The Department of Justice announced today the filing of a consent decree with the Louisiana Department of Public Safety and Corrections (LDPSC) that resolves allegations of sexual harassment of an office administrator in violation of Title VII of the Civil Rights Act of 1964, as amended (Title VII).

The department’s complaint, filed today along with the consent decree, alleges that Susan Peterson, a female correctional officer at the Arizona State Prison Complex in Tucson, Ariz., was regularly subjected to verbal and physical sexual harassment by several of her male supervisors and coworkers from early 2005 through November 2008.

Hector Martinez Maldonado, a former Puerto Rico Senator, and Juan Bravo Fernandez, the former president of the largest private security firm in Puerto Rico, were each sentenced today to 48 months in prison, respectively, for their roles in a bribery scheme involving the passage of legislation beneficial to Bravo Fernandez’s business.

Enrique Gomez De Molina, 48, of Miami Beach, Fla., was sentenced in federal court in Miami today to 20 months in prison for illegal trafficking in endangered and protected wildlife.

The Departments of Justice and Education, together with six private student plaintiffs and the Anoka-Hennepin School District, filed a proposed consent decree today in the U.S. District Court for the District of Minnesota, resolving complaints of sex-based harassment of middle and high school students in the school district.

The Justice Department announced today that Charles Wilhelm, 23, of Independence, Mo., pleaded guilty in U.S. District Court in Kansas City, Mo., to federal hate crime charges in connection with the vandalism and arson of a bi-racial man’s home in 2006.

An Afghan national with ties to the Taliban was convicted today by a jury in U.S. District Court for the District of Columbia of conspiracy, distribution of heroin for importation into the United States and narco-terrorism.

Muhammad Abid Hussain, 27, was sentenced by U.S. District Judge John D. Bates.

The Departments of Justice and Education reached a settlement agreement with the University of California, San Diego (UCSD), to resolve an investigation into complaints of racial harassment against African-American students on campus. Titles IV and VI of the Civil Rights Act of 1964 each prohibit harassment based on race.

Thomas Mitchell of Mansfield, Ohio pleaded guilty before United States District Judge George J. Limbert of the Northern District of Ohio to criminal information charging him with willfully failing to file an income tax return with the Internal Revenue Service (IRS), the Justice Department and IRS announced today.

Deborah Clark, 52, of Portsmouth, Va., pleaded guilty before U.S. District Judge Henry C. Morgan Jr.

A jury convicted William A. Herder of Richland County, Ohio, yesterday on federal tax charges, the Justice Department and Internal Revenue Service (IRS) announced.

Jonathon Felix, formerly of Villanova, Pa., was found guilty by a federal jury of willfully signing and filing false income tax returns, the Justice Department and Internal Revenue Service (IRS) announced today. U.S. District Court Judge for the Eastern District of Pennsylvania Petrese Tucker presided over the trial in Philadelphia.

Sung Soo Shin, of Staten Island, N.Y., president of Mission Design and Management Inc. (MDMI), pleaded guilty in the Eastern District of New York to filing a false corporate income tax return, for the fiscal year 2009, before U.S. District Court Judge Nicholas G. Garaufis, the Justice Department and the Internal Revenue Service (IRS) announced today.

Wolfgang Roessel of Ft. Lauderdale, Fla., pleaded guilty today in the U.S. District Court in the Southern District of Florida to filing a false tax return for 2007, the Justice Department and Internal Revenue Service (IRS) announced.

The Justice Department announced today that it has reached a settlement with United Airlines Inc., resolving Ten Eyck LaTourrette’s allegation that the airline violated the Uniformed Services Employment and Reemployment Rights Act (USERRA) by under compensating his retirement plan during his military service. LaTourrette is currently a major serving in the Colorado Air National Guard and a first officer for United Airlines.

Haji Bagcho, an Afghan national and large scale drug trafficker, was sentenced by U.S. District Judge Ellen S. Huvelle in the District of Columbia.

Today in federal court in the Eastern District of North Carolina, a jury found Anes Subasic, 35, guilty of conspiring to provide material support to terrorists and conspiring to murder, kidnap, maim and injure persons abroad.

A Missouri woman was sentenced today to 63 months in prison for her role in the vandalism and arson of a biracial man’s home in Independence, Mo., the Department of Justice announced.

William R. Herder of Bellville, Ohio, was arrested today on federal tax charges, Assistant Attorney General of the Justice Department’s Tax Division Kathryn Keneally, U.S. Attorney for the Northern District of Ohio Stephen M. Dettelbach and Special Agent in Charge, Internal Revenue Service (IRS) Criminal Investigation, Cincinnati Field Office, Darryl K. Williams announced. On June 19, 2012, a federal grand jury sitting in Cleveland returned an indictment against Herder, charging him with corruptly endeavoring to impair and impede the due administration of the Internal Revenue laws, failure to file tax returns, failure to pay taxes, and structuring transactions to evade currency reporting requirements.

Three individuals, including Alabama businessman Ronald Gilley, lobbyist Jarrod Massey and former Alabama state representative Terry Spicer were sentenced to prison today in Montgomery, Ala., for bribery-related offenses.

Iraqi citizen Mohanad Shareef Hammadi pleaded guilty to federal terrorism charges today in U.S. District Court for the Western District of Kentucky before Senior Judge Thomas B. Russell.

The Justice Department today concurrently filed a complaint and consent decree against the Burke County, N.C., Department of Social Services, alleging that the county did not have an effective harassment and discrimination policy in place and did not provide sufficient training in race harassment and discrimination for its employees and supervisors, in violation of Title VII of the Civil Rights Act of 1964, as amended. Title VII is a federal statute which prohibits employment discrimination on the basis of sex, race, color, national origin or religion.

Bruce Gregory Harrison III of Greensboro, N.C., was sentenced today to 144 months in prison following his December 2011 conviction for payroll tax fraud and other crimes, announced Kathryn Keneally, Assistant Attorney General for the Justice Department’s Tax Division; Ripley Rand, U.S. Attorney for the Middle District of North Carolina; and Richard Weber, Chief of Internal Revenue Service (IRS) - Criminal Investigation.

The Justice Department today announced that Rawland Leon Sorensen, the owner and manager of dozens of residential rental properties in Bakersfield, Calif., will be obligated to pay more than $2 million in monetary damages and civil penalties to settle a Fair Housing Act lawsuit alleging that he sexually harassed women tenants and prospective tenants.

Three defendants pleaded guilty today to charges of conspiracy, smuggling, Lacey Act violations, money laundering and tax fraud for their roles in the international illegal trafficking of rhinoceros horn. All of the defendants were charged in February 2012 as part of “Operation Crash,” a nationwide U.S. Fish and Wildlife Service crackdown on those involved in the black market trade of endangered rhinoceros horn.

The Justice Department announced that it has entered into a settlement agreement with the Northeastern Local School District in Springfield and South Vienna, Ohio, to resolve allegations of racial harassment of African-American students in the district. The district serves approximately 3,700 students, less than two percent of whom are African-American.

A U.S. Customs and Border Protection (CBP) Officer, his girlfriend and an associate have been charged in Brownsville, Texas, for engaging in a multi-year bribery and alien smuggling operation along the U.S./Mexico.

A federal judge today sentenced William A. Herder of Richland County, Ohio, to 37 months in prison for tax crimes, the Justice Department and the Internal Revenue Service (IRS) announced. U.S. District Judge Sara Lioi also ordered Herder to pay restitution to the IRS. On May 21, 2012, an Akron, Ohio, jury convicted Herder on all counts of an indictment that charged Herder with one count of tax evasion, one count of corruptly endeavoring to obstruct the administration of the Internal Revenue laws and five counts of willful failure to file tax returns.

A federal judge in Boston sentenced Gary Alcock today to 14 months in prison for tax evasion, for conspiring to defraud the United States, and for willfully failing to file tax returns, the Justice Department and Internal Revenue Service (IRS) announced. U.S. District Judge F. Dennis Saylor also ordered Gary Alcock to pay restitution in the amount of $515,518. Alcock pleaded guilty to the charges on Dec. 9, 2011, and provided substantial assistance to the government in prosecuting the case against the remaining defendants, which Judge Saylor cited, among other factors, as a basis for a reduced sentence.

William R. Herder of Bellville, Ohio, pleaded guilty yesterday to corruptly endeavoring to obstruct the administration of the tax laws and currency structuring, Assistant Attorney General for the Justice Department’s Tax Division Kathryn Keneally, U.S. Attorney for the Northern District of Ohio Stephen M. Dettelbach and Special Agent in Charge, Internal Revenue Service (IRS) - Criminal Investigation, Cincinnati Field Office, Darryl K. Williams announced. Herder was previously indicted in June of this year.

A bail bondsman in Portsmouth, Va., was sentenced today to serve 30 months in prison for bribing public officials in exchange for receiving favorable treatment, announced Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division and U.S. Attorney for the Eastern District of Virginia Neil H. MacBride.

The Department of Justice’s Antitrust Division issued a statement today regarding Entergy Corp.’s commitments to join a regional transmission organization (RTO) and divest its transmission system; Entergy’s proposed acquisitions of the Hinds and Hot Spring generating facilities in Mississippi and Arkansas, respectively, from KGen Power Corporation; and the division’s open investigation into Entergy’s alleged anticompetitive conduct.

The Justice Department announced that it has filed a joint motion with the state of Arkansas to dismiss the settlement in United States v. Arkansas, a case involving conditions at the Arkansas Juvenile Assessment and Treatment Center in Alexander, Ark. The state has fully complied with the settlement, which includes reforms in mental health care, fire safety, education and religious freedom for the youth residing at the facility. In addition to complying with the settlement, during the course of the department’s investigation and settlement, the state shifted its focus on juvenile justice from an institution-based model to a community-based model. The result has been a significant statewide decrease in the number of incarcerated youth. At the same time, crime in Arkansas has dropped even though the population of youth under 18 has grown.

Kaushik Jayantibhai Thakkar, 33, an Indian national, pleaded guilty today at a hearing before U.S. District Judge Ewing Werlein Jr., in Houston, to one count of conspiracy to bring undocumented immigrants into the United States for profit and to one count of unlawfully bringing two undocumented immigrants into the United States for profit.

In a coordinated international takedown, law enforcement officials in Romania, the Czech Republic, the United Kingdom and Canada, acting on provisional arrest requests made by the United States, arrested six Romanian nationals today for their alleged involvement in a sophisticated multimillion dollar cyber fraud scheme that targeted consumers on U.S.-based Internet marketplace websites.

Kentucky-based Lusk Mechanical Contractors and Commonwealth Technologies, and their owners, Harry Lusk and Wendell Goodman, have agreed to pay $6.25 million to resolve allegations that they submitted false statements to the Small Business Administration and false claims to the Army, the Justice Department announced today.
