2. Relevant facts are that plaintiff has filed suit for recovery against the defendant no.1 and 2. The case of the plaintiff, as set out in the plaint, is that plaintiff is a company registered under the Companies Act 1956 and is engaged in the manufacturing of coating powder and trading of decorative and industrial paints and thinner since 1994. The defendant is a limited company and registered under the Companies Act, 1956 and involved in the manufacturing of electrical panels. The defendant through its directors/ officials approached the plaintiff for purchase of the coating powder and industrial paints and thinner and at the time of commencement of the business, the terms of business, as specifically printed on or contained in the plaintiff's invoices were agreed by the defendant and thereafter business dealings and transactions started between the parites hereto in 2004 and since 15.04.2004 they have been maintaining a running account.

1.2 Notice to the respondent was dispensed with, as the respondent had not yet been summoned by the Trial Court.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. Therefore, noticing that several opportunities have already been afforded to the complainant, the complaint was dismissed. 3 Sh.Anish Bhola, counsel for the petitioner has assailed the CR No.-89/2020 Page No.-1 of 4 impugned Order on the ground that the Ld. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.

Twenty-three Surat returnees were among 24 people who tested positive for COVID-19 in Odisha on Saturday, taking the total cases in the state to 294, the Health and Family Welfare department said. Of the 24 fresh Covid cases, Ganjam reported 18, while three came from Mayurbhanj and one each from Nayagarh, Bhadrak and Sundergarh. Nayagarh district reported its first novel coronavirus case when a 40-year-old Surat returnee tested positive to the disease. With this, the COVID-19 has now spread to19 of the 30 districts of Odisha. At present, there are 224 active cases in the state and 68 people have recovered. Two people from Bhubaneswar have succumbed to the disease, an official said adding that 343 persons are in hospital isolation. The state health department had on Friday conducted 3,348 tests for COVID-19, he said, adding that Odisha has so far tested 56,322 samples. The West Bengal government has asked the heads of all hospitals to ensure that immunisation programmes against vaccine-preventable diseases continue in full steam amid the Covid-19 outbreak. Immunisation should go on during COVID-19 outbreak to protect children and pregnant women from 'vaccine-preventable diseases' (VPD), the health and family welfare department said in a notification. It was addressed to the superintendents of all medical colleges and hospitals and the chief medical officer of health of all districts. Copy of the notification issued on May 6 was made available on Saturday.

Security forces have launched a search operation in a forest area near the International Border in Samba district after three grenades and 54 rounds of AK ammunition were recovered from the area, police said on Sunday. The explosives and ammunition were noticed by some villagers in the forest area near Goran village in Kandi belt on Saturday following which the police were informed, a senior official said. He said a joint search operation was launched following the recovery as the area used to be an old route for infiltration from across the border. Security forces had conducted massive combing operations all along the IB in Jammu, Kathua and Samba districts recently. However, nothing was found during these operations.

At least 34 new COVID-19 cases were reported in Bihar, raising the total count in the state to 629, a top health department official said on Sunday. Of the 34, 11 hail from Begusarai, seven each from Saharsa and Madhepura, five, including a woman, from Rohtas, two from Darbhanga and one each from Khagaria and Araria districts, Sanjay Kumar, the principal secretary of the state health department, said. "We are ascertaining the infection trail. These are yesterday's results received late in the night," Kumar said, adding that seven out of 34 patients were minors. Barring Jamui, all 37 districts in the state have reported coronavirus cases. The number of active cases in the state currently stands at 306. Altogether, 318 people have recovered so far. India's fuel consumption fell almost 46 per cent in April as all petroleum products, except LPG, saw massive demand erosion following the nationwide lockdown that halted economic activity and travel. The demand, which showed signs of pick up in the last 10 days of April after the government allowed resumption of economic activity beyond the urban municipal limit, is likely to rebound in second half of May as more areas are opened. India's fuel consumption fell 45.8 per cent to 9.929 million tonnes in April, down from 18.32 million tonnes fuel consumed in the same month a year back, according to official data released by the petroleum ministry. Fuel consumption during March, when travel restrictions began to be imposed to curb the spread of coronavirus, stood at 16.08 million tonnes. Petrol sales were down 60.43 per cent to 9,73,000 tonnes in April. Thirumala was acquired by France-based dairy group Lactalis in 2014 and the company produces dairy products across nine manufacturing units in southern states. Thirumala CEO Christophe Jouin said the company had taken precautions by communicating across factories, setting up milk collection points and issuing safety guidelines to employees. "The first step was to carry out checking of temperatures of employees before they enter the factory and maintaining social distancing norms during daily work, among others," he told PTI. Left without jobs and desperate to return home amid the lockdown, 10 migrant labourers have set off on foot from Pune in Maharashtra for their native place hundreds of kilometres away in Uttar Pradesh. The Pune administration has asked the officials concerned to make necessary arrangements for such migrants at hotels and halls available on highways in the district and set up camps for them, in the wake of the death of 16 migrant labourers after being run over by a goods train in Aurangabad. The 10 migrant workers, all natives of Allahabad district in Uttar Pradesh, started walking to their homes from Pune on Saturday evening after losing their jobs and finding to difficult to sustain their livelihood here. "We all were working as construction labourers in Pune. Now we don't have food to survive. Therefore, we have started for our native place in Uttar Pradesh," one of the labourers from the group said.
