2. The Informant, a company incorporated in May, 2015, has been operating under the brand name of Treebo Hotels' and is in the business of providing franchising services to budget hotels in India. In addition to this, Treebo also provides service to numerous independent budget hotels who partner with it under its newly launched 'Hotel Superhero' scheme. Under the said scheme, Treebo only provides services such as hotel management technology services, listing on its platform and other online travel aggregators, credit facilities, support and quality control of the staff and hotel management resources etc. but does not provide its brand name.

3. MMT is an Online Travel Agency (OTA) engaged in the business of providing travel and tourism related services in India. It is a part of MakeMyTrip group of companies (MMT Group). OYO, on the other hand, provides budget accommodation to customers and is in the market for providing franchising services to budget hotels under the brand name 'OYO'.

The application has been filed on the ground of urgency that the special leave petition filed in the Supreme Court cannot be taken up immediately.

In view of the present situation, the time to comply with the order passed by the Trial Court is extended till June 30, 2020. However, this order will not be a charter for the applicant to continue manufacturing its products. Indeed, it is submitted on behalf of the applicant that no manufacturing activity is being undertaken in the present situation.

G. A. 804 of 2020 is disposed of without prejudice to the rights and contentions of the parties thereto.

This appeal challenges the judgment and order dated 12.2.2019 passed by the High Court1 dismissing Letters Patent Appeal No.97 of 2019 1 The High Court of Delhi at New Delhi 2 Civil Appeal No.2379 of 2020 (arising out of SLP (C) NO.5269 of 2019) BCH Electric Limited Vs. Pradeep Mehra and thereby affirming the decision of the Single Judge of the High Court in Writ Petition No.10318 of 2017.

By Trust Deed executed on 19.03.1979 between the appellant, a company registered under the Indian Companies Act, 1956 on one hand and three trustees on the other, an “Approved Gratuity Fund” was constituted “for the purpose of providing Gratuities to the employees of the Company under the Payment of Gratuity Act, 1972 (hereinafter referred to as ‘the Act’) and the Gratuity Scheme of the Company”.

1. The question arises in the appeal for our consideration is as to whether the decree passed on a compromise can be challenged by the stranger to the proceedings in a separate suit.

2. The seminal facts which are relevant for the present purpose and the circumstances in which it arises for our consideration are Signature Not Verified Digitally signed by DEEPAK SINGH that the appellant­plaintiff filed suit before 4 th sub­judge, Chapra Date: 2020.05.06 16:03:14 IST Reason:

seeking a declaration that the compromise decree dated 15 th 1 September, 1994 passed in Second Appeal No. 495/86 by the High Court is illegal, inoperative and obtained by fraud and misrepresentation and also prayed for injunction against the respondents­defendants restraining them from entering into peaceful possession of the suit property.

Heard the learned counsel for the parties. The applicant has filed this first application u/S 439 Cr.P.C. for grant of bail. The applicant has been arrested by Police Station Maharajpura, District Gwalior in connection with Crime No.162/2020 registered in relation to the offence punishable under Section 49(A) of Excise Act.

It is alleged by the counsel for the applicant that 5 liters of country made liquor is said to have been seized from the present applicant. He was not arrested on the spot. Investigation is over in the matter and charge sheet has been filed on 23.3.2020. He is in custody since 12.03.2020 and prays for grant of bail.

Per contra, counsel for the State has opposed the bail application submitting that the report from the FSL has been received and the liqour seized from the present applicant was found to be 2 THE HIGH COURT OF MADHYA PRADESH M.Cr.C. No.13147/2020 (Batri Khan vs. State of M.P.) harmful for human consumption. However, factum of completion of investigation and filing of charge sheet could not be disputed. There is no criminal history of the present applicant.

Aggrieved with denial of information, the appellant filed a First Appeal dated 20.11.2018, which was decided by the FAA's order dated 30.11.2018, upholding the PIO's reply. Dissatisfied with denial of information, the appellant filed the instant Second Appeal before the Commission.

Since her son was only few months old at the time of her husband's death, compassionate appointment was sought only when he attained 18 years. But respondent denied the benefit of compassionate appointment since the appellant had approached the respondent after a gap of 20 years. Since the appellant claims she is not in receipt of the proper pension amount and the benefit of compassionate appointment has also been denied by the respondent, the family is facing a financial crisis. Hence, she sought the aforementioned information by filing the instant case. Decision:

1. Category-wise cut-off marks of the result declared on 16.04.2019;

2. Marks obtained by the appellant in written examination and candidates with what score have been selected from Rajasthan OBC quota;

3. On what basis will be candidates selected from among the 447 candidates finalized for medical examination.

PIO/DIG, CISF denied disclosure of information invoking Section 24 of the RTI Act, vide reply dated 12.06.2019.

Aggrieved with denial of information, the appellant filed a First Appeal dated 01.07.2019, which was decided by the FAA vide order dated 04.07.2019, reiterating the stance taken by the PIO.

Dissatisfied with denial of information, the appellant filed the instant Second Appeal before the Commission.

Aggrieved with denial of information, the appellant filed a First Appeal dated 20.08.2019, which was decided by the FAA vide order dated 06.09.2019, upholding the stance taken by the PIO and observing that the information could not be provided under the RTI Act since it did not fulfill the criteria of either human rights violation or of corruption as provided in the Section 24 of the RTI Act.

Dissatisfied with denial of information, the appellant filed the instant Second Appeal before the Commission.

The Appellant filed RTI application dated 11.05.2019 seeking information through five points pertaining to an incident that took place on 19.04.2014 at around 2330 hrs wherein a truck bearing registration no. WB37 8459 loaded with TMT iron rods was apprehended by the Local Police near CISF Unit NTPC Barh.
