By Srinivas Alavilli Bengalureans, did you notice that someone fixed that black spot on your way to work and it now looks nice with a little bench and simple art that makes the place walkable and pleasant on the eyes? Did you come across pictures on social media of people sweating it out and cleaning lakes on a Sunday morning? Do you know someone that teaches and helps out in the local government school? Did you notice there was a massive protest to save trees on Jayamahal Road and a thousand people got on the streets? Did you know local residents were filing RTIs, writing letters, and meeting officials behind the scenes before it became a protest? Did you notice that right now there is a group of concerned citizens trying to save trees in the compound of the Queens Road veterinary hospital? Have you met the senior citizen in your park who takes care of composting and upkeep of the park on a daily basis to keep it a happy place for local residents? Did you ever sit in a small meeting along with your neighbors to learn about waste segregation at source from fellow citizens that are working with BBMP to keep our city clean? Do you know, every day, in some place or the other in our city, a group of citizens are getting involved locally, in one way or another, and making a difference to their neighborhood that they can see and feel? Did you wonder how 8,000 people gathered in one place for the human chain in support of the ‘Steel Flyover Beda’ campaign? Did you know that much before the steel flyover, people got together and stopped wasteful projects in Koramangala and elsewhere? The people that do this are just like you and me – regular people with jobs and other responsibilities. They have come to the realisation that talk is cheap, and actions speak louder. These people – who partner with their local Corporator and the Health Inspector (to bring the truck when the cleanup is done) and work closely with various city agencies are indeed an asset to our city. Does it bother you that the system is so broken that people need to get involved in getting simple things done while there is an elected body that runs the city and has an annual budget of Rs 9,000 crores and all the resources in terms of personnel and equipment? Do you feel that the good work citizens do must be scaled up because our city is huge with 1.2 crore population? In my travels over a decade in this city I have come across hundreds of people that are committed and passionate and bring their professional expertise to learn about things like composting and rain water harvesting. I am often amazed at the level of understanding ordinary citizens have about mobility, road design, city planning and the laws that govern it. Does it not make sense for these every day unsung heroes to become part of the ward committees of BBMP? Do you find yourself asking, "What is this ward committee?". Here is the simple answer: a ward committee is a group of 10 residents of a ward that works with the Corporator and the corporation (BBMP) for the betterment of the ward. They have monthly meetings with the Corporator and officials and review projects and give feedback on behalf of people of that ward. Their presence in ward committees will go a long way in making the right decisions for the ward and in bridging the gap and building trust between the government and the citizen. We request you to think of all those people and nominate them to get on ward committees. Most of these people are reluctant warriors and shun the spotlight. But it is time we publicly acknowledge their work and ask them to be formally engaged when there is an opportunity that is built into our law but never gets implemented. We request you to spread the word so more people are aware that there is such a thing called the Ward Committee and now is open for active citizen participation. We have more than 850 nominations so far. But our city has 198 wards which means we need 1880 members! We invite you to do your bit in strengthening our local government which in fact is the government we see and experience every day. Why Matter Matters: How Technology Characteristics Shape the Strategic Framing of Technologies

The authors investigate how the executives of the two largest research institutes for photovoltaic technologies — the National Renewable Energy Laboratory (NREL) in Golden, USA and the Fraunhofer Institute for Solar Energy Systems (Fraunhofer ISE) in Freiburg, Germany — have made use of public framing to secure funding and shape the technological development of solar photovoltaic (PV) technologies. The article shows that the executives used four framing dimensions (potential, prospect, performance, and progress) and three framing tactics (conclusion, conditioning, and concession), and that the choice of dimensions and tactics is tightly coupled to the characteristics of the specific technologies pursued by the research institutes.

The Terms They Are A-Changin'...: Watching Cloud Computing Contracts Take Shape


EXECUTIVE SUMMARY

Many web services are examples of cloud computing, from storage and backup sites such as Flickr and Dropbox to online business productivity services such as Google Docs and Salesforce.com. Cloud computing offers a potentially attractive solution to customers keen to acquire computing infrastructure without large up-front investment, particularly in cases where their demand may be variable and unpredictable, as a means of achieving financial savings, productivity improvements and the wider flexibility that accompanies Internet-hosting of data and applications.

The greater flexibility of a cloud computing service as compared with a traditional outsourcing contract may be offset by reduced certainty for the customer in terms of the location of data placed into the cloud and the legal foundations of any contract with the provider. There may be unforeseen costs and risks hidden in the terms and conditions of such services.

This document reports on a detailed survey and analysis of the terms and conditions offered by cloud computing providers.

The survey formed part of the Cloud Legal Project at the Centre for Commercial Law Studies (CCLS), within the School of Law at Queen Mary, University of London, UK. Funded by a donation from Microsoft, but academically independent, the project is examining a wide range of legal and regulatory issues arising from cloud computing. The project's survey of 31 cloud computing contracts from 27 different providers, based on their standard terms of service as offered to customers in the E.U. and U.K., found that many include clauses that could have a significant impact, often negative, on the rights and interests of customers. The ease and convenience with which cloud computing arrangements can be set up may lull customers into overlooking the significant issues that can arise when key data and processes are entrusted to cloud service providers. The main lesson to be drawn from the Cloud Legal Project’s survey is that customers should review the terms and conditions of a cloud service carefully before signing up to it.

The survey found that some contracts, for instance, have clauses disclaiming responsibility for keeping the user’s data secure or intact. Others reserve the right to terminate accounts for apparent lack of use (potentially important if they are used for occasional backup or disaster recovery purposes), for violation of the provider’s Acceptable Use Policy, or indeed for any or no reason at all. Furthermore, whilst some providers promise only to hand over customer data if served with a court order, others state that they will do so on much wider grounds, including it simply being in their own business interests to disclose the data. Cloud providers also often exclude liability for loss of data, or strictly limit the damages that can be claimed against them – damages that might otherwise be substantial if a failure brought down an e-commerce web site.

Although in some U.S. states, in E.U. countries and in various other jurisdictions the validity of such terms may be challenged under consumer protection laws, users of cloud services may face practical obstacles to bringing a claim for data loss or privacy breach against a provider that seems local online but is, in fact, based in another continent. Indeed, service providers usually claim that their contracts are subject to the laws of the place where they have their main place of business. In many cases this is a US state, with a stipulation that any dispute must be heard in the provider’s local courts, regardless of the customer’s location.

Perhaps the most disconcerting discovery of the Cloud Legal Project’s survey was that many providers claimed to be able to amend their contracts unilaterally, simply by posting an updated version on the web. In effect, customers are put on notice to download lengthy and complex contracts, on a regular basis, and to compare them against their own copies of earlier versions to look for changes.

The cloud computing market is still developing rapidly, and potential cloud customers should be aware that there may be a mismatch between their expectations and the reality of cloud providers' service terms, and be alive to the possibility of unexpected changes to the terms.

Dealing with Delhi: How culture shapes India’s Middle East policy


Indian Prime Minister Narendra Modi’s recent visit to the United Arab Emirates revealed New Delhi’s intention to bolster bilateral relations with the Gulf states. With the rise of ISIS and a growing terrorist threat in the West, unprecedented attention has focused on Islam, which despite being the world’s fastest growing religion, is also one of the most misunderstood. In his new book “Islamic Exceptionalism: How the Struggle over Islam is Reshaping the World” (St. Martin’s Press, 2016), Senior Fellow Shadi Hamid offers a novel and provocative argument on how Islam is, in fact, “exceptional” in how it relates to politics, with profound implications for how we understand the future of the Middle East. Hamid argues for a new understanding of how Islam and Islamism shape politics by examining different modes of reckoning with the problem of religion and state, including the terrifying—and alarmingly successful—example of ISIS.

On June 9, Shadi Hamid and Isaiah Berlin Senior Fellow in Culture and Policy Leon Wieseltier discussed the unresolved questions of religion’s role in public life and whether Islam can—or should—be reformed or secularized.

Help shape a global network of innovation districts


How are two innovation districts in Stockholm successfully melding their tech and life science clusters to create new products?

What can the Wake Forest Innovation Quarter in North Carolina teach us about creating strong, vibrant, and innovative places?

How are innovation districts in Australia leveraging government policies and programs to accelerate their development?

Over the last year, members of the Anne T. and Robert M. Bass Initiative on Innovation and Placemaking team talked with hundreds of local leaders and practitioners advancing innovation districts in almost every global region. These conversations revealed the remarkable level of creativity and innovative, out-of-the-box thinking being employed to grow individual innovation districts.

In the course of our work, we have been intrigued by the question, is there value to be gained from a global network of innovation districts? To this end, we have reached out to successful global networks in Europe, the United States, and Asia to distill what it takes to make a strong and sustainable global network. Among our findings so far:
  • Network members are solving on-the-ground challenges by talking with and learning from their peers. Several said that these horizontal exchanges are essential to leapfrogging ahead. 
  • Online interaction is growing but network members say that face-to-face contact is critical. Comparing notes, asking questions, and engaging in conversations foster collaboration while maintaining a healthy dose of competition. 
  • The right tools and supports can make all the difference. In networks where participants had full schedules, developing new ways to share intelligence, like early morning webinars or virtual conferences, regular e-newsletters, and simple methods to share data helped facilitate their learning.
