A U.S. Border Patrol agent has been indicted by a federal grand jury in Tucson, Ariz., on federal civil rights charges related to an alleged assault on a detainee at a federal detention facility. The two-count indictment, returned on March 11, 2009, alleges that on May 10, 2006, Eduardo Moreno violated the civil rights of a federal detainee by assaulting and causing bodily injury to the individual while Moreno was on duty at the U.S. Border Patrol processing facility in Nogales, Ariz.

The Department today announced a settlement resolving allegations that the town of St. John, Ind., violated the Fair Housing Act when it denied a petition for a zoning variance based on the disability of a prospective resident.

A former Nazi concentration camp guard who settled in Racine, Wis., after World War II and acquired U.S. citizenship, has been removed to Austria due to his participation in Nazi-sponsored acts of persecution during World War II. Josias Kumpf, 83, served as an armed SS Death’s Head guard at the Nazi-run Sachsenhausen Concentration Camp in Germany and at the Trawniki Labor Camp in Poland.

In response to the Red River flooding in North Dakota and Minnesota and subsequent relief efforts, the National Center for Disaster Fraud is reminding members of the public to be aware of and report any instances of alleged fraudulent activity related to relief operations and funding for victims. Rudy Frabizio, 46, of Acton, Mass., was convicted today of possession of child pornography. Frabizio was found guilty after a seven-day jury trial in the U.S. District Court for the District of Massachusetts in Boston. Frabizio may face up to five years in prison. His sentencing is scheduled for Aug. 5, 2009.

The United States has sued four Certified Public Accounts (CPA), 27 tax preparers and one other individual, seeking to bar them from promoting an alleged tax scam involving bogus income tax credits claimed for sham sales of methane from landfills.

Northrop Grumman Corp., its subsidiary Northrop Grumman Space and Mission Systems Corp., and its predecessor TRW Inc. (collectively, Northrop) have agreed to settle for $325 million, False Claims Act allegations that Northrop provided and billed the National Reconnaissance Office (NRO) for defective microelectronic parts, known as Heterojunction Bipolar Transistors (HBTs).

The Department announced the arrest of a former trooper with the Texas Department of Public Safety who is charged with depriving multiple Latino motorists of their civil rights. According to the four count indictment returned by a federal Grand Jury in Corpus Christi, Texas, on April 8, 2009, Michael Anthony Higgins violated federal law by willfully stealing money from Latino motorists that he had stopped on the highway while working as a trooper.

The Department announced that a federal district court judge in Louisville, Ky., approved a settlement of the Department’s lawsuit alleging that those involved in the design and construction of 12 multifamily housing complexes discriminated on the basis of disability. The complexes contain more than 800 units covered by the Fair Housing Act’s accessibility provisions.

The United States has reached a settlement with NetApp Inc. and NetApp U.S. Public Sector Inc. (collectively NetApp), following an investigation of alleged false claims and contract fraud. NetApp has agreed to pay the United States $128 million, plus interest. This is the largest contract fraud settlement the General Services Administration (GSA) has obtained to date.

The Department announced a settlement under the Americans with Disabilities Act (ADA) with the city of Philadelphia to greatly improve accessibility for individuals with mobility disabilities at the city’s 1,200 polling places. Today’s settlement is the first settlement by the Department with a city focused solely on accessible polling places. Under the terms of the settlement, the city of Philadelphia recognizes that accessible polling places are the cornerstone of its voting accessibility program and will make its polling places accessible to persons with disabilities.

Lazare Kabaya Kobagaya, 82, of Topeka, Kan., was arrested today on charges of naturalization fraud and misuse of an alien registration card. According to the indictment, Kobagaya allegedly participated in genocidal activities during the 1994 Rwandan conflict including mobilizing attackers to commit arson and murder. Kobagaya is alleged to have failed to disclose his alleged participation in these activities during his immigration and naturalization processes.

The Department filed a lawsuit in U.S. District Court in Baltimore alleging that the city of Baltimore’s zoning code discriminates against individuals with disabilities by requiring substance abuse treatment facilities to go through a burdensome “conditional ordinance” zoning process in order to locate in any zone.

William Michael King, a fifty-year-old truck driver from Maryland, pleaded guilty today to assault and violating the civil rights of an African American man he encountered while King delivered construction materials to the Pentagon.

Atlantic States Cast Iron Pipe Co. a Phillipsburg, N.J.-based division of McWane Inc. of Alabama was sentenced today to pay a fine of $8 million for violations of environmental and worker safety laws as well as obstructing the federal investigation of its conduct.

U.S. Attorney General Eric Holder today announced that more than $424 million in Recovery Act funds will go to 20 states, territories and the District of Columbia to maintain or increase public safety, while creating or retaining jobs within the law enforcement community.

A federal grand jury in Fort Smith, Ark., has indicted five men from the Donaldson, Ark., area on federal civil rights charges as well as charges of making false statements to the FBI.

The Department today filed suit against the Fitchburg Housing Authority in Fitchburg, Mass., and its Executive Director Robert W. Hill alleging that they violated the Fair Housing Act when they refused to allow a tenant to transfer to a different apartment as a reasonable accommodation for her disabilities.

A federal court in Tampa, Fla., has permanently barred Daniel Prewett from preparing tax returns for others. The court also barred Prewett from helping customers hide income offshore to avoid taxes, and from promoting other tax-dodging schemes. The court has also enjoined Prewett’s wife, Elizabeth George; former Prewett employees Frances Carlson, Elsie Chouinard and Natalie Swaney; and Prewett’s three tax preparation businesses, listed below. The individual defendants agreed to the injunctions.

A Massachusetts man has been charged in U.S. District Court in Boston with crimes related to the illegal importation and illegal trafficking of sperm whale teeth. On May 13, 2009, a federal grand jury sitting in Boston, returned an indictment that was unsealed today against David L. Place of Nantucket, Mass.

Three Colombian nationals have been arrested in Colombia on charges of conspiracy to commit alien smuggling for profit, alien smuggling for profit, and conspiracy to commit visa fraud in connection with their alleged roles in an extensive and sophisticated visa fraud scheme against the U.S. Embassy in Bogotá, Colombia.

Frederick Allen and Kimberlee Allen, both of Harwich, Mass., were arraigned today before Magistrate Judge Marianne B. Bowler in Boston on charges of conspiracy to defraud the United States, tax evasion and failure to file tax returns. The indictment alleges that the Allens conspired to defraud the United States of assessing and collecting federal income taxes from 1998 through April 2009.

Three Saudi nationals were transferred today from the detention facility at Guantanamo Bay to the Kingdom of Saudi Arabia under appropriate security measures.

Indiana-based University Loft Company has agreed to pay the United States $400,000. The settlement resolves allegations that the company knowingly sold Malaysian-made furniture to government purchasers in violation of the Trade Agreements Act (TAA).

The Department announced a simultaneous lawsuit and settlement with the state of Texas concerning the care given to residents of the state’s 13 facilities for persons with developmental disabilities. A Kansas woman pleaded guilty to making a false statement to the FBI during an investigation into allegations of fraud against the Federal Communications Commission’s (FCC) E-Rate program. According to the plea agreement, filed today in U.S. District Court in Kansas City, Kan., Mary Jo LaDuron, aka Mary Jo Gault, of Leavenworth, Kan., lied to FBI agents who were investigating allegations of fraud against the E-Rate program.

Paul Tillis, a former Florida Department of Corrections officer, was sentenced today in federal court in Jacksonville, Fla., on a federal civil rights charge related to assaulting an inmate.

Dustin I. Nix, 21, of Donaldson, Ark., pleaded guilty today in federal court in Hot Springs, Ark., to two federal civil rights charges for his role in a conspiracy to force a woman and her young children from their home in Donaldson because she associated with African Americans.

Everett Cooney waived indictment and pleaded guilty in court in Little Rock, Ark., to a federal charge of sex trafficking an underage female. Chief U.S. District Judge J. Leon Holmes accepted Cooney’s guilty plea.

John Joseph Cota, the pilot who caused the Cosco Busan, a 900-foot long container ship, to collide with the San Francisco Bay Bridge and discharge approximately 53,000 gallons of oil into San Francisco Bay, was today sentenced to serve 10 months in federal prison by U.S. District Court Judge Susan Illston for the Northern District of California.
