3. The brief facts of the prosecution case are as under;

The first informant, Sri. K.Y. Raghavendra Rao is a resident of Vinoba Nagar in Davanagere. He has a daughter and a son. His daughter is a minor. When she 3 was studying in I PUC, accused No.1 used to follow her and tease her. He used to roam in front of her house. She had informed the matter to her parents. In spite of advising the accused, he did not stop following her. The matter was brought to the notice of one Leela Kumaraswamy, working in an NGO. However, accused No.1 did not cooperate when she had called him over phone to enquire about the matter. The accused was threatening the victim girl to listen to his words or to face dire consequences.

2. The petitioner is seeking bail under Section 439 of Cr.P.C. in connection with Crime No.47/2020 of Harihara Town Police Station, registered for the offence punishable under Sections 143, 147, 149, 148, 307, 324 of IPC.

3. The facts of the case in nutshell are that the petitioner/ accused No.1 and the complainant are running a liquor shop in the name and style as "Swapna Bar and Restaurant' in Harihara for a period of six years. The complainant asked the petitioner to submit the accounts pertaining to the business of the said bar and restaurant. In this background, the petitioner/accused No.1 along with his followers, went to the house of the complainant on 21.03.2020 at about 8.45 p.m. and picked up quarrel with him and abused him in filthy language and assaulted with 3 beer bottle on his face and head and caused bleeding injury.

2. The petitioner in Crl.P.NO.101035/2019 is accused No.1 in C.C.No.796/2018. The petitioner is :4: represented in this court as the Branch Manager, ICICI Bank Limited.

3. The petitioner in Crl.P.No.100295/2019 is accused No.1 and accused No.3 and 5 in Crl.P.No.101035/2019 in C.C.No.796/2018.

4. The facts of the matter as per the petitioners in both the matters are as under:

4.1. It is stated that respondent No.1 Sri. Shashikant S. Timmapur had availed a loan of Rs.18,50,000/- in the year 2006 from ICICI Bank Limited ( 'the Bank' for short) by pledging various shares which he held in certain listed companies.

2. It is very much clear from the FIR that accused persons demanded a sum of Rs.11,000/- from the deceased on account of birth of a child to the wife of the deceased and upon his reluctance to pay the amount demanded and his willingness to pay Rs.5,000/-, accused insisted for the full payment; they picked up the quarrel with the deceased and one of the accused Renuka Kunvar allegedly thrashed the head of the deceased against the wall resulting into brain hemorrhage to which the deceased eventually succumbed and died after hospitalization of seven days. The material has been collected and the evidence has been recorded and it is pointed out by the learned Public Prosecutor that accused persons have been identified by the auto-rickshaw driver in his statement under Section 161 of the Criminal Procedure Code in whose auto- rickshw the accused persons commuted to the place of the deceased and thus the argument to the contrary that the accused persons remained unidentified in absence of TI parade has no substance.

2. Learned advocate Mr. Baghel for the applicant submits that present application is filed after the charge-sheet. He submits that there is no recovery or discovery from the present applicant. He further submits that the mobile, which is alleged to have been noted in the alleged incident is not recovered from any of the accused persons. He also submits that since the charge-sheet is filed, there is no possibility of tampering with the evidence of prosecution and the applicant is not likely to flee from the justice. He also submits that the applicant is not named in the FIR. He therefore, urges that the applicant may be released on bail by imposing suitable conditions.

He has submitted that Aadhar Card clearly describes that the present applicant is born in the year 2001. Moreover, it is case of the prosecution that earlier about five months ago when the deceased Kailashben had gone to the house of the complainant where she complained the complainant i.e. her brother that present applicant had wish to bring new wife as he did not like her. He has submitted that as per FIR itself there is no recent incident which led the deceased for committing suicide. He has also submitted that deceased Kailashben and present applicant are belonging to different castes and community and they conducted love marriage and there is age difference which the complainant who is the brother of the deceased did not like and, therefore, out of vengeance, the false FIR is lodged. Mumbai, May 10 () An Air India flight landed here from London at 1.30 am on Sunday carrying 239 Indians from the UK who were stranded there due to suspension of commercial passenger air services and the subsequent lockdown, an official statement said. In addition to this, two more repatriation flights -- one each from Singapore and Manila ( Philippines) -- are expected to arrive in Mumbai on Sunday, it said. Learned counsel for the petitioner submits that despite the fact that the petitioner approached initially the Chief Judicial Magistrate, Srinagar, for registration of case against the respondent No. 6, by filing application/complaint under Section 156(3) Cr. PC, but even on the directions of the concerned Magistrate, the Crime Branch has not acted upon the directions. 02/07.05.2020. The bail application of Gulli Mandal @ Gurudeo Mandal in connection with Cyber P.S. Case No. 08 of 2018 registered for the offences under Sections 419/420/467/468/471/120(B) of the Indian Penal Code and Sections 66(C) and 66(D) of the Information Technology Act, has been moved by Mr. Kaushal Kishor Mishra, learned counsel for the petitioner and opposed by Mr. Ravi Prakash, learned A.P.P. for the State, which has been conducted through Video Conferencing in view of the guidelines of the High Court taking into account the situation arising due to COVID-19 pandemic.

1.2 Notice to the respondent was dispensed with, as the respondent had not yet been summoned by the Trial Court.

2 A perusal of the impugned order reveals that the Ld. Trial Court declined to take cognizance of the complaint primarily for the reason that the complainant despite availing several opportunities had not filed the ECS mandate. Further the account statement filed did not bear any stamp and was not even signed. Therefore, noticing that several opportunities have already been afforded to the complainant, the complaint was dismissed. 3 Sh.Anish Bhola, counsel for the petitioner has assailed the CR No.-95/2020 Page No.-1 of 4 impugned Order on the ground that the Ld. MM committed a grave error in observing that the ECS mandate was not on record. It is pointed out that the petitioner/ complainant along with the complaint had placed on record a ' Debit Authorization Form issued by the customer" i.e. the respondent to the petitioner bank. It is argued that the Debit Authorization Form is akin to ECS mandate. . To link the Debit Authorization Form with the loan agreement involved, an account statement was placed on record. The petitioner/complainant had also placed on record along with the complaint a memorandum issued by the bank, intimating return of the mandate on account of insufficiency of funds. Sh.Bhola has, further, argued that the offence as envisaged u/sec.-25 of the Payments & Settlement Systems Act (hereinafter referred to as 'the PSS Act') was completed, when the respondent, who had taken a loan and had issued authorization to debit the amount each month from his account failed to maintain sufficient balance in his account, thereby, resulting in failure of debit of amount. It is, therefore, argued that the Ld. MM committed a grave error in dismissing the complaint as both the documents constituting the offence were on record.

2.Since the petitioner, who is the retired employee of the Transport Corporation, claims to have not been paid with the surrender leave salary of 24.5 days for the period from 2011 to 2019, the present writ petition has been filed seeking for direction in that regard.

3.The petitioner would submit that he has already made a representation dated 03.03.2020 in this regard, which is said to be pending. If the said representation is directed to be disposed of within stipulated time, the ends of justice could be secured.

An Air India flight with 163 Indians landed at the Hyderabad international airport from Kuwait on Saturday night as part of the government's Vande Bharat Mission to bring home Indian nationals stranded abroad, airport sources said. The AI flight 988 landed at the airport shortly after 10 pm, the sources said. To facilitate the arriving passengers and aircraft crew, the Hyderabad International Airport has kept the international arrivals and the stretch right from the aerobridge to the arrivals ramp fully sanitized and fumigated, the sources said. It will be ensured that passengers follow social distancing norms, they said. The passengers would be screened by thermal cameras prior to immigration formalities, they said. Glass shields were provided at each manned immigration counter to avoid any personal contact between the passengers and immigration officers, they said. In the wake of the gas leak at a factory in Visakhapatnam, the National Disaster Management Authority (NDMA) has issued detailed guidelines for restarting industries after the lockdown and the precautions to be taken for the safety of the plants as well as the workers. In a communication to all states and union territories, the NDMA said due to several weeks of lockdown and the closure of industrial units, it is possible that some of the operators might not have followed the established standard operating procedures. As a result, some of the manufacturing facilities, pipelines, valves may have residual chemicals, which may pose risk. The same is true for the storage facilities with hazardous chemicals and flammable materials, it said. The NDMA guidelines said while restarting a unit, the first week should be considered as the trial or test run period after ensuring all safety protocols. The death toll due to COVID-19 rose to 2,109 and the number of cases climbed to 62,939 in the country on Sunday, registering an increase of 128 deaths and 3,277 cases in the last 24 hours, according to the Union Health Ministry. The number of active COVID-19 cases stood at 41,472, while 19,357 people have recovered and one patient has migrated, the ministry said. The total number of cases also include 111 foreign nationals. Of the 2,109 fatalities, Maharashtra tops the tally with 779 deaths. Gujarat comes second with 472 deaths, followed by Madhya Pradesh at 215, West Bengal at 171, Rajasthan at 106, Uttar Pradesh at 74, Delhi at 73, and Andhra Pradesh and Tamil Nadu at 44.
