1. The petitioners have sought a direction upon respondent No. 3 to issue passports in their favour.

2. According to the petitioners, they had applied for passports after depositing the requisite fee. The application of the petitioner was allotted file number JM1066761201422 whereas, application of petitioner No. 2 was allotted file number JM1066765476422, whereafter, the said applications were forwarded to respondent No. 2 for verification. The applications were submitted by the petitioners on 11.08.2022 and 12.08.2022 but despite lapse of so many years, the respondents have not taken any action in the matter which has compelled the petitioners to approach this Court.

1. The petitioner has sought temporary bail for the purpose of attending marriage ceremony of his younger brother which is stated to be scheduled on 9th and 10th November, 2024.

2. Heard and considered.

3. The petitioner has been arrested in a case arising out of the Crime No. 15/2024 for the commission of offences under Sections 8/21/22/29 NDPS Act. As per case of the prosecution, commercial quantity of contraband drugs was recovered from the possession of the petitioner on 27.08.2024 when he along with co-accused was travelling in a bus. The investigation is stated to be still in progress.

1. By the present petition, the petitioner challenges the proceedings in Complaint Case No. 476576/2016 filed by the respondent under Section 138 of the Negotiable Instruments Act, 1881 ('NI Act').

2. The complaint was filed alleging that the petitioner and other co-accused persons, acting on behalf of the accused company namely M/s Fresco Foods Pvt. Ltd., entered into an agreement dated 12.03.2009 with the complainant whereby the respondent disbursed a sum of ₹1,60,00,000/- as a venture capital amount to the accused. This venture capital assistance was refundable upon the full repayment of the term loan. It is the case of the respondent that the accused undertook that in the event of the venture capital amount not being refunded on the same date as that of the repayment of the term loan from the bank, the same would attract interest at the same rate as that being charged by the bank for the term loan.

1.     This First Appeal under Section 19 of the Consumer Protection Act, 1986 (in short, 'the Act') challenges the order dated 16.02.2018 in complaint no. CC/26 of 2012 of the Rajasthan State Consumer Disputes Redressal Commission, Jaipur (in short, 'the State Commission') allowing the complaint and directing the opposite parties no.1 to 4 jointly and severally to pay Rs.50 lakh to the complainant as compensation for medical negligence for the death of his son with simple interest @ 9% per annum from the date of the complaint (23.04.2012) till the date of payment within 2 months of the order.

2.     I have heard the learned counsel for both the parties and perused the material on record carefully.

This is an appeal filed by the Assessee directed against the order of ld.Commissioner of Income Tax(Appeal)[NFAC], under section 250 of the Income tax Act, 1961 dated 28.06.2024 for A.Y.2019-20. The assessee has raised the following grounds of appeal :

"1. The Ld.CIT(A) has wrongly confirmed the disallowance of deduction of Rs.15,60,115/- claimed by the appellant u/s.80P(2)(a)(i) of the Income Tax Act, 1961.

2. Alternatively, the interest income earned by the appellant from the investments in a co-operative bank is also eligible for deduction under section 80P(2)(d) of the Income Tax Act, 1961.

3. The Appellant crave leave to add, delete, amend, alter, vary and/or withdraw all or any one of the above grounds of appeal."

3.       The Complainant approached the Hon'ble National Consumer Disputes Redressal Commission with the following prayers:

"a) To compensate  the complainant for the actual loss suffered (amounting to Rs.1,03,83,335/-) and release the remaining claim amount for the loss due to fire amounting to Rs.60 Lakhs (Approximately) along with interest at the rate of 15% p.a. from the date of loss i.e. 22.05.2017 till its actual payment to the complainant.

b) To compensate and make payment of Rs.25,00,000/- as compensation on account of unfair trade practice, harassment, mental agony caused to the complainant by the misleading and negligent acts of respondent/Insurance Company and not paying the insurance claim at reinstatement value basis as specified in the insurance policy.

1. This Letters Patent Appeal1 is directed against the judgment rendered by the learned Single Judge on 19 February 2013 in terms of which an Award rendered by the Industrial Tribunal2 has come to be upheld. In terms of the Award dated 05 October 2005, the petitioner- appellant was directed to frame a policy of regularisation in respect of the respondent workmen. Both the Tribunal as well as the learned LPA Tribunal Single Judge have essentially held against the appellant on the ground that the engagement of the respondent-workmen through a contractor was merely a ruse to overcome the obligations which would have stood attached in case it were to be recognized to be the principal employer.

The crux of the prosecution case is that: the accused, in furtherance of their common intention, had during the period from September 2023 to 13.05.2024 induced the defacto complainant to make investments in their companies named 'INVESCO CAPITAL' and 'GOLDMANS SACHS'. Accordingly the defacto 2024:KER:83459 complainant invested Rs.7,65,00,000/- by transferring the amount from his and his wife's joint account believing that he would receive Rs.39,72,85,929/-. However, the accused did not pay any profit or return the capital. Thus, the accused have committed the above offences.

The Court:- This appeal is arising out of an order rejecting an application for judgment upon admission filed under Order 13A of the Commercial Courts Act, 2015. This order is not appealable in terms of Section 13 of the Commercial Courts Act, 2015. Learned Counsel appearing on behalf of the appellant has fairly conceded that the appeal is not maintainable.

Hence the appeal is dismissed as not maintainable. The original certified copy shall be returned to the appellant by the Department concerned after retaining a photocopy of the same in order to enable the appellant to take appropriate steps in accordance with law.

1. Defendant Nos.2 to 4 have filed the present appeal under Section 41 of the Punjab Courts Act, 1918. Challenge in the present appeal is to the judgment dated 11.09.1992 vide which the Ist Appellate Court had set aside the judgment and decree dated 02.12.1988 passed by the trial Court and had decreed the suit filed by the plaintiff/respondent 1 of 25 Neutral Citation No:=2024:PHHC:145434 RSA-1920-1992 (O&M) [2] No.1 (presently represented by his LRs) for specific performance. BACKGROUND OF THE CASE

1 This petition has been filed under Section 483 of BNSS, 2023 for grant of regular bail in case F.I.R. No.0108 dated 19.09.2021 registered under Section 21 of Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Bhikhiwind, District Tarn Taran.

2. Custody Certificate of the petitioner has been filed today in Court. The same is taken on record.

3. As per the case of the prosecution, the petitioner was found to be in illegal possession of 255 grams of heroin.

4. Counsel for the petitioner submits that the petitioner is behind bars for more than 3 years, 1 month and 17 days. Trial is proceedings at snail's pace as by now only 5 out of 11 witnesses could be examined.

This second appeal is filed against the judgment and decree, dated 04/08/2021 passed in AS No.12 of 2020 by the Subordinate Judge, Theni, confirming the judgment and decree, dated 31/01/2020 passed in OS No.47 of 2012 by the District Munsif, Bodinayakkanur.

2.Plaint averments in brief:-

The plaintiffs are the grandsons of one Mariammal. The suit property belonged to Mariammal absolutely. In the suit property, a shop is situated at Kamarajar Bazar, which is the subject matter of the suit. The plaintiffs are the power agent of the above said Mariammal, by a power of attorney, dated 25/02/1997. Mariammal mortgaged the property to the defendant through a registered mortgage deed, dated 16/07/1982 for a consideration sum of Rs.30,000/-. The mortgage period was five years. The rate of interest was fixed at 12% per annum. On 19/07/1982, another agreement was entered into between the parties, by which it was agreed that the payment of interest for simple mortgage should be adjusted by giving possession of the mortgaged property to the defendant, which is mentioned in the schedule. It is also agreed that the defendant must enjoy the property for five years. The house tax assessment agreed to be paid by the https://www.mhc.tn.gov.in/judis mortgagee. But the plaintiffs paid the taxes for the mortgaged property. On 19/07/1982, another sum of Rs.30,000/- was paid. Another mortgage deed was also executed on 19/07/1982. On 20/07/1982, another agreement was entered into. In the earlier mortgage deed, dated 19/07/1982 after the expiry of five years, the plaintiffs approached the defendant for redemption of mortgage on payment of Rs.60,000/-. But the defendant was evading and delaying. So, the suit is laid for delivery of possession after receiving the mortgage amount and for costs.

2. The Petitioner is the State Bank of India represented by its Branch Manager at their Zonal Office, Trichirappalli. Aggrieved by the common award passed by the First Respondent Central Government Industrial Tribunal (CGIT) at Chennai made in I.D.No.22 to 25 of 2007 dt. 27.7.2010 these writ petitions were filed by them.

3. The 1st Respondent CGIT by its Common Award granted the following relief to the 2nd Respondent workmen in all the WPs:-

“In the result all the petitioners in ID 22/2007, 23/2007, 24/2007 and ID 25/2007 are entitled to be reinstated into service forthwith with continuity of service and all attendant benefits but they are not entitled to back-wages for the whole period during which they remained out of employment of Respondent. After reinstatement into service the Management may start a process for the regularization of the workmen if and in accordance with the rules in vogue they are entitled to the same.”

This writ petition has been filed challenging the order, dated 18.02.2000 passed by the Respondent No.2, dismissing the petitioner from service and the order dated 27.06.2003 passed by the Respondent No.1 on an appeal filed by the petitioner, confirming the punishment of dismissal from service in the year 2013 and seeking a consequential relief to reinstate the petitioner into service.

2. The brief facts that are relevant for disposal of this writ petition are as under:-

2.1. The petitioner herein, while working as a 'Peon' in Rasipuram Branch of the respondent Bank, Salem Division, he was subjected to departmental proceedings by issuing a charge-sheet dated 21.06.1997 containing two charges. The said charges reads as under:-

Challenging the order of the Waqf Tribunal partly allowing the application directing the Tamil Nadu Waqf Board to register the T.O.Mohamed Thambi Waqf, Illayangudi Taluk, Sivagangai District as a seperate waqf, prepare a proforma report showing the "Rule of Succession" to the post of mutawalli as "hereditary", conduct a detailed enquiry among the legal representatives of the waqif/founder namely late T.O.Mohamed Thambi and appoint mutatwalli for the said waqf by following the procedures prescribed under the Waqf Act, 1995 (as amended in 2013) as per the intention of the waqif.

This writ petition is filed seeking mandamus to direct the respondents to extend the petitioners an opportunity to exercise option notionally with effect from 1.8.2003 or any subsequent dates based on the date of cession of service, in any event as per the 9th bipartite settlement.

2. The facts in brief in this writ petition are that the petitioners were originally joined their service at the Bank of Madura at various positions on different dates. The petitioner's case is that the petitioner had joined in Amrit Bio Energy and Industries Limited as an executive director on 27.04.2004, for the erection and commissioning of renewal energy power project. The said Amrit Bio Energy and Industries Limited is a group of companies under Amrit Projects Ltd. a company incorporated under the provisions of the companies Act, 1956. After being satisfied with the performance of the petitioner, Kailash Chand Dujari, the Managing Director of Amrit Projects Ltd. and its group of companies had offered the petitioner to become director of several other group companies of Amrit Projects Ltd. After joining the said Amrit Group the petitioner was to look into the development and set up of a power project of 10 M.W. in the District of Bankura, West Bengal. The said project was successfully completed under the supervision of the petitioner. The said Amrit Project Limited had started a business receiving deposits from the public at large without consulting with the petitioner. The petitioner had tendered resignation and resigned from the said Amrit Projects Limited and all its group of companies in the year 2013.
