(United States Fifth Circuit) - Reverse and remand. Defendant advanced the theory that its insurance policy did not cover injuries caused by drunk driving collisions, because they are not “accidents”. The trial court granted summary judgment to Defendant, insurance company, stating that the intentional decision to drive while intoxicated meant the collision was not an accident. The appeals court held that there was nothing in Texas law that would construe the term “accident” in the manner put forth by the Defendant.

(United States Third Circuit) - Dismissal of a shareholder action alleging that defendant Board of Directors and the individual members failed to comply with its 2007 plan which would render tax deductible certain incentive compensation paid to the company's executives, which allegedly resulted in the payment of more than $36 million of excess compensation, is affirmed, where: 1) with regard to the derivative suit, plaintiff did not make a pre-suit demand to the Board of Directors or present sufficient allegations explaining why a demand would have been futile; and 2) with regard to the direct suit, federal tax law does not confer voting rights on shareholders not otherwise authorized to vote or affect long-settled Delaware corporation law which permits corporations to issue shares without voting rights, so plaintiff's contention regarding defendant-company's issuance of non-voting shares fails to state a claim on which relief may be granted.

(Supreme Court of California) - Held that a city's practice of annually transferring funds from a city-operated electric utility to the city's general fund did not run afoul of the California Constitution, which prohibits local governments from imposing any tax without voter approval. A citizen association brought this suit arguing that the city was, in effect, using utility rates to impose a tax without voter approval. Rejecting this contention, the California Supreme Court reversed the court of appeal.

(California Court of Appeal) - Upheld a decision of the Contractors' State License Board finding that a large contracting company violated California law by failing to obtain a building permit before replacing a boiler. Affirmed the denial of the company's writ petition.

(United States DC Circuit) - Vacated and remanded. The district court dismissed claims by a group of chartered schools complaining about school funding practices but the case was vacated and remanded for dismissal because they lacked jurisdiction to hear the claims in the first instance.

(United States Ninth Circuit) - Reversed district court’s dismissal of Plaintiff’s enforcement action against Defendant for alleged fraud in precious metal sales. Defendant maintained that there was an exception in the Commodity Exchange Act for retail commodity sales. Held that the burden was on the Defendant to prove that the exception applied and the exception could be satisfied if the commodity sat in a third-party depository. However, that was not the case in this suit. Plaintiff was not barred from bringing suit and the action should not have been dismissed. Remanded for further proceedings.

(United States Seventh Circuit) - Restitution award vacated. The FTC sued Defendant for several violations of consumer protection statutes. The trial court found for the FTC, entered a permanent injunction against Defendant and ordered $5 million in restitution to the FTC. The appeals court affirmed the judgment as to the violations of consumer statutes and the injunction but held that restitution was not authorized by section 13(b) of the Federal Trade Commission Act.
