Dustin I. Nix, 21, of Donaldson, Ark., pleaded guilty today in federal court in Hot Springs, Ark., to two federal civil rights charges for his role in a conspiracy to force a woman and her young children from their home in Donaldson because she associated with African Americans.

Endoscopic Technologies Inc. (Estech), a medical device manufacturer, has agreed to pay the United States $1.4 million to resolve civil claims in connection with the alleged promotion of its surgical ablation devices. Surgical ablation devices use focused energy to create controlled lesions or scar tissue on a patient’s heart or other organs.

Attorney General Eric Holder today announced more than $8.7 million in Recovery Act funds for three communities in California to use in fighting crime and drug trafficking as part of the Justice Department’s Southwest Border Strategy.

The former director of information technology for a non-profit organ and tissue donation center was sentenced today to two years in prison for hacking into her former employer’s computer network.

Paul Richard Arceneaux, a resident of Church Point, La., was sentenced today to prison for failing to file his personal tax returns for 2003 and 2004 and corruptly interfering with the due administration of the Internal Revenue laws. The Honorable Walter J. Gex III, U.S. District Court Judge for the Southern District of Mississippi, sentenced Arceneaux to 46 months in prison and three years of supervised release. The court also ordered Arceneaux to pay restitution of $176,616.18.

The Department released a new technical assistance fact sheet on legal requirements relating to admitting individuals with HIV or AIDS to occupational training schools and granting state licensure in occupations such as barbering, massage therapy and home health care assistance.

Dr. Gabriel DeCandido, a physician practicing internal medicine in Largo, Fla., has agreed to pay the United States $1.7 million to settle allegations that he defrauded the Medicare program. In a complaint filed in the United States District Court for the Middle District of Florida, United States ex rel. Michael Flanery v. Dr. Gabriel DeCandido, et al., the United States alleged that Dr. DeCandido violated the False Claims Act by billing the Medicare program for higher levels of service than he actually rendered to patients and by billing for services not provided.

Carl Courtright III, of Granite City, Ill., was sentenced today to life plus 10 years in prison for production of child pornography and other offenses.  A federal jury convicted Courtright of one count of production of child pornography, two counts of possession of child pornography, one count of receipt of child pornography and one count of bank fraud following a five-day trial in March 2009.

John Joseph Cota, the pilot who caused the Cosco Busan, a 900-foot long container ship, to collide with the San Francisco Bay Bridge and discharge approximately 53,000 gallons of oil into San Francisco Bay, was today sentenced to serve 10 months in federal prison by U.S. District Court Judge Susan Illston for the Northern District of California.

Rene Oswald Cobar, a Guatemalan national, and Luis Angel Gonzalez-Largo, a Colombian national, were each sentenced today to 235 months in prison on federal drug charges. Cobar and Gonzalez-Largo were sentenced by U.S. District Judge James C. Mahan for the District of Nevada. Cobar and Gonzalez-Largo were indicted on May 5, 2004, in the District of Nevada for conspiracy to distribute cocaine.

Today the Departments of Justice, State and Treasury announced coordinated actions against the Gulf Cartel/Los Zetas drug trafficking organization, now known as the "Company," in the latest in a series of efforts by the U.S. government to neutralize and dismantle this violent cartel.

Warren Mumpower of Spokane, Wash., was sentenced to life in prison today for his activity in a global child pornography trafficking enterprise.

A federal judge today sentenced Waquita Wallace to 20 years in prison and five years of supervised release for a federal civil rights charge of sex trafficking by force, fraud or coercion for compelling a young St. Louis woman to commit acts of prostitution.

Colorado Interstate Gas Company (CIG), the operator of the Natural Buttes Compressor Station located on the Uintah and Ouray Indian Reservation near Vernal, Utah, has agreed to pay more than $1 million and install environmental controls at its facility as part of a consent decree that resolves violations of the Clean Air Act.

A father and son pleaded guilty today in U.S. District Court in Greenbelt, Md., to illegally over fishing striped bass, also known as rockfish, from 2003 through 2006.

Helmerich & Payne Inc. (H&P) has entered into an agreement with the Department of Justice to resolve improper payments by H&P to government officials in Argentina and Venezuela in violation of the Foreign Corrupt Practices Act (FCPA).

A stock trader from Jupiter, Fla., was sentenced today to 30 months in prison for engaging in securities fraud involving several publicly traded companies.

The former and current owners and operators of a chemical facility in Addyston, Ohio, LANXESS Corp. and INEOS ABS USA Corp., have agreed to pay a $3.1 million civil penalty and INEOS will spend up to $2 million to install environmental controls and modify operating procedures to resolve violations of multiple environmental laws.

"I stand here to celebrate the more than $12 million that has been awarded to the D.C. Metropolitan Police Department to fund the hiring and rehiring of 50 law enforcement officers in the District. These funds will provide 100 percent of the approved salary and benefits for these officers for three years, and all police departments receiving the grants will then be required to retain the grant-funded positions for a fourth year."

Aleris International Inc., one of the nation’s largest aluminum recyclers, and 13 of its subsidiaries have committed to implementing environmental improvements and controls projected to cost $4.2 million at 15 plants located in 11 states.

Aggregate Industries - Northeast Region Inc., will pay a $2.75 million civil penalty and implement a regional evaluation and compliance program to resolve numerous violations of the Clean Water Act at 23 facilities in Massachusetts and New Hampshire.

Ohio Edison Company, a subsidiary of FirstEnergy Corp., has agreed in a consent decree to repower one of its coal-fired power plants using primarily renewable biomass fuels.

Charles Brown, 54, of Mesa, Ariz., was sentenced today to five years in prison and lifetime supervised release following his prison term for receiving child pornography.

The Boeing Company will pay the United States $25 million to resolve allegations that the company performed defective work on the entire KC-10 Extender fleet. The KC-10 Extender is a mainstay of the Air Force’s aerial refueling fleet in the Iraq and Afghanistan war theaters.

The operator and manager of the Rathbone Retirement Community in Evansville, Ind., has agreed to pay up to $116,000 to resolve a housing discrimination lawsuit. The November 2008 lawsuit alleged that the defendants violated the Fair Housing Act by prohibiting the use of motorized wheelchairs and scooters in residents’ apartments and in the home’s common dining room during meals.

Dynamics Research Corporation (DRC), a defense contractor based in Andover, Mass., has agreed to pay the United States $15 million plus interest to settle allegations that two of its former executives engaged in a fraudulent kickback scheme in connection with two technical services contracts with the Air Force.

The North Eastern Massachusetts Law Enforcement Council (NEMLEC) will pay the United States $200,000 to settle allegations that it made false claims related to the use of Justice Department grant funds. Based in Boston, NEMLEC is a non-profit corporation and a law enforcement council. It is comprised of a consortium of 47 police departments in Middlesex and Essex Counties, as well as two county sheriff’s departments.

A fifth individual pleaded guilty today to illegally accessing numerous confidential passport application files. Kevin M. Young, 42, of Temple Hills, Md., pleaded guilty before U.S. Magistrate Judge Alan Kay in the District of Columbia to a one-count criminal information charging him with unauthorized computer access. Young is scheduled to be sentenced on Dec. 9, 2009.

Tyson Fresh Meats, Inc., the world’s largest supplier of premium beef and pork, has agreed to pay a $2,026,500 civil penalty to settle allegations that it violated terms of a 2002 consent decree and a federally-issued pollution discharge permit at its meat processing facility in Dakota City, Neb.

Attorney General Eric Holder has appointed U.S. Attorney for the District of Minnesota B. Todd Jones to chair the Attorney General’s Advisory Committee (AGAC) of U.S. Attorneys.

Covenant Medical Center in Waterloo, Iowa has agreed to pay the United States $4.5 million to resolve allegations that it violated the False Claims Act. This settlement resolves allegations that Covenant submitted false claims to Medicare by having financial relationships with five physicians that violated the Stark Law.

Japanese electronics manufacturer Epson Imaging Devices Corporation (Epson) agreed to plead guilty and pay a $26 million criminal fine for its role in a conspiracy to fix prices in the sale of Thin Film Transistor-Liquid Crystal Display panels (TFT-LCD) sold to Motorola Inc.

A sixth individual pleaded guilty today to illegally accessing numerous confidential passport application files. Karal Busch, 28, of District Heights, Md., pleaded guilty before U.S. Magistrate Judge Alan Kay in the District of Columbia to a one-count criminal information charging her with unauthorized computer access.

Eugene Morris, a former correctional officer with the Texas Department of Criminal Justice, was sentenced today in federal court in Houston for providing a false statement related to a federal civil rights investigation. Morris was sentenced to two years in prison and two years of supervised release.

A former sand and gravel subcontractor was sentenced today to serve five years in prison and to pay a $5,000 criminal fine by U.S. District Judge Carl J. Barbier after being convicted by a federal jury of conspiracy and bribery in connection with a $16 million hurricane protection project for the reconstruction a New Orleans levee.

Nathaniel James Nicholson, 25, of Eugene, Oregon, appeared before U.S. District Judge Anna J. Brown and pled guilty to the crimes of conspiracy to act as an agent of a foreign government and conspiracy to commit money laundering.

The vice president of a Missouri pesticide company, HPI Products Inc., pleaded guilty today in federal court in Kansas City, Mo., for violating a federal pesticides law designed to provide proper regulatory oversight and prevent improper storage of pesticides.

William Garvey, the president of HPI Products Inc., a pesticide company based in St. Joseph, Mo., was sentenced today in federal court in Kansas City, Mo., for violations of the Clean Water Act and hazardous waste storage laws related to the company’s pesticide production.

Tax preparer Lawrence Sperling, was sentenced to 33 months in prison today by Judge Deborah Chasanow in Greenbelt, Md., for preparing false tax returns for clients. In April 2009, Sperling pleaded guilty to one count of aiding and assisting in the preparation and presentation of a false tax return.

An Oklahoma man pleaded guilty today for his role in a scheme to solicit kickbacks in connection with the award of a private security services subcontract to protect U.S. government personnel and contractors in Afghanistan. Bryan Lee Burrows, 42, of Wagoner, Okla., pleaded guilty today before U.S. District Court Judge Leonie M. Brinkema in the Eastern District of Virginia to one count of conspiracy to solicit a kickback.

The former director of sales and marketing for Pacific Consolidated Industries LP (PCI) pleaded guilty today to charges related to the bribery of a U.K. Ministry of Defense (UK-MOD) official in order to obtain lucrative equipment contracts with the U.K. Royal Air Force, in violation of the Foreign Corrupt Practices Act (FCPA).

A former Ft. Campbell, Ky., soldier was sentenced today by U.S. District Judge Thomas B. Russell to life in prison after being convicted on May 7, 2009, of charges arising out of the rape of a 14-year-old Iraqi girl and the murder of the girl and her family.

Robert P. Merz was sentenced to life in prison today for advertising, transporting, receiving and possessing child pornography.

The Department announced that four men who committed three hate crime assaults in response to President Barack Obama’s election victory were sentenced today by U.S. District Judge Carol B. Amon in federal court in Brooklyn, N.Y.
