Roger Lowe, 50, of Indianapolis, was sentenced today to five years in prison for receiving child pornography.

The Department has entered into a consent decree with Wagner Industrial Electric Inc. that, if approved by the court, will resolve the Department’s complaint the company failed to properly reemploy Indiana Army National Guard Reservist Kevin Stenger in violation of the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

Donald Sikma, a businessman from Dyer, Ind., has pleaded guilty to filing a false tax return. Sikma, whose trial was scheduled to begin today, entered his guilty plea Monday before Judge Theresa L. Springmann in Fort Wayne, Ind.

Herbert L. Corn, the former superintendent of the city of Rochester Wastewater Treatment Plant in Rochester, Ind., pleaded guilty today in U.S. District Court in South Bend, Ind., to falsifying monthly discharge monitoring reports that concealed violations of the Clean Water Act at the Rochester plant.

A former executive of Bennett Environmental Inc. (BEI), a Canadian-based company that treats and disposes of contaminated soil, pleaded guilty to participating in a conspiracy to pay kickbacks and commit fraud at the U.S. Environmental Protection Agency (EPA)-designated Superfund site, Federal Creosote, located in Manville, N.J. The former executive also pleaded guilty to participating in a money laundering conspiracy and impeding a proceeding before the U.S. Securities and Exchange Commission.

George Michael Lee, Duc Cong Nguyen, Hop Nguyen and Tien Duc Vu were sentenced today in San Diego for their roles in a scheme by the "Tran Organization" to cheat casinos across the United States and Canada.

Paul Richard Arceneaux, a resident of Church Point, La., was sentenced today to prison for failing to file his personal tax returns for 2003 and 2004 and corruptly interfering with the due administration of the Internal Revenue laws. The Honorable Walter J. Gex III, U.S. District Court Judge for the Southern District of Mississippi, sentenced Arceneaux to 46 months in prison and three years of supervised release. The court also ordered Arceneaux to pay restitution of $176,616.18.

Western Energy Company, the operator of the Rosebud Mine on federal coal leases outside of Billings, Mont., has paid the United States more than $12 million in mineral royalties and accrued interest as the result of a settlement agreement. Under the agreement that was filed in U.S. District Court for the District of Columbia, Western Energy has agreed to pay $12,239,538 in additional royalties and interest, 49 percent of which will be shared with the state of Montana because the production occurred on federal lands in that state.

William Travis Brown, 39, of Sellersburg, Ind., was convicted today by a federal jury in Indianapolis of transporting and possessing child pornography. Brown was charged on July 8, 2009, in an amended indictment with one count of transportation and one count of possession of child pornography.

A Canadian citizen has been charged in an indictment unsealed yesterday for his alleged participation in an eight-year conspiracy to defraud the United Nations Oil for Food Program (OFFP) and to bribe Iraqi government officials in connection with the sale of a chemical additive used in the refining of leaded fuel.

The operator and manager of the Rathbone Retirement Community in Evansville, Ind., has agreed to pay up to $116,000 to resolve a housing discrimination lawsuit. The November 2008 lawsuit alleged that the defendants violated the Fair Housing Act by prohibiting the use of motorized wheelchairs and scooters in residents’ apartments and in the home’s common dining room during meals.

The Department of Justice today announced that Mohammed Jawad, a native of Afghanistan, has been transferred from the detention facility at Guantanamo Bay to Afghanistan.

Bruce Mikulyuk, of Mishawaka, Ind., has been indicted by a federal grand jury for charges stemming from a cross burning in September 2007. Mikulyuk made his first court appearance today in South Bend, Ind. A trial has been scheduled for Nov. 3, 2009. Mikulyuk was charged with one count of interfering with the housing rights of another and one count of using fire in the commission of a felony.

The Department of Justice today announced that two Syrian nationals have been transferred from the detention facility at Guantanamo Bay to the control of the government of Portugal.

Denver resident Lil Vargas-Arias pleaded guilty today in U.S. District Court in Detroit to participating in a conspiracy to defraud the Medicare program.

The former superintendent of a wastewater treatment facility in Rochester, Ind., was sentenced today in U.S. District Court in South Bend, Ind., to serve one year in prison for falsifying discharge monitoring reports that concealed violations of the Clean Water Act.

Teresa Vogt, a resident of Anaheim, Calif., pleaded guilty on Sept. 15, 2009, to one count of obstruction of justice before U.S. District Court Judge Dale S. Fischer in Los Angeles. Vogt and eight co-defendants were indicted in May 2005 on tax fraud, conspiracy, money laundering and other charges related to the operation of the Genesis Fund.

The city of Jeffersonville, Ind., has agreed to make extensive improvements to its sewer systems that will significantly reduce the city’s longstanding sewage overflows into the Ohio River in a comprehensive Clean Water Act settlement with federal and state government.

Clinic owners and operators Jose Martinez and Denisse Martinez pleaded guilty today in U.S. District Court in Detroit to participating in a conspiracy to defraud the Medicare program.

Richard LaShure, 41, and Aaron Latham, 20, both of Muncie, Ind., pleaded guilty to conspiring to violate the civil rights of an African American family and to interfering with their housing rights by burning a cross in the family’s yard.

Three detainees have been transferred from the detention facility at Guantanamo Bay to the control of the governments of Ireland and Yemen.

Formosa Plastics Corp., Texas, and Formosa Plastics Corp., Louisiana, will spend more than $10 million on pollution controls to address air, water, and hazardous waste violations at two petrochemical plants in Point Comfort, Texas, and Baton Rouge, La.

Daniel Earl Danforth, 30, of Minden, La., has been indicted by a federal grand jury for hate crime violations and obstruction of justice charges stemming from a cross-burning in Athens, La., last year near the home of an interracial couple. Danforth was arrested today following the return of the indictment on Sept. 25, 2009.

The consent decree will resolve the Department’s complaint on behalf of an Indiana National Guardsman alleging that the law firm violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

The city violated the Fair Housing Act by refusing to grant a nonprofit organization a permit to operate a group home for 11 men recovering from drug and alcohol addiction.

James M. Tanksley, 52, pleaded guilty today to receipt of child pornography and possession of child pornography and was sentenced to 80 months in prison.

Michael Wildridge, 41, pleaded guilty today to transportation and possession of child pornography and was sentenced to 10 years in prison.

Bruce Mikulyuk, 50, of Mishawaka, Ind., pleaded guilty today to interfering with the housing rights of a white woman and an African American man by burning a cross in their yard and later returning with a knife and threatening the man if he did not leave.

As directed by the President’s Jan. 22, 2009 Executive Order, the interagency Guantanamo Review Task Force conducted a comprehensive review of each of these cases. As a result of that review, these detainees were approved for transfer from Guantanamo Bay.

Three Miami-Dade County, Fla., residents have been indicted in connection with an alleged $2.3 million Medicare fraud scheme operated out of X-Press Center, a Detroit-area clinic that purported to specialize in providing injection and infusion therapies.

A Louisiana man pleaded guilty today to firing three shots from a shotgun at the home of three Hispanic men and, after they fled, entering the home and setting a fire that burned it to the ground.

“It will not be a priority to use federal resources to prosecute patients with serious illnesses or their caregivers who are complying with state laws on medical marijuana, but we will not tolerate drug traffickers who hide behind claims of compliance with state law to mask activities that are clearly illegal,” Holder said.

The United States today sued Lincoln Fabrics Ltd., a Canadian company, and Lincoln Fabrics Inc., aka Lincoln Textiles Inc., its American subsidiary, under the False Claims Act in connection with the companies’ weaving and sale of defective Zylon fabric which was used as the key ballistic material in bullet-proof vests.

Six detainees who are Chinese nationals of Uighur ethnicity have been transferred from the detention facility at Guantanamo Bay to the control of the Republic of Palau.

Under the settlement, which must still be approved by the court, 11 defendants will pay all costs related to making the complexes for which they were responsible accessible to persons with disabilities.

The department filed a lawsuit today in federal court for the Eastern District of Missouri alleging a pattern or practice of violations of the Fair Housing Act by the owner and managers of Forum Manor Apartments for refusing to rent to African-Americans and males, refusing to allow tenants to have African-American visitors, sexually harassing female tenants and retaliating against tenants who complained about such discrimination.

The Departments of Justice and Defense today announced forum decisions for ten detainees at Guantanamo Bay whose cases were previously charged in military commissions, including five detainees accused of conspiring to commit the Sept. 11, 2001 terror attacks and a detainee accused of orchestrating the attack on the USS Cole

Charles Paul Edward Jumet of Fluvanna County, Va., pleaded guilty today in connection with his role in a conspiracy to pay bribes to Panamanian government officials to secure a maritime contract.

"Today we announce a step forward in bringing those we believe were responsible for the 9/11 attacks and the attack on the USS Cole to justice."

A federal jury in Indianapolis convicted William Travis Brown on July 23, 2009, of one count of transportation and one count of possession of child pornography.

The former general manager of a Sugar Land, Texas-based business was arrested on Nov. 18, 2009, for his alleged role in a conspiracy to bribe Mexican government officials to secure contracts with the Comisión Federal de Electridad (CFE), a Mexican state-owned utility company.

Both detainees are the subject of outstanding arrest warrants in Italy and will be prosecuted there.
