The Department’s Civil Rights Division held a conference today titled 2009 Title VI Conference: Celebrating the 45th Anniversary of the Legislation and Exploring Current Issues in Enforcement at the FDIC Conference Center in Arlington, Va. Approximately 400 representatives from federal, state and local agencies, community organizations and advocacy groups gathered to share new ideas and discuss trends in Title VI enforcement.

A father and son pleaded guilty today in U.S. District Court in Greenbelt, Md., to illegally over fishing striped bass, also known as rockfish, from 2003 through 2006.

Consultores de Navegacion, a Spanish company that operates the M/T Nautilus, an ocean-going chemical tanker ship, was sentenced today by U.S. District Judge Douglas P. Woodlock to pay a fine of more than $2 million and serve three years of probation for criminal violations related to the overboard discharge of oil-contaminated bilge waste on the high seas.

The Department announced an agreement with the village of Midlothian, Ill., to improve access to civic life for persons with disabilities. The agreement was reached under the Department’s Project Civic Access initiative, which aims to bring state and local governments into full compliance with the Americans with Disabilities Act (ADA). This agreement is the 162nd under Project Civic Access.

Computer Assets Inc. and its principals, Abraham Salazar and Damon Salazar, have agreed to pay $350,000 over three years and surrender up to $35 million in pending E-Rate applications to settle allegations that the company violated the False Claims Act in connection with the Federal Communications Commission’s E-Rate program.

A Canadian citizen has been charged in an indictment unsealed yesterday for his alleged participation in an eight-year conspiracy to defraud the United Nations Oil for Food Program (OFFP) and to bribe Iraqi government officials in connection with the sale of a chemical additive used in the refining of leaded fuel.

Attorney General Eric H. Holder, Jr., announced today the appointment John H. Guendelsberger as a new member of the Board of Immigration Appeals (BIA). The BIA is part of the Justice Department’s Executive Office for Immigration Review located in Falls Church, Va., and is responsible for hearing appeals of decisions rendered by immigration judges or certain Department of Homeland Security officers.

"I stand here to celebrate the more than $12 million that has been awarded to the D.C. Metropolitan Police Department to fund the hiring and rehiring of 50 law enforcement officers in the District. These funds will provide 100 percent of the approved salary and benefits for these officers for three years, and all police departments receiving the grants will then be required to retain the grant-funded positions for a fourth year."

Paul Revere Transportation LLC, a bus company based in Boston, has agreed to pay a $650,000 civil penalty after being found liable by a jury in June for violating federal and state clean air laws for idling their buses for extended periods of time. The company was found liable on June 8, 2009, after a six-day trial in U.S. District Court in Boston, for 234 separate violations of the Clean Air Act and a Massachusetts anti-idling regulation.

"People who actually work in law enforcement, and people who actually work in our nation’s schools, know that our jobs are closely interwoven. When their neighborhoods and homes don’t feel safe, our children have a tough time paying attention in school. And when our children are not engaged at school, they’re going to be much more likely to get into trouble outside of it."

A federal jury today convicted former United States Congressman William J. Jefferson, 62, of New Orleans, La., of using his office to corruptly solicit bribes.

A federal court in Seattle has permanently barred Daniel Andersen from promoting fraudulent tax schemes. Documents the government filed on August 11 requested that the court enjoin Andersen, arguing that he was a founding member of the Institute for Global Prosperity, an entity that promoted both its own fraudulent tax scheme and the fraudulent tax schemes of others.

Two former employees of Edward H. Okun, who was sentenced to 100 years in prison on Aug. 4, 2009, after a three-week jury trial, were sentenced today before U.S. District Judge Robert E. Payne for their roles in a scheme to defraud and obtain approximately $126 million in client funds held by The 1031 Tax Group LLP (1031TG).

A federal district judge in New York has permanently barred Howard Levine from preparing federal tax returns for others. The court also ordered Levine to provide his customer lists to the government and to mail copies of the court order to his customers.

Hansruedi Schumacher and Matthias Rickenbach, both of Switzerland, were indicted today for conspiring to defraud the United States. According to the indictment, Schumacher worked as an executive manager at Neue Zuercher Bank (NZB), a Swiss private bank located in Zurich, Switzerland. Rickenbach worked as a Swiss attorney who provided legal advice and services to U.S. clients.

Two demolition and salvage companies and three of their respective owners and supervisors were indicted today by a federal grand jury in Chattanooga, Tenn. The indictment describes a year-long scheme in which the former Standard Coosa Thatcher plant in Chattanooga was illegally demolished while still containing large amounts of asbestos.

Detroit area physical therapist Jay Jha, 45, pleaded guilty today to participating in a conspiracy to defraud the Medicare program of approximately $18.3 million.

The Department of Justice today announced that two Syrian nationals have been transferred from the detention facility at Guantanamo Bay to the control of the government of Portugal.

Cedric E. Salabye of Dilkon, Ariz., was sentenced Friday in federal court in Phoenix for selling 11 bald eagle tail feathers. Salabye pleaded guilty on April 23, 2009, to one count of a federal indictment charging him with selling eagle feathers in violation of the Bald and Golden Eagle Protection Act. 

The Department filed a lawsuit in federal court in Los Angeles charging Ventura County, Calif., with discrimination in its employment practices by refusing to hire a qualified applicant because she is deaf.

The Department today commemorated the 15th anniversary of the Violence Against Women Act (VAWA), which was signed into law on September 13, 1994.

Timothy L. Lantz was sentenced today to 15 years in prison for transporting child pornography in interstate commerce and failing to update his sex offender registration in violation of the Adam Walsh Act.

Almighty Latin King and Queen Nation (ALKQN) member Marie Chavez, aka "Shorty," wife of an alleged ALKQN leader, Jose Nava, aka "Chino," was sentenced today, while his brother Luis Nava, aka "Flaco," re-entered a guilty plea to a superseding indictment that charged them and 14 others with various offenses related to alleged narcotics and weapons trafficking, as well as violent activities throughout Texas.

The Department has reached a consent decree with the city of Bonita Springs, Fla., that, if approved in federal court in Fort Myers, Fla., will resolve the department’s allegations that the city discriminated against an African American employee in violation of Title VII of the Civil Rights Act of 1964.

A Dutch aviation services company, its director and sales manager pleaded guilty today in the District of Columbia to federal charges related to a conspiracy to illegally export aircraft components and other items from the United States to entities in Iran via the Netherlands, the United Arab Emirates and Cyprus.

The Department announced that it had reached a settlement with a Virginia landlord to resolve allegations that she violated the Servicemembers Civil Relief Act (SCRA). The lawsuit alleged that the landlord failed to return prepaid rent and security deposits to a tenant who had terminated her lease early in order to comply with military orders to relocate from to Georgia.

Daniel Earl Danforth, 30, of Minden, La., has been indicted by a federal grand jury for hate crime violations and obstruction of justice charges stemming from a cross-burning in Athens, La., last year near the home of an interracial couple. Danforth was arrested today following the return of the indictment on Sept. 25, 2009.

The consent decree will resolve the Department’s complaint on behalf of an Indiana National Guardsman alleging that the law firm violated the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA).

AGCO Corp., a U.S. corporation based in Duluth, Ga., has agreed to pay a $1.6 million penalty for illegal kickbacks paid to the former government of Iraq.

A federal judge today assessed the Southern Union Company $18 million for illegally storing mercury at a company-owned site in Pawtucket.

Guilty pleas were entered today in federal court in Lubbock, Texas, by three admitted gang members who were charged for their participation in a violent drive-by shooting in which two people, a man and a pregnant woman, were killed, and four others were wounded.

Talk alone isn’t going to stop rival gangs from shooting up our streets, or drug dealers from peddling dope in our schools, or terrorists from attacking our cities. The United States has asked a federal court in Denver to bar Curtis Morris, an Elizabeth, Colo., tax return preparer, and his business, Numbers & Beyond, from preparing tax returns.

Gunther Wenzek, a German national, pleaded guilty today before District Judge Anna J. Brown, of the U.S. District Court for the District of Oregon, to one count of smuggling coral into the United States at the port of Portland, Ore.

"Listening to the complex needs of the communities, and recognizing their unique responses, is perhaps the most important thing we can do at the Department."

The Department announced this week that it has filed a lawsuit against TK Properties L.L.C., its officer, Scott Terveen, and two employees, Ann Wagner and Corey Anderson, for violating the Fair Housing Act by discriminating on the basis of race.

Solomon Nathaniel of Sterling Heights, Mich., pleaded guilty today in U.S. District Court in Detroit to participating in a conspiracy to defraud the Medicare program.
