The Justice Department announced today that former jail trustee Willie James Caruthers pleaded guilty yesterday to acting with several others, including law enforcement officials, to assault an inmate inside of the Wilcox County, Ga., Jail on July 23, 2009.

The Department of Justice’s Antitrust Division issued the following statement today after announcing the closing of its investigation into Highmark’s affiliation agreement with West Penn Allegheny Health System (WPAHS).

Colton L. Partin, 22, of Apison, Tenn., Kyle C. Montgomery, 23, and James Smiley, 27, both of Chattanooga, Tenn., were sentenced today by Chief U.S. District Court Judge Curtis L. Collier. Smiley and Montgomery were sentenced to 12 months in prison and three years of supervised release for conspiring to intimidate African-Americans in the free exercise and enjoyment of housing rights secured to them by the laws of the United States. Partin was sentenced to 18 months probation, including six months home confinement. All three men will also serve 300 hours of community service. The men pleaded guilty on Jan. 6, 2012.

The Departments of Justice and Education reached a settlement agreement with the University of California, San Diego (UCSD), to resolve an investigation into complaints of racial harassment against African-American students on campus. Titles IV and VI of the Civil Rights Act of 1964 each prohibit harassment based on race.

AmMed Direct LLC has agreed to pay the United States and the state of Tennessee $18 million plus interest to settle allegations that it submitted false claims to Medicare and Tennessee Medicaid (TennCare), the Justice Department announced today. The suit alleges that most of the customers of their business, Urban Tax Professionals, are also from Liberia and were referred to the defendants by family or friends.

The Justice Department announced a settlement today with Orange County, N.Y., to protect the rights of Spanish-speaking Puerto Rican voters under Section 4(e) of the Voting Rights Act. Today’s consent decree is intended to resolve concerns that limited-English proficient Puerto Rican voters were being denied their full voting rights because the county failed to provide bilingual ballots and Spanish-language assistance as required by law.

Attorney General Eric Holder and Dominican Prosecutor General Radhamés Jiménez Peña met today in Washington, D.C., to sign a permanent agreement to share forfeited assets between the governments of the United States and the Dominican Republic. Anthony Allega Cement Contractor Inc., a Cleveland construction firm, has agreed to pay the United States $500,000 to resolve allegations that it knowingly submitted false claims related to a federally-funded construction project, the Justice Department announced today. The United States alleged that Allega submitted false claims that made it appear that the company was in compliance with the U.S. Department of Transportation’s (DOT) Disadvantaged Business Enterprise (DBE) program, as required in order to obtain and maintain Allega’s contract with the government. The DBE program provides opportunities to businesses owned by minorities and women, as well as socially and economically disadvantaged individuals, to participate in federally-funded construction and design projects.

Tokyo-based Fujikura Ltd. has agreed to plead guilty and to pay a $20 million criminal fine for its role in a conspiracy to fix prices of automotive wire harnesses and related products installed in U.S. cars.

On April 20, 2012, U.S. District Court Senior Judge Ewing Werlein Jr. sentenced Michael Burkett, 34, aka “Redneck,” to 27 months in prison and Shane Dallmeyer, 31, aka “Lock Jaw,” to 33 months in prison.

Following a comprehensive investigation, the Justice Department today announced its findings regarding the Juvenile Court of Memphis and Shelby County (JCMSC), and the Shelby County Juvenile Detention Center in Tennessee. The Justice Department found that the juvenile court fails to provide constitutionally required due process to all children appearing for delinquency proceedings, that the court’s administration of juvenile justice discriminates against African-American children, and that its detention center violates the substantive due process rights of detained youth by not providing them with reasonably safe conditions of confinement. The investigation, opened in August 2009, was conducted under provision of the Violent Crime Control and Law Enforcement Act of 1994 and Title VI of the Civil Rights Act of 1964.

Direct Resource Inc. has agreed to pay the government $450,000 to resolve allegations that the company falsely claimed payment in violation of the Trade Agreements Act (TAA), which prohibits the sale of products to federal agencies from countries that do not have a reciprocal trade agreement with the United States, the Justice Department announced today. The Columbus, Ohio, company allegedly knowingly sold products from China, a country that does not have such an agreement with the United States.

(QEPFS), formerly Questar Gas Management Co., to resolve alleged violations of the Clean Air Act at five natural gas compressor stations on the Uintah and Ouray Reservation in Northeastern Utah.

The United States has sued Pete Gutierrez and Jeanette Gutierrez, who do business as Fast Cash Refund Express and Fast Cash Refund Express Electronic Services, seeking to bar them and their companies from preparing any federal tax returns for others, the Justice Department announced today. In addition to the Gutierrezes, the civil injunction suit also named FCRE Inc., and Fast Cash Refund Express Electronic Tax Service LLC, as defendants.

The Justice Department announced that it has reached an agreement with Wythe County, Va., that will allow for the county and its three political subdivisions, the Wythe County School District and the towns of Rural Retreat and Wytheville, to bail out from their status as “covered jurisdictions” under the special provisions of the Voting Rights Act, and thereby exempt these jurisdictions from the preclearance requirements of Section 5 of the Voting Rights Act. The agreement is in the form of a consent decree filed today in the U.S. District Court for the District of Columbia, and must be approved by the court.

BP North America Inc. has agreed to pay an $8 million penalty and invest more than $400 million to install state-of-the-art pollution controls and cut emissions from BP’s petroleum refinery in Whiting, Ind.
