1. The Appellant is a generator maintaining and operating two units of coal-fired thermal generation plants. For purposes of setting up the said units, the construction work started some time in 2011. It had entered into an arrangement with the second Respondent (Discom) for supply of electricity for purposes of start-up, its need continuing the first unit having been commissioned on 11.02.2014 followed by the second unit commissioned on 02.08.2015.

2. The Appellant was a consumer for start-up power for the period 01.09.2013 to 31.05.2015. By the billing raised for supply of such electricity in terms of the Supply Agreement dated 07.01.2013, the Respondent Discom treated it as a commercial consumer on the reasoning that it would fall in the residual category, referring in this context to the tariff schedule, in absence of any separate category for start-up power consumer being specified in tariff schedule.

1. The present Appeal No. 340 of 2016 has been preferred by M/s. 2. The petitioner is seeking bail under Section 439 of Cr.P.C. in connection with Crime No.47/2020 of Harihara Town Police Station, registered for the offence punishable under Sections 143, 147, 149, 148, 307, 324 of IPC.

The facts of the case in nutshell are that the petitioner/ accused No.1 and the complainant are running a liquor shop in the name and style as "Swapna Bar and Restaurant' in Harihara for a period of six years. The complainant asked the petitioner to submit the accounts pertaining to the business of the said bar and restaurant. In this background, the petitioner/accused No.1 along with his followers, went to the house of the complainant on 21.03.2020 at about 8.45 p.m. and picked up quarrel with him and abused him in filthy language and assaulted with 3 beer bottle on his face and head and caused bleeding injury.

The present application is filed under Section 439 of the Code of Criminal Procedure, 1973, for regular bail in connection with the First Information Report registered with the Limkheda Police Station, Dahod district vide FIR No.11821035200189 of 2020 for the offences punishable under Sections 306 and 498A of the Indian Penal Code.

Mr. Jain, the learned advocate appearing on behalf of the applicant submits that considering the nature of the offence, the applicant may be enlarged on regular bail by imposing suitable conditions. In that incident, Kailashben and Ravindra died whereas daughter Shital has survived. He has also submitted that the reasons mentioned for suicide are mentioned in FIR that the present applicant does not like the deceased and did not want to bring her back as he wanted to bring new wife. He has further submitted that age of deceased Kailashben as shown in FIR is 24 years whereas age of the applicant is 19 years and they had love marriage and out of the said wedlock they gave birth to two children. He has submitted that Aadhar Card clearly describes that the present applicant is born in the year 2001. Moreover, it is case of the prosecution that earlier about five months ago when the deceased Kailashben had gone to the house of the complainant where she complained the complainant i.e. her brother that present applicant had wish to bring new wife as he did not like her. He has submitted that as per FIR itself there is no recent incident which led the deceased for committing suicide. He has also submitted that deceased Kailashben and present applicant are belonging to different castes and community and they conducted love marriage and there is age difference which the complainant who is the brother of the deceased did not like and, therefore, out of vengeance, the false FIR is lodged. At last he has prayed that considering all these aspects and circumstances, present application may be granted.

1. This interlocutory application has been filed under Section 389(1) of the Code of Criminal Procedure for suspension of the sentence and grant of ad-interim bail, to the petitioners, during the pendency of the appeal.

2. The petitioners/ appellants have been convicted for the offence under Sections 25(1-A), 26(2) read with Section 35 of the Arms Act by the court of learned Additional Judicial Commissioner, II, Ranchi, in Sessions Trial No.361 of 2016.

1.2 Notice to the respondent was dispensed with, as the respondent had not yet been summoned by the Trial Court.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. Therefore, noticing that several opportunities have already been afforded to the complainant, the complaint was dismissed. 3 Sh.Anish Bhola, counsel for the petitioner has assailed the CR No.-88/2020 Page No.-1 of 3 impugned Order on the ground that the Ld. MM committed a grave error in observing that the ECS mandate was not on record. It is pointed out that the petitioner/ complainant along with the complaint had placed on record a ' Debit Authorization Form issued by the customer" i.e. the respondent to the petitioner bank. It is argued that the Debit Authorization Form is akin to ECS mandate. The petitioner/complainant had also placed on record along with the complaint a memorandum issued by the bank, noticing return of the mandate on account of insufficiency of funds. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.

2. The petitioners herein are the agent of M/s.Cochin Air Cargo Customs Clearing Agent (Shipping clearing and Freight Forwarding Agent) is licensed Customs Brokerage Company Lic No.1/2012, having office near at International Airport, Shanmugam, Trivandram, Kerala.

During the course of the business, the petitioners' concern got an order for shipment of “Air inlet automobile spare parts” from a new customer named 'Swiss Global' having office at New Delhi and after receiving KYC form, GST No., certificate of import export code, proprietor PAN and Aadhar card, accepted the shipment through Tiruchirappalli Airport. After getting shipment bills number from the exporter, the petitioners received the goods at Trichy Airport and the same has been sent for customs clearance on 09.06.2019. but, the second respondent did not give customs clearance due to non availability of E-way bill. After getting E-way bill from the exporter, the petitioners sent the same to the second respondent. But the second respondent detained the goods on 10.06.2019.
