Kemper v. Deutsche Bank AG

(United States Seventh Circuit) - Held that the mother of a U.S. Army service member who was killed by a roadside bomb in Iraq did not state a claim against a Germany-based bank. She claimed that the bank was responsible for her son's death under the Anti-Terrorism Act because it had conspired with Iran by evading U.S. banking sanctions. She contended that the fatal bomb was a signature Iranian weapon. Affirmed that she did not plausibly plead a claim.

(United States Second Circuit) - Held that a group of electrical power generators and related trade groups could not proceed with their lawsuit challenging the constitutionality of the New York Public Service Commission's Zero Emissions Credit program, which subsidizes qualifying nuclear power plants by creating state‐issued clean-energy credits. Affirmed a dismissal of the lawsuit for failure to state a claim.

Tripplett v. Workers' Compensation Appeals Bd.

(California Court of Appeal) - Affirmed the denial of a former professional football player's claim for workers' compensation benefits as former defensive tackle, Larry Tripplett, sought workers' compensation for cumulative injuries he suffered during his playing career. He argued that he was eligible for benefits in California, but the Fourth Appellate District disagreed, finding that he was ineligible because he was outside the state when he signed his employment contract with the Indianapolis Colts.

(United States Seventh Circuit) - Upheld a federal agency's decision that a former coal miner was entitled to benefits under the Black Lung Benefits Act. His former employer, a coal company, had challenged the benefits award.

(United States Fifth Circuit) - Affirmed. A suit arising from the denial of a petition for declaration of citizenship because the applicant failed to demonstrate that they resided in the jurisdiction where they applied was properly dismissed for lack of jurisdiction because the Administrative Procedures Act provides an adequate remedy.

Impeachment Inquiry Update & California Democratic State Endorsement Convention Preview

Members of California’s Congressional delegation are center stage at the House Intelligence Committee impeachment inquiry hearings on Capitol Hill.
