Like every May 9, Gennadiy Matveyev observed a tradition this Friday at his little dacha near Moscow: he and his wife Galina raised the Russian flag to remember the victory over Nazi Germany in 1945. Tesla CEO Elon Musk said Saturday the company will file a lawsuit against Alameda County and threatened to move its headquarters and future programs to Texas or Nevada immediately, escalating a fight between the company and health officials over whether its factory in Fremont can reopen. Tesla had planned to bring back about 30% of its factory workers Friday as part of its reopening plan, defying Alameda County's stay-at-home order. TechCrunch has reached out to Elon Musk directly.

(California Court of Appeal) - Affirmed an order establishing a limited conservatorship of the person in a case involving a woman with autism spectrum disorder who objected to the conservatorship and to the appointment of her mother and elder sister as conservators.

(California Court of Appeal) - Held that a father who paid child support did not have to reimburse his ex-wife's new partner for expending funds to care for the child. Affirmed a ruling after a bench trial.

(United States Ninth Circuit) - Held that an employee of the Salvation Army could not proceed with her claims for retaliation and hostile work environment, because Title VII's religious organization exemption barred the claims. Also, it did not matter here that the Salvation Army had failed to timely raise the defense. Affirmed a summary judgment ruling.

(United States Ninth Circuit) - Affirmed the dismissal of a copyright infringement action brought against an individual who allegedly downloaded and distributed (i.e., pirated) a movie through peer-to-peer BitTorrent networks. The individual argued that he was not liable for infringement even if the infringing Internet Protocol (IP) address was his, because multiple individuals could connect via his IP address. Agreeing with him and noting that he operated an adult foster care home, the Ninth Circuit held that the complaint failed to state a claim of either direct or contributory infringement.

(California Court of Appeal) - Held that a fan of the singer Michael Jackson could not proceed with her proposed class action lawsuit against an entertainment company and others for releasing a posthumous album that allegedly contained three fake tracks not actually sung by the popular singer. The defendants, who filed an anti-SLAPP motion, contended that the claims against them must be stricken. Agreeing with them, the California Second Appellate District reversed the trial court's denial of the anti-SLAPP motion in relevant part.

(United States Second Circuit) - Vacated an injunction that prevented a movie producer from releasing a film about the rock band Lynyrd Skynyrd. Held that a consent order settling a 1988 lawsuit concerning band members' rights to make films about the band did not support the issuance of an injunction here.

(United States First Circuit) - In an infringement action to determine whether a Puerto Rico credit union infringed a bank's word mark and trade name ORIENTAL with its competing marks COOP ORIENTAL, COOPERATIVA ORIENTAL, ORIENTAL POP, and CLUB DE ORIENTALITO, the District Court's finding of non-infringement and refusal to enjoin their use is: 1) reversed as to COOP ORIENTAL, COOPERATIVA ORIENTAL, and ORIENTAL POP, where the district court's determination of non-infringement was clearly erroneous; and 2) affirmed where the district court's determination is supportable as to CLUB DE ORIENTALITO.

(United States Federal Circuit) - In a trademark case to determine whether appellant used its marks in connection with personnel placement and recruitment services, or whether the Trademark Trial and Appeal Board correctly held that it failed to do so because it used its marks on software offerings, without more, the Board's decision is vacated where proper question is whether appellant, through its software, performed personnel placement and recruitment services and whether consumers would associate appellants registered marks with personnel placement and recruitment services, regardless of whether the steps of the service were performed by software.

(United States Supreme Court) - Held that parties do not consent to classwide arbitration if the agreement is ambiguous on that point. An employer sought to block an employee from proceeding with a proposed class action lawsuit and instead force his claims into individual arbitration. The U.S. Supreme Court agreed that the employer had the right to do this, because the arbitration agreement was ambiguous about the availability of classwide arbitration. Chief Justice Roberts delivered the opinion of the 5-4 Court.

(United States Supreme Court) - Held that the Tennessee Valley Authority is subject to suits challenging any of its commercial activities, just as if it were a private corporation supplying electricity. The TVA insisted that, as a government-owned corporation, it has sovereign immunity from all tort suits arising from its performance of so-called discretionary functions. However, the U.S. Supreme Court disagreed in a unanimous opinion delivered by Justice Kagan.

(United States Ninth Circuit) - Reversed a misdemeanor conviction for eluding examination or inspection by immigration officers in violation of 18 USC section 1325. Held that an alien that crosses into this country at a non-designated place of entry is not guilty of eluding examination, because such conduct must occur at a designated examination place.
