mcc Flap Over 527s Aside, McCain-Feingold Is Working as Planned By webfeeds.brookings.edu Published On :: Thu, 20 May 2004 00:00:00 -0400 The decision by the Federal Election Commission to defer action on new rules to constrain the activities of so-called 527 political organizations is being portrayed as an utter collapse of the new McCain-Feingold campaign finance law. In fact, nothing could be further from reality.The dispute over whether several new Democratic-leaning independent political groups should be required to register with the FEC and abide by contribution limits is a legitimate one, and there is merit in the regulatory proposal rejected by the full commission that was offered by Commissioners Scott Thomas and Michael Toner. But this argument largely concerns unresolved questions stemming from judicial and FEC interpretations of the 1974 law that governs federal election law not McCain-Feingold.Had the Thomas-Toner proposal been adopted, the Media Fund and America Coming Together would have faced tougher requirements on the sources and amounts of contributions they receive. But supporters of the Media Fund and ACT still would have had legal options to continue their campaign activities. ACT would have had to raise more hard money to match its soft-money contributions, but it had already been moving in that direction, as had Moveon.org, which is now focusing its campaign activities on hard-money fundraising and expenditures.Millionaire contributors to the Media Fund could have separately made independent expenditures in the form of television ads that expressly advocated the defeat of President Bush. Unions could have financed their own "issue ads" supporting Sen. John Kerry (D-Mass.) and attacking Bush until 30 days before the party convention or 60 days before the general election. Corporations would have retained the option to sponsor similar ads. Thereafter, even without FEC action, a key provision of McCain-Feingold kicks in. As the election nears, no 527 organization can use corporate or union money to finance broadcast ads that feature federal candidates.McCain-Feingold was not written to bring every source of unregulated federal campaign funding within the scope of the law. Rather, it was designed to end the corrupting nexus of soft money that ties together officeholders, party officials and large donors. The law's principal goal was to prohibit elected officials and party leaders from extracting unregulated gifts from corporations, unions and individual donors in exchange for access to and influence with policymakers.Indeed, the law has accomplished this objective. Members of Congress and national party officials are no longer soliciting unlimited contributions for the party committees, nor are they involved in the independent fundraising efforts of the leading 527 groups. The FEC's decision to defer action, therefore, does not pose the same risk of corruption as did the soft-money decisions of the past.One of the fundamental concerns raised by the activities of 527s is that these groups, with their ability to receive unlimited contributions, would overshadow the candidates and weaken the role of parties in the electoral process. The new law, however, increased contribution limits to candidates and parties, to offset the effects of inflation and to ensure that parties remain major players in federal elections. Here, the evidence is overwhelming that the law's objective is being realized.Bush and Kerry have both registered extraordinary fundraising success. Kerry has already raised more than $110 million, while the president has raised more than $200 million. In raising these sums, the presidential nominees have attracted the support of more than 500,000 donors who did not give money during the 2000 campaign. Congressional candidates, too, are also reaching out to new donors, with fundraising up 35 percent over the last cycle.And in the first 15 months of this cycle, the national party committees have raised more than $430 million in hard money alone $60 million more than they had raised in hard and soft money combined at the comparable point in the previous presidential cycle. This financial strength reflects the parties' success at adding more than 2 million new donors to their party rolls. For all the attention they are garnering, these 527 groups both Democratic-leaning and Republican-leaning pale when compared to the activities of the parties and candidates.The 2004 elections have enormously high stakes. Supporters of Bush and Kerry are highly motivated to boost the election prospects of their favored candidate. All signs point to a vibrant get-out-the-vote effort by both parties and a rough equality in funding by and on behalf of the two major presidential campaigns. This reflects the 50/50 partisan division in the country and suggests that a disparity in resources is unlikely to determine the outcome of the presidential election.The FEC has cheered some and disappointed others with its decision to defer new rulemaking on independent political organizations. Mikey, though, hasn't arrived yet, and this leads to inevitable jokes about 'Indian Standard Time'. But to be fair to the New Zealander, he reaches only a few minutes later and immediately hits it off with Natalie, whom he knows from before. But the two haven't met in a while, their individual projects having kept them too busy to find the time. Mikey, 48, is a composer who dabbles in Bollywood projects such as Shaitan (2011) and most recently Ribbon, which released last month. Natalie, a 28-year-old Italian-Canadian, has made a mark in Bollywood too, as a playback singer in films like English Vinglish and Chennai Express. A Hindi video in collaboration with Raghu Ram is also just around the corner. She's recovered from an appendicitis operation only a few days ago, she tells us, and explores the menu with Mikey before they settle down for an engaging conversation. I don't know if you remember Myspace?Shunashir: I do remember it.Mikey: Yeah, I do too.Natalie: So this is then, okay? And I got a message on Myspace from someone from India, who said, "Hi, we'd like you to come to India and record on this fusion album on the chakras." But the whole thing didn't make sense to me at the time. So, I said, "Thanks; yeah, maybe one day." But I didn't know who that album was by. Long story short, they messaged me again and said, "Can you do some recording for us from Canada?" and I said, "Okay." Two months later, I get back home from school in Quebec and there's a CD in the mail; it's Sonu Nigam's Maha Ganesha album, which is what I sung for!Mikey: Wow. Shunashir: Yeah, wow. And how was it for you, Mikey?Mikey: My relationship with India actually began because I was born here, in Chennai. My parents were missionaries in the country, in Andhra Pradesh. But anyway, let's fast forward. I moved to New Zealand when I was five years old, did my schooling there, got into music, moved to London and got a studio there. And one day, somebody knocks on the door of the studio, some Indian fellow, and says, "Hi, I'm your new brother-in-law." And this guy is Lucky Ali.Natalie: Oh my gosh!Mikey: Yeah, but he hadn't released anything then, so he wasn't known as a singer. He had come to do some sort of recording in Watford and said, "Can I come in and maybe, we can do some music together?" So, I said, "Okay, come back over the weekend," and that's how we recorded a couple of songs, Oh Sanam and Sunoh.Shunashir: ...Which kind of changed the Indi-pop game at that point of time, at least in terms of videos.Mikey: Right. And the Oh Sanam video was shot in Cairo, at the pyramids. And the woman who was dressed in the purdah, with everyone in India wondering who this person with blue eyes in Lucky Ali's big hit song is — that's my sister!Natalie: That's so funny, and really cool. (The food — poached pear and blue cheese salad, grand chicken Caesar salad, meatballs in creamy sauce and pizza American — arrives)Mikey: Have you noticed how so many Mumbai menus suddenly have watermelon and feta salad?Natalie: I think it's a Greek combination and you're right, it's everywhere now. But the pizza in Italy (which is where part of her family is from) is totally different from the one we get in Mumbai. They have less ingredients and the main thing is always the tomato sauce. You can tell the restaurant by its tomato sauce. Shunashir: Have you not taken to Indian food?Natalie: No, no. It's not that. But I am fonder of North Indian food because I find that it's a little sweeter in general, all your butter chickens and navratan kormas. And I think North Indian food is pretty much what you mean by Indian food elsewhere in the world, right?Mikey: Well, do you know what the national dish in the UK is? Shunashir: It used to be chicken tikka masala, but I'm not so sure about now.Mikey: I think it still is. By "national dish" they mean the most commonly ordered dish in restaurants.Natalie: I don't know why it is, but when I'm at home here, I don't like having cooked food as much. Maybe it's the weather?Mikey: Yeah, it could be. You'll also see that countries that are hotter actually have more chilli in their food. That's because it's counter-intuitive. The COVID-19 pandemic has halted all global sporting activities, jeopardising the T20 World Cup, scheduled in Australia from October 18-November 15, and also "indefinitely" suspending the 13th IPL, which was slated to begin on March 29. "I think the IPL will try and target that October window and the T20 World Cup will get pushed back," McCullum, the coach of IPL side Kolkata Knight Riders, told 'Sky Cricket Podcast'. There is also the women's ODI World Cup scheduled in New Zealand in February, 2021. "That may mean the Women's World Cup gets pushed back but hopefully we get to see all three tournaments operate." McCullum said he neither sees the T20 World Cup happening without the stadium fans nor does he believe that teams from 16 nations will be able to travel to Australia in the wake of the pandemic, which has infected more than 20 lakh people globally. If IPL doesn't happen, none of the players or support staff get paid. The ICC's Chief Executives Committee (CEC) is set to meet on Thursday to discuss the financial implications of COVID-19 and also the contingency planning for all ICC global events, including the T20 World Cup, over a conference call. "For Australia to move 16 international teams plus all of their support staff and then broadcasters, seems a bridge too far. I can't see them playing the T20 World Cup behind closed doors either," McCullum said. "There may be a window a bit later in the new year of 2021 which could then open up a window for the IPL (in October and November). You'd have to move some overseas players for the IPL but with the broadcasters based in India, it is a lot easier to pull it all together. "The ICC and world cricket need crowds to operate but India can probably sustain things commercially behind closed doors because they are going to get so many eyeballs." Former New Zealand seamer Simon Doull, who joined McCullum and Ian Smith on the podcast, also believes spectators will be important to get the revenues flowing from the T20 World Cup. "A lot of the ICC's revenue for down the track comes from the World Cups so they want as many people in the stands as possible," he said. "They would hate to see a T20 World Cup under lockdown where no one could go and watch and the atmosphere would probably be a little bit less." Doull also said ICC needs to decide how important is the T20 World Cup. "How important is the T20 World Cup? That the first question from an ICC point of view," he said. "Is it important enough to have private jets out of each county with cricket teams on them, two weeks in quarantine in Australia and then the tournament taking place, whether there are fans in the stands or not? Several countries, including Australia have imposed travel restrictions, and McCullum feels adding a team from New Zealand in the tournament could pique the interest of the audience in the league, which has suffered a dip in crowd and TV numbers in the past two years. "What an opportunity for the Big Bash if there's a shortage of international cricket," McCullum told 'SEN Radio'. "If we're being honest, the Big Bash has tailed off a little bit in its following of late and what a great opportunity to really launch that back into Australian sporting fans' eyes and what a great opportunity to bring a New Zealand team in the BBL," he added. The former captain also suggested removing the "overseas" cap on New Zealand players as several international players may not be able to compete if the COVID-19 restrictions continue. "Perhaps you could even use New Zealand players as local players because there may be a distinct lack of overseas players who will want to travel, especially high-quality ones," McCullum said "A little bit of creative thinking and another opportunity to get some New Zealanders across Tasman," he added. Talks for a trans-Tasman bubble, which will alow travel between the two countries, have been on at the government level as cases of coronavirus in both countries continue to drop. Last week, Australian officials granted 36 New Zealand rugby players and staff a rare exemption from the country's ban on international arrivals.
