(Court of Appeals of New York) - In an injury and tort action, brought against defendant city after twelve-year old plaintiff was seriously injured in a collision involving a speeding driver on a Brooklyn roadway, the trial court's entry of judgment for plaintiff is affirmed. The Court held that: 1) plaintiff did not have to prove the existence of a special duty because the city's acts or omissions regarding the road were made in a proprietary capacity; 2) the evidence was legally sufficient to uphold the jury's finding that the city's negligence was a proximate cause of the accident; and 3) the doctrine of qualified immunity did not apply.

(Supreme Court of California) - In a government contracts dispute alleging the tort of intentional interference with prospective economic advantage, the Court of Appeals judgment overturning the trial court's judgment sustaining defendants demurrer, is reversed where plaintiffs' allegations -- that they had submitted the second lowest bids on several contracts awarded to defendant, and that their bids would have been accepted but for defendant's wrongful conduct during the bidding process -- are insufficient because: 1) public works contracts are a unique species of commercial dealings; 2) in the contracts at issue here, the public entities retained broad discretion to reject all bids; 3) the bids were sealed, and there were no postsubmission negotiations; 4) in awarding the contracts, the public entities could give no preference to any bidder based on past dealings, and were required to accept the lowest responsible bid; and 5) in these highly regulated circumstances, plaintiffs had 'at most a hope for an economic relationship and a desire for future benefit.' Blank v. Kirwan (1985) 39 Cal.3d 311, 331.

Trustees of Indiana University v. Curry

(United States Seventh Circuit) - Upheld the constitutionality of an Indiana law making it a felony to acquire, receive, sell or transfer fetal tissue. Indiana University sought an injunction barring enforcement of the statute, which impacts medical research. Reversing the district court, the Seventh Circuit held that the statute is not unconstitutionally vague, and also rejected the university's other constitutional arguments.

Murray v. City of Philadelphia

(United States Third Circuit) - Dismissed an appeal filed in a civil rights case by the estate of a man who was shot and killed by police officers. As the administrator of the estate, the man's mother filed suit alleging that the officers had used excessive force. When the jury returned a verdict in favor of the officers, she appealed pro se. Dismissing her appeal on grounds that she had filed it without counsel, the Third Circuit held that a non-attorney who is not a beneficiary of an estate may not conduct a case pro se on behalf of the estate.
