jail Thane crime: Man gets 3 years jail for abetting wife's suicide By www.mid-day.com Published On :: 22 Jan 2019 12:44:36 GMT Thane: A local court sentenced a man to three years rigorous imprisonment for abetting the suicide of his wife but acquitted his mother for lack of evidence in Maharashtra's Thane. District Judge RV Tamhanekar, in a recent order, also fined Bhiwandi-resident Sanjay Waghmare (26) Rs 7000. Sanjay and his wife Priyanka had married in 2016 and there were frequent fights between the couple as well as the victim and her mother-in-law Jinsabai, said additional public prosecutor Sandhya Mhatre. After one such quarrel on August 30, 2017, Priyanka set herself ablaze, the APP said, adding that she died in a nearby hospital on September 4. In his order, the judge said, "The accused has caused cruelty to the victim and his act was of such a nature as was likely to drive Priyanka to commit suicide". Sanjay was found guilty of the charges under sections 498A and 306 of the IPC, the APP said. In a similar incident, the deposition of two minor siblings was considered as significant evidence by a Thane court which awarded five years imprisonment to their 45-year-old father for abetting the suicide of his wife. Assistant Sessions Judge S A Sinha held the accused, Sunil Martand Gaikwad, guilty under IPC sections 306 (abetment of suicide) and 498 A (cruelty) while pronouncing the punishment. The judge also imposed a fine of Rs 15,000 on him. The prosecution told the court that Gaikwad, a resident of Gorsai village in Thane's Bhiwandi taluka, had married the victim, Vaishali, on May 27, 2005. The couple had a son and a daughter, aged 11 and 10 at present. As per the prosecution, the accused would come home late from work after consuming liquor and then fight with his wife. Fed up with the harassment, the woman hanged herself at her home on June 21, 2017, they said. In their sworn statements in court, the couple's two children said their father would abuse and beat their mother after consuming liquor. They told the court that on the day of the incident, Gaikwad came home in an inebriated state and abused their mother following which the couple quarrelled. The children then went to sleep. The daughter woke up after some time and saw her mother hanging. She started crying and alerted her brother. jail Lockdown rules: Prisoners in Maharashtra jails can make one phone call per month By www.mid-day.com Published On :: 28 Apr 2020 03:43:09 GMT The Maharashtra Jail Administration has allowed prisoners to talk to their families over landlines. as family visits to jails have been disallowed due to the lockdown. There are a around 36,000 prisoners across jails in Maharashtra, out of which 8,500 prisoners have been convicted. The total capacity of these jails is 24,000 so most jails in the state are overpopulated. In an attempt to create social distancing within the prisons, 4,611 accused who were serving jail sentences for non-serious crimes, were released on bail. However, the state administration continues to keep those involved in serious crimes behind bars. According to a jail official, allowing inmates to communicate over phone was allowed so that they could be in touch with their families. The officer said, "We have details of all the accused and on the basis of those, we call their houses and allow them to speak to their families." Otherwise the accused could meet their families once a month. The phone call facility between the accused and their family members are being allowed in every jail in the state. Around 25 accused are able to talk to their families every day. Every accused gets to make a phone call once a month. IG Prisons, Deepak Pandey told mid-day, "The jailer first confirms that the person on the other side of the phone is a member of the family of the accused, only then the call is allowed. A duration of 5 minutes is given for each conversation between the inmate and their family." The inmate has been admitted for treatment at JJ Hospital. The jail administration, looking at the seriousness of the matter, got 150 people, including staff and inmates tested, of which results are awaited. According to information received from prison sources on May 2, the inmate, who was accused of murder, collapsed in the jail after which he was admitted to JJ Hospital, Meanwhile, he underwent the Coronavirus test and he was found positive on May 4 as per his reports. The jail administration then got into action and tested 150 people in the jail for the virus, and their reports are awaited. An official of Arthur Road Jail told mid-day, "We had taken measures to prevent coronavirus. After one of the inmates and two jail staff tested positive, we got 150 people in Arthur Jail tested. The report is yet to come." Two jail staff who tested positive have been kept under quarantine. They were earlier sent out for fieldwork. According to the jail sources, if an employee has been sent outside the jail after lockdown, he would not be given in-prison duty again and would be sent on quarantine for 14 days. The jail has been closed down because of the coronavirus outbreak, due to which no new inmates are being accepted in the jail. At such a time, only essentials services workers are allowed inside the jail. As the number of cases in the state is on a surge, the prison department planned some important measures. As the inmates in the prison were prone to get infected, some of the prisoners were temporarily sent out on bail. A total of 200 prison inmates and staff members were tested after a prisoner and two staffers were found positive for COVID-19. ROn Monday, a 50-year-old undertrial was found to have contracted the virus, after which two more jail staffers also tested positive. 200 tested so far Of the 200 tested so far, reports of 97 have come back negative. Sample of the 300 others, who shared the barrack with the infected people, will be collected on Friday. While the undertrial is being treated at JJ Hospital, the administration is in the process of getting others the required treatment. All of them will be shifted to GT Hospital and St George on Friday. Arthur Road Jail or the Mumbai Central Prison has a capacity of 800 inmates but currently it houses more than 2,000 prisoners. Home minister Anil Deshmukh said, "A total of 103 people have been found corona positive, including 77 prisoners and 26 Jail Police. The process of admitting all of them to the hospital for treatment is underway." Cook may have been the carrier To prevent the spread of COVID-19 in prisons, seven jails were locked down, preventing entry and exit of new accused and staff. But, the authorities suspect they contracted the virus from a cook who had caught the infection. The Minister said the amendment was necessitated after incidents of violence were witnessed against them while discharging their crucial duty for the country. The amendment has ensured that the investigation takes place in a time-bound manner. A special provision is also made in the ordinance in case vehicles or clinics are damaged. According to the police, the woman identified as Parveena hanged herself with her "dupatta" in her cell on the intervening night of Sunday and Monday. The woman was rushed to Deen Dayal Upadhyay Hospital, where she was declared brought dead by the doctors, the police said. Praveena, a resident of Delhi, was lodged in Tihar jail number 6 since April 25 in connection with a murder case registered at Chhawla police station. She, along with her husband, was accused of killing her father-in-law and mother-in-law, after which she had also tried to commit suicide but failed. An inquest proceeding under Section 176 (inquiry by a magistrate into the cause of death) of the Code of Criminal Procedure (CrPC) is being conducted in connection with the alleged suicide. "A Delhi resident named Vinod Tihara was arrested by Directorate of Revenue Intelligence (DRI) wing of Noida on March 17 on allegations of violations of GST norms and is currently in Meerut jail," SSP Meerut, Ajay Sahni, told PTI. The SSP's version was later corroborated by Meerut Jail Superintendent Dr B P Pandey, who gave more details on the charges against Tihara. "Vinod Tihara, a resident of Delhi's Rohini has been in Meerut jail since March 17. The case no is 2/20 and he has been charged under Customs Act 132 and 135," Pandey said. Under Section 132 of Indian Customs Act, "if a person knowingly makes, signs or uses, or causes to be made, signed or used, any false declaration, statement or document in the transaction of any business relating to the customs, he shall be punishable with imprisonment for a term which may extend to 2 years, or with fine, or with both." Under section 135, there are multiple clauses and sub clauses dealing with "misdeclaration, fradulent evasion and carrying, concealing or purchasing goods which are liable to confiscation." There was no immediate clarity on the exact violation Tihara has been accused of committing. Tihara is Delhi cricket's representative at the BCCI and an influential figure in state's cricket body. He had been "unreachable" since mid-March leaving DDCA officials, including members of his faction, flummoxed. "For the longest time, we were under the impression that Vinod ji has tested positive for COVID-19. One or two people who contacted his family members were told that he is under isolation. His phone is switched off for the past one month," a senior DDCA office-bearer told PTI. During a recent online hearing in a matter of financial misappropriation of funds, organised by DDCA ombudsman Justice (Retd) Deepak Verma via Skype, one of the body's lawyers, known for his proximity to Tihara, told the apex council members that he had tested positive for novel coronavirus. "We all freaked out as we had met Tihara till March 15 at various places. We told him that why weren't we informed as we all needed to quarantine ourselves. "He then changed track and said that if you people would have been COVID-19 positive, then you would have known by now. It was very suspicious," the Apex Council member who was suspended that day, said. In fact, some of the members are now wondering how did a letter signed by Tihara in support of one of the lawyers, whose service was being terminated, was submitted to Ombudsman, when all this while he had been in jail.
