(Court of Appeals of New York) - In this case, petitioner, a not-for-profit religious corporation that owns real property, commenced proceedings pursuant to CPLR article 78 and RPTL article 7 after respondent Board of Assessment and Review for the Town of Catskill refused petitioner's applications for tax-exempt status pursuant to RPTL 420-a. The Appellate Division's grant of the petitions is affirmed, where petitioner adequately established its entitled to the RPTL 420-a exemption, as the proof at trial established that petitioner "exclusively" utilized the property in furtherance of its religious and charitable purposes.

(United States Second Circuit) - In an action for copyright infringement brought by successors-in-interest of the estates of William 'Bud' Abbott and Lou Costello against the author and producers of the play The Hand of God, the District Court's judgment in favor of defendants is affirmed where, although defendants' verbatim incorporation of more than a minute of the iconic Who's on First? comedy routine in their commercial production was not a fair use of the material, plaintiffs fail plausibly to allege a valid copyright interest.

Obduskey v. McCarthy and Holthus LLP

(United States Supreme Court) - Held that a business engaged in nonjudicial foreclosure proceedings was not a "debt collector" under the Fair Debt Collection Practices Act. A homeowner claimed that the business violated certain statutory requirements in carrying out a foreclosure on behalf of a lender. Rejecting this argument, the U.S. Supreme Court held that the Act was inapplicable to this nonjudicial foreclosure proceeding. Justice Breyer delivered the opinion for a unanimous Court, clarifying the statute's definition of debt collector.

(Supreme Court of California) - Held that customers who had paid sales tax on purchases they believed to be exempt did not have an equitable cause of action to compel the retailers to seek a tax refund from the state, under the facts here. Affirmed a judgment sustaining the retailers' demurrer.

(California Court of Appeal) - Affirmed. Plaintiff filed suit alleging that Defendant failed to pay them for their work growing marijuana as agreed under a contract. Defendant failed to file a responsive pleading. The trial court ordered Plaintiff to take the Defendant’s default by a specified date. The default was taken. Defendant then sought to set-aside the default. The trial court denied relief. The appeals court found no abuse of discretion finding that the Defendant’s failure to respond to the complaint was knowing and deliberate.

US v. McCoy

(United States Fourth Circuit) - Affirmed a conviction and sentence for federal drug trafficking conspiracy where a defendant pleaded guilty and waived his right to appeal except on the basis of ineffective assistance of counsel or prosecutorial misconduct. Defendant's appeal argued that a factual basis did not support his guilty plea, which he could argue as this type of challenge falls outside the scope of a valid waiver. However, in affirming the Fourth Circuit held that a factual basis did, in fact, support his plea.

Fox's Judge Napolitano Slams ‘Dangerous’ McConnell Plan To Shield Businesses From Coronavirus Lawsuits

Fox News judicial analyst Andrew Napolitano said on Thursday that a Republican plan to shield businesses from coronavirus-related lawsuits is “dangerous.”

Earlier this week, Senate Majority Leader Mitch McConnell (R-KY) suggested that he would not support additional relief funds to households and businesses unless the package also includes a measure shielding businesses from liability for coronavirus infections.

But Napolitano argued that the provision would be anti-conservative and violate states rights.

“Can the Congress tell state courts that they cannot hear claims of liability when someone goes into a public accommodation and contracts coronavirus?” the Fox News analyst explained. “Congress has been very reticent to do that. Conservatives who believe in states rights have been very reluctant to interfere with the operation of state courts.”

Napolitano pointed out that the only other instance where Congress has restricted state courts is a law that prohibits gun manufacturers from being sued over gun violence.

“I think that this liability shield business is very dangerous,” he added. “The decision of whose fault someone was harmed by should be decided by juries and not by politicians.”
