Finance Minister Nirmala Sitharaman will hold a review meeting with CEOs of public sector banks (PSBs) on Monday to discuss various issues, including credit offtake, as part of efforts to prop up the economy hit by the COVID-19 crisis. The meeting, to be held via video-conferencing, will also take stock of interest rate transmission to borrowers by banks and progress on moratorium on loan repayments, sources said. The RBI had on March 27 slashed the benchmark interest rate by a massive 75 basis points and also announced a three-month moratorium to be given by banks to provide relief to borrowers whose income has been hit due to the lockdown. Earlier this month, RBI Governor Shaktikanta Das held a meeting with heads of both public and private sector banks to take stock of the economic situation

2. Relevant facts are that plaintiff has filed suit for recovery against the defendant no.1 and 2. The case of the plaintiff, as set out in the plaint, is that plaintiff is a company registered under the Companies Act 1956 and is engaged in the manufacturing of coating powder and trading of decorative and industrial paints and thinner since 1994. The defendant is a limited company and registered under the Companies Act, 1956 and involved in the manufacturing of electrical panels. The defendant through its directors/ officials approached the plaintiff for purchase of the coating powder and industrial paints and thinner and at the time of commencement of the business, the terms of business, as specifically printed on or contained in the plaintiff's invoices were agreed by the defendant and thereafter business dealings and transactions started between the parites hereto in 2004 and since 15.04.2004 they have been maintaining a running account.

1.2 Notice to the respondent was dispensed with, as the respondent had not yet been summoned by the Trial Court.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. Therefore, noticing that several opportunities have already been afforded to the complainant, the complaint was dismissed. 3 Sh.Anish Bhola, counsel for the petitioner has assailed the CR No.-91/2020 Page No.-1 of 4 impugned Order on the ground that the Ld. MM committed a grave error in observing that the ECS mandate was not on record. It is pointed out that the petitioner/ complainant along with the complaint had placed on record a ' Debit Authorization Form issued by the customer" i.e. the respondent to the petitioner bank. It is argued that the Debit Authorization Form is akin to ECS mandate. . To link the Debit Authorization Form with the loan agreement involved, an account statement was placed on record. The petitioner/complainant had also placed on record along with the complaint a memorandum issued by the bank, intimating return of the mandate on account of insufficiency of funds. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.

The case of the plaintiff as disclosed from the plaint is that the plaintiff is engaged in the business of providing internet services under licence from Department of Telecommunications, Ministry of Communications & Information Technology. The defendants approached the plaintiff for taking internet services and after negotiations the plaintiff agreed to provide services to a defendant and thereafter the plaintiff and the defendant signed customer application form (CAF) on 04.04.2015. The plaintiff provided the internet services to a defendant No. 1 company on monthly basis and after providing the services, the plaintiff raised bill of Rs.27,54193/­ and out of the said amount the defendants paid a sum of Rs. 22,08,000/­ and the balance sum of Rs. 5,46,193/­ is outstanding and due against the defendants which defendants failed to pay despite demands from the plaintiff.

2. With the above directions, this Criminal Original Petition is closed.

Doctors at the government-run ESIC Hospital here committed a "mistake" by not testing samples of a 16-year-old girl, who later died of Covid-19, Assam Health Minister Himanta Biswa Sarma said on Saturday. The girl breathed her last on Thursday at the B Barooah Cancer Institute. Her samples, which were taken after her death, tested positive for coronavirus infection/ "The girl first went to ESIC Hospital with all symptoms like fever and pain in legs. It was a mistake by doctors that her samples were not sent for testing... It is a matter of concern," Sarma told reporters here. Talking about the Gauhati Medical College and Hospital (GMCH), which was closed for new patients after a doctor at the facility tested positive on Thursday, he said a total of 529 samples have been collected from doctors, nurses, professors and superintendent of the institute for testing "Out of those, reports of 357 samples came out negative and one was positive. The West Bengal government has asked the heads of all hospitals to ensure that immunisation programmes against vaccine-preventable diseases continue in full steam amid the Covid-19 outbreak. Immunisation should go on during COVID-19 outbreak to protect children and pregnant women from 'vaccine-preventable diseases' (VPD), the health and family welfare department said in a notification. It was addressed to the superintendents of all medical colleges and hospitals and the chief medical officer of health of all districts. Copy of the notification issued on May 6 was made available on Saturday.

The West Bengal Health Department on Saturday formed teams to support surveillance and monitoring of treatment at five hospitals treating COVID-19 patients in the city. The team members will pay regular visits to these hospitals and send reports to the department, the state government said in an order. The department has also set up a dedicated help line for issues regarding the non-availability of PPEs and other supplies. The feedback and suggestions will be duly recorded and acted upon by the state government for appropriate remedial measures, the order said. The West Bengal government has also constituted a team for guidance on containment activities in different districts of the state.

Security forces have launched a search operation in a forest area near the International Border in Samba district after three grenades and 54 rounds of AK ammunition were recovered from the area, police said on Sunday. The explosives and ammunition were noticed by some villagers in the forest area near Goran village in Kandi belt on Saturday following which the police were informed, a senior official said. He said a joint search operation was launched following the recovery as the area used to be an old route for infiltration from across the border. Security forces had conducted massive combing operations all along the IB in Jammu, Kathua and Samba districts recently. However, nothing was found during these operations.

The Bombay High Court has directed the Maharashtra government to issue a clear directive to the state police to ensure ambulances or other vehicles ferrying pets and sick animals to and from veterinary clinics are not stopped during the lockdown. Justice S C Gupte in an order on Friday said the police administration must not obstruct or stop such vehicles. He also directed the state to clarify its stand on permitting residents across the state take their dogs out for a walk during the coronavirus-enforced lockdown period. The court was hearing a Public Interest Litigation (PIL) filed by a Pune resident seeking permission to take her pet dogs outside for their daily walks. The PIL, filed through advocate Harshwardhan Bhende, claimed several police stations under the jurisdiction of Pune Police had issued "arbitrary directions" to housing societies to stop residents from taking their dogs outside for walks. Authorities in Jammu and Kashmir carried out nearly 1,000 surprise inspections and lifted 62 samples of different food items for screening since the beginning of this month, an official spokesperson said on Sunday. The special drive by the Food Safety Wing of Food and Drugs Administration Department was necessitated amidst growing concern that some unscrupulous traders can take advantage of the lockdown imposed by the government due to the COVID-19 pandemic, he said. "During the special drive, commenced on May 1, the enforcement staff carried out 996 inspections, lifted 62 samples of different food items like mustard oil, til oil, spices, milk and dates, and destroyed food items, which included vegetables, fruits, milk amounting to Rs 25,000," the spokesperson said. He said four Food Business Operators (FBOs) were also fined for violating the Food Safety and Standards(FSS) Act. Municipal leaders, including mayor of the BJP-ruled North Delhi Municipal Corporation (NDMC), on Sunday took part in a sanitisation drive outside Chief Minister Arvind Kejriwal's residence on Flagstaff Road here. The sanitisation exercise is part of the NDMC's campaign to prevent spread of COVID-19, said Jai Prakash, chairman of the standing committee of NDMC. "We have been sanitising the whole municipal area with mechanical and manual spray of sanitisers. So, we are here on Flagstaff road which comes under the NDMC's jurisdiction," Jai Prakash said. The municipal corporation has deployed nearly 40 large truck mounted power sprays and around 40 smaller mechanical sprays, to cover roads, residential areas, markets and other public places under the NDMC, he said.

Senior Biju Janata Dal (BJD) leader and Chairman of the Western Odisha Development Council (WODC), Subash Chauhan died at a private hospital here on Sunday following a prolonged illness. He was 54. Chauhan, who was undergoing treatment for liver ailment was a bachelor and breathed his last in the morning, family sources said. Closely associated with the RSS and VHP for many years, the former national Convenor of the Bajrang Dal had quit the BJP and joined the Biju Janata Dal in the run-up to the 2019 general elections. Chauhan was subsequently appointed the chairman of WODC in September last year. Superstar Rajinikanth on Sunday warned the ruling AIADMK against reopening state-run liquor outlets in Tamil Nadu, saying if it was done, it should not harbour "dreams" of coming to power again, apparently in next year's Assembly elections. Nearly a month after recovering from the coronavirus, actor Zoa Morani says she has donated her blood plasma to do her bit in helping the patients currently suffering from the novel virus. The actor, who was quarantined and kept under medication in April, also urged those who have recovered from COVID-19 to donate their plasma. : Communicating across its nine factories and setting up milk collection points are some of the steps taken by dairy products major Thirumala as per COVID-19 guidelines for manufacture, to ensure supply does not get affected, a top official said. Thirumala was acquired by France-based dairy group Lactalis in 2014 and the company produces dairy products across nine manufacturing units in southern states. Thirumala CEO Christophe Jouin said the company had taken precautions by communicating across factories, setting up milk collection points and issuing safety guidelines to employees. "The first step was to carry out checking of temperatures of employees before they enter the factory and maintaining social distancing norms during daily work, among others," he told PTI. Union Minister Jitendra Singh on Sunday came to the help of 13 girl students from the Northeast studying in Delhi University, after they were asked to vacate their hostel, and he made it clear that they can continue to stay in their current accommodation "as long they as wish". The minister for Development of the North Eastern Region (DoNER) intervened after the DU administration asked the students to vacate the North Eastern Students House for Woman by May 31. The provost had asked the students to leave the hostel as soon as possible due to the expiry of mess contract by month-end. While the hostel has a capacity of about 100, currently 13 students are stuck there because of the lockdown.
