(United States Ninth Circuit) - Granted a new trial in a copyright case involving a claim that Led Zeppelin copied key portions of its hit Stairway to Heaven from a song written by a musician named Randy Wolfe. Held that several jury instructions were erroneous and prejudicial, including the instructions on originality, and thus vacated the jury's verdict of no infringement.

(United States Ninth Circuit) - Affirmed the dismissal of a trademark infringement lawsuit brought by a financial services company, holding that the use of its trademarks by a publishing company constituted nominative fair use.

(United States Fifth Circuit) - Held that the First Amendment's commercial speech protections entitled a company to operate automotive service centers under the name "Tire Engineers," even though a state board that licenses engineers objected to the use of the profession's occupational title. Reversed and rendered summary judgment in favor of the company, in this declaratory judgment action.

(United States Supreme Court) - Held that consumers could proceed with an antitrust lawsuit alleging that Apple Inc. used monopolistic power to overcharge for iPhone apps. Apple contended that the lawsuit was barred because the consumers were not "direct purchasers" within the meaning of the Illinois Brick case. However, the U.S. Supreme Court rejected Apple's argument in a 5-4 decision, on review of a dismissal ruling. Justice Kavanaugh delivered the majority opinion, joined by the four liberal justices.

(United States Supreme Court) - Addressed whether the State of Mississippi's peremptory strike of a particular black prospective juror was motivated by discriminatory intent. Justice Kavanaugh, who delivered the opinion of the 7-2 Court, explicitly stated that the decision broke no new legal ground but rather simply reinforced the Batson decision, in this case involving a man's sixth murder trial (the other five had ended in hung juries or else been reversed on appeal).

(United States Federal Circuit) - Affirmed in part, reversed in part, and vacated in part. Plaintiff brought a patent infringement action. A jury found that the defendant infringed on both asserted claims and that neither claim was invalid. The Federal Circuit Court of Appeals affirmed some of plaintiff’s infringement claims, but stated that plaintiff’s theory of infringement of other claims was inadequate to support the judgment of infringement and therefore reversed on that claim.

(United States Seventh Circuit) - Partially affirmed, partially vacated. A man was properly convicted on drug charges and was subject to a sentence enhancement for maintaining drug premises, but the court plainly erred in calculating his relevant conduct and the case was remanded for resentencing.
