The Justice Department announced today that it has reached a settlement agreement with Valley Club, a former swimming facility located in Huntingdon Valley, Pa, resolving allegations that the company discriminated against persons because of race. The Justice Department’s investigation was conducted under Title II of the Civil Rights Act of 1964, which prohibits discrimination on the basis of race, color, national origin and religion in places of public accommodation, such as hotels, restaurants and places of entertainment.

A tax return preparer from Macon, Ga., pleaded guilty Thursday to filing a false claim for tax refund, theft of government money and aggravated identity theft.

The Department of Justice and the U.S. Environmental Protection Agency today announced a settlement with two subsidiaries of Sinclair Oil Corporation to resolve alleged violations of air pollution limits established in a 2008 consent decree at refineries in Casper and Sinclair, Wyo.

The Justice Department announced today that it reached an agreement with MicroLink Devices, a manufacturer of semiconductor structures and advanced solar cells based in Niles, Ill. The Justice Department today concurrently filed a complaint and consent decree against the Burke County, N.C., Department of Social Services, alleging that the county did not have an effective harassment and discrimination policy in place and did not provide sufficient training in race harassment and discrimination for its employees and supervisors, in violation of Title VII of the Civil Rights Act of 1964, as amended. Title VII is a federal statute which prohibits employment discrimination on the basis of sex, race, color, national origin or religion.

GFI Mortgage Bankers Inc., a large independent home mortgage firm that concentrates on the New York, New Jersey, and Florida markets, will pay $3.555 million to resolve a lending discrimination lawsuit filed by the Department of Justice and the U.S. Attorney’s Office for the Southern District of New York. The lawsuit alleges that GFI engaged in a pattern or practice of discrimination by pricing residential mortgage loans for qualified African-American and Hispanic borrowers higher than for similarly-qualified non-Hispanic white borrowers between 2005 and 2009.

The Justice Department announced today that it and the National Federation of the Blind have reached a settlement with the Sacramento Public Library Authority in Sacramento, Calif., to remedy alleged violations of the Americans with Disabilities Act (ADA). The agreement resolves allegations that the library violated the ADA by using inaccessible Barnes & Noble NOOK electronic reader devices in a patron lending program.

The Scotts Miracle-Gro Company, a producer of pesticides for commercial and consumer lawn and garden uses, was sentenced today in federal district court in Columbus, Ohio, to pay a $4 million fine and perform community service for eleven criminal violations of the Federal Insecticide, Fungicide and Rodenticide Act, which governs the manufacture, distribution, and sale of pesticides.

The Justice Department announced today that it has filed a lawsuit against the owner and operator of the Heritage Point mobile home park in Montgomery, Ala., alleging that the companies and their employees or officers discriminated against African-Americans.

The Justice Department filed a motion to intervene today in a lawsuit against Jerry Estopy, d/b/a Estopy Farms, a sorghum and soy farm in McAllen, Tex., which also provides equipment and equipment operators for harvests at other farms. The Justice Department seeks to intervene in a lawsuit filed by two U.S. citizens against the farm. The department alleges that the company discriminated against one of the U.S. citizens when it refused to hire him based on his citizenship status. The Immigration and Nationality Act’s (INA) anti-discrimination provision prohibits employers from discriminating against workers based on national origin or citizenship status in the hiring or firing process.

The Justice Department announced today that Luther Burbank Savings will invest $2 million in California communities and take other steps as part of a settlement to resolve allegations that it engaged in a pattern or practice of discrimination on the basis of race and national origin.

Anthony L. Dinunzio, 53, of East Boston, Mass., the acting leader of the New England La Cosa Nostra (NELCN) crime family, pleaded guilty today for his role in a conspiracy to extort protection payments from adult entertainment businesses in Rhode Island, according to a signed plea agreement filed today in U.S. District Court in Providence, R.I.

The Justice Department today announced a settlement agreement with Grand Circle LLC, based in Boston, doing business as Grand Circle Travel, to resolve alleged violations of the Americans with Disabilities Act (ADA) and ensure that persons with disabilities, including those who use wheelchairs or other mobility aids, are afforded full and equal access to the company’s travel services and facilities.

Bank of America N.A. has agreed to maintain revised policies, conduct employee training and pay compensation to victims to resolve allegations that it engaged in a pattern or practice of discrimination on the basis of disability and receipt of public assistance in violation of the Fair Housing Act (FHA) and the Equal Credit Opportunity Act (ECOA).

Three defendants pleaded guilty today to charges of conspiracy, smuggling, Lacey Act violations, money laundering and tax fraud for their roles in the international illegal trafficking of rhinoceros horn. All of the defendants were charged in February 2012 as part of “Operation Crash,” a nationwide U.S. Fish and Wildlife Service crackdown on those involved in the black market trade of endangered rhinoceros horn.

A Japanese freight forwarding company has agreed to plead guilty and to pay a $2.3 million criminal fine for its role in a conspiracy to fix certain fees in connection with the provision of freight forwarding services for air cargo shipments from Japan to the United States.

The U.S. District Court for the Southern District of New York entered a consent decree between the United States and a company that operates fan club websites for popular recording artists such as Justin Bieber and Selena Gomez, the Justice Department announced today. The government’s complaint, filed in connection with the decree, charges the company with violating both the Federal Trade Commission (FTC) Act and the Children’s Online Privacy Protection Rule. The company has agreed to pay a $1 million penalty to settle these charges.

Specialist Stephanie Heller, 37, of Wharton, Texas, pleaded guilty to a two-count criminal information charging her with one count of bribery and one count of conspiracy to commit bribery and wire fraud.

The United States has filed a complaint against three related companies that bought and sold consumer credit reports, the Justice Department announced today. Kolon Industries Inc. and several of its executives and employees have been indicted for allegedly engaging in a multi-year campaign to steal trade secrets related to DuPont’s Kevlar para-aramid fiber and Teijin Limited’s Twaron para-aramid fiber. The indictment seeks forfeiture of at least $225 million in proceeds from the alleged theft of trade secrets from Kolon’s competitors.

The Justice Department announced today that it reached an agreement with Advantage Home Care LLC, a home health care provider based in Hackensack, N.J., resolving claims that the company violated the anti-discrimination provision of the Immigration and Nationality Act (INA), when it required newly-hired lawful permanent residents to provide more or different documents during the Form I-9 employment eligibility verification process.

The Justice Department has reached an agreement with the county of Los Angeles to extend critical reforms at the Los Angeles County Juvenile Probation Camps that were set to expire later this month. Bobby Teets, 46, aka “Bull,” pleaded guilty on Dec. 9, 2010, to racketeering aggravated assault for his role in the assault of an applicant for membership in the gang, and was sentenced today by U.S. District Court Judge Ewing Werlein Jr. Teets is to serve the 72-month sentence consecutively to the state prison term he is currently serving.

Two German shipping companies pleaded guilty today in federal court in Houston to criminal charges that they concealed the illegal dumping of oil at sea from U.S. Coast Guard inspectors.

The Justice Department and Internal Revenue Service (IRS) announced today that attorney Aristotle R. Matsa (Rick Matsa), of Worthington, Ohio, was sentenced to 85 months in prison by the Judge Edmund A. Sargus Jr. of the U.S. District Court for the Southern District of Ohio. Judge Sargus also ordered Matsa to pay a criminal fine of $265,000, make restitution to the IRS in the amount of $388,000, and pay restitution to a client from whom Rick Matsa embezzled funds in the amount of $24,069.

Willie Lambert, 57, of Pittston, Pa., was sentenced today by U.S. District Judge Arenda L. Wright Allen in the Eastern District of Virginia to serve 30 months in prison, three years of supervised release and $449,514 in restitution, jointly and severally with co-defendants. Sean M. Lovelady, 28, of Pomona, Calif., was sentenced today by Judge Wright Allen to 23 months in prison, three years of supervised release and $7,500 in restitution.

A Newport News, Va., federal jury has found Jeffrey Charles guilty for conspiring with his daughter and son-in-law to defraud the United States, the Justice Department and the Internal Revenue Service (IRS) announced today. Charles was found guilty of one count of conspiracy, three counts of aiding and assisting in the preparation of false tax returns and one count of filing a false tax return.

Grant E. Bibb, 41, of Eagle Pass, Texas, and Paul Escobar, 32, of San Antonio, were sentenced today by Chief U.S. District Judge Fred Biery in the Western District of Texas.

Five charter fishing boat captains operating out of Rudee Inlet in Virginia Beach, Va. were indicted today for violating the Lacey Act by selling illegally harvested Striped Bass

John Hall, 27, an inmate at the Federal Correctional Institution in Seagoville, Texas, pleaded guilty today in federal court to violating the Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act stemming from his assault of a fellow inmate, who he believed to be gay, the Department of Justice announced. Hall assaulted his fellow inmate with a dangerous weapon, causing bodily injury to the victim on Dec. 20, 2011.
