Centre in Bishkek for 14 defence lawyers and 12 officers from the Prosecutor’s office on the right to liberty and freedom from arbitrary arrest or detention, ended today in the Kyrgyz capital.

The workshop focused on the international framework for measures of restraint, as well as the internationally recognized constitutional right to institute proceedings in cases of violations.

The detention of minors, persons with disabilities, women with children, or defendants in need of continued medical treatment and hospitalization were among the topics discussed, and participants learned more about their specific concerns to ensure that the restraint measures taken comply with human rights standards.

“The right to liberty is a basic fundamental right, protected by international human rights law and enshrined in the Kyrgyz Constitution,” said Anete Erdmane, acting Senior Human Dimension Officer at the OSCE Centre. “To ensure that restrictions on liberty are applied in compliance with the law and that other human rights are not violated as a result of the deprivation of liberty, it is important that prosecutors and lawyers are aware of the relevant standards and obligations. In line with its mandate, the OSCE Centre works to improve the administration of justice and strengthen the rule of law in Kyrgyzstan.”

The course was delivered by Ulugbek Azimov, a well-known national expert in the field, while  Sergey Poduzov, an international human rights law expert from Russia, also led a training session.

The training course is part of the OSCE Centre’s project on promoting a comprehensive approach to the rule of law, administration of justice, prevention of torture, and capacity building.

Staff of the National Centre of the Kyrgyz Republic for the Prevention of Torture, with support of the OSCE Centre in Bishkek will conduct monitoring visits to the detention facilities in Isyk-Kul, Naryn and Talas provinces between 10 and 17 August. These visits aim at monitoring detention conditions and human rights situation in the closed facilities.

The monitoring findings will be included in the 2016 Annual Report of the National Centre for the Prevention of Torture.

Geneva — U.N. High Commissioner for Human Rights Michelle Bachelet on Thursday cast doubt on whether she will release a long-awaited report on the mass incarceration of Uyghurs in China's Xinjiang region before she leaves office on August 31. When she announced her departure in June, Bachelet said she would publish the report before her term ended. In her final briefing as high commissioner, she said she hoped it would be possible but indicated its release, once again, might be delayed. Bachelet said her office has received substantial input from the Chinese government that must be carefully reviewed before the report can be issued. She said that was normal procedure for all country reports published by her office. "In my meeting with high level national officials and regional authorities in Xinjiang, I raised concern about human rights violations, including reports of arbitrary detention and ill-treatment in institutions," she said. "And the report looks in depth on to these and other serious human rights violations concerning the Uyghurs and other predominantly Muslim minorities in Xinjiang." Human rights activists accuse China of the mass detention, torture, and cultural persecution of a million Uyghurs and other Turkic Muslims in so-called vocational camps. China denies the allegations, saying people in training centers receive skills they need to get good jobs. Bachelet said she raised many concerns with Chinese authorities during her visit to Xinjiang in May. In July, the Reuters news agency reported that China had sent Bachelet a letter asking her not to publish the report. She has confirmed receipt of that letter, which was signed by diplomats of some 40 countries. The high commissioner said such solicitations from countries under the human rights spotlight are not unusual, adding she does not give in to pressure. "I have been receiving pressures from countries who want to publish or not to publish," Bachelet said. "You cannot imagine the numbers of letters, meetings asking for the non-publication. Huge numbers … I have been under tremendous pressure to publish or not to publish. But I will not publish or withhold publication due to any such pressure. I can assure you of that." Work on the report has been ongoing for the past three years. The high commissioner has one week left on her mandate. She assured journalists that she was trying very hard to do what she had promised, namely to release the report before she leaves on August 31.

Throughout 2022, the ruling Taliban in Afghanistan introduced and enforced some of the worst gender-based discriminatory policies seen anywhere in the world.

It has taken the government nearly half a decade to prepare a case against Frenchie and during this long period, this young woman has been left to languish in detention. That itself raises serious questions about the fairness of the process."

A Honduran immigrant held at a troubled detention center in California's high desert died Wednesday night while in the custody of Immigration and Customs Enforcement (ICE). Vincente Caceres-Maradiaga, 46, was receiving treatment for multiple medical conditions while waiting for an immigration court to decide whether to deport him, according an ICE statement. He collapsed as he was playing soccer at the detention facility and died while en route to a local hospital.

Caceres-Maradiaga's death is the latest in a string of fatalities among detainees held at the Adelanto Detention Facility, which is operated by the GEO Group, the country's largest private prison company. Three people held at the facility have died in the last three months, including Osmar Epifanio Gonzalez-Gadba, a 32-year-old Nicaraguan found hanging in his cell on March 22, and Sergio Alonso Lopez, a Mexican man who died of internal bleeding on April 13 after spending more than two months in custody.

Since it opened in 2011, Adelanto has faced accusations of insufficient medical care and poor conditions. In July 2015, 29 members of Congress sent a letter to ICE and federal inspectors requesting an investigation into health and safety concerns at the facility. They cited the 2012 death of Fernando Dominguez at the facility, saying it was the result of "egregious errors" by the center's medical staff, who did not give him proper medical examinations or allow him to receive timely off-site treatment. In November 2015, 400 detainees began a hunger strike, demanding better medical and dental care along with other reforms.

Yet last year, the city of Adelanto, acting as a middleman between ICE and GEO, made a deal to extend the company's contract until 2021. The federal government guarantees GEO that a minimum of 975 immigrants will be held at the facility and pays $111 per detainee per day, according to California state Sen. Ricardo Lara (D-Bell Gardens), who has fought to curtail private immigration detention. After that point, ICE only has to pay $50 per detainee per day—an incentive to fill more beds.

Of California's four privately run immigration detention centers, three use local governments as intermediaries between ICE and private prison companies. On Tuesday, the California senate voted 26-13 to ban such contracts, supporting a bill that could potentially close Adelanto when its contract runs out in 2021. The Dignity Not Detention Act, authored by Lara, would prevent local governments from signing or extending contracts with private prison companies to detain immigrants starting in 2019. The bill would also require all in-state facilities that hold ICE detainees, including both private detention centers and public jails, to meet national standards for detention conditions—empowering state prosecutors to hold detention center operators accountable for poor conditions inside their facilities.

An identical bill passed last year but was vetoed by Gov. Jerry Brown. "I have been troubled by recent reports detailing unsatisfactory conditions and limited access to counsel in private immigration detention facilities," Brown wrote in his veto message last September. But he deferred to the Department of Homeland Security, which was then reviewing its use of for-profit immigration detention. In that review, the Homeland Security Advisory Council rejected the ongoing use of private prison companies to detain immigrants, citing the "inferiority of the private prison model." Yet since President Donald Trump took office, the federal government has moved to expand private immigration detention, signing a $110 million deal with GEO in April to build the first new immigration detention center under Trump.

Nine people have died in ICE custody in fiscal year 2017, which began October 1. Meanwhile, private prison stocks have nearly doubled in value since Election Day.
