This Suo-Moto Writ Petition has been taken up pursuant to a note dated 07.05.2020 of Registrar General, which was put up before Hon'ble the Chief Justice on 08.05.2020 and as directed, the same has been listed before this Division Bench today.

We have perused the file and have heard Mr. Rahul Mehra, Ld. Standing Counsel (Criminal) for Government of NCT of Delhi and Mr. Sandeep Goel, Director General (Prisons).

It has been noticed that for effective implementation of the directions issued by Hon'ble Supreme Court of India in Suo Moto Petition (Civil) W.P. (C) 3080/2020 Page 1 of 3 No.1/2020-In Re: Contagion of COVID-19 Virus in Prisons vide its orders dated 23.03.2020 and 13.04.2020, a High Power Committee (HPC) was constituted by High Court of Delhi to decongest the Jails to prevent the spread of COVID-19 (Novel Corona Virus) and as per the recommendations of this Committee dated 28.03.2020, 07.04.2020 and 18.04.2020 and on the basis of orders in WP (C) No.2945/2020 titled as "Shobha Gupta & Ors. vs. Union of India & Ors.", 2177 Under Trial Prisoners (UTPs) were released on interim bail for a period of 45 days from the date of their respective release.

SHRI A. RAJA (NILGIRIS): Sir, a tragic incident happened in the early hours of Monday, the 2nd December 2019 at Nadoor Village near Mettupalayam Municipality in my constituency. A compound wall constructed by  a private individual had collapsed,  instantly killing 17 Scheduled Castes people, including children. The fact remains that the villagers had on several occasions complained to the district administration and the State Government with regard to the danger posed by the compound wall. The incident led to scores of people, including relatives of the deceased and the members of the pro-Dalit organisations like Tamil Tigers and other political parties protest against the district administration and pressing for reasonable demand to accommodate them inside the Mettupalayam Government Hospital Campus.

HON'BLE MR. JUSTICE JAYANT NATH JAYANT NATH, J. (JUDGMENT)

1. This Writ Petition is filed seeking appropriate order for setting aside the sealing order dated 5.1.2019 and a direction to deseal the premises being Khasra No.257, Village Siraspur, Delhi.

2. The case of the petitioner is that since 1988 the petitioners have been enjoying the property and spending huge amounts on the same. In 2011 a threat was extended to dispossess the petitioners without following due process of law. The petitioner thereafter filed three separate Writ Petitions which were disposed of by this court on 22.2.2011 directing the petitioners to file appropriate petition for declaration of their rights with respect to the land in their possession. The respondent/Gaon Sabha were permitted to file W.P.(C) 1355/2019 Page 1 of 7 ejectment proceedings against the petitioner and till disposal of the ejectment proceedings protection was given to the petitioner.

1. The present petition under Article 226 of the Constitution of India has been listed before this Bench by the Registry in view of the urgency expressed therein.

2. The writ petition has been heard by way of video conferencing.

3. Present public interest litigation has been filed seeking immediate relief for the Rohingya families living in three different settlements in Delhi (i.e. Khajuri Khas, Shram Vihar and Madanpur Khadar) on the ground that they have been denied relief under the various relief packages announced by the Government of Delhi to combat the COVID-19 pandemic.

Learned counsel for petitioner states that despite order dated 11th May, 2018 passed by the Supreme Court in W.P.(C) 859/2013, the respondent has failed to provide basic amenities such as safe drinking water, sanitation, medical aid and education for their children. The West Bengal government has asked the heads of all hospitals to ensure that immunisation programmes against vaccine-preventable diseases continue in full steam amid the Covid-19 outbreak. Immunisation should go on during COVID-19 outbreak to protect children and pregnant women from 'vaccine-preventable diseases' (VPD), the health and family welfare department said in a notification. It was addressed to the superintendents of all medical colleges and hospitals and the chief medical officer of health of all districts. Copy of the notification issued on May 6 was made available on Saturday.

The West Bengal Health Department on Saturday formed teams to support surveillance and monitoring of treatment at five hospitals treating COVID-19 patients in the city. The team members will pay regular visits to these hospitals and send reports to the department, the state government said in an order. The department has also set up a dedicated help line for issues regarding the non-availability of PPEs and other supplies. The feedback and suggestions will be duly recorded and acted upon by the state government for appropriate remedial measures, the order said. The West Bengal government has also constituted a team for guidance on containment activities in different districts of the state.

Sitting on a liquor stockpile of around Rs 3,000 crore, restaurants and hotels across the country are asking state governments to allow them to sell the stock lying with them due to the coronavirus lockdown. "We are truly living in unprecedented times where on one hand we are sitting with expensive liquor inventory and on the other hand, we are cash starved," National Restaurant Association of India (NRAI)PresidentAnurag Katriar said. As part of a stimulus package for the coronavirus-hit economy, the government is working on a credit guarantee scheme to enable banks to provide additional 10-15 per cent working capital to MSMEs for payment of wages, sources said. Currently, banks are offering an extra line of credit of 10 per cent based on working capital limits, which the government intends to increase further. Since units are closed due to lockdown and there has been no operation for the past two months, most micro, small and medium enterprises (MSMEs) do not have money for paying wages and financial assistance for them is under consideration of the government, the sources said. One of the proposals under consideration is to provide 10-15 per cent additional line of credit by banks over the working capital limit of the MSME sector, which is the largest employer in the country after agriculture.
