The Justice Department and Puerto Rico-based Indrescom Security Technology Inc. have agreed to settle allegations that the company discriminated against a work-authorized individual during the Employment Eligibility Verification Form I-9 process by requiring him to present a lawful permanent resident card, despite the fact that the employee had already produced documents establishing his identity and authority to work in the United States, and not allowing him to work when he did not produce the card.

Edward Arakelyan, 21, and Arman Vardanyan, 22, were each charged in a criminal information filed on March 5, 2012, in U.S. District Court in Oakland, Calif., with one count of conspiracy to commit bank fraud, one count of bank fraud, and one count of aggravated identity theft.

The Justice and Interior Departments today completed the first in a series of national level training courses, “Criminal Jurisdiction in Indian Country” (CJIC), designed to strengthen the ability of tribal and local law enforcement to participate in the investigation and enforcement of federal crimes in Indian country and fulfill a key training requirement under the Tribal Law and Order Act of 2010 (TLOA).

The Justice Department reached a settlement agreement today with Onward Healthcare, a healthcare staffing company based in Wilton, Conn., resolving allegations that the company posted discriminatory job advertisements on its home page and third party websites that limited its jobs to U.S. citizens.

The United States has filed civil injunction lawsuits in five cities seeking to shut down both the company that operates Instant Tax Service (ITS) as well as five owners of ITS franchises, the Justice Department announced today.

Ngozi Pole, of Waldorf, Md., also was sentenced by U.S. District Judge Emmet G. Sullivan in the District of Columbia to serve three years of supervised release and 500 hours of community service following his prison term and ordered to pay $77,608.86 in restitution.

The Department of Justice and the U.S. Attorney’s Office for the Southern District of New York filed a lawsuit alleging that GFI Mortgage Bankers Inc., a mortgage banker with operations in seven states, violated federal fair lending laws by charging African-American and Hispanic borrowers higher interest rates and fees on home mortgage loans because of their race or national origin, not based on their creditworthiness.

"I don’t need to tell anyone here what a difficult challenge youth violence is. You’re all part of the Forum because you’ve seen the consequences of juvenile crime in your own communities. You understand how complex this issue is – and you know this is not a problem any of us can solve alone – especially in this tough fiscal climate," said Acting Assistant Attorney General Leary.

"Especially in recent weeks – as the importance of protecting our children from harm has been at the forefront of our national discourse – the urgency of this challenge has been brought into stark focus. And the need to take action has never been more clear," said Attorney General Holder.

"There are parts of the world where everyone shares the same culture, the same religion, and the same language. But that’s not America. And it’s not Cincinnati. According to the Census Bureau, there are over 13,000 people in this city who were born outside of the United States. There are around 20,000 whose primary language isn’t English. And there are still more who follow customs and traditions that our own upbringing didn’t expose us to," said Deputy Attorney General Cole.

The Justice Department announced today the filing of a complaint in U.S. District Court in Arizona against Home Depot U.S.A. Inc. for violating the employment rights of California Army National Guard soldier Brian Bailey under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

Harout Hagop Sarafian was sentenced by U.S. District Judge Virginia A. Phillips.

The Justice Department today announced that it has resolved a lawsuit alleging that Air Methods Corp. and LifeMed Alaska, LLC willfully violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) by discriminating against and failing to reemploy Chief Warrant Officer Third Class Jonathon L. Goodwin of Wasilla, Alaska. The suit was filed in federal district court in Alaska.

Stephen A. Favato, a resident of Point Pleasant Beach, N.J., and a former partner in BDO Seidman LLP’s Woodbridge, N.J., office, was sentenced to 18 months in prison for tax crimes, the Justice Department and the Internal Revenue Service (IRS) announced today. In August 2010, a jury sitting in Newark, N.J., found Favato guilty of one count of corruptly endeavoring to obstruct and impede the Internal Revenue laws and one count of aiding and assisting in the preparation and filing of a false income tax return.

"While the Department of Justice does a great deal in this area, it is committed to doing more to serve survivors of domestic violence, sexual assault, and child abuse and to prevent these terrible crimes from occurring in the first place. That is why, led by the excellent work of the Office on Violence Against Women, we are working to support a coordinated community response to address the causes and consequences of domestic violence, sexual assault, stalking and child abuse," said Deputy Attorney General Cole.

The International Competition Network (ICN) launched and approved three new initiatives on international enforcement cooperation, the investigative process in competition cases and working with the courts.

Daniyar Zhaxalyk, 25, a citizen of Kazakhstan who entered the United States on a student visa, pleaded guilty today in Houston to one count of money laundering.

The Justice Department today filed a lawsuit against the city of Jacksonville, Fla., alleging that the city is engaged in a pattern or practice of employment discrimination against African-Americans in its fire and rescue department in violation of Title VII of the Civil Rights Act of 1964. The lawsuit challenges the fire department’s use of written examinations for the promotion of firefighters to four ranks – Lieutenant, Captain, and District Chief, all in the suppression line, and Engineer.

The Department of Justice and the Department of the Interior announced today that Freeport-McMoRan Corporation and Freeport-McMoRan Morenci Inc. have agreed to pay $6.8 million to settle federal and state natural resource damages claims related to the Morenci copper mine in southeastern Arizona.

The Justice Department today announced that it has reached a consent decree with Waupaca County, Wis., to resolve allegations that the county discriminated against an employee by denying her a promotion because of her sex.

Integrated Production Services Inc. (IPS), a Houston-based natural gas and oil drilling contractor, was sentenced today in federal court in Muskogee, Okla., to pay a criminal fine of $140,000 for violations of the Clean Water Act at its hydraulic fracturing operation in Atoka County, Okla., the Justice Department announced.

The Department of Justice announced today that it has settled its lawsuit against the Mortgage Guaranty Insurance Corporation (MGIC) for discriminating against women on maternity leave in violation of the Fair Housing Act. This settlement is the department’s first involving discrimination against women and families in mortgage insurance.

National Express Corporation and Petermann Partners Inc. will divest several school bus contracts and associated assets in the states of Washington and Texas in order to proceed with their proposed merger.

Joseph Hines of Tempe, Ariz., was sentenced by U.S. District Judge Virginia A. Phillips. In December 2010, Hines, 24, pleaded guilty to one count of conspiracy to solicit child pornography.

Suzanne Land, a Cincinnati attorney, pleaded guilty today to obstructing and impeding the Internal Revenue Service (IRS) while representing the estates of two deceased clients, the Justice Department and IRS announced. District Court Judge Herman J. Weber presided over the guilty plea hearing.

Frederic Alan Gladle, 53, was sentenced by U.S. District Judge Lee Yeakel.

"Sex trafficking is a big money-maker for criminals and a scourge to society. Traffickers callously seek to furnish their market with women, girls, and boys who have been cast out by society and whose options are few. In many cases, they are young people – not even teenagers – who are looking for the home they’ve never had. What they find, instead, are betrayal, cruelty, and abuse. And sadly, too often our systems of support and justice have offered no quarter," said Acting Assistant Attorney General Leary.

Pharmacia Corporation and Bayer CropScience Inc. have agreed to pay $4.25 million to federal and state natural resource trustees to resolve claims for natural resource damages connected with the Industri-plex Superfund site located in Woburn, Mass.

The Justice Department announced that it has reached two settlements today resolving claims that health care providers refused to serve people with HIV in violation of the Americans with Disabilities Act (ADA).

John Wyss, aka “Bones,” 55, of Monroe, Wis., was found guilty of one count of engaging in a child exploitation enterprise, one count of conspiracy to advertise child pornography and one count of conspiracy to distribute child pornography.

The Department of Justice today announced the filing of a lawsuit against the Nevada Division of Forestry (NDF) alleging that NDF discriminated against Ms. Tawnya Meyer, a former employee, when they fired her soon after she announced her pregnancy.

The Justice Department announced today that it has reached a settlement with Home Depot U.S.A. Inc., to resolve allegations that the company violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA) when it terminated the employment of Army National Guard soldier Brian Bailey.

Attorney General Eric Holder issued the following statement today on the resignation of United States Attorney for the Northern District of Illinois Patrick Fitzgerald.

Veniamin Gonikman, 56, a naturalized U.S. citizen originally from Ukraine, was sentenced today in federal court for his role in an international conspiracy to compel Eastern European women to work in exotic dance clubs in the Detroit metropolitan area. U.S. District Court Judge Victoria A. Roberts sentenced Gonikman to 36 months in prison followed by 3 years of supervised release. He is the ninth and final member of the charged conspiracy to be sentenced.

"Today, I’m very pleased to announce that we’re awarding almost $27 million to support NCMEC’s great work. The funds will continue all the great programs I just named – and many more, like the national resource center and information clearinghouse," said Acting Assistant Attorney General Leary.

"I’ve spent much of my career – as a prosecutor, in government, and as head of the National Center for Victims of Crime – working to strengthen our responses to victims of all ages.
