New Amendments to California Bill Clarify Scope of Prohibition on Junk Fees for Restaurant Industry

On June 29, 2024, Governor Newsom signed into law an amendment to California Code 1770, clarifying the scope of SB 478. Under SB 478 and previously published guidance from the attorney general, California restaurants were effectively prohibited from charging service fees or other surcharges, which many restaurants have implemented to offset rising costs, unless the amount of the service fee was specifically identified as part of the listed prices.

Establishing a Software Inventory

In the event of a security breach, a software inventory is essential to determine what was breached, and who needs to be notified.  First responders require a software inventory to perform forensic analysis and determine breach notification requirements for vendors, business partners, and regulatory bodies. Organizations that have a clear understanding of software in their environment can quickly assess a breach impact and identify affected areas. If legal proceedings are involved, an organized software inventory greatly assists in limiting data handed over to Law Enforcement and assists technical staff in depositions or testimony. 

Business Continuity and Disaster Recovery plans specify requirements for restoration of critical assets and services, but these need to be identified to establish a Recovery Time Objective (the amount of time to recover a service to an acceptable level of operation) and Recovery Point Objective (the last point of known good data.)  Developing and maintaining a software inventory is a critical first step in implementing an effective cyber security program.

A software inventory helps demonstrate compliance with regulatory controls and Service Level Agreements (SLA) for software used in the environment. From the perspective of “less is more,” a software inventory also identifies unnecessary software running in the environment, which increases the attack surface without providing a business advantage.

Security operations perform scans to identify operating system and application versions, including unsupported software and unpatched systems. This information is used to establish a secure baseline and measure drift from that baseline. A software inventory is necessary to determine if the software is authorized, appropriately licensed, supported, and has the most recent security fixes applied.
Identifying the authorized software assets is an important step to ensure critical assets are protected. The larger the organization, the more difficult the inventory process becomes. Tenable.io and Tenable.sc help organizations build a software inventory. There are several software discovery plugins that run by default in the following scan templates:

  • Basic and Advanced Agent Scans
  • Advanced (Network) Scan
  • Basic (Network) Scan
  • Credentialed Patch Audit
  • Internal PCI Network Scan

Maintaining a software inventory aids in cyber hygiene and minimizes unauthorized software installation. Many organizations perform an annual audit by an external third party, where they are required to enumerate authorized software that is running in the environment. Organizations that maintain a current software inventory throughout the year can produce information required by auditors and vendors with minimal effort.

The real estate industry on trial

In 2019, Mike Ketchmark got a call. Mike is a lawyer in Kansas City, Missouri, and his friend, Brandon Boulware, another lawyer, was calling about a case he wanted Mike to get involved with. Mike was an unusual choice - he's a personal injury lawyer, and this was going to be an antitrust case.

But Brandon knew Mike was great in front of a jury. And that he'd won huge settlements for his clients in the past.

So the lawyer friend drops by Mike's office, and pitches him the case. Rhonda and Scott Burnett had just sold their home for $250,000, and out of that amount, they had paid $15,000 in commission (plus a small fee), which was split between two real estate agents - even though they had hired only one. And the commission was high - 6%. Mike's friend said the whole thing seemed... suspicious. Maybe even illegal.

Mike agreed to take the case, a case that would soon become bigger than one about just what had happened to the Burnetts. It would become a fight about the way homes are bought and sold in the U.S. and challenge the way real estate agents have done business for more than 100 years.

GBPUSD Technical Analysis – The US Dollar restarted its run

Fundamental Overview

The puzzling weakness in the US Dollar following Trump’s victory looks more and more like it was just a “sell the fact” reaction. The greenback is now back in the driving seat, and we might also be seeing some pre-positioning into a potentially hot US CPI report tomorrow.

At the latest Fed’s decision, Fed Chair Powell said that they expect bumps on inflation and that one or two bad data months on inflation won’t change the process. This keeps the 25 bps cut in December in place even if we get higher inflation readings.

The market though is forward-looking, and the rise in Treasury yields showed that the market sees risks to the inflation outlook. Moreover, the red sweep could increase those fears if the progress on inflation stalls, or worse, reverses.

On the GBP side, this morning we got the UK labour market report and although the data was mostly mixed, it leant more on the dovish side. Overall though, it didn’t change anything for the market or the BoE.

GBPUSD Technical Analysis – Daily Timeframe

On the daily chart, we can see that GBPUSD broke through the support zone around the 1.2840 level and extended the drop as more sellers piled in. The natural target should be the swing low at 1.2665 level. That’s where we can expect the buyers to step in with a defined risk below the level to position for a rally back into the 1.28 handle.

GBPUSD Technical Analysis – 4 hour Timeframe

On the 4 hour chart, we can see more clearly the break of the support which was defining the range between the 1.2840 support and the 1.3040 resistance. If the price retests the support now turned resistance, we can expect the sellers to step in with a defined risk above the level to position for a drop into the 1.2665 level next. The buyers, on the other hand, will want to see the price breaking higher to position for a rally back into the 1.3040 resistance.

GBPUSD Technical Analysis – 1 hour Timeframe

On the 1 hour chart, we can see that we have a minor downward trendline defining the current bearish momentum. The sellers will likely keep on leaning on it to position for new lows, while the buyers will look for a break higher to pile in for a rally into new highs. The red lines define the average daily range for today.

This week is a bit empty on the data front with the most important releases scheduled for the latter part of the week. Tomorrow, we have the US CPI report. On Thursday, we get the latest US Jobless Claims figures. On Friday, we conclude the week with the US Retail Sales data.
