The United States has filed a lawsuit to block KV Pharmaceutical Company, its subsidiaries, ETHEX Corp. and Ther-Rx Corp., and its principal officers from making and distributing adulterated and unapproved drugs. At the same time, KV agreed to the injunction in a consent decree.

John Cowdery, a former elected member of the Alaska state senate, was sentenced today to three years probation with a special condition requiring him to serve six months of home confinement for conspiring to bribe another Alaska state legislator.  U.S. District Judge Ralph Beistline for the District of Alaska also ordered Cowdery to pay a $25,000 fine.      

Beverly L. Masek, a former elected member of the Alaska House of Representatives, pleaded guilty today to conspiracy to commit bribery.  Masek pleaded guilty before U.S. District Judge Ralph Beistline in Anchorage to one count of conspiracy to commit bribery concerning programs receiving federal funds.

The Department is making grant funding available for public education programs concerning immigration-related employment discrimination. The Office of Special Counsel for Immigration Related Unfair Employment Practices (OSC), a section of the Department’s Civil Rights Division, announced the availability of funds for public education programs regarding employees’ rights and employers’ obligations under the anti-discrimination provision of the Immigration and Nationality Act (INA).

In response to the Red River flooding in North Dakota and Minnesota and subsequent relief efforts, the National Center for Disaster Fraud is reminding members of the public to be aware of and report any instances of alleged fraudulent activity related to relief operations and funding for victims. Members of the public can report fraud, waste, abuse or allegations of mismanagement involving disaster relief operations through the Disaster Fraud Hotline at 866-720-5721, the Disaster Fraud Fax at 225-334-4707 or the Disaster Fraud e-mail at disaster@leo.gov. A partner in a Pennsylvania-based lobbying firm was sentenced today by U.S. District Judge Henry H. Kennedy Jr., to five months of home detention for destroying evidence in connection with a public corruption investigation, Acting Assistant Attorney General Rita M. Glavin of the Criminal Division, U.S. Attorney Jeffrey A. Taylor for the District of Columbia, Assistant Director of the FBI’s Washington Field Office Joseph Persichini Jr., and Special Agent in Charge C. André Martin of Internal Revenue Service (IRS) Criminal Investigation announced.

A federal court has barred a Chicago tax preparation firm, El Caminante, Inc. and its principal operator, Maria Colica, from preparing federal income tax returns claiming false tax credits. The company and Colica agreed to the injunction. The Government civil injunction complaint filed in the case alleged that Colica fraudulently claimed fuel tax credits for customers who were not entitled to them.

The Department announced the arrest of a former trooper with the Texas Department of Public Safety who is charged with depriving multiple Latino motorists of their civil rights. According to the four count indictment returned by a federal Grand Jury in Corpus Christi, Texas, on April 8, 2009, Michael Anthony Higgins violated federal law by willfully stealing money from Latino motorists that he had stopped on the highway while working as a trooper.

A federal court has permanently barred Donald Morris of Bloomfield, Conn., from preparing federal income tax returns for others. Morris consented to the permanent injunction order, which was entered by U.S. District Court Judge Jane C. Hall in the U.S. District Court for the District of Connecticut.

"To ensure that the Department holds itself to the highest standards during discovery -- as in every stage of litigation -- in our criminal cases, and also in our civil litigation, we have taken both short-term and long-term action."

The Justice Department today filed a lawsuit in U.S. District Court in Newark, N.J., on behalf of U.S. Naval Reserve member George Lawton against the Newark Public Schools (NPS) alleging violations of the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

The University of Medicine and Dentistry of New Jersey (UMDNJ) has agreed to pay the United States $2 million to resolve federal civil fraud allegations that its hospital defrauded Medicaid. From 1993 to 2004, UMDNJ’s University Hospital submitted claims to Medicaid for outpatient physician services that were also being billed by doctors working in the hospital’s outpatient centers.

There is no tension between a sentencing scheme that is effective and fair and one that is tough and equitable. We must work toward these twin goals and we must do so now.

Frederic A. Bourke Jr., 63, was found guilty today by a federal jury in Manhattan of conspiracy to violate the Foreign Corrupt Practices Act (FCPA) and the Travel Act, and making false statements to the FBI.

"As a prosecutor, you need to be determined enough to pursue every single violent criminal, no matter how cold the evidence. You need to be dogged enough to charge all meritorious cases, no matter how difficult the challenges. You need to be tough enough to withstand public scrutiny, no matter how unfair the criticism."

The Justice Department today announced a settlement that, pending court approval, will resolve allegations that those involved in the design and construction of the Summerland Heights Apartments, a 318-unit apartment complex in Woodbridge, Va., discriminated on the basis of disability in the design and construction of the project.

Ohio Edison Company, a subsidiary of FirstEnergy Corp., has agreed in a consent decree to repower one of its coal-fired power plants using primarily renewable biomass fuels.

A former Congressional staffer and chief of staff in two federal agencies was indicted today by a federal grand jury in the District of Columbia on public corruption charges, the Justice Department announced. The five-count indictment charges Horace M. Cooper, 44, of Lorton, Va., with one count of conspiracy, one count of fraudulent concealment, two counts of false statements, and one count of obstruction of an official proceeding. U.S. Magistrate Judge Alan Kay today issued a criminal summons directing Cooper to make an initial appearance in U.S. District Court for the District of Columbia on Wednesday, Sept. 9, 2009, at 1:45 p.m.

"The work we have begun in the administration has already made a difference. What we are looking for are the short- and long-term solutions that combine the lessons learned from the past with the resources have, and will continue to fight for, in the future."

The Department today awarded $723,000 in grants to twelve groups serving communities throughout the country.

Twenty defendants have been charged in seven cases for allegedly participating in Medicare fraud schemes that resulted in more than $26 million in fraudulent bills to the Medicare program.

The federal suits – filed in Los Angeles; Panama City, Fla.; Salt Lake City; Nashville, Tenn.; and Pocatello, Idaho – allege that the defendants promote a tax fraud scheme designed to siphon hundreds of millions of dollars from the U.S. Treasury through fraudulent tax refund claims.

Bill J. Allen and Richard L. Smith were each sentenced in separate hearings today for their participation in a corruption scheme in which they provided approximately $395,000 in corrupt payments to public officials from the state of Alaska.

“This task force’s mission is not just to hold accountable those who helped bring about the last financial meltdown, but to prevent another meltdown from happening,” Attorney General Eric Holder said.

After three years of satisfying obligations under a deferred prosecution agreement, the charges against Statoil ASA for violating the anti-bribery and accounting provisions of the Foreign Corrupt Practices Act (FCPA) have been dismissed with prejudice.

The department announced today that it has entered into a consent decree with the Newark Public Schools (NPS) that will resolve its lawsuit on behalf of George Lawton, a naval reservist, against NPS alleging it violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

Clement Calhoun of Cherokee, N.C., pleaded guilty today in U.S. District Court in Asheville, N.C., to federal charges for unlawfully trafficking in bear gall bladders.

As a result of the new format, members of the public, including public interest organizations, scholars, and the media, will be able to more easily track FOIA performance.

Shamai Kedem Leibowitz, aka Samuel Shamai Leibowitz, 39, of Silver Spring, Md., pleaded guilty in federal court in Greenbelt, Md., to a one-count information charging him with knowingly and willfully disclosing to an unauthorized person five FBI documents classified at the "secret" level that contained classified information concerning the communication intelligence activities of the United States.

The new directive is part of a larger Justice Department initiative to create better communication and coordination to fight crime and promote justice in Indian Country.

The jury returned guilty verdicts on all four counts of the indictment that charged Michael Anthony Higgins with violating federal law by willfully stealing money from motorists that he had stopped on the highway while working as a trooper.

The Department has entered into a settlement agreement with the Metropolitan Government of Nashville, Tenn., and Davidson County, Tenn., to enhance the security of students with disabilities on public school buses.

A federal court has issued a permanent injunction barring Karen Liane Miller of Nashville, Tenn., from preparing federal income tax returns for others.

The Department has reached a settlement agreement with the Alameda County, Calif., Sheriff’s Office, under which it will provide sign language interpreters and other auxiliary aids and services to arrestees, detainees, suspects, victims, witnesses, complainants and visitors who are deaf, hard of hearing or deaf-blind at two jails.
