Self-proclaimed “Governor” of Alabama Sentenced to Ten Years in Federal Prison for Tax Fraud

Monty Ervin and Patricia Ervin, owners of Southern Realty in Dothan, Ala., were sentenced today to federal prison for conspiring to defraud the United States and tax evasion, the Justice Department and Internal Revenue Service (IRS) announced. After a two-week trial that began Oct. 25, 2011, a federal jury in Montgomery, Ala., convicted the Ervins of one count of conspiracy and three counts of tax evasion. The jury also convicted Patricia Ervin of one count of structuring transactions to avoid bank reporting requirements. Monty Ervin was sentenced to 120 months in prison; Patricia Ervin was sentenced to five years of probation, with the condition that she spend 40 consecutive weekends in jail. In sentencing the Ervins, the court found that Monty Ervin was the leader and organizer of the conspiracy and exercised control over Patricia Ervin.

Minnesota Business Owner Pleads Guilty to Federal Excise Tax Crimes and Tax Fraud

Jason W. Leas, a resident of Crookston, Minn., and co-founder of Best Used Trucks of Minnesota Inc., pleaded guilty today to one count of failing to pay federal excise taxes, one count of failing to file a federal excise tax return and one count of filing a false individual federal income tax return for tax year 2007, the Justice Department and Internal Revenue Service (IRS) announced. Leas was charged by information filed on May 29, 2012. He entered his plea of guilty before U.S. District Court Senior Judge Richard H. Kyle in Duluth, Minn.

Former Florida Salesperson Sentenced to Jail for Tax Fraud Conspiracy

Dr. Ellen Meredith Stubenhaus, previously of Lake Worth, Fla., and later an expatriate living in Costa Rica, was sentenced to 60 months in prison today by U.S. District Judge M. Casey Rodgers in Tallahassee, Fla., the Justice Department and Internal Revenue Service (IRS) announced. Stubenhaus, who was extradited from Costa Rica to the United States in September 2011, had previously pleaded guilty to conspiracy to defraud the United States. In addition to her jail sentence, Stubenhaus was sentenced to three years of supervised release and ordered to pay restitution of $373,549 to the IRS.

Residents of California and Utah Sentenced for Tax Fraud

David L. Johnson and Michael L. Putnam were sentenced today following their convictions for tax crimes related to their involvement in the Genesis Fund, the Justice Department and Internal Revenue Service (IRS) announced. Both Johnson and Putnam had previously pleaded guilty before U.S. District Judge Dale S. Fischer in the Central District of California. According to the original indictment filed in this case, the Genesis Fund was a private investment fund that was marketed as investing in foreign currency trading, but that operated as a Ponzi scheme.

Charles A. Davis, 63, formerly of Mooresville, N.C. was sentenced today in U.S. District Court to 120 months in prison for committing tax fraud, the Justice Department and Internal Revenue Service (IRS) announced. U.S. Judge Richard L. Voorhees in the Western District of North Carolina also ordered Davis to serve twelve months of supervised release after his prison term and pay $538,569 as restitution to the IRS.

Ohio Attorney Sentenced to 85 Months in Prison for Tax Fraud and Obstruction of Justice Crimes

The Justice Department and Internal Revenue Service (IRS) announced today that attorney Aristotle R. Matsa (Rick Matsa), of Worthington, Ohio, was sentenced to 85 months in prison by the Judge Edmund A. Sargus Jr. of the U.S. District Court for the Southern District of Ohio. Judge Sargus also ordered Matsa to pay a criminal fine of $265,000, make restitution to the IRS in the amount of $388,000, and pay restitution to a client from whom Rick Matsa embezzled funds in the amount of $24,069.

Federal Court Permanently Bars Michigan Lawyer from Promoting Alleged Tax Fraud Scheme

A federal court has permanently barred a Michigan lawyer, Tammy Daniels of Farmington Hills, from promoting an alleged tax fraud scheme, the Justice Department announced today. The civil injunction order, to which Daniels consented without admitting the allegations against her, was signed by Judge Paul D. Borman of the U.S. District Court for the Eastern District of Michigan. In August the court enjoined Daniels’s co-defendants, Damian and Holly Jackson, from preparing federal tax returns for others and promoting the scheme.

Justice Department Sues Nevada CPA to Block Promotion of Alleged Tax Fraud Scheme

The United States has sued a Las Vegas-based CPA and two others to stop an alleged tax-fraud scheme, the Justice Department announced today. Named as defendants in the civil injunction suit were CPA Wayne Reeves, Reeves’ wife, Diane Vaoga, and their alleged co-promoter, James Stoll. The government complaint was filed last month in Las Vegas with the U.S. District Court for the District of Nevada. Announcement of the court filing was delayed until Reeves was served with court papers this week.

Former Alabama State Employee Sentenced for Identity Theft and Tax Fraud

Natacia Webster of Montgomery, Ala., was sentenced today to 50 months in prison for conspiracy, wire fraud and aggravated identity theft, the Justice Department and Internal Revenue Service (IRS) announced.
